Broad consent – the act of gaining one consent for multiple potential future research projects – sits at the core of much current genomic research practice. Since the 25th May 2018, the General Data Protection Regulation (GDPR) has applied as valid law concerning genomic research in the EU and now occupies a dominant position in the legal landscape. Yet, the position of the GDPR concerning broad consent has recently been cause for concern in the genomic research community. Whilst the text (...) of the GDPR apparently supports the practice, recent jurisprudence contains language which is decidedly less positive. This article takes an in-depth look at the situation concerning broad consent under the GDPR and – despite the understandable concern flowing from recent jurisprudence – offers a positive outlook. This positive outlook is argued from three perspectives, each of which is significant in defining the current, and ongoing, legitimacy and utility of broad consent under the GDPR: the principled, the legal technical, and the practical. This study describes which clinical ethics approaches are available to support healthcare personnel in clinical practice in terms of their construction, functions and goals. Healthcare personnel frequently face ethically difficult situations in the course of their work and these issues cover a wide range of areas from prenatal care to end-of-life care. Although various forms of clinical ethics support have been developed, to our knowledge there is a lack of review studies describing which ethics support approaches are available, how they (...) are constructed and their goals in supporting healthcare personnel in clinical practice. This study engages in an integrative literature review. We searched for peer-reviewed academic articles written in English between 2000 and 2016 using specific Mesh terms and manual keywords in CINAHL, MEDLINE and Psych INFO databases. In total, 54 articles worldwide described clinical ethics support approaches that include clinical ethics consultation, clinical ethics committees, moral case deliberation, ethics rounds, ethics discussion groups, and ethics reflection groups. Clinical ethics consultation and clinical ethics committees have various roles and functions in different countries. They can provide healthcare personnel with advice and recommendations regarding the best course of action. Moral case deliberation, ethics rounds, ethics discussion groups and ethics reflection groups support the idea that group reflection increases insight into ethical issues. Clinical ethics support in the form of a “bottom-up” perspective might give healthcare personnel opportunities to think and reflect more than a “top-down” perspective. A “bottom-up” approach leaves the healthcare personnel with the moral responsibility for their choice of action in clinical practice, while a “top-down” approach risks removing such moral responsibility. Willie James Jennings contends that the goal of whiteness is the creation and preservation of segregated space. For Jennings, whiteness, as well as upholding perceived notions of white normativity, is a way of being in the world, an imagined reality made real by our movement in physical space which destroys the identity-forming connections between communities and land. In this article I bring together Pope Francis’s reflections on the globalised economy in Laudato Si’ with the critiques of James H. Cone and (...) Jennings to demonstrate the horrific harm of whiteness on marginalised people groups and the land itself. To resist the building project of whiteness, therefore, requires attention to our relationship with land. At this point I turn more readily to the land of England, offering the beginnings of a theology of place given the substantial land holdings of the Church of England. I close by asking whether the Church of England can be trusted to use its land to dismantle whiteness given its troubling colonial history in relation to land use. (shrink)

Mark Walker argues for Skeptical-Dogmatism-the view that we should disbelieve our cherished philosophical views, such as beliefs about what makes for a good life, religious beliefs, and political beliefs. To not disbelieve one's preferred views in these contested matters is hubristic.

One thread of abortion criticism, arguing that gender equality requires that men be allowed to terminate legal parental status and obligations, has reinforced the stereotype of men as uninterested in fatherhood. As courts facing disputes over stored pre-embryos weigh the equities of allowing implantation of the pre-embryos, this same gender stereotype has been increasingly incorporated into a legal balancing test, leading to troubling implications for ART and family law.

BackgroundMoral case deliberation is one form of clinical ethics support, and there seems to be different ways of facilitating the dialogue.PurposeThis paper aimed to explore Swedish facilitators' experiences of their role in moral case deliberations.MethodThis study had a qualitative approach with explorative design. Semi-structured interviews with eleven MCD facilitators were conducted. Their experiences were analyzed using thematic analysis.ResultBeing a facilitator was understood through the metaphor of sailing: against the wind or with it. There are reasons to be skeptical of the claim that philosophy and science are making progress toward the complete truth of the universe and our place in it. I discuss two different kinds of skeptical worries about justifying contemporary philosophical and scientific beliefs. Widespread philosophical disagreement leads to a suspicion that most philosophers are probably wrong. In science there is more agreement, but science has not justified some of its basic assumptions including the use of Occam's Razor for theory selection. (...) Worse, noetic skepticism questions whether humans even have the cognitive capacity for understanding the complete truth. We do not believe that children or apes have that capacity, so the question naturally arises within both philosophy and science as to whether we have reason to believe that adult humans are adequately equipped. This book moves away from the frameworks that have traditionally guided ethical decision-making in the Western clinical setting, towards an inclusive, non-coercive and, reflective dialogic approach to moral decision-making. Inspired in part by Jürgen Habermas's discourse theory of morality and principles of communicative action, the book offers a proportionist approach as a way of balancing out the wisdom in traditional frameworks, set in the actual reality of the clinical situation at hand. Fast‐forward two hundred years to the opening sequence of Alien: Resurrection where United Systems Military (USM) science officers aboard the Auriga are toying with her DNA—salvaged from frozen blood samples on Fiorina 161—to try to create a cloned version of the alien queen that was growing inside her at the time of her death. The absurd is what links the two— Ripley's desire to make some sense out of her troubling existence and the fact that the world is unable to (...) offer her any such sense. French essayist, Albert Camus, repeatedly stresses this point in different, sometimes rather poetic, ways throughout his classic essay, “The Myth of Sisyphus”. Ripley‐8 has one messed‐up and confusing life. When Camus talks about philosophical suicide, he is really talking about an irrational “leap of faith”. Ripley and Call are both artificial creations living a similar sort of existence. (shrink)

The article contributes to the discussion of political reasoning in general, and public reason in particular, analysed from the vantage point of comparative political theory. It aims to bring out the complexity and diversity of actual political reasoning, and it serves as a corrective to some over-simplified discussions of public reason, by defenders and critics alike. I argue that the notion of public reason can be extended to and is operative in non-liberal and religious societies, with the acknowledgment that it (...) needs to undergo a methodological metamorphosis in the process. This requires what I call multiple justificatory strategy, which allows the use of different justifications in order to respond to the plurality existing in society. However, there are certain qualifications in the use of multiple justifications. This chapter offers a complete account of Aristotle’s underexplored treatment of the virtue of wittiness (eutrapelia) in Nicomachean Ethics IV.8. It addresses the following questions: (1) What, according to Aristotle, is this virtue and what is its structure? (2) How do Aristotle’s moral psychological views inform Aristotle’s account, and how might Aristotle’s discussions of other, more familiar virtues, enable us to understand wittiness better? In particular, what passions does the virtue of wittiness concern, and how might the virtue (and its (...) attendant vices) be related to the virtue of temperance (and its attendant vices)? (3) How does wittiness, as an ethical virtue, benefit its possessor? (4) How can Aristotle resolve some key tensions that his introducing a virtue of wittiness apparently generates for his ethics? The purpose of this article was to examine the historical contribution of Wilhelm Dilthey's approach to the philosophy and methodology of hermeneutics in the demarcated context of nursing science. Dilthey's work made a fundamentally significant, yet ancillary, contribution to nursing science. Organically born from a need to deduce Biblical texts, hermeneutics later developed as a means to understand the truth of another's experience, in literal German language referred to as verstehen. A German‐born empiricist and devout hermeneutic scholar, Dilthey extended the (...) philosophy of hermeneutics to a methodological approach as a way to recapture expressed meaning of human experiences. His directive work paved a procedural pathway to probe the science of human nature while bound to the appropriate sociohistorical context. Hermeneutic methodology provides a phenomenological‐like way to more keenly understand and interpret the whole person. This methodological approach steers a truth‐seeking strategy fixed in meticulous and rigorous inquiry. Dilthey transparently recognized the humble fact that there is no true way to wholly grasp another's experience, an inherent limitation of our human abilities. The current paper posits that hermeneutical understanding verstehen can be paralleled to the concept of empathy in nursing. Understanding and empathy are foundational components to the field of nursing as a caring science. The complex yet invaluable philosophy and methodology of Wilhelm Dilthey's hermeneutics is notably relevant and applicable to nursing science as we strive to care for, treat, and heal patients as whole beings. Although storybooks are often used as pedagogical tools for conveying moral lessons to children, the ability to spontaneously extract "the moral" of a story develops relatively late. Instead, children tend to represent stories at a concrete level - one that highlights surface features and understates more abstract themes. Here we examine the role of explanation in 5- and 6-year-old children's developing ability to learn the moral of a story. Two experiments demonstrate that, relative to a control condition, prompts to explain (...) aspects of a story facilitate children's ability to override salient surface features, abstract the underlying moral, and generalize that moral to novel contexts. In some cases, generating an explanation is more effective than being explicitly told the moral of the story, as in a more traditional pedagogical exchange. These findings have implications for moral comprehension, the role of explanation in learning, and the development of abstract reasoning in early childhood. (shrink)

In this age of multiculturalism, global travel and terrorism, it is vital that citizens be inculcated with the fundamental values of democracy and equipped with the cognitive skills to further those values. Plato critiqued the democratic character for its potential selfishness and lack of civic engagement---this was true in ancient Athens and is still true today. Using a primarily philosophical but also an interdisciplinary approach, I discuss the historic and social contexts of moral education in democracies both ancient and modern. (...) My topic contributes to this inquiry about democratic education by discussing Virtue Ethics and Communitarianism, with attention to empirical matters as dealt with in Sociology and Psychology. This dissertation explores the Neutral Liberalism-Communitarian debate about moral education to explicate current social and educational circumstances, both theoretically and practically. I propose a model for teaching morality based on self-knowledge, without a traditional religious grounding, without competing with religious authority, resorting to dogma, or indoctrination. I draw on the works of Plato, Aristotle, Jean-Jacques Rousseau, William James, Charles Taylor and others, supporting my proposals with current research from Social Cognitive Psychology. Research in Psychology has shown that some ways of thinking about the self are more efficacious and functional than others. By grounding moral education in self-knowledge and virtue theory, we can ensure the preservation of our democracy by improving the ability of our citizens to reason well about personal, practical and political matters. It is with these virile words of the Martinique poet Aimé Сésaire, an expression of assurance regained, testimony to a self-confidence once stolen but then reconquered, that I would like to open my remarks.*Africa was present at the last great international philosophical meeting two years ago in Montreal. I would like here to illustrate the meaning behind this presence and to explain the reasons why we wanted to be present, in order to avoid facile misunderstandings which could have weighty consequences.

Fifteen original essays open up a novel area of inquiry: the distinctively ethical dimensions of women's experiences of and in aging. Contributors distinguished in the fields of feminist ethics and the ethics of aging explore assumptions, experiences, practices, and public policies that affect women's well-being and dignity in later life. The book brings to the study of women's aging a reflective dimension missing from the empirical work that has predominated to date. Ethical studies of aging have so far failed to (...) emphasize gender. And feminist ethics has neglected older women, even when emphasizing other dimensions of 'difference.' Finally work on aging in all fields has focused on the elderly, while this volume sees aging as an extended process of negotiating personal and social change. (shrink)

This entry examines a set of ancient Chinese texts – with their associated literary and ideological tendencies – that had come to be seen as distinctive by the early Han period. This set constitutes one of the standard referents of “Daoism,” a word whose difficulties command attention in their own right. The ancient writers we could label “Daoists” were united by no single text, founder, agenda, or concept; grouped together, they show tendencies towards dissidence, paradox, and humor that distinguish them (...) from moralistic and technocratic rivals. These writers engaged a variety of themes and practices familiar from the early Chinese religious environment; alongside the eccentricities of Daoist writers themselves, the distinctiveness of this environment makes it challenging to put them in philosophical dialogue with other religious traditions. Buddhist uses of the Daoist heritage illustrate its potential relevance to a range of other religious perspectives. (shrink)

The Ikhwan al-Safa (Brethren of Purity), the anonymous adepts of a tenth-century esoteric fraternity based in Basra and Baghdad, hold an eminent position in the history of science and philosophy in Islam due to the wide reception and assimilation of their monumental encyclopaedia, the Rasa'il Ikhwan al-Safa (Epistles of the Brethren of Purity). This compendium contains fifty-two epistles offering synoptic accounts of the classical sciences and philosophies of the age; divided into four classificatory parts, it treats themes in mathematics, logic, (...) natural philosophy, psychology, metaphysics, and theology, in addition to didactic fables. Epistles 32 to 36 comprise the first five treatises in the third division of the Rasa'il, on the sciences of the soul and intellect. Combining Islamic revelation with Hellenistic philosophy, the Ikhwan delineate herein their metaphysical system. Epistles 32 and 33 present adaptations of the Pythagorean doctrines, and of Neo-Platonist leitmotifs, whereby a numerical analogy is applied to the unique and transcendent God, or the One, from whom all existence emanates. Epistle 34 takes up the pervasive theme of the correspondence between microcosm and macrocosm, situating the human being as the central link between the celestial and terrestrial realms. In Epistle 35, we find an explanation of the intellectual faculties of the individual human soul, whose ultimate aim is ascension to the timeless reality of pure intellect. Finally, Epistle 36 presents itself as the astrological epistle par excellence of the Rasa'il; from the coming-to-be of worms, to the emergence of religions and empires, nothing in the sub-lunar sphere escapes the determining influence of the celestial cycles. Kant held the moral law to be an objective imperative, an entity in its own right. It carries with it prescriptive force, in parallel to other principles of pure reason, like those of logic and mathematics. Objective imperatives therefore do not derive their authority from any other source,such as common consensus or the will of God. In Objective Imperatives, Ralph C. S. Walker seeks to show that this is a highly defensible view: Kant's Categorical Imperative, properly understood, is broadly (...) right. The key to it is rationality, and not universality, which functions only as anapproximate test. Often, Kant sets the matter out badly, and most of the common objections to him can be shown to be due to misunderstandings. A morality that gives us an objective imperative does appear incompatible with the determinism to which Kant commits himself, but Walker argues that thisappearance is misleading. (shrink)

Slow Philosophy: Reading Against the Institution makes the case for thinking about reading in philosophical terms. In Ethics and the Autonomy of Philosophy, Bernard Walker sets out with two objectives. First, Walker argues that ethics is autonomous as a discipline. Oftentimes ethics books, from a Christian perspective, lean toward grounding ethics in theology or in biblical proof texting. Walker departs from this tradition. Ethics grounded in theology entails a limited scope for those doing ethics in that the Christian God must be assumed for both Christian and non-Christian when at the table of ethical (...) dialogue. For the non-Christian, this loads the dice and shuts down ethical consensus and dialogue, if not ethical truth. With that said, this book does not depart from Christian ethical views on such issues as the sanctity of life, antiracism, the death penalty, the objectivity of ethics, and the importance of integrating faith into ethics; however, Walker does so from a common denominator of philosophy rather than theology. Second, Walker ventures into the streets and engages the man/woman on the streets approach to ethics and ethical decision-making. He points out the shortcomings of the ubiquitous views of the man/woman on the streets, viz., cultural relativism, skepticism, and the attitude that ethics is merely a matter of personal choice.
