This article examines how domestic violence impacts the lives and education of young children, children, and young people and how they can be supported within the education system. Schools are often the service in closest and longest contact with a child living with domestic violence; teachers can play a vital role in helping families access welfare services. In the wake of high profile cases of child abuse and neglect, concerns have been raised about the effectiveness of (...) multi-agency responses to children living with abuse. In the UK, the case of four-year-old Daniel Pelka who died in 2012 following abuse and starvation by his mother, who experienced domestic violence, and her partner, led to a serious case review. It found recording systems in Daniel’s school were not used consistently, and details held by different agencies were not collated to enable the formation of a coherent assessment. The lack of integrated working cited in the report echoes findings from previous serious case reviews. A strong correlation exists between domestic abuse and child abuse, with approximately half of all domestic violence situations involving direct child abuse. Children can also be affected indirectly by violence occurring in their home by seeing or hearing it taking place. This article examines the impact of domestic violence on the mental health of children, and the impact on their education. Violence in children’s lives often causes disruption to their schooling and harms the quality of their educational experiences and outcomes. The abuse children experience can result in emotional trauma, physical and psychological barriers to learning, and disruptive behavior in school, while the underlying causes of these problems remain hidden. Knowing when and how to seek advice from multi-agency professionals is an essential part of effective practice among school staff. Despite their vital role in identifying signs of abuse and signposting referral pathways, research indicates teachers often lack confidence and knowledge for such work. The article examines how the professional learning and professional confidence of teachers can be developed, and how recent policy and practice developments in the UK have the potential to influence work in this area. Domestic violence and abuse (DVA) are at last coming to be recognised as serious global public health problems. Nevertheless, many women with personal histories of DVA decline to disclose them to healthcare practitioners. In the health sciences, recent empirical work has identified many factors that impede DVA disclosure, known as barriers to disclosure. Drawing on recent work in social epistemology on testimonial silencing, we might wonder why so many people withhold their testimony and whether there is some kind (...) of epistemic injustice afoot here. In this paper, I offer some philosophical reflections on DVA disclosure in clinical contexts and the associated barriers to disclosure. I argue that women with personal histories of DVA are vulnerable to a certain form of testimonial injustice in clinical contexts, namely, testimonial smothering, and that this may help to explain why they withhold that testimony. It is my contention that this can help explain the low rates of DVA disclosure by patients to healthcare practitioners. (shrink)

Domestic violence is a growing societal concern that often spills over into the workplace. However, employers are not recognizing the spillover of domestic violence as a workplace issue. This is problematic considering the serious financial, legal, and ethical consequences for organizations. We analyzed six cases involving domestic violence that were litigated under specific legal bases: Violence Against Women Act, discrimination laws including Title VII, Family and Medical Leave Act, Americans with Disabilities Act, Social (...) Security Disability, Occupational Safety and Health Act, and associated state and municipal ordinances. We chose cases that illustrate the problems of companies meeting the legal standards but not necessarily reaching ethical expectations. Our approach is congruent with the perspective that both legal and ethical analyses should be used in organizational decision making. We suggest for future research the analysis of additional litigated cases, other ethical perspectives, and additional sources of data. In addition, we suggest that companies who are striving for corporate social responsibility should integrate the ethical treatment of domestic violence victims. (shrink)

The aim and objective of this study is to analyse the causes of domestic violence against married women in Pakistan providing a complete picture of understanding on the phenomenon. This study was conducted in Safoora Goth, Karachi one of the oldest residential centre of Karachi where all local ethnic groups and class of people are inhabited. The factors included in the study were various reasons of domestic violence, nature of domestic violence, types of (...) class='Hi'>domestic violence, separation, and feeling of deprivation, husband drug addiction, partner violence, family system, family economic, ages of women and all other such related causes regarding domestic violence. The universe of the study was Safoora Goth, Karachi. The calculated sample size was 313 respondents in which researcher selected simple random sampling technique. The tool for the data collection was a questionnaire. Hypotheses were tested statistically among 5 hypotheses all have gotten accepted and showed the result as there are various causes of domestic violence. Thus, the researcher concluded that family system, family income and husband drug addiction are related to the domestic violence in a great deal. (shrink)

_This study investigates how domestic violence and abuse have been portrayed in Bina Shah’s Slum Child. The study analyzes how women’s portrayal construes domestic violence, abuse, marginalization, and victimization. The study employs Thematic Roles given by Andrew and Radford, as cited in Saeed to explore the linguistic choices which are significant in reflecting the underlying ideology of the author. Research shows that the beats, mourns, screams, and shouts of the female characters as portrayed in the novel (...) represent the distress, restraint, and implicit horrendous recollections. This study has contended that the selected novel features the complex relationship of females with space and researched how the female characters swaying among private and public spaces find the metropolitan space afraid for them. Although there has been much research on the connection between nonhuman animal cruelty/ abuse and domestic violence, the link between nonhuman animal care and domestic violence has received less attention. This study, based on responses from 477 college students in New Provi-dence, The Bahamas, indicates that the presence of domestic violence in homes is linked with the level of care and the prevalence of negative interactions with dogs. Dogs received 10 or more of 11 (...) components of essential care in 58.0% of homes without domestic violence compared with 43.7% in homes with domestic violence. A dog was reported being physically injured in 6.8% of homes when domestic violence was absent and in 13.6% of homes when domestic violence was present. The study suggests that in homes with domestic violence, dogs as well as people are at higher risk of intentional harm and/or neglect. (shrink)

Domestic violence is one of the most common forms of violence against women. Domestic violence during pregnancy is associated with adverse perinatal and maternal outcomes. We aimed to assess whether domestic violence was associated with mode of delivery, low birthweight and preterm birth in two sites in Nepal. In this prospective cohort study we consecutively recruited 2004 pregnant women during antenatal care at two hospitals between June 2015 and September 2016. The Abuse Assessment (...) Screen was used to assess fear and violence. Having ever experienced either fear or violence was defined as any domestic violence. Obstetric outcomes were obtained from hospital records for 1381 women, selecting singleton pregnancies only. Mode of delivery was assessed as birth by cesarean section or not. A birthweight of less than 2500 g was defined as low birthweight and preterm birth as birth before completion of 37 weeks gestation. Descriptive and multiple logistic regression analyses were performed to assess associations. Twenty percent of the women reported any domestic violence. Among all 1381 women, 37.6% gave birth by cesarean section. Of those women who delivered by cesarean section, 84.7% had an emergency cesarean section. Less than 10% of the babies were born prematurely and 13.5% were born with low birthweight. We found no significant association between exposure to any domestic violence during pregnancy and risk of a low birthweight baby or birth by cesarean section. However, having experienced both violence and fear was significantly associated with giving birth to a preterm infant [aOR 2.33 ]. Domestic violence is common in Nepal. This is a potential risk factor for severe morbidity and mortality in newborns. We found that the risk of having a preterm baby was higher for pregnant women who experienced both fear and violence. This should be recognized by the health sector. In this study, no significant differences were found in the rate of cesarean section nor low birthweight for women who had experienced any domestic violence compared to those who did not. (shrink)

This article aims to clarify and expand our conceptual repertoire for understanding domestic violence and abuse by making legible different characteristic harms, particularly those that cannot be made sense of in terms of physical harm. Sections 2 and 3 of this article review popular understandings of the harms of domestic violence and abuse. These often emphasize either (a) pain and suffering or (b) the loss of capacities for self-governance as characteristic harms of domestic violence (...) and abuse. In its second half, this article argues that domestic violence and abuse characteristically involve yet another harm to the victim, one that cannot neatly be explained in terms of hedonistic welfare or concerns for a victim's capacities for self-governance. More specifically, this article argues that through the characteristic social isolation of domestic violence and abuse, perpetrators alienate victims from what motivationally roots them to the world. Although relationships that motivationally root us to the world might make us fundamentally dependent on others and can cause us great pain, they nevertheless play a profoundly valuable role in our lives by giving us reasons to go on living. The phenomenon of domestic violence is as old as humanity itself, but legal protection against violence both internationally and nationally begins to be provided very late. In the Republic of North Macedonia, until 2004, there was no legal protection of victims of domestic violence, nor was adequate sanctioning of perpetrators. Only since 2004, with the amendments and additions to the Criminal Code in the criminal sphere, and the Law on the Family in the civil sphere, (...) the phenomenon of domestic violence began to receive due legal attention, with the application of provisions for the sanctioning of perpetrators and temporary measures protection for victims. The adoption of the Istanbul Convention (The Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence) and its ratification in 2018 undoubtedly contributed to the Republic of North Macedonia undertaking a series of reforms in the field of domestic violence. So initially, in 2021, the new Law on domestic violence was adopted in harmony with the principles of the Istanbul Convention, whereas in 2023 the Law on the amendment of the Criminal Code was adopted. This law focused on changes in criminal offenses related to domestic violence and gender-based violation, as well as the incorporation of new criminal offenses in this regard. These legislative reforms, especially the amendments approved in February 2023 which are of particular importance in the prevention and fight against domestic violence and violence against women in the Republic of North Macedonia are the focus of this research. Anthropological studies have shown that attitudes and behavior of majority of Muslims towards gender and women's issues are influenced by the combined patriarchal culture and patriarchal reading of Islamic teachings which is reflected in conventional fiqh. This creates room for domestic violence; men occupy a dominant position and women are obliged to show their submission to them, such submission being portrayed as divine order. Some of the men interviewed in this study defended their dominant position by exaggerating the (...) interpretation of religious texts that grant special privileges to men. Because of its serious repercussions on women, and because it runs counter to the basic principles of Islam on justice and equality and the overall objective of sharia, i.e. maslahat, such male-biased reading of religious texts should be challenged. Over 30 verses in the Qur'an support equality between women and men and refer to women's rights in various aspects of life. Many of these women-friendly Qur'anic verses are further supported by the Hadith, traditionally attributed to Prophet Muhammad. The question that emerges is: why are Muslims' attitudes quite contradictory to the spirit of gender equality and equity and women's emancipation advocated in the Qur'an's verses? Using three different perspectives: theology, legal, and anthropological case studies, this paper explores the answer to the above question and suggests how the gap between Islamic ideals on gender and their realities can be bridged. Children are the most sensitive part of a sciety, therefore the violence against them is considered a serious violation of their personal rights and their higher interests. In most of cases, children in Republic of Macedonia are very little or not at all informed concerning the possibilities of reporting the cases of violence against them by their parents or relatives. The issue of domestic violence is still considered a private problem which occurs within the home. Thus, (...) in most of cases, this problem remains unsolved in silence, without any alert for the state institutions or SOS phone lines for reporting domestic violence. Some children who are more aware for being subjected to violation of their rights are afraid to report the case because of further consequences. In this article some facts will be given about observing the symptoms and signs of violence against children, forms and types of violence against children, determination factors of the violence as well as the consequences and the impact of the domestic violence on the physical and psychological development of children. Based on the legal provisions and international conventions, parents, responsible institutions and the society in general are morally and legally obliged to respect and preserve the interest of the child. This article will show that in practice, these legal obligations are violated by parents and in specific cases also by the competent institutions because the lack of intervention. (shrink)

In this paper, I discuss how Turkish feminists have approached the phenomenon of male violence in Turkey as a political problem by following the feminist precept that the private is public. In the last twenty years, feminist activists in media have made male violence increasingly visible, by criticizing the framing of femicides as fatalities of jealousy and love. I argue that Turkish feminists do not consider male violence as just a “situation” or a structure of “oppression.” They (...) problematize it as systematic political violence, which calls for a critique of the anti-feminist state policies that restitute masculine supremacy by the promotion of patriarchal values. The political consolidation of masculinity by the rejection of gender equality is a key aspect of authoritarianism. Turkish government does not frame domestic violence as a women’s problem but as a family problem. In contrast, feminist arguments invite the government to confront domestic violence as male violence. I suggest that the male violence that women experience in Turkey can be seen as a manifestation of bio-power at the age of the crisis of neo-liberalism. (shrink)

During the early months of the COVID-19 pandemic, domestic violence came to be understood as a national emergency. In this paper, we ask how and why domestic violence was constructed as a crisis specific to the pandemic. Drawing from newspaper data, we show that the domestic violence victim came to embody the violation of gendered boundaries between “public” and “private” spheres. Representations of domestic violence centered on violence spilling over the boundaries (...) of the home, infecting the home, or the home imploding. While theorists of crisis have focused on the central role of temporality in crisis construction, and especially the performative invocation of “new time,” we argue that crisis rhetoric often relies on anxiety about the transgression of spatial boundaries. Our spatial approach to crisis has two components. First, we argue that crisis framings often invoke the idea that seemingly distinct arenas of social life are becoming disorganized or blurred. And second, because thresholds between social spaces are coded as sacred during crisis, this spatial reordering is rendered dangerous, resulting in calls to resecure boundaries. (shrink)

This book provides the first serious, sustained philosophical investigation of the criminal prosecution of domestic violence. It provides a theoretical framework for understanding ongoing debates regarding the criminal justice system's response to domestic violence.

Legal responses to battered women who kill have long animated scholarly debate and law reform activity. In September 2012 after 47 years of alleged abuse, Frenchwoman Jacqueline Sauvage fatally shot her abusive husband three times in the back. The subsequent contested trial, conviction for murder, unsuccessful appeal and later presidential pardon of Sauvage thrust the French law of self-defence into the spotlight. The Sauvage case raises important questions surrounding the adequacy of the French criminal law in this area, the ongoing (...) proliferation of gendered stereotypes in law and the need for reform. In the wake of the Sauvage case, this article provides a timely analysis of the gendered law of self-defence in France. Drawing from an in-depth analysis of the judgments imposed in the Sauvage case, this article examines the adequacy of French legal responses to battered women who kill and ignites an argument for further law reform. In this article, I argue that victims of domestic violence characteristically suffer from two distinct kinds of moral harm: moral damage and moral injury. Moral damage occurs when the ability to develop or sustain good moral character has been compromised by an agent’s circumstances. Moral injury refers to a kind of psychological anguish that follows from when an agent causes or becomes causally implicated in actions that we ordinarily would understand to be morally grievous offenses because of their (...) circumstances. A person can experience moral damage or moral injury separately, but the experiences of moral damage and moral injury can also overlap. Because abusers often expect victims to adopt morally deficient dispositions and often implicate victims in wrongdoing, I argue that victims of domestic violence characteristically suffer from both moral damage and moral injury. By appreciating the different yet overlapping moral experiences of the victim, we become better positioned to identify strategies for responding to and repairing the different harms they suffer. This paper explores the feasibility of offering a restorative justice (RJ) approach in cases of domestic violence (DV). I argue that widely used RJ processes—such as ‘conferencing’—are unlikely to be sufficiently safe or effective in cases of DV, at least as these processes are standardly designed and practiced (Sections 1-6). I then support the view that if RJ is to be used in cases of DV, then new specialist processes will need to be co-designed with key stakeholders to (...) ensure they embody not only RJ principles, but also feminist theory and the concept of transformative justice (Section 7). In this paper I discuss two related ideas and cross-reference them, as it were, on the common ground of the Spinozistic text. First, I want to construct a Spinozistic account of domestic violence and a Spinozistic response to such violence. This will involve attempting to explicate the phenomenon (or at least one aspect of it, to be defined) through the terms and conceptual structure of Spinoza's Ethics. Second, I want to discuss a feminist reading (interpretation) of Spinoza, (...) that of Luce Irigaray. The projects work together, as a better Spinozistic account requires a charitable reading of Spinoza to which Irigaray points the way. Irigaray will turn out to be more Spinozistic that Spinoza himself. In addition, the construction of a Spinozistic response to domestic violence will highlight the textual basis of Irigaray’s reading. It is hoped that this will contribute to making Irigaray’s reading accessible to philosophers trained in the analytic tradition. The undercurrent of both discussions will be an attempt to explicate and further what I take to be a shared moral insight in the late twentieth century, namely, that domestic violence, and particularly violence against women as wives and partners, is morally wrong. This research examines the implementation and judicial response to Uzbekistan's new domestic violence laws enacted in 2023. Through an exploration of the semiotics of these laws, we uncover the nuanced portrayal of victim as "wife" instead of "human," reflecting a societal prioritization of family dynamics over individual rights. Through this analytical lens, we examine how domestic violence laws, as legal transplants, are interpreted by the judicial system. We highlight their translation into people’s behavior, judicial traditions, and (...) the struggling with socio-cultural norms. The findings from both quantitative and qualitative research contribute to understanding effectiveness and improving practices to achieve justice for victims. We investigated how new domestic violence laws are applied in the judicial system and the challenges victims face in seeking justice. The research highlights the necessity and effectiveness of laws while revealing socio-cultural resistance within the judicial system, such as holding victims accountable in domestic violence cases. The judicial response to domestic violence cases often favors restorative justice mechanisms, emphasizing reconciliation and lenient penalties. Notably, 61% of criminal cases conclude with reconciliation. Despite the impossibility of reconciliation in administrative cases, courts resort to the concept of "insignificance" of the violation, terminating cases on this basis in 28% of instances. However, the absence of reconciliation significantly diminishes the effectiveness of laws, depriving victims of restitution and the ability to influence the perpetrator's behavior. In the era of restorative justice application, rising questions emerge regarding its effectiveness, particularly due to socio-cultural pressure on victims and their unequal negotiation opportunities. In this article, the authors assess the still limited literature on domestic violence among immigrant women in major receiving countries so as to begin delineating a framework to explain how immigrant-specific factors exacerbate the already vulnerable position—as dictated by class, gender, and race—of immigrant women in domestic violence situations. First, a review of this scholarship shows that the incidence of domestic violence is not higher than it is in the native population but rather that (...) the experiences of immigrant women in domestic violence situations are often exacerbated by their specific position as immigrants, such as limited host-language skills, isolation from and contact with family and community, lack of access to dignified jobs, uncertain legal statuses, and experiences with authorities in their origin countries. Investigations and commentaries on domestic violence and its sequelae have been featured in several recent medical journals. For discussion purposes, I will highlight aspects from three of them. According to Megan Bair-Merritt and her colleagues, in a recent issue of the Journal of Pediatrics, screening for domestic abuse in a pediatric practice can uncover cases that otherwise might not be identified.1 Of the women who brought their children to a pediatric clinic at Johns Hopkins Children’s Center, 23 (...) percent disclosed that they had been victims of either emotional or physical abuse; 57 percent of the abused women indicated that at least one child had been exposed to this violent interaction. Domestic violence is one of the most serious forms of violation of basic human freedoms and rights regardless of ethnicity, gender, religion, and status. A reflection on many international statistics shows that women are the most frequent victims of domestic violence. Based on the definition of the phenomenon of domestic violence, the forms of abuse, the manner how violence is treated, the possibility of children, men, extramarital spouses, brothers, sisters, and old people living (...) in an extended domestic community, of also being victims is not excluded. Since domestic violence is not only a national problem but a worldwide problem, international organizations have worked towards the eradication of this phenomenon by sanctioning it in various international conventions. Also, the legal systems of many countries prohibit and sanction domestic violence by special laws obliging the state authorities to act in all situations when there are indications that there are direct or indirect violent acts in a family. In this paper, the authors present only the domestic violence against children as an evident problem in families, but which is often unreported. The legal frameworks of the Republic of North Macedonia and Republic of Kosovo are presented in this paper with the aim to describe the material-legal and procedural-legal treatment of domestic violence by pointing out the failure of the state authorities in implementing the laws on protection and prevention of this phenomenon. The authors take the approach of only treating the legal consequences of child abuse by parents that in both legislations is deprivation of parental rights for the violent parent. They conclude that the state authorities should intensify their work in taking control measures towards all the families where there are suspicions that the parental rights are neglected, and the child is abused. Because many cases of abuse have not been detected or reported, and in both countries a special study especially on domestic violence against children does not exist, the possibility that the number for this type of child abuse is great. Typology of perpetrators of domestic violence The objective of the research conducted by the author was to obtain an answer to the question: could we distinguish different types of intrafamily violence perpetrators considering a specified profile of personality factors and temperament traits and how domestic violence perpetrators cope with stressful situations? The research was conducted on a group of 325 men who were convicted pursuant to article 207§1 & 2 of harassment over family members. In (...) terms of a gender the group was homogenous. On the basis of the literature on the subject, the following personality traits of violence perpetrators were categorised: locus of control, self-acceptance, aggressiveness, hostility, intelligent quotient and temperament traits. The following research techniques were employed in the study: the Wechsler Intelligence Scale, Berger's Self-Acceptance Scale, the Delta Questionnaire by R. Drwal, the SABD Questionnaire - Buss-Durkee, Formal Characteristics of Behaviour - Temperament Inventory by J. Strelau, the WCQ questionnaire by R.S. Lazarus and S. Folkman, a categorised interview and an analysis of court records. As a result of the analysis conducted on a group of the studied sample of violence perpetrators, four subgroups, differing in terms of selected personality traits, were specified. They are reactively aggressive perpetrators, perpetrators of low preventive competences, psychopathic and retaliatory perpetrators and perpetrators with a big adaptive potential. Further on, four distinguished groups have been characterised in terms of stress-coping strategies, and psychological processes of coping with stress proceeded differently in the research group. Battles against domestic violence in the People’s Republic of China have been carried out since 1995. In this study, legislative progression of laws related to domestic violence is first examined and clarified; second, findings from the legislative review are investigated on the basis of civil and criminal cases; third, the interaction among social and traditional norms, legislation, and judicial outcomes is explored and interpreted from a sociosemiotic perspective. It is found in this study that: 1) legislation (...) and judicial practices of domestic violence in the P. R. C. are closely intertwined with social and traditional norms; 2) there is a gap between judicial practices dealing with domestic violence and the legislation; 3) the Anti-Domestic Violence Law offers a notch for state powers to embrace the familial relationship and to safeguard a victim. In this paper we draw on data from in-depth interviews with men who have used violence and abuse within intimate partner relationships to provide a new lens through which to view the conceptual debates on naming, defining and understanding ‘domestic violence’, as well as the policy and practice implications that flow from them. We argue that the reduction of domestic violence to discrete ‘incidents’ supports and maintains how men themselves talk about their use of (...) class='Hi'>violence, and that this in turn overlaps with contentions about the appropriate interventions and responses to domestic violence perpetrators. We revisit Hearn's 1998 work The Violences of Men, connecting it to Stark's later concept of coercive control, in order to develop and extend understandings of violence through analysis of the words of those who use it. We conclude by exploring the implications of these findings for recent legal reform in England and Wales and for policies on how we deal with perpetrators. (shrink)

Theoretically, violence is a human rights issue, and human rights are fundamental to values of dignity, equality, non-discrimination and non-interference, and these cut across gender, social, cultural, political, class, religious and geographical issues. Human beings, properties and resources are in millions daily destroyed. Children are abused. Women remain injured and humiliated, so much so that men’s status seemed to be changing. Hence, this study embarked on examining Women in Domestic Violence inNigeriausing gender perspectives. In this study, the author investigates how the battered women’s movement has transformed the treatment of domestic violence in Salt Lake City’s specialized domestic violence court. Using Lisa Brush’s account of how the state promotes the dominance of men and the disadvantage of women, the author shows that Salt Lake City’s domestic violence court transforms both its governance of gender and its gender of governance, lending support to optimistic theories of the state. The author (...) argues that this court is an example of a state institution that has been transformed into a feminist regime committed to individual and social change. The author encourages feminist theorists to engage with the work of Jurgen Habermas to better conceptualize the potentially positive relations among the state, social movements, and social change. This article examines the development of a multidimensional, transnational feminist research approach from and within Uganda in relation to a high-profile case of domestic violence and femicide of a middle-class, upper-caste Indian migrant woman in Kampala in 1998. It explores indigenous Ugandan public and Ugandan Asian/indian community interpretations and the dynamics of cross-racial feminist mobilisation and protest that emerged in response to the Joshi-Sharma domestic violence case. In doing so, it advocates for a transnational feminist research (...) approach from and within Uganda and the Global South that works against the grain of nationalist and nativist biases in existing feminist scholarly trends. This approach lays bare power inequalities and internal tensions within and across racialised African and Asian communities, and thus avoids the romanticisation of cross-racial feminist African-Asian solidarities.
