There is a long tradition in philosophy and literary theory defending the view that engagement with literature promotes readers’ empathy. Until the last century, few of the empirical claims adduced in that tradition were investigated experimentally. Recent work in psychology and neuropsychology has now shed new light on the interplay of empathy and literature. This article surveys the experimental findings, addressing three central questions: What is it to read empathically? Does reading make us more empathic? What characteristics of literature, if (...) any, affect readers’ empathy? While experimental studies have delivered no conclusive answers to these questions, it has exposed their psychological complexity and constructed a more nuanced picture of the diverse ways in which literature interacts with our empathic capacities. There are two classic principles for deciding who should have a right to vote on the laws, the All Affected Principle and the All Subjected Principle. This article is devoted, firstly, to providing a sympathetic reconstruction of the All Subjected Principle, identifying the most credible account of what it is to be subject to the law. Secondly, it shows that that best account still suffers some serious difficulties, which might best be resolved by treating the All Subjected Principle as a (...) subset of the All Affected Principle with which the All Subjected Principle must in any case be supplemented. Two Approaches to the EarthIn several postwar texts, the earth increasingly receives attention from Carl Schmitt.1 In The Nomos of the Earth, the most important of these texts, he refers to Friedrich Hölderlin, a much earlier, very different author, who also considers the subject of the earth. Even though the positions of both are, ultimately, quite similar, they maintain significant terminological differences. Schmitt and Hölderlin both employ the word “nomos,” but in very different ways. Hölderlin regards “nomos” as “law” (...) in the sense of “positive” norm or “Gesez.”2 This use of “nomos” as “Gesez” differs from a second notion of law as the meaning operating at the basis of what Hölderlin calls the “sphere.” The sphere is a meaningful whole in which man originally exists. Law is here the very relations of the sphere as a meaningful whole. Hölderlin calls it the law in a “negative” sense.3 This second notion of law by Hölderlin (negative law or law as the meaning at the basis of the sphere) coincides precisely with the Schmittian idea of “nomos” as an “order of meaning [Sinnreich],”4 what he also calls the law in an “ontonomous and existential” sense.5 The first use of law as “nomos” or “Gesez” by Hölderlin coincides with Schmitt’s use of “Gesetz”: of law as “positive” law. Objective The objective of this article is to provide an ethical analysis of a high-risk, advanced treatment case where the patient received transcatheter aortic valve insertion, for aortic valve stenosis. Particular emphasis will be placed upon the significance of evidence and the implications for priority setting. Method One paradigmatic case involving a TAVI patient from a large university hospital in Norway is described and analysed. The method used was ethical case analysis modified after Kymlicka by Miljeteig et al. Perioperative mortality (...) risk was estimated using the Euroscore risk-logarithm and the Society of Thoracic Surgeons’ risk model, STS. These predict the risk of operative mortality and morbidity associated with adult cardiac surgery. GRADE, the Grading of Recommendations Assessment, Development and Evaluation, was used to evaluate the evidence. Results In the case analysis, we found that it would be ethically justifiable not to recommend TAVI treatment for this patient. Although the patient had a severe condition in need of treatment, the expected improvement was marginal, the quality of evidence was low and the opportunity costs for other patients and society were higher than usually deemed appropriate. Conclusions Decision-making in the absence of high quality evidence from randomized trials is a complex process involving difficult ethical judgments. Novel high-risk devices often enter the European market with limited clinical evidence. Transparency and improved clinical evaluation are required so patient safety is not jeopardized. We argue that implementation of high risk, high cost interventions should be better regulated at a national level. Background All clinical decisions imply priority setting and therefore indirectly affect other patients and other patient groups. The use of expensive, innovative health technologies has an affect on individual patients as well as on other patient groups competing for the same resources. (shrink)

In the past decade, the notion of a neural correlate of consciousness has become a focal point for scientific research on consciousness. A growing number of investigators believe that the first step toward a science of consciousness is to discover the neural correlates of consciousness. Indeed, Francis Crick has gone so far as to proclaim that ‘we need to discover the neural correlates of consciousness. For this task the primate visual system seems especially attractive. No longer need one spend time (...) attempting to endure the tedium of philosophers perpetually disagreeing with each other. Consciousness is now largely a scientific problem’. Yet the question of what it means to be a neural correlate of consciousness is actually far from straightforward, for it involves fundamental empirical, methodological, and philosophical issues about the nature of consciousness and its relationship to the brain. Even if one assumes, as we do, that states of consciousness causally depend on states of the brain, one can nevertheless wonder in what sense there is, or could be, such a thing as a neural correlate of consciousness. When we perceive an object, we perceive the object from a perspective. As a consequence of the perspectival nature of perception, when we perceive, say, a circular coin from different angles, there is a respect in which the coin looks circular throughout, but also a respect in which the coin's appearance changes. More generally, perception of shape and size properties has both a constant aspect—an aspect that remains stable across changes in perspective—and a perspectival aspect—an aspect that changes depending on (...) one's perspective on the object. How should we account for the perspectival aspect of spatial perception? We present a framework within which to discuss the perspectival aspect of perception and put forward three desiderata that any account of the perspectival aspect of perception should satisfy. We discuss views on which the perspectival aspect of perception is analyzed in terms of constitutively mind-dependent appearance properties as well as views on which the perspectival aspect of perception is analyzed in terms of representations of mind-independent perspectival properties. We argue that the trend toward providing users with feasible and actionable explanations of AI decisions—known as recourse explanations—comes with ethical downsides. Specifically, we argue that recourse explanations face several conceptual pitfalls and can lead to problematic explanation hacking, which undermines their ethical status. As an alternative, we advocate that explanations of AI decisions should aim at understanding.

Research on ethical norms has grown in recent years, but imprecise language has made it unclear when these norms prescribe “what ought to be” and when they merely describe behaviors or perceptions (“what is”). Studies of ethical norms, moreover, tend not to investigate whether participants were influenced by the prescriptive aspect of the norm; the studies primarily demonstrate, rather, that people will mimic the behaviors or perceptions of others, which provides evidence for the already well-substantiated social proof theory. In this (...) review article, we delineate three streams of norms research in business ethics: behavioral, perceptual, and prescriptive. We argue that by properly categorizing norms, and designing studies to investigate when prescriptions, more than mere mimicry, improve ethical outcomes in organizations, researchers can enhance managers’ efforts to promote ethical outcomes in organizations. What makes us human is our special motivation to share with others how we feel, what we believe, and what we want to happen in the future. We want to share with others what is real about the world. Shared reality is crucial to what we believe--sharing is believing. It is central to our sense of self, what we strive for and how we strive. It is basic to how we get along with others. It brings us together in fellowship (...) and companionship, but it also tears us apart by creating in-group "bubbles" that conflict with one another. According to the distinguished philosopher Richard Wollheim, an emotion is an extended mental episode that originates when events in the world frustrate or satisfy a pre-existing desire (Wollheim, 1999). This leads the subject to form an attitude to the world which colours their future experience, leading them to attend to one aspect of things rather than another, and to view the things they attend to in one light rather than another. The idea that emotions arise from the satisfaction or frustration (...) of desires—the ‘match-mismatch’ view of emotion aetiology—has had several earlier incarnations in the psychology of emotion. Early versions of this proposal were associated with the attempt to replace the typology of emotion found in ordinary language with a simpler theory of drives and to define new emotion types in terms of general properties such as the frustration of a drive. The match-mismatch view survived the demise of that revisionist project and is found today in theories that accept a folk-psychological-style taxonomy of emotion types based on the meaning ascribed by the subject to the stimulus situation. For example, the match-mismatch view forms part of the subtle and complex model of emotion episodes developed over many years by Nico Frijda (Frijda, 1986). According to Frijda, information about the ‘situational antecedents’ of an emotion—the stimulus in its context, including the ongoing goals of the organism—is evaluated for its relevance to the multiple concerns of the organism. Evaluation of match-mismatch—the degree of compatibility between the situation and the subject's goals—forms part of this process. (shrink)
