This article helps to clarify and articulate the ideological, legal, and ethical attitudes regarding software as intellectual property (IP). Computer software can be viewed as IP from both ethical and legal perspectives. The size and growth of the software industry suggest that large profits are possible through the development and sale of software. The rapid growth of the open source movement, fueled by the development of the Linux operating system, suggests another model is possible. The large number of unauthorized copies (...) of software programs suggests that many people do not believe in laws regarding software copyright. There are many and varied views of software as IP, even within the information systems (IS) profession. In this article, four distinct subgroups of IS professionals are identified. The article describes the four subgroups and their respective ideological views on software ownership; it explores the subgroups' attitudes regarding software laws; and finally, it explains the ethical positions embraced by each subgroup. This article presents a critical qualitative study of two opinion articles, written by two eminent scholars (Jürgen Habermas and Timothy Snyder), on the German government’s hesitant arms supply for Ukraine during the first phase of the Russian war of aggression in 2022. The main aim of the article is the uncovering of the discursive practices of critique performed by two major public intellectuals. This case study thus allows insights into the simplistic representation of the Russo-Ukrainian war in German elite media (...) discourse. The analysis focuses on actor representations and topic limitations and manipulations in the two op-eds. It is shown that both Habermas and Snyder use characteristic ways of social actor representations in their texts which exhibit their allegiances. Furthermore, both of them limit and change topics at the meso- and macro-levels of their texts in order to make their arguments sound. In closing, the critical potential of linguistic discourse analysis is shortly addressed by arguing that the context sensitive application of the categories for analyzing discourse can uncover the internal norms to which authors orient which makes them open for a critical analysis. Kulturelle und philosophische Ansichten werden erläutert.

Der Titel stellt die alte Pilatusfrage «Was ist Wahrheit?» im Zeitalter interdisziplinärer Umbrüche aus heutiger Sicht neu. Dazu wird die Wahrheit in der Ästhetik, Ethik, im Gewissen, in Technik und Hermeneutik neu reflektiert. Der Bogen spannt sich über klassische Begriffe bis zu den soziologischen Deformationen der Wahrheit durch den Pluralismus. Die Globalisierung der heutigen Informationsgesellschaft über PC und Internet brachte die Wahrheit aus der «Mode». Dazu wird ein Paradigmenwechsel vorgeschlagen, der auf Zusammenhängen zwischen apriorischen Erkenntnissen, unentscheidbaren Aussagen und dem Mysterium (...) beruht. Letztlich wird die Frage nach der «Wahrheit des Seins» als ihr transzendentales Spezifikum gestellt. Das objektive Maß der Wahrheit berührt neu die Klarheit der Wahrheit des Seins gegenüber der Widersprüchlichkeit des Irrtums. Titel und Thematik sind ein wissenschaftlich kompatibler Beitrag im Dialog zwischen Vernunft und Glaube als interdisziplinäre neue Antwort auf die alte Pilatusfrage. (shrink)

Gibt es einen spezifisch "linken" Kitsch in Abgrenzung zu politisch "rechtem"? Dieser vernachlässigten, für das Verständnis "linken Denkens" seit der Französischen Revolution aber wichtigen Frage gehen die Beiträge dieses Bandes nach.0Gezeigt wird, dass "linkes" Denken aus ganz anderen Gründen kitschanfällig ist als sein "rechtes" Pendant, auch wenn die Pathosformeln sich mitunter frappierend ähneln. Denn während rechte Ideologien den Veränderungsdruck der Moderne kompensieren, streben linke eher danach, ihn nach dem Motto "Mehr desselben" zu überbieten. I present the mismatch problem for Act Consequentialism, and I critically evaluate some popular solutions before offering my own solution to a specific version of the problem. The mismatch problem arises for Act Consequentialism when a group could have done better, but no individual in the group had an alternative with a better outcome. In such cases, the theory delivers mismatched verdicts: it condemns what the group does, but it cannot condemn any of the individual acts. In the first chapter (...) of the dissertation, I explain exactly how this problem works. In the next four chapters, I identify a variety of cases that give rise to the mismatch problem, and I explain why the most popular strategies for modifying Act Consequentialism do not get around it. In the final chapter, I introduce a novel taxonomy of problem cases, and I introduce a 'cautious' version of Act Consequentialism that doesn't encounter the mismatch problem for a certain class of case. Business, management, and business ethics literature pay little attention to the topic of AI robots. The broad spectrum of potential ethical issues pertains to using driverless cars, AI robots in care homes, and in the military, such as Lethal Autonomous Weapon Systems. However, there is a scarcity of in-depth theoretical, methodological, or empirical studies that address these ethical issues, for instance, the impact of morality and where accountability resides in AI robots’ use. To address this dearth, this study offers a (...) conceptual framework that interpretively develops the ethical implications of AI robot applications, drawing on descriptive and normative ethical theory. The new framework elaborates on how the locus of morality and moral intensity combine within context-specific AI robot applications, and how this might influence accountability thinking. Our theorization indicates that in situations of escalating AI agency and situational moral intensity, accountability is widely dispersed between actors and institutions. ‘Accountability clusters’ are outlined to illustrate interrelationships between the locus of morality, moral intensity, and accountability and how these invoke different categorical responses: illegal, immoral, permissible, and supererogatory pertaining to using AI robots. These enable discussion of the ethical implications of using AI robots, and associated accountability challenges for a constellation of actors—from designer, individual/organizational users to the normative and regulative approaches of industrial/governmental bodies and intergovernmental regimes. BackgroundThe Mental Capacity Act was enacted in 2007 in England and Wales, but the assessment of mental capacity still remains an area of professional concern. Doctors’ compliance with legal and professional standards is inconsistent, but the reasons for poor compliance are not well understood. This preliminary study investigates doctors’ experiences of and attitudes toward mental capacity assessment.MethodsThis is a descriptive, cross-sectional study where a two-domain, study-specific structured questionnaire was developed, piloted and digitally disseminated to doctors at differing career stages employed (...) in a large, multi-site National Health Service Trust in London over 4 months in 2018. Descriptive statistics and frequency tables adjusted for missing data were generated and secondary analysis was conducted.ResultsParticipants were predominantly UK trained, female and between the ages of 30 and 44 years. Less than half of the participants reported receiving formal MCAx training. Only one-third of the participants self-rated themselves as very competent or extremely competent. Self-reported MCA confidence was significantly affected by career stage with Consultants with over 10 years of experience reporting lowest confidence.ConclusionsThis study describes significant variation in practice by doctors and low self-confidence in the practice of MCAx. These results raise concerns that MCAx continues to be inconsistently performed by doctors despite appropriate awareness of the law and professional guidance on best practice. (shrink)

In areas that are predominately Hispanic and African American, the numbers rise to between 40% and 50%. Although there are continuing efforts to educate the adult population, many school systems and public health jurisdictions have had little impact on the rising numbers (...) of overweight and obese children. This session described the process of initiating a student-based, student driven approach to obesity, junk food, and diabetes and disease prevention.A need existed for a grassroots approach at the student level to raise awareness of increasing obesity rates and diabetes and other related diseases in the adolescent population. This extends a result of Harel and Kozen 118) relating IND and Π 1 1 over countable structures with some coding power, and provides a computational analog of a result of Barwise et al. 108) relating the Π 1 1 relations on a countable structure to a certain family of inductively definable relations on the hereditarily finite sets over that structure.

Did the Carthaginian cavalry general Maharbal really urge Hannibal to march on Rome after Cannae, and then comment bitterly Vincere sets, Hannibal; victoria uti nescis, when his leader refused? There are two main objections: Maharbal may not have been there, and anyway Cannae was too far away to justify such a march. The whole story has been seen as one of those well-known Roman historiographical inventions. Some maladaptive thought processes are characterized by reflexive and habitual patterns of cognitive and emotional reactivity. We review theoretical and empirical work suggesting that mindfulness—a state of nonjudgmental awareness of the present moment—can facilitate the discontinuation of such automatic mental operations. We propose a framework that suggests a series of more specific mechanisms supporting the de-automatizing function of mindfulness. Four related but distinct elements of mindfulness (awareness, attention, focus on the present, and acceptance) can each contribute to de-automatization through subsequent (...) processes, including discontinuing automatic inference, enhancing cognitive control capacity, facilitating metacognitive insight, and preventing suppression or thought distortion. De-automatizing can, in turn, allow enhancement of adaptive self-control ability and increased well-being. (shrink)
