First published in 1959, this original study argues that the main characteristic of music is that it expresses and evokes emotion, and that all composers whose music has a tonal basis have used the same, or closely similar, melodic phrases, harmonies, and rhythms to affect the listener in the same ways. He supports this view with hundreds of musical examples, ranging from plainsong to Stravinsky, and contends that music is a language in the specific sense that we can identify idioms (...) and draw up a list of meanings. The book's final section analyzes two symphonies, Mozart's Fortieth and Vaughan Williams's Sixth, to explore the nature of musical inspiration and the process whereby the notes actually convey emotion from composer to listener. On the premise that ‘morality’ refers to a system of rules governed by a material categorical imperative, I argue that the sources thesis of legal positivism (and, consequently, its separation thesis) is untenable. This is because it portrays legal obligations as hypothetical imperatives, which they cannot be if a material categorical imperative exists. Legal systems lay down obligation-asserting rules; but any rules are necessarily invalid if they require behaviour contrary to a material categorical imperative. Because the sources thesis attests otherwise, (...) legal positivism presupposes, minimally, that a material categorical imperative cannot be known to exist. I argue, however, that human agents cannot coherently question that a material categorical imperative exists. By definition, they necessarily adopt hypothetical imperatives. But understanding the concept of a hypothetical imperative requires the concept of a categorical imperative to be understood, and understanding having the concept of a categorical imperative postulates that there can be only one categorical imperative, that it exists, and that it is Alan Gewirth’s Principle of Generic Consistency (PGC). This argument only fails if the concept of a categorical imperative is incoherent. In all of this, I follow Kant, except about the material content of the categorical imperative and the nature of free will. (shrink)

This volume collects six original essays by internationally respected researchers who have devoted themselves to the study of legal obligation. It brings together works that innovatively address key dimensions of the current debates concerning legal obligation from different and, in some cases, even opposing theoretical perspectives. As a result, the collection offers a comprehensive discussion of legal obligation that promises to significantly advance our understanding of the obligatory dimension of law. What specifically connects the contributions gathered here is one common (...) thread: coming to terms with a notion – legal obligation – that is of both practical and theoretical importance. On the one hand, it is widely regarded as a fundamental legal concept by legal practitioners and laypeople alike, as not only judges, prosecutors, lawyers, and juries but also ordinary citizens make extensive use of obligation-related terms and discourses. On the other hand, the notion of legal obligation is of paramount significance for the theory of law. Indeed, even legal theorists who, quite understandably, refuse to reduce the law to a mere obligation-imposing device and opt instead for a view in which the normative dimension of the law also encompasses powers, rights, permissions, privileges and immunities, duly acknowledge the centrality of legal obligation for the understanding and conceptualisation of law. Can one refute Berkeleyan phenomenalism by arguing that sensory objects seem mind-independent, and that, according to Berkeley, experience is to be taken at face value? Relying on Mackie’s recent discussion of the issue, I argue, first, that phenomenalism cannot be straightforwardly refuted by relying on perceptual or bodily experience of mind-independence together with the truthfulness of experience. However, I maintain, second that phenomenalism can be indirectly refuted by appealing to the bodily experience of resistance. Such experience presents us with the (...) causal activity of the resisting physical object. If experience is truthful, as the phenomenalist has it, physical objects are causally active. Reporting and investigating research misconduct can lead to disciplinary proceedings being initiated, and ultimately to disciplinary sanctions being imposed on convicted scientists. The conversion of research misconduct findings into disciplinary sanctions is poorly understood. This article analyses all the disciplinary decisions handed down on appeal by the Conseil national de l'enseignement supérieur et de la recherche (CNESER) between 1991 and 2023, concerning breaches of research integrity by academics and doctoral students ( n = 333). Three findings are highlighted. Firstly, the (...) article describes how the CNESER sanctioned research misconduct even before the notion of research integrity became part of French law, by monitoring scientists’ compliance with “deontological rules”. Secondly, we show that assessing disciplinary fault involves evaluating a much broader set of circumstances than the mere existence of research misconduct, which can explain why the latter do not result in disciplinary sanctions or lighter sanctions. Thirdly, the research highlights situations where research misconduct is intertwined with other allegations, blurring the relative importance of these motives in the awarding of disciplinary sanctions. The article concludes with a call for greater accessibility to the disciplinary decisions handed down by universities in the first instance, as a key next step in gaining a better understanding of the disciplinary response to research misconduct. The concept of human dignity is increasingly invoked in bioethical debate and, indeed, in international instruments concerned with biotechnology and biomedicine. While some commentators consider appeals to human dignity to be little more than rhetoric and not worthy of serious consideration, the authors of this groundbreaking new study give such appeals distinct and defensible meaning through an application of the moral theory of Alan Gewirth.

This paper defends hedonic intentionalism, the view that all pleasures, including bodily pleasures, are directed towards objects distinct from themselves. Brentano is the leading proponent of this view. My goal here is to disentangle his significant proposals from the more disputable ones so as to arrive at a hopefully promising version of hedonic intentionalism. I mainly focus on bodily pleasures, which constitute the main troublemakers for hedonic intentionalism. Section 1 introduces the problem raised by bodily pleasures for hedonic intentionalism and (...) some of the main reactions to it. Sections 2 and 3 rebut two main approaches equating bodily pleasures with non- intentional episodes. More precisely, section 2 argues that bodily pleasures cannot be purely non-intentional self-conscious feelings, by relying on Brentano’s objection to Hamilton’s theory of pleasure. Section 3 argues that bodily pleasures cannot be non-intentional sensory qualities by relying on Brentano’s objections to Stumpf’s theory of pleasure. Section 4 develops a brentanian view of the intentionality of bodily pleasures by claiming bodily pleasures are directed at a sui generis class of sensory qualities. Section 5 presents an objection to Brentano’s later theory of pleasure according to which all sensory pleasures are directed at sensing acts. (shrink)

Solidaire d’une certaine « politique de la recherche », Descartes voit l’une de ses inventions, la « langue universelle », être pour la première fois « contresignée » par Derrida. Cette reconnaissance ne doit pas toutefois cacher un désaccord où se révèle l’originalité de la pensée derridienne de l’invention : résolument anticartésienne, elle propose une inventio qui, en tant qu’elle confond avec le jeu même de la « différance », s’exclut de la cogitatio. Événement immanent à la res extensa qui, pour cette raison, ne saurait être entièrement rationalisé et qui, c’est significatif, en même temps qu’il s’ouvre à la chance, renvoie à une autre conception de l’être-ensemble. This study examines to what extent different types of CEOs in family firms influence external and internal stakeholder-related CSP as compared to CEOs in nonfamily firms. Linking family CEO and nonfamily CEO with CSR outcomes, we provide evidence that family CEOs are positively associated with both external and internal CSR, whereas nonfamily CEOs within family firms tend to be negatively associated with both external and internal CSR. We show that the incumbent CEO’s age moderates the above relationships, indicating the existence (...) of shifting family priorities and suggesting a tendency toward CSR conformity as the salience of succession concerns increases. Alan Gewirth's Reason and Morality , in which he set forth the Principle of Generic Consistency, is a major work of modern ethical theory that, though much debated and highly respected, has yet to gain full acceptance. Deryck Beyleveld contends that this resistance stems from misunderstanding of the method and logical operations of Gewirth's central argument. In this book Beyleveld seeks to remedy this deficiency. His rigorous reconstruction of Gewirth's argument gives its various parts their most compelling formulation and (...) clarifies its essential logical structure. Beyleveld then classifies all the criticisms that Gewirth's argument has received and measures them against his reconstruction of the argument. The overall result is an immensely rich picture of the argument, in which all of its complex issues and key moves are clearly displayed and its validity can finally be discerned. The comprehensiveness of Beyleveld's treatment provides ready access to the entire debate surrounding the foundational argument of Reason and Morality . The main purpose of the present chapter is to argue in favor of the claim that, contrary to what is usually and tacitly assumed, organization is not necessary for organicism. To this purpose, I first set up the stage by providing a working characterization of organicism that involves two free parameters, whose variations allow for covering the rich and diverse conceptual landscape of organicism, past and present. In particular, I contend that organization is usually construed as a “mean to an (...) end” notion, or as a tool put at the service of vindicating organicism’s twofold defining assumption, namely, that organisms are determinative entities in their own right, to the effect that (organismic) biology is epistemologically autonomous from physico-chemistry. After a short detour devoted to show that organicism generally collapses on a spectrum of variants of emergentism, I take inspiration from a recent account of emergence called “transformational emergence” to put forward a transformational version of organicism. For such a version meets organicism’s defining standards in a way that is free of any commitment to organization, arguing for its very conceptual soundness finally allows for legitimizing the claim that organicism doesn’t really need organization. On l'observe en particulier dans la genèse de ce concept chez Augustin, en réponse à la doctrine manichéenne du mal: la rédemption du Christ reflue vers les origines de l'humanité pour dévoiler notre responsabilité de la faute sous le pardon divin qui la recouvre. Ce dogme fournit une clef de lecture de l'histoire, il montre (...) la présence active de l'amour et du pardon aux origines du temps, pour dénoncer et réprimer la violence des hommes ; il conteste l'inertie du temps par la profusion du pardon, il exprime un sens de l'existence, il enseigne une intelligence de la temporalité.Le cas du péché originel illustre le fonctionnement du dogme en général dans la culture, bien au-delà de la sphère de l'Église, son rôle à la fois révélateur, contestant et régulateur. In particular we see this in the birth of the concept, in Augustine’s answer to the Manichaean doctrine of evil: the redemption of Christ flows back towards the origins of humanity to unveil our responsability for the fault, which is covered over by the divine pardon. This dogma gives a key for reading bistory. It shows the active presence of love and forgiveness from the beginning of time, which denounces and represses the violence of men. It contests the inertia of time by the profusion of forgiveness, it expresses a sense to existence, and it teaches an understanding of temporality.The case of original sin illustrates the functioning in culture of dogma in general, well beyond the spbere of the Cburch, and its role both as revealer, contestant, and regulator. But it is still necessary to know how to interpret dogmas, in the fashion of foundation myths, that is to, say in so far as they are based on a symbolic logic of a narrative language. Tbe contemporaneousness of the Concil of Trent and the baroque style equally show the inscription of dogma in culture: the multiplication of peripberal ornaments ougbt not to turn our look away from the center of the architecture, which is the figure of Christ. In a community that takes rights seriously, consent features pervasively in both moral and legal discourse as a justifying reason: stated simply, where there is consent, there can be no complaint. However, without a clear appreciation of the nature of a consent-based justification, its integrity, both in principle and in practice, is liable to be compromised. This book examines the role of consent as a procedural justification, discussing the prerequisites for an adequate consent -- in particular, that an agent with (...) the relevant capacity has made an unforced and informed choice, that the consent has been clearly signalled, and that the scope of the authorisation covers the act in question. It goes on to highlight both the Fallacy of Necessity (where there is no consent, there must be a wrong) and the Fallacy of Sufficiency (where there is consent, there cannot be a wrong). Finally, the extent to which the authority of law itself rests on consent is considered. If the familiarity of consent-based justification engenders confusion and contempt, the analysis in this book acts as a corrective, identifying a range of abusive or misguided practices that variously under-value or over-value consent, that fictionalise it or that are fixated by it, and that treat it too casually or too cautiously. In short, the analysis in Consent in the Law points the way towards recognising an important procedural justification for precisely what it is as well as giving it a more coherent application. The philosophical debate about the concept of Law is dominated by two traditions: Legal Positivism and Natural-Law Theory. Within Anglo-American Jurisprudence, Legal Positivism is unquestionably the more popular approach. Whilst in recent years there have been a number of assaults upon this ruling view, opposition to Legal Positivism is still very much at the margins of contempory Jurisprudence, The authors of this major work argue, however, that Legal Positivism should be rejected, contending that it is incorrect not in some minor (...) detail but in what they take to be its central tenet, the thesis that the concept of law is morally neutral. Their contention amounts to a rejection of Legal Positivism in favour of Natural-Law Theory. Law as a Moral Judgment is an important and controversial contribution to Jurisprudence. Of all the things we do and say, most will never be repeated or reproduced. Once in a while, however, an idea or a practice generates a chain of transmission that covers more distance through space and time than any individual person ever could. What makes such transmission chains possible? For two centuries, the dominant view was that humans owe their cultural prosperity to their powers of imitation. In this view, modern cultures exist because the people who carry them are (...) gifted at remembering, storing and reproducing information. How Traditions Live and Die proposes an alternative to this standard view. What makes traditions live is not a general-purpose imitation capacity. Cultural transmission is partial, selective, often unfaithful. Some traditions live on in spite of this, because they tap into widespread and basic cognitive preferences. These attractive traditions spread, not by being better retained or more accurately transferred, but because they are transmitted over and over. This theory is used to shed light on various puzzles of cultural change and to explain the special relation that links the human species to its cultures. Morin combines recent work in cognitive anthropology with new advances in quantitative cultural history, to map and predict the diffusion of traditions. The rise of blockchain as a techno-solution in the development sector underscores the critical imbalances of data power under ‘computational capitalism’. This article will consider the political economy of techno-solutionist and blockchain discourses in the developing world, using as its object of study blockchain projects in Pacific Island nations. Backed by US State Department soft power initiatives such as Tech Camp, these projects inculcate tech-driven notions of economic and political development, or ICT4D, while opening up new terrains for data accumulation (...) and platform control. Blockchain developers in search of proof of concept have found the development sector a fecund space for tech experimentation as they leverage a desire for tech-development and exploit regulatory weakness. The material implications of blockchain projects and discourse have been to create governance solutions which bypass the developing world state as a largely corrupting intermediary. In the Pacific, this has meant blockchain supply-chain management systems, proprietary financial innovation in humanitarian relief and an Asian Development Bank project to manage indigenous Fijian lands exclusively on the blockchain. In all these instances, discourses of solutionism, innovation and data empowerment have been deployed in aid of blockchain cartographies of control. (shrink)

Samuel Johnson claimed to have refuted Berkeley by kicking a stone. It is generally thought that Johnson misses the point of Berkeley's immaterialism for a rather obvious reason: Berkeley never denied that the stone feels solid, but only that the stone could exist independently of any mind. I argue that Johnson was on the right track. On my interpretation, Johnson’s idea is that because the stone feels to resist our effort, the stone seems to have causal powers. But if appearances (...) are to be taken at face value, as Berkeley insists, then the stone has causal powers. I argue that such causal powers threaten not only Berkeley’s view that only minds are active, but also, and more fundamentally, his central claim that sensible things depend on perception. (shrink)

Who is Daisaku Ikeda? At one level, he is the leader of a religious movement--Soka Gakkai--which began in Japan, where it still has its headquarters, but which now claims 12 million adherents around the world. At another level, he is a globetrotting figure whose formal conversations with diverse writers, thinkers and diplomats--including Arnold Toynbee, Joseph Rotblat and Mikhail Gorbachev--have garnered him an international profile, as well as academic recognition. Perhaps above all else, Daisaku Ikeda is viewed as a campaigner for (...) peace. And it is Ikeda's specific contribution to peacebuilding, notably through the central emphasis he has placed on the significance of dialogue, that this book explores: the first to do so in a concerted way. Olivier Urbain shows that while Soka Gakkai (the "value society") may stem from the medieval principles of Nichiren Buddhism, under Ikeda's leadership it has taken these classic wisdoms and transformed them. Now essentially classless and secularised, as well as adaptable and sensitive to modern challenges like resource shortages and climate change, this, argues the author, is a pragmatic approach to peace which has proved both popular and eminently transportable. The eighteenth century, having inherited a pessimism from classical anthropology that its own ideology of progress had to absorb, seemed to have invented le mal de vivre. Le mal de (...) vivre was indeed an invention because, despite a terminology that was inspired by the theory of humors (“hysterical vapors” among women; “hypochondriac melancholy” for men), the philosophers and doctors of the Enlightenment already had envisaged the fatality of an anatomical “limit” for the etiology of “afflictions of the soul.” In this way, according to the Eléments de Physiologie (Elements of Physiology) of Diderot, the agitation of the imagination actually represented the degree of irritability, or of erethism, of the nervous system: “the dreams of young people in a state of innocence come from the extremities of the fibres (meaning the nervous fibres) which are the original carriers of obscure desires, vague disquiet, a melancholy whose cause they do not understand.” If we believe the article on “delight” (jouissance) in the Encyclopaedia, a “vague and melancholy disquiet,” which is linked in particular with the physiological changes occurring at puberty, constitutes a general and “normal” state of sensation, all “delight” implying by this definition the absence of disquiet in comparison with its external object. Reduced to its vibratile intensities, the “perceiving body” that is deprived of its totalizing metaphor becomes pulverized and fragmented into so many “desiring monads.” Like Condillac's statue, it destabilizes itself through the fields of force of the phenomenal world, completely obedient to the energy economy of other bodies that define its external frontier, left to the contradictory universal laws of attraction and repulsion that govern them: “Here below, each part, through a higher impulse, combines toward the central harmony of a whole. We collide with one another and are thrown backward and forward by the force maintaining a general equilibrium and order, in which we participate mechanically.”. (shrink)

Le but de cet article est double. Il s’agit d'abord d'introduire des données inédites concernant un jeu de langage du serbo-croate : le šatrovački qui, à l'image du verlan connu en France, inverse les syllabes. Je présenterai aussi le chemin qui a été parcouru lors de la confection du corpus. Dans un deuxième temps, un aspect particulier du corpus, l'épenthèse de schwa, fera l'objet d'une exploitation théorique.Le premier objectif sera l’occasion de développer quelques points intéressants parmi lesquels la question non (...) anodine du choix des informateurs, connexe à la marginalité des données considérées, et la question de l’influence du cadre théorique sur la collecte de données. Ce faisant, on verra en quoi réside l’intérêt d’un tel corpus. En outre, une description ainsi qu’une proposition d'explication des processus morpho-phonologiques en jeu seront fournies. On verra notamment que le comportement des bases monosyllabiques CVC est un argument fort en faveur de l’hypothèse des noyaux vides finaux, hypothèse fondée indépendamment. (shrink)

On entend par survenance moral la thèse selon laquelle, nécessairement, si deux entités sont parfaitement similaires en ce qui concerne toutes leurs propriétés non-morales, elles sont parfaitement similaires en ce qui concerne leurs propriétés morales. En dépit de son apparente simplicité, cette définition pose de nombreux problèmes. Ainsi, alors que la survenance morale est souvent présentée comme l’une des rares thèses faisant consensus en philosophie, il s’avère à y regarder de près que son interprétation varie grandement selon les philosophes. Trois (...) questions, en particulier, demandent à être éclaircies, sur lesquelles nous nous concentrerons ici : 1. On fait souvent appel à la survenance dans le but d’expliquer les propriétés morales. Mais à strictement parler, la survenance ne revêt par elle-même aucun caractère explicatif : quelle relation la survenance morale entretient-elle avec la relation de fondation ou d’explication morale ? 2. On tient la survenance morale pour une thèse consensuelle, mais on s’accorde peu sur la base de survenance des valeurs morales6. D’aucuns la restreignent à des propriétés naturelles ; d’autres y incluent des propriétés non-naturelles, pour peu qu’elles ne soient pas normatives ; d’autres encore y incluent des propriétés normatives, pour peu qu’elles ne soient pas morales ; d’autres enfin y incluent les principes moraux eux-mêmes. Que recouvre exactement la base de survenance des propriétés morales ? La survenance est une thèse modale (« nécessairement... »). Mais quelle modalité entre-t-elle ici en jeu ? La nécessité qui sous-tend la survenance morale est-elle métaphysique, conceptuelle, normative...? (shrink)

In this paper, after presenting three challenges that any knowledge-based demarcation between science and non-science should meet, namely, the skeptical, triviality, and mimicry challenges, I show how a recent contender in epistemology, viz., presuppositional epistemic contextualism, allows these challenges to be met, hence pointing toward a novel solution to the perennial demarcation problem. Conceiving of scientific knowledge from the vantage point of contextualism forces us to consider science as being first and foremost a distinctive epistemological context, which has the peculiarity (...) of coming with a very high degree of stringency for the truth conditions of putative knowledge attributions. The fact that science imposes particularly stringent norms on knowledge is measured by the extension of the set of counterpossibilities that science is (i) in the business of eliminating on the basis of available evidence and (ii) ready to take seriously (insofar as they are consistent with the scientific community’s pragmatic presuppositions at a given time and place). On a pris l'habitude de voir en l'analyse un instrument logique de décomposition et de clarification des concepts, confirmant du même coup l'évaluation critique qu'en a donnée Kant : l'analyse est un procédé stérile qui ne contribue en rien à l'expansion et au renouvellement des connaissances. Soulignant la cohérence de ses emplois historiques, le présent ouvrage cherche au contraire à rétablir l'analyse en sa fonction inventive : de l'Antiquité au XVII siècle, la méthode analytique constitue, en effet, une solution aux (...) insuffisances de la déduction logique ; s'appuyant sur la construction et le déchiffrement des figures, elle offre une voie à la fois détournée et probante pour la résolution des problèmes. Descartes est l'héritier de cette tradition, mais il est aussi, à maints égards, l'artisan de la conception moderne de l'analyse dont il a fait la voie privilégiée de la connaissance de soi dans les Méditations métaphysiques. Accomplissement heuristique de "l'ordre des raisons" mais aussi aventure temporelle inscrite dans la durée féconde de la méditation, l'analyse se révèle alors l'instrument d'une raison radicalement inventive.
