The Dual State, first published in 1941, remains one of the most erudite books on the legal origins of democracy and dictatorship. It provided the first comprehensive analysis of the rise and nature of National Socialism, and was the only such analysis written from within Hitler's Germany. Fraenkel's concept of the dual state, being the normative state and the the prerogative state. It retains its vital relevance for the theory of democracy in the twenty-first century. The Dual State considerably influenced (...) scholars studying and working on questions of political justice in the period following World War II, particularly in the context of political and legal theory; in the domain of legal history; in the area of constitutional theory; in the context of comparative politics; and in what has become known as the field of comparative constitutional law. This republication of Fraenkel's classic work makes it once again widely available to scholars and students in the field. It includes both Fraenkel's 1974 introduction to the German second edition, never before published in English, and a new introduction by Dr Jens Meierhenrich, examining the world in which The Dual State was originally published, and the lasting legacy of this classic work. Complementary and alternative medicine has become an important section of healthcare. Its high level of acceptance among the general population represents a challenge to healthcare professionals of all disciplines and raises a host of ethical issues. This article is an attempt to explore some of the more obvious or practical ethical aspects of complementary and alternative medicine.

As long-term childhood cancer survivors are at risk for late effects, ongoing medical care is crucial to detect and treat physical illnesses as early as possible. However, previous research from around the world has shown that many adult survivors did not participate in long-term medical follow-up. This study aimed to provide insight into German survivors’ care situation, with a particular focus on barriers to follow-up care. We investigated a sample of adult CCS drawn from the German Childhood Cancer Registry’s oldest (...) cohort. Our analyses included data from a standardized medical examination, a self-report questionnaire, and in-depth interviews with a subsample. Half of the participants reported participating in some kind of medical follow-up. In a logistic regression analysis, attendance of medical follow-up care was associated with higher age. Reasons for non-attendance were assigned to four categories: lack of information about medical follow-up and/or its purpose, termination by the health care provider, structural barriers, and emotional-motivational aspects. The interviews contributed to a better understanding of how these reported barriers played out in the care of individual survivors. Further, they revealed that some survivors currently in medical follow-up had had periods without follow-up care in the past—which were also in many cases related to a lack of information, both on the part of health care providers and CCS themselves. The results indicated that a large proportion of long-term CCS do not receive the recommended follow-up care. Further, there is a great need for more information regarding the aims of long-term medical follow-up and available offers. This is an important prerequisite for CCS to make informed decisions. The author considers Pope John Paul II's 1998 encyclical, Fides et ratio, as bringing into view new horizons for Catholic philosophical theology by virtue of its endorsement of a constrained philosophical pluralism. Through a retrospective examination of the history of magisterial interventions as depicted in the encyclical, the author notes how a progressive openness to philosophical pluralism relates to the changed status of Thomism within magisterial teaching on the practice of Catholic philosophical theology. Fides et ratio describes an evolution in (...) magisterial emphasis from proscription to prescription, which corresponds to change in the status of Thomism from an absolute to an exemplary norm. Attention to this decisive shift in the normative status of Thomism, as implied within the encyclical itself, provides both new illumination on the Pope's general intentions and new clarity with regard to some contested interpretive issues. Finally, the author highlights several new challenges that are implied by this development in magisterial teaching. (shrink)

If cooperative dispositions are associated with unique phenotypic features (’green beards’), cooperative individuals can be identified. Therefore, cooperative individuals can avoid exploitation by defectors by cooperating exclusively with other cooperative individuals; consequently, cooperators flourish and defectors die out. Experimental evidence suggests that subjects, who are given the opportunity to make promises in face-to-face interactions, are indeed able to predict the partner’s behavior better than chance in a subsequent Prisoners’ Dilemma. This evidence has been interpreted as evidence in favor of green (...) beard approaches to the evolution of human cooperation. Here we argue, however, that the evidence does not support this interpretation. We show, in particular, that the existence of conditional cooperation renders subjects' choices in the Prisoners’ Dilemma predictable. However, although subjects predict behavior better than chance, selfish individuals earn higher incomes than conditional cooperators. Thus, although subjects may predict other players’ choices better than chance evolution favors the selfish subjects, i.e., the experimental evidence does not support the green beard approach towards the evolution of cooperation. Initiated by the author an empirical investigation into the development of the sense of right and wrong has been conducted in children between the ages of 3 and 13 years in 2001 and 2002. Firstly the author reviews the actual state of knowledge and - following a short overview of the feasible scientific methods - he describes the method of the present investigation. Semistructured interviews were focused on the childlike points of view concerning problems of civil law (e.g. possession and (...) property, binding to contracts) and criminal law (e.g. violation of property rights, accountability of conduct, esp. participation and attempt). It turned out that certain pre-judicial beliefs are apparently inborn and maturate while children grow up, but are also influenced by specific imprinting processes within the cultural background. Natural law, up to now mainly philosophically grounded, obtains hereby for the first time a differentiated empiric basis. (shrink)

INTRODUCTION XIII On a number of occasions Mach expressed the sentiment, especially in his correspondence, that America was the land of intellectual freedom and opportunity, the coming frontier for a new radical empiricism that would help to wash metaphysics out of philosophy. In 1901 he sponsored the German edition of Concepts and Theories of Modern Physics (1881) (...) 2 by J. B. Stallo, Cincinnati lawyer and philosopher. Mach warmly endorsed Stallo's book because his scientific aims so closely approximated his own, and because Stallo rejected the latent metaphysical elements and concealed ontological assumptions of the mechanical-atomistic inter­ pretation of the world. The second edition of Wiirmelehre was dedicated to Stallo in 1900. The fourth edition of Populiir-wissenschaftliche Vorlesungen (1910), containing seven new essays, was dedicated to Harvard Professor of physiology, philosophY, and psychology, William James. Mach had a strong intellectual affinity for James' pragmatism because, like himself, he recognized that James had come to radically empirical views from science. Both men took pure pre-conceptualized experience, from which the mental and physical predicates of experience are composed, to be neutral rather than real, unreal, objective or subjective. (shrink)

It is evident how much Olby and Provine have contributed to a better understanding of the emergence of genetics. It is equally evident, I believe, how many obscure issues still remain to be elucidated. Indeed, their volumes have raised as many new questions as they have answered old ones. In particular, the role of constructive as well as retarding contemporary concepts in the development of new generalizations still requires far more analysis. The somewhat independent trends of various national schools and (...) the influence of neighboring fields (e.g. statistics, animal husbandry, systematics) are other areas deserving further study. The paper introduces a new type of rules into Natural Deduction, elimination rules by composition. Elimination rules by composition replace usual elimination rules in the style of disjunction elimination and give a more direct treatment of additive disjunction, multiplicative conjunction, existence quantifier and possibility modality. Elimination rules by composition have an enormous impact on proof-structures of deductions: they do not produce segments, deduction trees remain binary branching, there is no vacuous discharge, there is only few need of permutations. This new (...) type of rules fits especially to substructural issues, so it is shown for Lambek Calculus, i.e. intuitionistic non-commutative linear logic and to its extensions by structural rules like permutation, weakening and contraction. Natural deduction formulated with elimination rules by composition from a complexity perspective is superior to other calculi. (shrink)
