The World Medical Association has announced that a new revision process of the Declaration of Helsinki has been started. This article will identify the criticisms that have been made in the bioethics literature, particularly since the last revision. In addition, criticisms are discussed that were made in the literature even before the last revision and have not fallen silent. The plausibility of the recommendation for a change in the Declaration of Helsinki is examined.

In this paper, I develop an account of Frederick Douglass’s use of declaration as an emancipatory mode of political action. An act of declaration compels an audience to acknowledge the declarer as possessing a type of normative standing (e.g. personhood or citizenship). Douglass, through acts of declaration like his Fifth of July speech and fight with the ‘slavebreaker’ Covey, compels American audiences to acknowledge him as a fellow citizen by forcefully enacting a commitment to resist tyranny and oppression. The distinctive (...) emancipatory potential of declaration is grounded in its political epistemology of acknowledgment, on which political actors understand other persons as members of a shared community through the ways in which they comport themselves in relation to one another. This chapter focuses on the frameworks of Head‐Driven Phrase Structure Grammar (HPSG) as it developed from Generalized Phrase Structure Grammar (GPSG), and Lexical‐Functional Grammar (LFG). Declarative frameworks are not generative, as they do not ‘generate’ anything in the sense of the preceding paragraph. Pullum refers to that kind of approach as Generative‐Enumerative Syntax and differentiates it from Model‐Theoretic Syntax: GPSG, HPSG, and LFG essentially fall in the latter category. It describes some key aspects of declarative frameworks, and the motivation for (...) them. The chapter considers how declarative frameworks instantiate a view of Generative Grammar directly inspired by Noam Chomsky's early work, but without the procedural component. It presents some of the core design features which motivate declarative frameworks, and explores how syntactic phenomena are factorized and formalized in declarative frameworks, with a view to comparison with Minimalist Program analyses. Historical discourse is a period phenomenon shaped by the rhetorical and genre understanding of the moment in which it became formalized and professionalized - that is, the second half of the nineteenth century. In the figurative arts, realist painting and its rival, photography, was dominant, and the literary form this notion of consciousness took was the realist novel. Literary realism devices replaced romantic literature devices, just as those latter devices had succeeded, but never replaced the eighteenth-century devices. Historical discourse and (...) the very notion of proper history followed realism devices, mostly the single-lens photographic perspective, one viewer’s viewpoint. From a discourse perspective, this approach took the form of declarative, statement-making. Also, it is not to say that the declarative sentence which gives this term its name was rejected as the preferred way of making assertions about the world - far from it. Although a few self-conscious stylists work hard to avoid it, the declarative sentence is almost inevitable. Their readers work even harder. But just as narrativity encompasses a realm that extends far beyond narratives, so that narratives can proliferate in an environment that has, in a crucial sense, rejected grand narratives, so declarative statements will exist without entailing statement-making. The declarative act became the defining mark of professional history and remained its principal mode, just as it remains the predominant mode of literature and any number of other discourses. Indeed, this essay is written in the declarative rhetorical mode. However, literary modernism, philosophy, and a host of scientific developments have left this way of representing the world behind. Moreover, the same technological and intellectual changes that caused the modernist vision have, at the same time, created a different world to be depicted, a different sort of event to be represented historically. Not only the form but also the content have changed. The ethical and practical frustrations of representing such events have led to a theoretical challenge to the declarative form of knowing and to a challenge for the genre distinctions that constitute guild history: the idea of the past produced by academically professionalized individuals. For example, the difference between history and fiction - or rather, their respective relationship to truth and reality - has blurred. Concerns over conflicts of interest in academic research and medical practice continue to provoke a great deal of discussion. What is most obvious in this discourse is that when COIs are declared, or perceived to exist in others, there is a focus on both the descriptive question of whether there is a COI and, subsequently, the normative question of whether it is good, bad or neutral. We contend, however, that in addition to the descriptive and normative, COI declarations and accusations (...) can be understood as performatives. In this article, we apply J.L. Austin’s performative speech-act theory to COI discourses and illustrate how this works using a contemporary case study of COI in biomedical publishing. We argue that using Austin’s theory of performative speech-acts serves to highlight the social arrangements and role of authorities in COI discourse and so provides a rich framework to examine declarations, accusations and judgements of COI that often arise in the context of biomedical research and practice. According to orthodox (Kolmogorovian) probability theory, conditional probabilities are by definition certain ratios of unconditional probabilities. As a result, orthodox conditional probabilities are undefined whenever their antecedents have zero unconditional probability. This has important ramifications for the notion of probabilistic independence. Traditionally, independence is defined in terms of unconditional probabilities (the factorization of the relevant joint unconditional probabilities). Various “equivalent” formulations of independence can be given using conditional probabilities. But these “equivalences” break down if conditional probabilities are permitted to have (...) conditions with zero unconditional probability. We reconsider probabilistic independence in this more general setting. We argue that a less orthodox but more general (Popperian) theory of conditional probability should be used, and that much of the conventional wisdom about probabilistic independence needs to be rethought. We demonstrate that the key components of cognitive architectures (declarative and procedural memory) and their key capabilities (learning, memory retrieval, probability judgment, and utility estimation) can be implemented as algebraic operations on vectors and tensors in a high‐dimensional space using a distributional semantics model. High‐dimensional vector spaces underlie the success of modern machine learning techniques based on deep learning. However, while neural networks have an impressive ability to process data to find patterns, they do not typically model high‐level cognition, and (...) it is often unclear how they work. Symbolic cognitive architectures can capture the complexities of high‐level cognition and provide human‐readable, explainable models, but scale poorly to naturalistic, non‐symbolic, or big data. Vector‐symbolic architectures, where symbols are represented as vectors, bridge the gap between the two approaches. We posit that cognitive architectures, if implemented in a vector‐space model, represent a useful, explanatory model of the internal representations of otherwise opaque neural architectures. Our proposed model, Holographic Declarative Memory (HDM), is a vector‐space model based on distributional semantics. HDM accounts for primacy and recency effects in free recall, the fan effect in recognition, probability judgments, and human performance on an iterated decision task. HDM provides a flexible, scalable alternative to symbolic cognitive architectures at a level of description that bridges symbolic, quantum, and neural models of cognition. (shrink)

Authorial and artistic declarations would seem to be a boon to interpreters who favor actual intentionalism. However, because they believe there are limits on the power of authors and artists to embody their intentions in their works, moderate actual intentionalists hold that some intentions are irrelevant. Looking closely at authorial declaration about the sexuality of Albus Dumbledore in the Harry Potter novels, I argue in favor of the extreme actual intentionalist position that genuine authorial declarations should not be ignored because (...) authorial intention always determines meaning. The answer to the question in the subtitle is that we do not know with certainty, even though there is a definite right answer. We can argue for the answer we think is most likely, however. And aided by the distinction between meaning and significance, extreme actual intentionalism provides a clear and consistent way of making such arguments while avoiding the problem of being stuck with an interpretation we find aesthetically displeasing. Declarations of law, of politics and of ethics have proliferated in contemporary discourses of public life. In this article, a terrain of research is unfurled that addresses the demand and repetition of declaration. Declarations are understood as relations of speech addressed between the masks of law, of sovereignty, of critic and of enemy. It is argued that what is instituted in the declarations of our time is a melancholic relation of speech which disavows the insistence of the remainder. The remainder (...) persists. How then to bear witness to the remainder? Mourning provides some headway in the effort. What remains undeclared here must be mourned. (shrink)

This article argues that the Universal Declaration of Human Rights, by claiming certain inheritances from eighteenth-century American and French rights declarations, simultaneously disavowed others, reshaping the genre of the rights declaration in ways amenable to forms of imperial and racial domination. I begin by considering the rights declaration as genre, arguing that later participants can both inherit and disavow aspects of what came before. Then, drawing on original archival research, I consider the drafting of the UDHR, using as an entry (...) point the reception of the NAACP’s Appeal to the World petition, edited by W.E.B. DuBois. I reconstruct conversations within the drafting committee about the right to petition, self-determination, and the right to rebellion, and the separation of the Declaration from the rights covenants, to illustrate the allegiances between US racial politics and French imperial politics, and their legacies for our contemporary conceptions of human rights. On 5 August 1968, publication of the Harvard Committee’s report on the subject of “irreversible coma” established a standard for diagnosing death on neurological grounds. On the same day, the 22nd World Medical Assembly met in Sydney, Australia, and announced the Declaration of Sydney, a pronouncement on death, which is less often quoted because it was overshadowed by the impact of the Harvard Report. To put those events into present-day perspective, the authors reviewed all papers published on this subject and (...) the World Medical Association web page and documents, and corresponded with Dr A G Romualdez, the son of Dr A Z Romualdez. There was vast neurological expertise among some of the Harvard Committee members, leading to a comprehensible and practical clinical description of the brain death syndrome and the way to diagnose it. This landmark account had a global medical and social impact on the issue of human death, which simultaneously lessened reception of the Declaration of Sydney. Nonetheless, the Declaration of Sydney faced the main conceptual and philosophical issues on human death in a bold and forthright manner. This statement differentiated the meaning of death at the cellular and tissue levels from the death of the person. This was a pioneering view on the discussion of human death, published as early as in 1968, that should be recognised by current and future generations. (shrink)

International institutions such as UNESCO are deliberating on a new standard setting instrument for neurotechnologies. This will likely lead to the adoption of a soft law document which will be the first global document specifically tailored to neurotechnologies, setting the tone for further international or domestic regulations. While some stakeholders have been consulted, these developments have so far evaded the broader attention of the neuroscience, neurotech, and neuroethics communities. To initiate a broader debate, this target article puts to discussion twenty-five (...) considerations and desiderata for recognition by a future instrument. They are formulated at different levels of abstraction, from the big picture to technical details, seek to widen the perspective of preparatory reports and transcend the narrow debate about “neurorights” which overshadows many richer and more relevant aspects. These desiderata are not an exhaustive enumeration but a starting point for discussions about what deserves and what requires protection by an international instrument. (shrink)

Emergency declarations are a vital legal authority that can activate funds, personnel, and material and change the legal landscape to aid in the response to a public health threat. Traditionally, declarations have been used against immediate and unforeseen threats such as hurricanes, tornadoes, wildfires, and pandemic influenza. Recently, however, states have used emergency declarations to address public health issues that have existed in communities for months and years and have risk factors such as poverty and substance misuse. Leaders in these (...) states have chosen to use emergency powers that are normally reserved for sudden catastrophes to address these enduring public health issues. This article will explore emergency declarations as a legal mechanism for response; describe recent declarations to address hepatitis A and the opioid overdose epidemic; and seek to answer the question of whether it is appropriate to use emergency powers to address public health issues that are not traditionally the basis for an emergency declaration. Was the American War for Independence just? In July 1775, a full year before the Declaration of Independence, the colonists argued that they had the right to self-defense. They made this argument using language that accords with what we can broadly call classical just war thinking, based, inter alia, on their claim that their provincial authorities had a responsibility to defend the colonists from British violence. In the 1775 Declaration of the United Colonies, written two months after British troops attacked (...) colonial citizens, such arguments are made. This essay carefully looks at the historical context of the 1775 Declaration, the arguments made by the colonists, and the philosophical and theological underpinnings of those claims, and concludes that the colonists made a compelling argument commensurate with just war thinking. Individual differences in phonological processing abilities have often been attributed to perceptual factors, rather than to factors relating to learning and memory. Here, we consider the contribution of individual differences in declarative and procedural memory to phonological processing performance in adulthood. We examined the phonological processing, declarative memory, and procedural memory abilities of 79 native English-speaking young adults with typical language and reading abilities. Declarative memory was assessed with a recognition memory task of real and made-up objects. Procedural memory was (...) assessed with a serial reaction time task. For both tasks, learning was assessed shortly after encoding, and again after a 12-h, overnight delay. We regressed phonological processing ability with memory performance on both days. We found that declarative memory, but not procedural memory, was highly predictive of phonological processing abilities. Specifically, declarative memory scores obtained shortly after learning were associated with non-word repetition performance, whereas declarative memory scores obtained after the overnight delay were associated with phonological awareness. Procedural memory was not associated with either of the phonological processing measures. We discuss these findings in the context of adult participants with mature phonological systems. We examine possible implications for the relationship between declarative memory and phonological processing in adulthood. (shrink)

This paper explores the issue whether feminism needs a metaphysical grounding, and if so, what form that might take to effectively take account of and support the socio-political demands of feminism; addressing these demands I further propose will also contribute to the resolution of other social concerns. Social constructionism is regularly invoked by feminists and other political activists who argue that social injustices are justified and sustained through hidden structures which oppress some while privileging others. Some feminists (Haslanger and Sveinsdóttir, (...) Feminist metaphysics. In E. N. Zalta (Ed.), Stanford encyclopedia of philosophy. Stanford: Stanford University, 2011) argue that the constructs appealed to in social constructivism are real but not metaphysically fundamental because they are contingent. And this is exactly the crux of the problem—is it possible to sustain an engaged feminist socio-political critique for which contingency is central (i.e., that things could be otherwise) and at the same time retain some kind of metaphysical grounding. Without metaphysical grounding it has been argued, the feminist project may be rendered nonsubstantive (Sider, Substantivity in feminist metaphysics. Philosophical Studies, 174(2017), 2467–2478, 2017). There has been much debate around this issue and Sider (as an exemplar of the points under contention) nuances the claims expressed in his earlier writings (Sider, Writing the book of the world. Oxford: Clarendon Press, 2011) and later presents a more qualified account (Sider, Substantivity in feminist metaphysics. Philosophical Studies, 174(2017), 2467–2478, 2017). Nonetheless, I propose the critiques and defences offered by the various parties continue to depend on certain erroneous assumptions and frameworks that are challengeable. I argue that fundamentality as presented in many of these current accounts, which are underpinned by the explicit or implicit ontologies of monism and dualism and argued for in purely rationalist terms which conceive of subjects as primarily reason-responding agents, reveal basic irresolvable problems. I propose that addressing these concerns will be possible through an enactivist account which, following phenomenology, advances an ontology of interdependence and reconceives the subject as first and foremost an organism immersed in a meaningful world as opposed to a primarily reason-responding agent. Enactivism is thus, I will argue, able to legitimize feminist socio-political critiques by offering a non-reductive grounding in which not only are contingency and fundamentality reconciled, but in which fundamentality is in fact defined by radical contingency. My paper proceeds in dialogue with feminists generally addressing this ‘metaphysical turn’ in feminism and specifically with Sally Haslanger and Mari Mikkola. (shrink)

Objectives: To determine whether authors of scientific publications in molecular biology declare patents and other potential financial interests.Design: Survey of a 6-month sample of papers related to molecular biology in Nature.Methods: The esp@cenet worldwide patent search engine was used to search for patents applied for by the authors of scientific papers in Nature that were related to molecular biology and genetics, between January and June 2005.Results: Of the 79 papers considered, four had declared that certain authors had competing financial (...) interests. Seven papers in which no financial interests were declared had authors with patent applications that were based on the research in the paper or were closely related to it. Another paper had two authors with connections to biotechnology companies that were not disclosed.Conclusion: Two thirds of the papers in which authors had patent applications or company affiliations that might be considered to be competing financial interests did not disclose them. Failure to disclose such information may have negative implications on the perception of science in society and on its quality if the possible bias is hidden. Journals should make greater efforts to ensure full disclosure, and scientific institutions should consider failure to disclose financial interests as an example of scientific malpractice. Establishing a register of interests for scientists is one way to increase transparency and openness. (shrink)

This article examines the historical background, proliferation, and later internationalization of public declarations of forgiveness and remorse, first made in Europe a few decades after the end World War II. The author suggests that these declarations should be understood as a political practice, and bases her claim on three premises: after 1945, politicians began apologizing not only for their own crimes but mainly for those perpetrated by the communities they represented; these declarations implied a tacit acceptance of responsibility of both (...) the group that declares its remorse and of the group that accepts and possibly forgives the former for its past crimes; apart from representing a shared collective moral responsibility, declarations of forgiveness and remorse imply the continuity of a nation. We call a semantic theory 'classical' if it includes the assertions that (I) a function V assigning semantic value maps object language proper names into some set D, (ii) V maps object language atomic sentences into some set F, and (iii) the extension of any object language unary predicate is a member of the power set of D. Two theorems can be proven which assert that any classical theory which includes certain other assumptions assigns the same member of F to (...) every true object language sentence. Many accept the following argument: (1) every plausible semantic theory is classical and contains the assertions named in the theorems, (2) if the semantic value of declarative sentences is a representation or representational then, some different true sentences differ in what they represent, hence, declarative sentences are not representational. In his book Natural Law and Human Rights: Towards a Recovery of Practical Wisdom, Manent writes: "Let us dwell a moment on the proposition (...) in which so much passion is invested today: man is the being who possesses rights. It resonates as our self-definition and our perspective on humanity, one that we take to have fortunately replaced other definitions and perspectives, such as that man is God's creature or that man is a political animal."1 Contemporary political discourse has arrived, so he thinks, at an impasse of contradiction, incoherence, and self-defeating beliefs.Manent finds a vital help for thinking through these issues in Thomas Aquinas,2 but perhaps also a useful resource is the work of Thomas Jefferson. In Natural Law and Human Rights, Manent cites the first article of the 1789 Declaration of the Rights of Man and of the Citizen: "Human beings are born and remain free and equal in rights."3 But Manent does not cite the Declaration of Independence drafted by Jefferson. The 1776 Declaration provides a way of addressing many of Manent's concerns about human rights, human nature, and equality because it combines an appeal to the Creator [End Page 249] with the establishment of rights grounded in human nature and defended by limited government. In order to approach some of the important political, religious, and philosophical questions raised in Natural Law and Human Rights, we can reconsider the famous "American proposition": "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness." What exactly does this famous American proposition mean? Can it help us to address some of the concerns about incoherent political discourse that Manent highlights?We Hold These Truths to Be Self-EvidentWhat does "we hold these truths to be self-evident" mean? The interpretation of this phrase has generated no small amount of speculation.4 As Manent notes, appeals to self-evidence arise also today in disputes about same-sex marriage.5 Even if we cannot perfectly trace the remote or proximate historical origins of the phrase in 1776, we might still examine some possible meanings.For John Locke, a self-evident truth is akin to what later philosophers called an analytically true proposition.6 Such propositions are true in virtue of the agreement of the ideas that make up the proposition. "A bachelor is an unmarried man of marriageable age" is self-evidently true, since the idea of "bachelor" agrees with the idea "an unmarried man of marriageable age." It does not seem plausible that the self-evident truths of the Declaration of Independence were meant in this sense. The assertions of the Declaration are not true simply by agreement of ideas or by definition in a way that is obvious to anyone who is a native speaker.Thomas Reid suggests a different sense of self-evidence. On his view, [End Page 250] self-evidence does not mean obviousness to everyone, but rather clear to those with the requisite education and maturity: "Moral truths... are self-evident to every man whose understanding and moral faculty are ripe."7 If a person is conscious of no moral obligation whatsoever, then reasoning with such a person will not bring the person to understand his or her obligations. This commentary was submitted to the World Medical Association on behalf of the International Network on Feminist Approaches to Bioethics. Our submission included a description of feminist research ethics, suggestions for specific revisions to the Declaration, and elements found in other international research ethics codes that are important from a feminist perspective. Our goals were to encourage the WMA to craft a declaration that: conceptualizes issues of vulnerability in richer and more nuanced ways, resists the influence of profit motives, and (...) extends the scope of responsibility for ethical research more broadly. Irving Singer has defended the thesis that the "fine gold thread" of love, its sine qua non, is the bestowal of value by the lover on the beloved, even in those cases where the love itself is grounded in a positive appraisal of the beloved's attributes. He suggests that bestowal is a matter of elevating the importance of the beloved and his or her needs and interests above their appraised merit. I argue that love's bestowal is principally effected through speech (...) acts of the kind that John Searle refers to as _Status Function Declarations_, the very same linguistic mechanism by which, according to him, all of social or institutional reality is created. On this picture, the roles of lover and beloved are shown to be status functions constituted by a deontology that delineates the partiality of the former towards the latter. (shrink)

BackgroundMany journals prohibit the use of declarative titles that state study findings, yet a few journals encourage or even require them. We compared the effects of a declarative versus a descriptive title on readers’ perceptions about the strength of evidence in a research abstract describing a randomized trial.MethodsStudy participants (medical or dental students or doctors attending lectures) read two abstracts describing studies of a fictitious treatment (Anticox) for a fictitious condition (Green’s syndrome). The first abstract (A1) described an uncontrolled, 10-patient, (...) case series, and the second (A2) described a randomized, placebo-controlled trial involving 48 patients. All participants rated identical A1 abstracts (with a descriptive title) to provide baseline ratings and thus reduce the effects of inter-individual variability. Participants were randomized so that half rated a version of A2 with a descriptive title and half with a declarative title. For each abstract, participants indicated their agreement with the statement “Anticox is an effective treatment for pain in Green’s syndrome” using 100 mm visual analogue scales (VAS) ranging from “disagree completely” to “agree completely.” VAS scores were measured by an investigator who was unaware of group allocation.ResultsOne hundred forty-four participants from four centres completed the study. There was no significant difference between the declarative and the descriptive title groups’ confidence in the study conclusions as expressed on VAS scales—in fact, the mean difference between A1 and A2 was smaller for the declarative title group than that for the descriptive title group (32.6 mm, SD 27.4 vs. 39.8 mm, SD 22.6, respectively, p = 0.09).ConclusionsWe found no evidence that the use of a declarative title affected readers’ perceptions about study conclusions. This suggests that editors’ fears that declarative titles might unduly influence readers’ judgements about study conclusions may be unfounded, at least in relation to reports of randomized trials. However, our study design had several limitations, and our findings may not be generalizable to other situations. (shrink)

In this paper we introduce a nonmonotonic framework for belief revision in which reasoning about the reliability of different pieces of information based on meta-knowledge about the information is possible, and where revision strategies can be described declaratively. The approach is based on a Poole-style system for default reasoning in which entrenchment information is represented in the logical language. A notion of inference based on the least fixed point of a monotone operator is used to make sure that all theories (...) possess a consistent set of conclusions. (shrink)
