Both developing and developed countries face an increasing mismatch between what patients expect to receive from healthcare and what the public healthcare systems can afford to provide. Where there has been a growing recognition of the entitlement to receive healthcare, the frustrated expectations with regards to the level of provision has led to lawsuits challenging the denial of funding for health treatments by public health systems. This book analyses the impact of courts and litigation on the way health systems set (...) priorities and make rationing decisions. In particular, it focuses on how the judicial protection of the right to healthcare can impact the institutionalization, functioning and centrality of Health Technology Assessment (HTA) for decisions about the funding of treatment. Based on the case study of three jurisdictions - Brazil, Colombia, and England - it shows that courts can be a key driver for the institutionalization of HTA. These case studies show the paradoxes of judicial control, which can promote accountability and impair it, demand administrative competence and undermine bureaucratic capacities. The case studies offer a nuanced and evidence-informed understanding of these paradoxes in the context of health care by showing how the judicial control of priority-setting decisions in health care can be used to require and control an explicit scheme for health technology assessment, but can also limit and circumvent it. Frequent and open interaction between venture capitalists and entrepreneurs is necessary for venture capital investments to occur. Increasingly, these investments are made across jurisdictions. The vast majority of these cross-border investments are carried out in a syndicate of two or more VCs, indicating the effects of intra-industry networks needing further analysis. Using China as a model, we provide a novel multidimensional framework to explain cross-border investments in innovative ventures across developed and emerging economies. By analyzing a unique international dataset, we (...) examine worldwide venture capital investment flows from 2000–2012 and consider the effects of geographical, cultural, and institutional proximity as well as institutional and relational trust. We find trust to mitigate the negative effects of geographical and cultural distance, where institutional trust is more relevant for investments in emerging economies, and relational trust is more relevant for investments in developed economies. This study aims to investigate the impact of stakeholders’ views on the practices of green innovation, consequent effect on environmental and organizational performance, and moderating influence of innovation orientation. A quantitative method was employed for the sample size of 515 responses. To accumulate the data from the respondents, convenient random sampling was used. Data were collected from manufacturing and services firms through a field survey by using a closed-ended questionnaire based in the Punjab province of Pakistan. The analysis was done (...) using the structural equation model of the partial least square analysis method. Our findings proved a positive and significant link between stakeholders’ views on GI practices. A significant association has been found between GI practices and environmental and OP. The moderating effect was found to be negative but statistically significant. This research offers numerous contributions and provides decision-making insinuations. (shrink)

Frank Jackson (1982) famously argued, with his so-called Knowledge Argument (KA), that qualia are non-physical. Moreover, he argued that qualia are epiphenomenal. Some have objected that epiphenomenalism is inconsistent with the soundness of KA. One way of developing this objection, following Neil Campbell (2003; 2012), is to argue that epiphenomenalism is at odds with the kind of behavioral evidence that makes the soundness of KA plausible. In a recent paper, Charles Foster argued that the epistemic uncertainties surrounding prolonged disorders of consciousness make it impossible to prove that the withdrawal of life-sustaining treatment can be in a patient’s best interests and, therefore, the presumption in favour of the maintenance of life cannot be rebutted. In the present response, I argue that, from a legal perspective, Foster has reached the wrong conclusion because he is asking the wrong question. According to the reasoning in two leading cases —Bland (...) and James —the principle of respect for autonomy creates a persuasive presumption against treatment without consent. Therefore, it is the continuation of treatment that requires justification, rather than its withdrawal. This presumption also works as the tiebreaker determining that treatment should stop if there is no persuasive evidence that its continuation is in the best interests of the patient. The presumption in favour of the maintenance of life, on the other hand, should be understood as an evidential presumption on a factual issue that is assumed to be true if unchallenged. However, the uncertainties regarding PDOC actually give reasons for displacing this evidential presumption. Consequently, decision-makers will have to weigh up the pros and cons of treatment having the presumption against treatment without consent as the tiebreaker if the evidence is inconclusive. In conclusion, when the right question is asked, Foster’s argument can be turned on its head and uncertainties surrounding PDOC weigh in to justify the interruption of treatment in the absence of compelling contrary evidence. Stochastic forecasts in complex environments can benefit from combining the estimates of large groups of forecasters (“judges”). But aggregating multiple opinions faces several challenges. First, human judges are notoriously incoherent when their forecasts involve logically complex events. Second, individual judges may have specialized knowledge, so different judges may produce forecasts for different events. Third, the credibility of individual judges might vary, and one would like to pay greater attention to more trustworthy forecasts. These considerations limit the value of simple aggregation (...) methods like linear averaging. In this paper, a new algorithm is proposed for combining probabilistic assessments from a large pool of judges. Two measures of a judge’s likely credibility are introduced and used in the algorithm to determine the judge’s weight in aggregation. The algorithm was tested on a data set of nearly half a million probability estimates of events related to the 2008 U.S. presidential election (∼ 16000 judges). (shrink)

This paper discusses the post-trial access to drugs for patients who participated in clinical trials in Brazil. The ethical guidance for clinical trials in Brazil is arguably one of the clearest in the world in attributing to research sponsors the responsibility for providing post-trial drugs to patients who participated in their experiments. The Federal Constitution recognizes health as a fundamental right to be fulfilled by the State. Based on the Brazilian constitution and on the National Health Council resolutions, courts have (...) been accepting patients' claims and ordering the State and the pharmaceutical companies to provide these patients with the tested treatment in the quantity and duration they need it. This generous interpretation of the duties of the pharmaceutical companies and the State makes the Brazilian model for post-trial access unique when compared to the experience of other countries and thus should be followed with attention by future research in order to assess its consequences for patients, research sponsors, and the public health system. This paper discusses so-called post-trial access to drugs for patients who participated in clinical trials in Brazil. Brazil is currently a relevant country for the pharmaceutical industry due to the dimensions of its actual and potential market. As a consequence, the number of pharmaceutical trials has been rising. It is the largest market for pharmaceutical companies in Latin America, the 8th biggest in the world and second only to China among the so-called BRICS’s emerging countries. The demand for pharmaceutical products (...) in the country has been increasing by double digits over the last few years, reaching 20% in 2008. Not surprisingly, we are also witnessing a steady increase in the number of applications by national and international pharmaceutical companies before ethical research authorities for authorization to perform clinical trials of drugs. This paper analyzes individual probabilistic predictions of state outcomes in the 2008 U.S. presidential election. Employing an original survey of more than 19,000 respondents, ours is the first study of electoral forecasting to involve multiple subnational predictions and to incorporate the influence of respondents’ home states. We relate a range of demographic, political, and cognitive variables to individual accuracy and predictions, as well as to how accuracy improved over time. We find strong support for wishful thinking bias in expectations, as (...) Republicans gave higher probabilities to McCain victories and were worse at overall prediction. In addition, we find that respondents living in states with higher vote shares for Obama performed better at prediction and displayed less wishful thinking bias. We conclude by showing that suitable aggregations of our respondents’ predictions outperformed Intrade (a prediction market) and fivethirtyeight.com (a poll-based forecast) at most points in time. Host-microbiome interactions (HMIs) are critical for the modulation of biological processes and are associated with several diseases, and extensive HMI studies have generated large amounts of data. We propose that the logical representation of the knowledge derived from these data and the standardized representation of experimental variables and processes can foster integration of data and reproducibility of experiments and thereby further HMI knowledge discovery. A community-based Ontology of Host-Microbiome Interactions (OHMI) was developed following the OBO Foundry principles. ��The Coherent Approximation Principle (CAP) is a method for aggregating forecasts of probability from a group of judges by enforcing coherence with minimal adjustment. This paper explores two methods to further improve the forecasting accuracy within the CAP framework and proposes practical algorithms that implement them. These methods allow flexibility to add fixed constraints to the coherentization process and compensate for the psychological bias present in probability estimates from human judges. The algorithms were tested on a data set of nearly (...) half a million probability estimates of events related to the 2008 U.S. presidential election (from about 16000 judges). In this article, we demonstrate a sense in which the one-particle quantum mechanics and the classical electromagnetic four-potential arise from the quantum field theory. In addition, the classical Maxwell equations are derived from the QFT scattering process, while both classical electromagnetic fields and potentials serve as mathematical tools to approximate the interactions among elementary particles described by QFT physics. Furthermore, a plausible interpretation of the Aharonov–Bohm effect is raised within the QFT framework. We provide a quantum treatment of the source (...) of electromagnetic potentials and argue that the underlying mechanism in the AB effect can be understood via interactions among electrons described by QFT theory where the interactions are mediated by virtual photons. Customer civility is an established construct in the study of ethical consumption. However, scholars have paid insufficient attention to customer civility in relation to the flourishing peer-to-peer economy. Therefore, the purpose of this article is to develop and test a theoretical framework which examines the antecedents of the customer civility in the P2P economy. We use social exchange theory to develop a model that posits customer interaction experiences with property owners, properties, and P2P platforms as antecedents of customer civility in (...) the P2P economy. Two studies were used to test our framework: Study 1 comprises a survey of Chinese customers ; Study 2 involves secondary data crawled from the Web site of Xiaozhu, one of China’s largest P2P accommodation platforms. OLS regression analysis was used for hypothesis testing. Results demonstrate three antecedents of customer civility in the P2P accommodation sector: interpersonal trust, property experience, and platform governance. In addition, the positive effect of interpersonal trust on customer civility is stronger when customers have high economic incentive, while the effect of property experience is significantly stronger when customers have low economic incentive. As health policy-makers around the world seek to make progress towards universal health coverage, they must navigate between two important ethical imperatives: to set national spending priorities fairly and efficiently; and to safeguard the right to health. These imperatives can conflict, leading some to conclude that rights-based approaches present a disruptive influence on health policy, hindering states’ efforts to set priorities fairly and efficiently. Here, we challenge this perception. We argue first that these points of tension stem largely from inadequate (...) interpretations of the aims of priority setting as well as the right to health. We then discuss various ways in which the right to health complements traditional concerns of priority setting and vice versa. Religious/spiritual communities in the United States hold significant differences in the relative valuing of social order and progress toward social justice, and religious/spiritual leaders play an influential role in fostering those values. This recognition has prompted calls for theological education to revise the process of student formation, equipping them to address an increasingly diverse social world and the social disparities within their larger communities. Right-wing authoritarianism tends to be associated with a preference for social order and various forms of prejudice, (...) and negatively associated with prosocial attitudes and behaviors. However, there is a limited amount of research examining associations between right-wing authoritarianism and the prosocial constructs of social justice commitment and compassion. The present study explored the longitudinal associations between right-wing authoritarianism, social justice commitment, and compassion in a sample of graduate students from 18 Christian seminaries across North America over two and a half years of their education. Longitudinal data analysis indicated that right-wing authoritarianism exerted a negative influence on social justice commitment and compassion, during the initial time interval which then faded over time. Results also indicated a reciprocal process among right-wing authoritarianism and social justice commitment. Practical implications centered on the potential for interventions targeting the reduction of right-wing authoritarianism to increase social justice commitment and compassion, and interventions targeting greater social justice commitment to lower right-wing authoritarianism. I. EXECUTIVE SUMMARY The MRCT Center Post-trial Responsibilities: Continued Access to an Investigational Medicine Framework outlines a case-based, principled, stakeholder approach to evaluate and guide ethical responsibilities to provide continued access to an investigational medicine at the conclusion of a patient’s participation in a clinical trial. The Post-trial Responsibilities (PTR) Framework includes this Guidance Document as well as the accompanying Toolkit. A 41-member international multi-stakeholder Workgroup convened by the Multi-Regional Clinical Trials Center of Brigham and Women’s Hospital and Harvard University (...) (MRCT Center) developed this Guidance and Toolkit. Project Motivation A number of international organizations have discussed the responsibilities stakeholders have to provide continued access to investigational medicines. The World Medical Association, for example, addressed post-trial access to medicines in Paragraph 34 of the Declaration of Helsinki (WMA, 2013): “In advance of a clinical trial, sponsors, researchers and host country governments should make provisions for post-trial access for all participants who still need an intervention identified as beneficial in the trial. This information must also be disclosed to participants during the informed consent process.” This paragraph and other international guidance documents converge on several consensus points: • Post-trial access (hereafter referred to as “continued access” in this Framework [for terminology clarification – see definitions]) is the responsibility of sponsors, researchers, and host country governments; • The plan for continued access should be determined before the trial begins, and before any individual gives their informed consent; • The protocol should delineate continued access plans; and • The plan should be transparent to potential participants and explained during the informed consent process. -/- However, there is no guidance on how to fulfill these responsibilities (i.e., linking specific responsibilities with specific stakeholders, conditions, and duration). To fill this gap, the MRCT Center convened a working group in September of 2014 to develop a framework to guide stakeholders with identified responsibilities. This resultant Framework sets forth applicable principles, approaches, recommendations and ethical rationales for PTR regarding continued access to investigational medicines for research participants. Assistive technology has great potential to contribute to health, functioning, and quality of life. To date, as exemplified in the Canadian context, variations and inequities in access to assistive technology are evident; the development of legislation, policies, and programs has not kept up with the increasing use of assistive technology. In this article, we apply ;Daniels’s (2008) theory of just health to argue that equitable access to assistive technology funding and services is necessary for justice. Human beings, even very young infants, and members of several other species, exhibit remarkable capacities for attending to and engaging with others. These basic capacities have been the subject of intense research in developmental psychology, cognitive psychology, comparative psychology, neuroscience, and philosophy of mind over the last several decades. Appropriately characterizing the exact level and nature of these abilities and what lies at their basis continues to prove a tricky business. The contributions to this special issue investigate whether and to (...) what extent the exercise of such capacities count as, or are best explained by, a genuine understanding of minds, where such understanding depends on the creatures in question possessing capacities for attributing a range of mental states and their contents in systematic ways. The question that takes center stage is: Do the capacities for attending to and engaging with others in question involve mindreading or is this achieved by other means? In this editorial we will review the state of the debate between mindreading and alternative accounts of social cognition. The issue is organized as follows: the first two papers review the experimental literature on mindreading in primates (Bermúdez) and children (Low & Wang), and the kinds of arguments made for mindreading and alternative accounts of social cognition. The next set of papers (Hedger & Fabricius, Lurz & Krachun, Zawidzki, and de Bruin et al.) further critique the existing experimental data and defend various mindreading and non-mindreading accounts. The final set of papers address further issues raised by phenomenological (Jacob, Zahavi), enactive (Michael), and embodied (Spaulding) accounts of social cognition. (shrink)

This essay accounts for Mengzi’s 孟子 failure in persuading King Xuan of Qi (Qi Xuan Wang 齊宣王) to act morally. We argue that the distinction between internal and external reasons in contemporary philosophy helps to highlight the nature of the failure. The problem of nontransmission of the compassionate impulse within a person despite moral persuasion, which Mencians need to address in order to enhance the success of moral conversion, is now explained as a result of misdirecting the advisee to (...) the lofty ideal of sagehood. Casuistry, which involves analogical reasoning, is a popular methodological approach in bioethics. The method has its advantages and challenges, which are widely acknowledged. Meta-philosophical reflection on exactly how bioethical casuistry works and how the challenges can be addressed is limited. In this paper we propose a framework for structuring casuistry and analogical reasoning in bioethics. The framework is developed by incorporating theories and insights from the philosophy of science: Mary Hesse’s ideas on horizontal and vertical relations in analogical reasoning in (...) the sciences, Paul Bartha’s articulation model of analogical reasoning and Daniel Steel’s insights on mechanism-based extrapolation in biomedical research. Adopting our framework results in two practical benefits: it sets methodological standards for analogical reasoning and enables us to compare and evaluate diverging lines of analogical reasoning in a systematic way. Adopting the framework also has theoretical benefits: it helps to understand how analogical reasoning can have moral normativity; it pinpoints exactly where moral principles or theories enter analogical reasoning; and it helps to understand why casuistry is an attractive method in bioethics and in applied ethics more generally. The traditional understanding of abstraction operates on the basis of the assumption that only entities are subject to thought processes in which particulars are disregarded and commonalities are lifted out (the so-called method of genus proximum and differentia specifica). On this basis Frege criticized the notion of abstraction and convincingly argued that (this kind of) “entitary- directed” abstraction can never provide us with any numbers. However, Frege did not consider the alternative of “property- abstraction.” In this article an argument for (...) this alternative kind of abstraction is formulated by introducing a notion of the “modal universality” of the arithmetical and by developing it in terms of the distinction between type-laws (laws for entities – applicable to a limited class of entities) and modal laws (obtaining for every possible entity without any restriction). In order to substantiate this argument a case is made for the acceptance of an ontic foundation for the arithmetical (and other modes or functions of reality – with special reference to Cassirer, Bernays, Gödel and Wang), which, in the final section, serves to give an ontological account of (i) the connections between the arithmetical and other aspects of reality and (ii) the applicabality of arithmetic. In the course of the argument the impasse of logicism is briefly highlighted, while a few remarks are made with regard to the logical subject- object relation in connection with Frege's view that number attaches to a concept. At the twenty-second World Congress of Philosophy held in Seoul, Korea, from July 29 to August 5, 2008, a panel was convened to debate the ideas for a "democracy with Confucian characteristics'' in Daniel A. Bell's Beyond Liberal Democracy (Princeton: Princeton University Press, 2006). While all participants welcome the attempt to remedy the shortcomings of liberal democracy with Confucian teachings, Fred Dallmayr worries that Bell's political thinking for an East Asian context may "point beyond democracy tout court/' For Sor-hoon Tan, (...) Bell's chapter 6, "Taking Elitism Seriously: Democracy with Confucian Characteristics" may not be so much an alternative to liberalism as it is a challenge to the democratic value of equality that overlooks the dangers of an imperfect meritocracy. Chenyang Li, on the other hand, approaches Bell's proposal of combining a Confucianism-inspired Upper House of Talent and Virtue selected through competitive examinations with a lower house of democratically elected representatives from the concern that it surrenders the Confucian requirement of virtuous leadership. The Confucian doctrine of _tianxia_ outlines a unitary worldview that cherishes global justice and transcends social, geographic, and political divides. For contemporary scholars, it has held myriad meanings, from the articulation of a cultural imaginary and political strategy to a moralistic commitment and a cosmological vision. The contributors to _Chinese Visions of World Order_ examine the evolution of tianxia's meaning and practice in the Han dynasty and its mutations in modern times. They attend to its varied interpretations, its relation to (...) realpolitik, and its revival in twenty-first-century China. They also investigate tianxia's birth in antiquity and its role in empire building, invoke its cultural universalism as a new global imagination for the contemporary world, analyze its resonance and affinity with cosmopolitanism in East-West cultural relations, discover its persistence in China's socialist internationalism and third world agenda, and critique its deployment as an official state ideology. Some moral philosophers in the West hold that adult children have no more moral obligation to support their elderly parents than does any other person in the society, no matter how much sacrifice their parents made for them or what misery their parents are presently suffering. This is because children do not ask to be brought into the world or to be adopted. Therefore, there is a "basic asymmetry between parental and the filial obligations." I argue against the Daniels/English thesis (...) by employing the traditional Confucian view of the nature of filial obligation. On the basis of a distinction between 'moral duty' and 'moral responsibility' and the Confucian concept of justice, I argue that the filial obligation of adult children to care respectfully for their aged parents is not necessarily self-imposed. I conclude that due to the naturalistic character of the family, the nature of our familial obligations cannot be consensual, contractarian and voluntarist, but instead existential, communal and historical. Daniel Bell and Wang Pei’s recent monograph, Just Hierarchy, seeks to defend hierarchical relationships against more egalitarian alternatives. This paper addresses their argument, offered in one chapter of the book, in favour of a hierarchical relationship between human and nonhuman animals. This relationship, Bell and Pei argue, should conform to what they call “subordination without cruelty:” it is permissible to subordinate and exploit animals for human ends, provided that we do not treat them cruelly. We focus on three aspects (...) of their view: their argument for a hierarchical view; their understanding of cruelty; and their account of the heightened duties they claim we owe to nonhuman animals who are intelligent, domesticated, and/or “cute.” We argue that the reasons that Bell and Pei offer fail to support their conclusions, and that, even if one accepts a hierarchical view, the conclusions that Bell and Pei draw about the permissibility of practices such as killing animals for food do not follow. We conclude by emphasizing philosophers’ responsibility to thoroughly test their arguments and to engage with existing debates, especially when the practices they seek to justify involve harms of great magnitude.
