The purpose of the present study is the understanding of Gentili's position on the law of the sea as expressed in his classic De iure belli . The key constitutive elements turn out to be: 1) the idea of the sea as 'res communis' to all mankind, which amounts to the concept of 'freedom of the sea'; 2) 'jurisdiction' of the coastal state on the adjacent sea, even on the high seas, in order to police crime and prevent/punish piracy. As (...) such these two key elements, if taken in isolation, are rooted in the civil law tradition, but their true meaning can only be captured by placing them in the intellectual framework of which they constitute an integral part. Firstly, the epistemic structure of discourse hinges on the new science of natural jurisprudence, as applied to the subject of 'ius gentium bellicum'; secondly, the constituent theoretical languages emanate from a distinctive combination of civil law, scholastic-theological and humanist traditions. This procedure enables us to highlight the strikingly original and distinctly modern traits of Gentili's perspective on the law of the sea, which emerges as a corollary of his project of international/global order. A project that is based on the crucial notion of 'respublica magna' of mankind, a notion encompassing the two notions of 'freedom' and 'jurisdiction' that constitute and define the legal regime of the sea.The Stoic humanist notion of universal human society as 'corpus unum' implies, first of all, 'freedom of intercourse', or 'ius communicationis', to start from 'free passage' and 'freedom of commerce'. It is in the context of his argument about these basic freedoms that Gentili is finally led to discuss the subject of the 'law of the sea'. But, not only the concept of 'res communis', or 'freedom of use', but also the concept of 'jurisdiction', or 'protection', are strictly related to the same foundational concept of 'respublica magna'. This is a crucial characteristic of Gentili's approach to world order that is proved by reference to two cardinal points of his new 'cosmopolitan justice': 1) the 'international right to punish', as exemplified by the legitimacy of the wars of 'humanitarian intervention' and of the wars in support of the 'common law of mankind'; 2) the 'occupation of vacant land', which again underlines the relevance of the principle of 'jurisdiction' by striking a balance between the principle of 'free use' of nature and the 'jurisdiction' of the local ruler.Such a reconstruction definitely rejects the traditional image of Gentili as a supporter of 'maritime protectionism', on the ground of his Advocatio Hispanica published posthumously in 1613 and containing his pleadings as Spanish advocate before the Court of Admiralty. The guiding assumption here is that the book is strictly of a forensic character and as such devoid of any coherent theoretical substance. To the contrary, in his De iure belli, far from anticipating the English position in favour of 'mare clausum', Gentili tends to anticipate the essentials of Grotius' position, especially at the level of the ethic of the 'modern cosmopolis' and the related theme of colonial empire. On this very plane of discourse, Gentili's thinking transcends the so-called battle of the books and emerges as especially significant in illuminating the wider and deeper intellectual currents that contributed to the development of what were to become basic standard positions of modern international theory. Was Iris Murdoch a virtue ethicist? At first sight, it would appear that she was not. She does not offer an explicit definition of account of the term ‘virtue’, and there are significant differences between her views and those of standard Aristotelian virtue ethicists. There is no reason, however, to think that the standard Aristotelian view represents the only legitimate form of virtue ethics. In this chapter, I begin by recalling (in section 1) the main commonalities between Murdoch’s criticisms of (...) the prevailing moral theories of her time and those of other first-wave virtue-ethicists. I then highlight (in section 2) some cornerstones of Murdoch’s peculiar approach to morality, which represent the background against which her account of virtue is developed, and I propose to trace these cornerstones back to a more diverse range of influences than the standard version of Aristotelianism. In section 3, I sketch the basics of Murdoch’s account of virtue, and I argue that there are at least three routes to vindicate it as a genuine virtue-ethical approach: the Buddhist, the Kantian and the Socratic-Aristotelian. I explore each of these routes in turn in sections 4, 5, and 6. In conclusion, I argue that the virtue-ethical field would benefit a great deal from the kind of pluralistic account of virtue that Murdoch offers. (shrink)

Drawing upon the notion of the uncanny, this article examines my documentary photography concerning the ‘everyday’ indeterminate and potentially ominous spaces around the London transport system following the bombing incidents on the 7th July, 2005. The photographs consist of reframing images found which draw attention to the lingering reminders of terrorism within the cityscape. This paper examines also how issues of representation, race, suspects, victims, protest,defiance and accusations can be evoked in the ficto-critical use of urban documentary photography.

South Africa shared with the world the warning of a new strain of SARS-CoV2, Omicron, in November 2021. As a result, many high-income countries (HICs) instituted complete travel bans on persons leaving South Africa and other neighbouring countries. These bans were unnecessary from a scientific standpoint, and they ran counter to the International Health Regulations. In short, South Africa was penalized for sharing data. Data sharing during pandemics is commonly justified by appeals to solidarity. In this paper, we argue that (...) solidarity is, at best, an aspirational ideal to work toward but that it cannot ground an obligation to share data. Instead, low-and-middle income countries (LIMCs) should be guided by the principle of reciprocity, which states that we ought to return good for good received. Reciprocity is necessarily a conditional principle. LMICs, we argue, should only share data during future pandemics on the condition that HICs provide enforceable assurances that the benefits of data sharing will be equitably distributed and that LMICs won’t be penalized for sharing information. In the August riots in England 2011, web sites provided up-to-date access to bare witness to the unsettling events that conveyed the essence of contemporary war and crisis reporting. These characteristics include events happening in real time, dramatic accounts, continuous coverage and multimedia footage, with also the inclusion of eyewitness stories and images. The rhetoric of war was used and dramatic photographs played a pivotal role in conveying the civil unrest as a ‘war zone.’ Significantly, the local environment becomes the (...) place for potential trauma, but also a space where the spectacle of violence, destruction, as well as community spirit are foregrounded. This article examines the background to the riots and the vernacular of war photography and the cultural landscape civil unrest and urban space. (shrink)

It is generally agreed that one of the key differences between ancient skepticism and modern and contemporary skepticism is that the ancient skeptic does not call into question the existence of the external world, but only our ability to know the properties or qualities of external objects. In this paper, I argue that in Sextus Empiricus's attack on the Epicurean criterion of truth one finds evidence that the ancient Pyrrhonist also suspends judgment about the existence of external objects.

Faced with current urgent calls for more trust in experts, especially in high impact and politically sensitive domains, such as climate science and COVID-19, the complex and problematic nature of public trust in experts and the need for a more critical approach to the topic are easy to overlook. Scepticism – at least in its Humean mitigated form that encourages independent, questioning attitudes – can prove valuable to democratic governance, but stands in opposition to the cognitive dependency entailed by epistemic (...) trust. In this paper, we investigate the tension between the value of mitigated scepticism – understood as the exercise of reason-based doubt in a particular domain – and the need for trust in experts. We offer four arguments in favour of mitigated scepticism: the argument from loss of intellectual autonomy; the argument from democratic deficit; the argument from the normative failures of science; and the argument from past and current injustices. These arguments highlight the tension between the requirements for trust and justified scepticism about the role of experts. One solution, which we reject, is the idea that reliance, rather than trust, is sufficient for the purposes of accommodating experts in policy matters. The solution we endorse is to create a ‘climate of trust’, where questioning experts and expertise is welcomed, but the epistemic trust necessary for action upon information which the public cannot obtain first-hand is enabled and encouraged through structural, institutional, and justice-based measures. Scholarship on ancient Pyrrhonism has made tremendous advances over the past three decades, thanks especially to the careful reexamination of Sextus Empiricus’ extant corpus. Building on this momentum, the authors of the eight essays collected here examine some of the most vexed and intriguing exegetical and philosophical questions posed by Sextus’ presentation of this form of skepticism. The essays explore in a new light the skeptical interpretation of Plato, the differences between Pyrrhonism and Cyrenaicism, the Pyrrhonist’s stance on ordinary life, (...) religion, language, and ethics, Sextus’ discussion of our access to our own mental states, and the relationship between Pyrrhonism and epistemic internalism and externalism. Si bien distinta, y por cierto distante, de las teorías modernas (corpuscular y ondulatoria), encontramos en Suárez un corpus de principios, de base y raigambre aristotélica, que dan cuenta de una mecánica del todo exótica para nuestra men- talidad, pero abundante y enriquecida en contenido lógico y filosófico: la filosofía natural de Francisco Suárez está basada, en términos generales, en los conceptos de virtud, necesidad, (...) esfera de acción y energía en el sentido originario de esta palabra. Para sorpresa del lector mínimamente aficionado a estos temas, encontraremos en la física de Suárez explicaciones por momentos mucho más naturales, más claras y más satisfactorias sobre la propagación de la luz y sobre la acción a distancia de lo que han propuesto hasta hoy las teorías en vigencia. Francisco Suárez, desde ya, queda excluido del proyecto de Galileo y de Francis Bacon; no ofrece ni persigue resultados mate- máticos, sino un conocimiento ontológico del Universo y una interesante mecánica esencialista. Several scholars familiar with Sextus Empiricus’s Pyrrhonism who have attentively read his Against the Ethicists have gotten the impression that something strange is going on in this book. For, at variance with the ‘official’ Pyrrhonian attitude of universal suspension of judgment, a number of passages of Against the Ethicists seem to ascribe to the Pyrrhonist both a type of negative dogmatism and a form of realism, which together amount to what may be called ‘moderate ethical realism’. Para tanto, parte-se da noção de _contemplari externè_ para, em seguida, explanar a noção interpretativa de _simul desconcertante_, a qual desempenha importante papel a fim de forjar a noção de _centramento em si_, noção que permite captar os efeitos de interioridade e exterioridade relativas ao indivíduo humano e cujo engendramento faz a natureza (...) das coisas ser apreendida teleologicamente. A partir do _centramento em si _são examinadas e interpretadas categorias relevantes da imaginação, sendo a mais importante delas a _concatenatio_. The Pyrrhonian skeptic’s stance, as described by Sextus Empiricus, is in good part defined by his suspending judgment or belief about all the matters he has so far investigated. Most interpreters of Pyrrhonism maintain that it is a mistake to understand this form of skepticism in terms of doubt because suspension as conceived of by the Pyrrhonist is markedly different from the state of doubt. As an instrument for participatory technology development, Scenario-Based Design offers significant potential for an early inclusion of future users. Over the course of a 3-year research project, this method was examined as a procedure for participatory technology development. Methods and instruments aimed at achieving a potential user’s participation, and the resulting cooperation of heterogeneous social groups can be seen as translation tools. Their purpose is to act as translators between different social fields and the specific knowledge associated with them. These (...) translation capabilities and participatory methods should result in the best possible convergence of different orientations and purposes. In this paper, attempting to achieve the best possible convergence is described as a dilemma of alignment. Several approaches will be used to describe the dynamic of the alignment dilemma within the above-mentioned project. The reconstruction follows one question that is proposed as a heuristic pattern to meet the requirements of an accurate analysis of holistic participatory methods: Who or what has to adjust to whom or what, why, when, and in which way? The main conclusions include the finding that the alignment dilemma is not equally balanced, that the agency of epistemic objects within the process has to be captured, and that it is easy for translation—provided primarily by core instruments of the participatory method used—to begin to overwrite the needs and purposes of one social group with the interests and orientations of another. This book draws on Iris Murdoch's philosophy to explore questions related to the importance of attention in ethics. In doing so, it also engages with Murdoch's ideas about the existence of a moral reality, the importance of love, and the necessity but also the difficulty, for most of us, of fighting against our natural self-centred tendencies. Why is attention important to morality? This book argues that many moral failures and moral achievements can be explained by attention. Not only our actions (...) and choices, but the possibilities we choose among, and even the meaning what we perceive, are to a large extent determined by whether we pay attention, and what we attend do. In this way, the book argues that attention is fundamental, though often overlooked, in morality. While the book's discussion of attention revolves primarily around Murdoch's thought, it also engages significantly with Simone Weil, who introduced the concept of attention in a spiritual context. The book also engages with contemporary debates concerning moral perception and motivation, empirical psychology, animal ethics, and Buddhist philosophy. The Ethics of Attention will be of interest to researchers and advanced students working on Iris Murdoch, Simone Weil, ethics and moral psychology, and the philosophy of attention. (shrink)

How do we see the world aright? This question is central to Iris Murdoch’s philosophy as well as to that of her great source of inspiration, Simone Weil. For both of them, not only our action, but the very quality of our being depends on the ability to see things as they are, where vision is both a metaphor for immediate understanding and a literal expression of the requirement to train our perception so as to get rid of illusions. For (...) both, too, the method to achieve this goal is attention. For both, finally, attention requires a dethronement of the self, considered as the source of illusion. In this paper I investigate what moral perception means for each of these philosophers and how it operates through attention and its relationship with the self. I will show that, despite many striking similarities, Murdoch’s project does not equal ‘Weil minus God’, but offers a different concept of the self, a different understanding of its removal, and therefore a different picture of attention and moral perception. In evaluating both views, I will gesture towards a third way represented by Zen Buddhism, which both philosophers variously consider but do not embrace. (shrink)

Este artículo examina el significado y la función de las metáforas en la configuración del conocimiento, las percepciones y decisiones en el ámbito de la salud. Al analizar críticamente su impacto tanto positivo como negativo, especialmente en la relación entre profesionales de la salud y pacientes, se proponen tres dimensiones para desentrañar su significado: la política, que las examina como agentes de poder y como instrumento para la legitimación de las desigualdades; la cultural, que considera las metáforas como sedimentos culturales (...) que desafían el conocimiento biomédico predominante; y la ética, que cuestiona las implicaciones morales de las narrativas construidas. Este enfoque holístico busca mejorar la comprensión de la interacción compleja entre lenguaje, cognición y experiencia de enfermedad, promoviendo aproximaciones más completas en el ámbito de la salud. This book concerns the soul/body problem in Plato and Aristotle. Established as well as early career scholars actually working on Plato and Aristotle explore - under different points of view as well as through original readings and interpretations - the manifold dimensions involved in the conception of the soul/body relation articulated by the two greatest founders of Western Thought. The book starts with an exploration of the relation between cause and matter in Plato and Aristotle, then some papers on Plato's (...) theory of soul and body are presented, which involve new advancements in the research about Platonic epistemology, moral and political theory, metaphysics of mind, even about his religious and 'theological' view. Some papers on Aristotle's model follow, which are focused on his so-called "hylomorphism" as an alternative view to Plato's alleged "dualism": the ontology of the soul/body relation in Aristotle is explored, as well as the implications of this theoretical framework for his theory of knowledge, his moral theory, his cognitive psychology. Finally, two papers critically assess the philosophical connections between Aristotle's hylomorphism and its modern and contemporary Wirkungsgeschichte. (shrink)

Among the possible ways of gaining moral knowledge, moral perception figures as a controversial yet fruitful option. If moral perception is possible, moral disagreement is addressed not by appealing to principles but to the process and the objects of perception, and moral progress occurs not through deliberation but by refining one’s perceptual faculties. The possibility of “seeing clearly and justly” is at the heart of Iris Murdoch’s thought, but Murdoch herself does not put forth a systematic argument for this view. (...) In this paper I propose an argument for moral perception based on Murdoch’s philosophy, while engaging with contemporary debates in moral perception. The key idea I take from Murdoch is that perception is conceptually laden, where concepts are understood as ways of grasping the world according to human concerns. Murdoch’s position enables us to solve a difficult tension: explaining the motivating force of perception while maintaining objectivity in ethics. This view of moral perception also constitutes a radical position in the debate, where even the most optimistic defenses appeal to the supervenience of values on facts. If Murdoch is right, however, we perceive complex properties, including values, directly, so that appeal to supervenience becomes unnecessary and some of the grounds for the very distinction between fact and value are put into question.
