In QALY-thinking, an activity that takes N people from a bad state (including 'dying') to the state of healthy for X years should have priority over an activity that takes N other people from the same bad state to a state of moderate illness for the same number of years (given equal costs). An empirical study indicates that this view may not be shared by the general public in Norway. Subjects tended to emphasise equality in value of life and in (...) entitlement to treatment rather than level of health after treatment. The relevance of costs per QALY in prioritising between different health care programmes in Norway is thereby brought in to doubt. While the sample in the study is too small to support firm policy conclusions, the results should contribute to an increased interest among health economists in actually measuring people's ethical preferences in matters of prioritising, rather than taking it for granted that their own values are shared by the general public. "Principe à valeur constitutionnelle en droit français, la sécurité juridique occupe une place centrale dans l'argumentaire du législateur aussi bien national qu'européen et se trouve au coeur de l'activité juridictionnelle. Dans une perspective économique du droit, les systèmes juridiques sont désormais eux-mêmes évalués à l'aune de la sécurité juridique, comme le démontrent les rapports "Doing Business", commandés par la Banque Mondiale depuis une dizaine d'années. Cependant, la crainte d'insécurité juridique semble ne jamais avoir été aussi forte. Elle est notamment révélée (...) par l'appel récurrent à la notion de sécurité juridique. La mondialisation et la "fondamentalisation" du droit amplifient le phénomène dans la mesure où l'exigence de sécurité se manifeste dans des contextes plus complexes de formation et d'application du droit. En parallèle, la notion d'insécurité juridique est évoquée en creux lors des travaux relatifs à la sécurité juridique. Or, cette dernière est le plus souvent envisagée à partir de la dénonciation de son contraire, l'insécurité juridique. Par conséquent, la sécurité juridique est envisagée de manière négative. Pourtant, l'insécurité juridique ne fait l'objet d'aucun travail conceptuel malgré son emploi généralisé. Sous l'égide de la Cour de cassation et de la Société de législation comparée, des juristes de plusieurs horizons se sont réunis à Paris le 22 mars 2021 pour mener une double analyse de cette notion dans un colloque intitulé "Insécurité juridique : l'émergence d'une notion? " Ils ont d'abord apprécié le recours à la notion d'insécurité juridique pour se livrer ensuite à un exercice prospectif, notamment au regard des nouveaux enjeux technologiques.". (shrink)

Sabine Fourrier et al. Le dépot archaïque d'Amathonte, III. Les petits objets p. 67-118 Cet article présente les petits objets découverts dans un remblai d'époque archaïque, déposé contre le rempart Nord de la ville basse d'Amathonte. Le matériel, riche et varié, reflète les différentes fonctions du palais, dont il provient. Plusieurs types sont inédits ou seulement attestés parmi les trouvailles du palais de l'acropole. Certaines catégories, comme les figurines de terre cuite ou les marques incisées sur vases, sont particulièrement (...) bien représentées. Malgré leur aspect souvent fragmentaire, ces objets donnent une vue d'ensemble du mobilier que contenait le palais archaïque d'Amathonte. (shrink)

L’Empire romain atteint à la fin de la République une étendue géographique qui englobe des aires culturelles très diverses, ce qui a une influence sur la typologie et les fonctions des maisons dans les différentes régions de la Méditerranée. Dans l’impossibilité de pouvoir donner une vue d’ensemble et laissant de côté pour cette même raison les provinces occidentales de l’Afrique du Nord et du Levant, nous allons évoquer, après un regard sur la description de la maison urbaine chez Vitruve, (...) quelques exemples de Pompéi pour nous concentrer par la suite sur quelques maisons dans les provinces orientales, en particulier en Grèce et en Asie Mineure, pour mesurer l’influence ou non des Romains dans l’architecture privée. Il s’avère que cette dernière est bien restreinte, et que l’intégration de l’atrium est plutôt une référence qu’un élément structurel des maisons dont le péristyle reste l’élément central. Reineke (bio)Simone Beauvoir's novel She Came to Stay immerses readers in a 1930s Parisian social scene, thanks in part to the character Françoise. Eavesdropping with Françoise on a man and woman seated at a table in the Pȏle Nord café, readers of the novel hear the woman confide, "I've never been able to follow (...) the rules of flirting. I have a morbid horror of being touched."1 As Françoise invites us to turn our gaze toward another couple seated nearby, we observe a possible instance of the very discomfort to which the first woman has attested. A hapless female looks "uncertainly at a man's huge (grosse) hand that has just pounced on hers (s'abattre sur)."2 Of these two scenes from She Came to Stay, Jean-Paul Sartre memorializes only the second.3 As described by Sartre in Being and Nothingness, a man and a woman on their first date are seated at a table. The man "takes" (prend) the hand of a woman and holds it between "his warm hands" (les mains chaudes) while the woman makes her hand inert, even as she "permits herself to enjoy his desire."4 Thanks to the pervasive influence of Being and Nothingness on the philosophical canon, the disquieting scene Françoise describes in She Came to Stay largely has been forgotten. Sartre sets the [End Page 1] terms for the unfortunate woman's ongoing life: She is a paradigm of "bad faith." Two decades later, her immortality is secured by René Girard: The woman is a prime exemplar of coquetry, a "fundamental" concept in the development of Girard's theory of mimetic desire.5In the wake of today's #metoo headlines, we may find ourselves eager to weigh in anew on the scene at Pȏle Nord. Are we witnesses to flirtation? Seduction? Unwanted sexual attention? Debates about coercion and guile, predators and prey, are unlikely to be productive; after all, Girard has advised that participants in such debates flounder in a problematic victimology.6 Nevertheless, Sartre and Girard's fascination with the mise en scène at Pȏle Nord warrants reexamination on other grounds. Sartre's discussion of the young woman beset by bad faith in Being and Nothingness is one of several instances in which Sartre is shown exerting a significant influence on Girard. Focusing closely on these occurrences, we can identify features of Sartrian existentialism that contribute constructively to the development of Girard's thought. So also can we uncover a problematic view of the body in mimetic theory. Girard shares with Sartre a profound ambivalence toward embodiment. An alternative perspective visible in Beauvoir's writing could enhance the treatment of the body and eroticism in mimetic theory.Girard's early work attests to Sartre's influence. Writing in Evolution of Desire, Cynthia Haven introduces the topic of Sartre's impact on Girard by recounting Parisian intellectuals' responses to tensions between Camus and Sartre: "Everyone took one side or the other." Girard's friends reported that Girard "was on the Sartre side."7 In an interview with Rebecca Adams, Girard states that "I was influenced by Sartre and Camus, like other people of my generation, especially by Sartre."8 Girard acknowledges Sartre's influence in several other contexts. In a 2007 interview with Pierpaolo Antonello, Girard recalls his early philosophical interests: "… From Sartre I went to Merleau-Ponty and all the authors related to phenomenology, which fascinated me and for a while I wanted to write in the phenomenological style."9 Commenting in the 2008 preface to La Conversion de l'art, Girard states that he is struck by the Sartrian "tone" of his own writing.10 Scholarly explorations of the specifics of the influence of Sartre on Girard have cataloged the most important Sartrian concepts: a lack of being, the in-itself/for-itself (en-soi/pour-soi); the "projet"; patterns of desire (e.g., masochism and sadism), and bad faith.11 These themes are discussed in what follows, with special attention to Girard and Sartre's perspectives on human... L'État pluriculturel est devenu un concept majeur du début du XXIe siècle, tant au Nord qu'au Sud de la planète. La plupart des États sont confrontés à l'éveil ou à l'affirmation des différentes cultures des différentes communautés en leur sein. Pour nos sociétés plurielles, voici venu le temps des droits aux différences. En réalité, devant ce phénomène universel, les positions de l'État varient : il aménage la coexistence des communautés culturelles ; ou il ne veut pas les connaître. Entre (...) ces deux pôles, bien des nuances existent, du refus des différences à leur tolérance, et enfin à leur reconnaissance. La France est un exemple typique de déchirement : elle est arc-boutée sur le principe fondateur de la République une et indivisible, mais elle prévoit à ce principe de telles exceptions qu'elle est en plein bouleversement. Comment l'État démocratique va-t-il régir sa pluriculturalité? Comment les différentes options praticables peuvent-elles, chacune, impliquer une part de cohésion et une part de fragmentation sociale? Comment concilier droits à la différence et droit à l'indifférence? De telles questions ne peuvent être traitées qu'en analysant les diverses expériences. C'est ce que fait le présent ouvrage, publiant les travaux d'un colloque tenu à Nouméa en juillet 2002, avec la participation de juristes et de politistes, d'anthropologues et de tous chercheurs en sciences sociales en général. Les États les plus divers, de tous les continents, sont analysés. People who express ‘ageist’ preferences may feel that, all else equal, an individual has greater right to enjoy additional life years the fewer life years he or she has already had. We shall refer to this as egalitarian ageism. They may also emphasise the greater expected duration of health benefits in young people that derives from their greater life expectancy. We may call this utilitarian ageism. Both these (...) forms of ageism were observed in an empirical study of social preferences in Australia. The study lends some support to the assumptions in the QALY approach that duration of benefits, and hence old age, should count in prioritising at the budget level in health care. (shrink)

Analyses on the so-called “Arab Spring” mainly focus on its possible consequences. But which are its causes? In attempting to provide an answer to this question, the author evaluates the multifaceted relationship between authorities and citizens – especially the youngest ones – underlining the occurrence of specific phenomena (youth bulge, high educational levels, widespread ICTs, unemployment, pervasive corruption, human rights violations) in the countries involved. The conclusion which is reached is that the wave of protests might have been generated by (...) the complete detachment existing between citizens and institutions, detachment which, paradoxically, might have been created and nourished by those in power themselves, through the “modernizing” reforms they have imposed in recent years. Daniel Hausman’s book ‘Valuing Health’ is a valuable contribution to our understanding of QALYs and DALYs and to moving health economics to adopting a broader perspective than that taken in conventional cost-effectiveness analysis. Hausman’s attempt at constructing a public value table for health states without having recourse to data from population preferences studies is also a fascinating read. But I have serious concerns about his resulting table. Hausman’s views on which dimensions of health a benevolent liberal state should care about (...) are essentially not different from what has long been emphasized in health economists’ work on valuations of health outcomes. His table would have been helpful as a sketch if it was the first attempt in health economics to quantify numerically the societal value of different types and degrees of health improvement. But research in the field has gone far beyond that. Multi-attribute utility instruments with much more accurate health classification systems than Hausman’s sketch are now at hand. Available also are models of societal valuations of QALYs that are broadly consistent with general population values, incorporate wider concerns than Hausman’s table does and do not have the questionable numerical properties that characterize Hausman’s sketch. By describing societal value judgements in health care in numerical terms one may in theory increase the precision of guidelines for priority setting and allow decision makers to judge more accurately the degree to which different health care programs provide societal value for money. However, valuing health programs in terms of QALYs disregards salient societal concerns for fairness in resource allocation. A different kind of numerical valuation of medical interventions, that incorporates concerns for fairness, is described. We discuss the evolutionary implications of connections drawn between the authors' learned “secondary modules” and the habit-formation system that appears to be ubiquitous among vertebrates. Prior to any subsequent coevolution with social learning, we suggest that aspects of general intelligence likely arose in tandem with mechanisms of adaptive motor control that rely on basal ganglia circuitry.

This is a largely historical study of Mexican social policy and its 20th century course to social development in such areas as income, education, health, nutrition, social safety, social security, with an emphasis on the motive forces. The overall pattern is examined in terms of affordability, rhetoric generated, and comparisons with other countries in the same stage of enhancement.
