This brief essay contrasts two modes of constitutional change: abusive constitutional projects that seek to erode democracy and restorative constitutional projects that aim to repair eroded democratic constitutional orders. Constitutional democracies are eroded and restored via the same mechanisms: formal processes of constitutional amendment and replacement, legislative amendment, changes to executive policies and practices (or respect for conventions), and processes of judicial decision-making. Under the right conditions, abusive uses of these mechanisms for antidemocratic ends can be reversed by prodemocratic or (...) restorative uses. The more difficult question is what kinds of political discourses are most likely to sustain successful processes of democratic rebuilding. In recent work, we have pointed to the role sometimes played by liberal democratic discourses as purported justifications for processes of abusive constitutional change: we label this the rise of “abusive constitutional borrowing.” Less well understood are the kind of discourses likely to sustain successful democratic healing or rebuilding. Often, the most popular discourse is a restorative one, which focuses on repairing damage caused by authoritarians and returning to a constitutional status quo ante. In this essay, we discuss the advantages and disadvantages of restorative constitutionalism as a response to prior episodes of democratic erosion. (shrink)

Across a number of countries including Venezuela, Colombia, Bolivia, Ecuador, Honduras, Costa Rica, and Nicaragua, incumbent presidents in Latin America have recently sought to amend their constitutions to eliminate or weaken presidential term limits. In some cases, these efforts to extend terms have been part of broader projects to consolidate power, weaken other state institutions, and tilt the electoral playing field in favor of incumbents. From a legal perspective, these cases are interesting because they highlight the limits of tools limiting (...) constitutional change, such as eternity clauses and the unconstitutional constitutional amendment doctrine, to constrain potentially anti-democratic or anti-liberal forms of constitutional change. Although constitutional texts in most of these cases gave courts ample ammunition to reject attempts to eliminate term limits or at least to force those changes down more demanding paths, courts did not stand in the way of most of these efforts and in some cases even used the doctrines to eliminate rather than protect term limits. The case studies highlight the extent to which the “superficial” spread of doctrines controlling constitutional change may fail to block, and indeed may promote, forms of constitutional change that threaten liberal democratic constitutionalism. It also suggests possibilities for deepening the effectiveness of transnational dialogue on these issues. (shrink)

This paper presents a critique of David Benatar’s arguments on the badness of all human lives. I argue that even if Benatar is right that there is an asymmetry between the good and the bad in life so that each “unit” of bad is indeed more effective than each “unit” of good, lives in which there is a lot of good and only little bad are still overall good. Even if there are more unfulfilled than fulfilled desires in life, (...) a distinction should be drawn between desires to fulfill important goals and desires to fulfill trivial ones, and Benatar’s claim is untrue of the former. Benatar’s claim that we cannot really know that the quality of our own lives is good is problematic, but even if it were true, it would not show that we cannot estimate correctly the quality of other people’s lives, which is the point at issue. We offer a reconstruction of Richard Price’s intuition-based epistemology of normative essences, highlighting its key elements and showing how it differs from the approaches taken by other intuitionists such as Thomas Reid and G. E. Moore, as well as sentimentalists such as Francis Hutcheson and David Hume. While our analysis aims to shed light on Price’s moral epistemology, it also seeks to contribute to contemporary debates about the epistemology of essence, advancing a general intuition-based theory. These two goals are (...) related, for the former operates in the service of the latter. In this way, our discussion illustrates the role that historical research might play in contemporary inquiries into intuition. (shrink)

An important challenge for non-naturalistic moral realism is that it seems hard to reconcile it with the (purported) fact of our reliability in forming correct moral beliefs. Some philosophers (including Cuneo and Shafer-Landau) have argued that we can appeal to conceptual truths about our moral concepts in order to respond to this challenge. Call this “the conceptual strategy”. The conceptual strategy faces a problem: it isn’t clear that the relevant moral concepts are “extension-revealing” in the way that the conceptual (...) strategy needs them to be. A further problem stems from the tradeoff between the “extension-revealing” and the “authority-revealing” aspects of normative concepts. To underscore the import of these issues, I discuss a version of the reliability challenge that concerns authoritative normative facts in ethics (rather than moral facts). The problems I identify for the conceptual strategy carry over to versions of it that are used in response to a range of epistemological arguments in ethics that (like the reliability challenge) are tied to Street’s “Darwinian Dilemma” argument. These problems also bear on the prospects of the conceptual strategy for explaining our (purported) reliability in other domains (e.g., in epistemology, law, and politics). (shrink)

A recent claim that in quantum chromodynamics in the Landau gauge the gluon propagator vanishes in the infrared limit, while the ghost propagator is more singular than a simple pole, is investigated analytically and numerically. This picture is shown to be supported even at the level in which the vertices in the Dyson- Schwinger equations are taken to be bare. Fundamental to spatial knowledge in all species are the representations underlying object recognition, object search, and navigation through space. But what sets humans apart from other species is our ability to express spatial experience through language. This target article explores the language ofobjectsandplaces, asking what geometric properties are preserved in the representations underlying object nouns and spatial prepositions in English. Evidence from these two aspects of language suggests there are significant differences in the geometric richness with which objects and places (...) are encoded. When an object is named (i.e., with count nouns), detailed geometric properties – principally the object's shape (axes, solid and hollow volumes, surfaces, and parts) – are represented. In contrast, when an object plays the role of either “figure” (located object) or “ground” (reference object) in a locational expression, only very coarse geometric object properties are represented, primarily the main axes. In addition, the spatial functions encoded by spatial prepositions tend to be nonmetric and relatively coarse, for example, “containment,” “contact,” “relative distance,” and “relative direction.” These properties are representative of other languages as well. The striking differences in the way language encodes objects versus places lead us to suggest two explanations: First, there is a tendency for languages to level out geometric detail from both object and place representations. Second, a nonlinguistic disparity between the representations of “what” and “where” underlies how language represents objects and places. The language of objects and places converges with and enriches our understanding of corresponding spatial representations. (shrink)

This chapter considers eternity, duration, time, and their interrelations, and aims to resolve a paradox in Spinoza's theory of the mind's eternity. Spinoza's metaphysics of time includes an endless series of virtuous regresses. Spinoza characterizes duratio as a “magnitude. Spinoza says that duratio is “conceived as being greater or lesser, and as composed of parts”. Spinoza addresses time and its relation to duratio in the Metaphysical Thoughts. Spinoza accepts Suarez's view that “duratio and existence are only rationally distinct”. Spinoza holds, (...) with some of the Scholastic philosophers, that extrinsic denominations are mind‐made. Spinoza also uses geometrical construction as a model for thinking about the relationship between eternity and time. This article first reviews the available medical methods for sex selection, the preference for children of a specific gender in various societies and the ethical controversies surrounding PGD for medical and social purposes in different countries. It focuses then on the question of whether procreative liberty or parental responsibility (...) should be the centre of attention in this context. Finally, the article critically examines the new Israeli guidelines and their implications for the women undergoing the necessary medical treatments, for the children born as a result, for other members of the family and for society in general. Moral Realism is a systematic defence of the idea that there are objective moral standards. Russ Shafer-Landau argues that there are moral principles that are true independently of what anyone, anywhere, happens to think of them. His central thesis, as well as the many novel supporting arguments used to defend it, will spark much controversy among those concerned with the foundations of ethics.

Our project in this essay is to showcase nonnaturalistic moral realism’s resources for responding to metaphysical and epistemological objections by taking the view in some new directions. The central thesis we will argue for is that there is a battery of substantive moral propositions that are also nonnaturalistic conceptual truths. We call these propositions the moral fixed points. We will argue that they must find a place in any system of moral norms that applies to beings like us, in worlds (...) similar to our own. By committing themselves to true propositions of these sorts, nonnaturalists can fashion a view that is highly attractive in its own right, and resistant to the most prominent objections that have been pressed against it. Simon Blackburn has developed an interesting challenge to moral realism based on its alleged inability to account for supervenience relations between the moral and nonmoral. If supervenience holds, then any base property once giving rise to a supervening one must always do so. The realist accepts supervenience, but also (according to Blackburn) accepts the claim that nonmoral base properties do not necessitate the moral ones that supervene on them. This combination is thought deadly, because it leaves the realist without an (...) explanation of why ethical supervenience should be true. I offer three responses on behalf of the moral realist. The first rejects the need for explanation, arguing that supervenience should be understood as closely analogous to Leibniz's law, which, I argue, needs no defense. I next argue that ethical naturalism may be right, and if so, would provide an adequate response to Blackburn. Lastly, I show that the success of Blackburn's arguments implies a global antirealism, and so does not, as he claims, amount to a special problem for realism in ethics. (shrink)

The volume opens with Peter Railton's exploration of some central features of normative guidance, the mental states that underwrite it, and its relationship to our reasons for feeling and acting. In the next offering, Terence Cuneo takes up the case against expressivism, arguing that its central account of the nature of moral judgments is badly mistaken. (...) Terence Horgan and Mark Timmons, two of the most prominent contemporary expressivists, then offer their take on how expressivism manages to avoid a different objection-that of collapsing into an objectionable form of relativism. Daniel Jacobson and Justin D'Arms next offer an article that continues their research program devoted to exploring the extent to which values might depend upon, or be constrained by, human psychology. Ralph Wedgwood engages in some classical metaethical conceptual analysis, seeking to explicate the meaning of ought. Mark van Roojen then contributes a new take on the Moral Twin Earth Argument, a prominent anti-realist puzzle advanced in the early 1990s by Horgan and Timmons. -/- Allan Gibbard next presents his latest thoughts on the nature of moral feelings and moral concepts, crucial elements in the overall project of defending the expressivism he is so well known for. James Dreier then takes up the details of Gibbard's recent efforts to provide a solution to what many view as the most serious difficulty for expressivism, namely, the Frege-Geach problem. Dreier identifies difficulties in Gibbard's expressivist account, and offers a suggestion for their solution. Sergio Tenenbaum explores the concept of a direction of fit, relied on so heavily nowadays in accounts of moral motivation. Nadeem Hussain and Nishiten Shah then consider the merits of Christine Korsgaard's influential critique of moral realism. T. M. Scanlon's widely-discussed buck-passing account of value attracts the critical eye of Pekka Väyrynen, who attempts to reveal the reasons that we might resist it. Derek Parfit's contribution concludes this volume, with an article on normativity that presents his most recent thinking on this fundamental notion. (shrink)

This review article focuses on David Copp's article 'Experiments, Intuitions, and Methodology in Moral and Political Theory'. Copp argues that recent developments in moral psychology challenge the common method in ethics, which infers moral truths from moral intuitions, as these intuitions are shown to likely be unreliable. Copp responds to the worry by arguing that even if moral intuitions cannot be trusted to indicate objective moral truths, the common method remains valuable for other reasons. David Hume's Enquiry concerning Human Understanding is the definitive statement of the greatest philosopher in the English language. His arguments in support of reasoning from experience, and against the "sophistry and illusion"of religiously inspired philosophical fantasies, caused controversy in the eighteenth century and are strikingly relevant today, when faith and science continue to clash. The Enquiry considers the origin and processes of human thought, reaching the stark conclusion that we can have no ultimate understanding of the physical world, or (...) indeed our own minds. In either sphere we must depend on instinctive learning from experience, recognizing our animal nature and the limits of reason. Hume's calm and open-minded skepticism thus aims to provide a new basis for science, liberating us from the "superstition" of false metaphysics and religion. His Enquiry remains one of the best introductions to the study of philosophy, and his edition places it in its historical and philosophical context. (shrink)

A leading political theorist’s groundbreaking defense of ideal conceptions of justice in political philosophy Throughout the history of political philosophy and politics, there has been continual debate about the roles of idealism versus realism. For contemporary political philosophy, this debate manifests in notions of ideal theory versus nonideal theory. Nonideal thinkers shift their focus from theorizing about full social justice, asking instead which feasible institutional and political changes would make a society more just. Ideal thinkers, on the other hand, question (...) whether full justice is a standard that any society is likely ever to satisfy. And, if social justice is unrealistic, are attempts to understand it without value or importance, and merely utopian? Utopophobia argues against thinking that justice must be realistic, or that understanding justice is only valuable if it can be realized. David Estlund does not offer a particular theory of justice, nor does he assert that justice is indeed unrealizable—only that it could be, and this possibility upsets common ways of proceeding in political thought. Estlund engages critically with important strands in traditional and contemporary political philosophy that assume a sound theory of justice has the overriding, defining task of contributing practical guidance toward greater social justice. Along the way, he counters several tempting perspectives, including the view that inquiry in political philosophy could have significant value only as a guide to practical political action, and that understanding true justice would necessarily have practical value, at least as an ideal arrangement to be approximated. Demonstrating that unrealistic standards of justice can be both sound and valuable to understand, Utopophobia stands as a trenchant defense of ideal theory in political philosophy. (shrink)

The zetetic turn in epistemology raises three questions about epistemic and zetetic norms. First, there is the relationship question: what is the relationship between epistemic and zetetic norms? Are some epistemic norms zetetic norms, or are epistemic and zetetic norms distinct? Second, there is the tension question: are traditional epistemic norms in tension with plausible zetetic norms? Third, there is the reaction question: how should theorists react to a tension between epistemic and zetetic norms? Drawing on an analogy to practical (...) philosophy, I develop a focal point view to resolve these motivating questions. On the focal point view, traditional epistemic norms and zetetic norms answer different types of normative questions. There is nevertheless a familiar type of evaluative tension between traditional epistemic norms and zetetic norms, but this tension is an unavoidable feature of the normative landscape and not a sign that traditional epistemic norms need revision. But if traditional epistemic norms are not zetetic norms, then in what sense is zetetic epistemology a project for epistemologists? I conclude by articulating a sense in which some nontraditional epistemic norms are zetetic norms, and in which zetetic epistemology is an important part of the study of theoretical rationality. One of the enduring concerns of moral philosophy is deciding who or what is deserving of ethical consideration. Much recent attention has been devoted to the "animal question" -- consideration of the moral status of nonhuman animals. In this book, David Gunkel takes up the "machine question": whether and to what extent intelligent and autonomous machines of our own making can be considered to have legitimate moral responsibilities and any legitimate claim to moral consideration. The machine question poses a (...) fundamental challenge to moral thinking, questioning the traditional philosophical conceptualization of technology as a tool or instrument to be used by human agents. Gunkel begins by addressing the question of machine moral agency: whether a machine might be considered a legitimate moral agent that could be held responsible for decisions and actions. He then approaches the machine question from the other side, considering whether a machine might be a moral patient due legitimate moral consideration. Finally, Gunkel considers some recent innovations in moral philosophy and critical theory that complicate the machine question, deconstructing the binary agent--patient opposition itself. Technological advances may prompt us to wonder if the science fiction of computers and robots whose actions affect their human companions could become science fact. Gunkel's argument promises to influence future considerations of ethics, ourselves, and the other entities who inhabit this world. (shrink)

This book is an attempt to get to the bottom of an acute and perennial tension between our best scientific pictures of the fundamental physical structure of the world and our everyday empirical experience of it. The trouble is about the direction of time. The situation (very briefly) is that it is a consequence of almost every one of those fundamental scientific pictures--and that it is at the same time radically at odds with our common sense--that whatever can happen can (...) just as naturally happen backwards. Albert provides an unprecedentedly clear, lively, and systematic new account--in the context of a Newtonian-Mechanical picture of the world--of the ultimate origins of the statistical regularities we see around us, of the temporal irreversibility of the Second Law of Thermodynamics, of the asymmetries in our epistemic access to the past and the future, and of our conviction that by acting now we can affect the future but not the past. In his “Reply to Iddo Landau,” Edmund Wall responds to the author’s critique of some of the views expressed in his “Sexual Harassment and Wrongful Communication.” The present article concentrates on what the author takes to be the main problem in Wall’s definition: by requiring that any act, even if intentional and cruel in nature, needs to be repeated to count as sexual harassment, Wall allows too much leeway and renders permissible a wide range of intentional, mean, and harmful (...) actions that most, including, the author believes, Wall himself, would like to outlaw. The variety of feminist thought has produced many fruitful discussions and debates. Liberal, radical, postmodern, psychoanalytic, and other feminists have criticized each others' work and underlying presuppositions. The aim of this paper is to point out a prejudice which has not yet received sufficient attention, although it lies at the base of a fair amount of feminist research: the bias that whereas men are bad and aggressive, women are good and peaceful. Although as an explicit view this contention has been (...) debated, its distortive influence on feminist research has so far remained undiscussed. In what follows I present examples of the effect of this bias on feminist research . Then I suggest why the bias has not yet been discussed . Finally I argue that feminist research should be as critically received and treated as any other. (shrink)

We set ourselves ends and strive to achieve them. We hope that their attainment will improve our condition. The closer we get to our goals, the happier we feel. Paradoxically, however, when we finally do achieve them our joy is sometimes diminished. We have a sense of insignificance and emptiness, and we feel that in attaining our goal we have lost the meaningfulness and balance we experienced while we were striving towards it. Revolutions often retain more characteristics of the pre-revolutionary state than their makers like to admit. Characterizing the pre-revolutionary state as bad , and wishing to accentuate the greatness of their doings, revolutionaries like to stress the differences between the previous state of affairs and the new one, and prefer to see the similarities as few and insignificant. They are frequently wrong. 1.

This paper reconstructs what I take to be the central evolutionary debunking argument that underlies recent critiques of moral realism. The argument claims that given the extent of evolutionary influence on our moral faculties, and assuming the truth of moral realism, it would be a massive coincidence were our moral faculties reliable ones. Given this coincidence, any presumptive warrant enjoyed by our moral beliefs is defeated. So if moral realism is true, then we can have no warranted moral beliefs, and (...) hence no moral knowledge. In response, I first develop what is perhaps the most natural reply on behalf of realism namely, that many of our highly presumptively warranted moral beliefs are immune to evolutionary influence and so can be used to assess and eventually resuscitate the epistemic merits of those that have been subject to such influence. I then identify five distinct ways in which the charge of massive coincidence has been understood and defended. I argue that each interpretation is subject to serious worries. If I am right, these putative defeaters are themselves subject to defeat. Thus many of our moral beliefs continue to be highly warranted, even if moral realism is true. (shrink)

How should one react when one has a belief, but knows that other people—who have roughly the same evidence as one has, and seem roughly as likely to react to it correctly—disagree? This paper argues that the disagreement of other competent inquirers often requires one to be much less confident in one’s opinions than one would otherwise be.

I attempt to get as clear as possible on the chain of reasoning by which irreversible macrodynamics is derivable from time-reversible microphysics, and in particular to clarify just what kinds of assumptions about the initial state of the universe, and about the nature of the microdynamics, are needed in these derivations. I conclude that while a “Past Hypothesis” about the early Universe does seem necessary to carry out such derivations, that Hypothesis is not correctly understood as a constraint on the (...) early Universe’s entropy.
