Recent ideological positioning on the world stage has born a startling resemblance to a form of positioning within nursing theory – that of taking complex ideas, reducing them to a simplistic binary form, and uncritically adopting one half of that form. In some cases, this adoption of a binary position has led to a passionately held form of ‘othering’ that prohibits a healthy and critical engagement with ideas. As alluring as settling for the binary form may be – we argue (...) for holding binaries in tension as a catalyst for stimulating dialogue – reasoning and exploration of new ways of wrestling with the social and moral complexity of nursing. Under current UK law, an embryo cannot be transferred to a woman's uterus without the consent of both of its genetic parents, that is both of the people from whose gametes the embryo was created. This consent can be withdrawn at any time before the embryo transfer procedure. Withdrawal of consent by one genetic parent can result in the other genetic parent losing the opportunity to have their own genetic children. We argue that offering couples only one type of consent (...) agreement, as happens at present, is too restrictive. An alternative form of agreement, in which one genetic parent agrees to forego the right to future withdrawal of consent, should be available alongside the current form of agreement. Giving couples such a choice will better enable them to store embryos under a consent agreement that is appropriate for their circumstances. Allowing such a choice, with robust procedures in place to ensure the validity of consent, is the best way to respect patient autonomy. (shrink)

Since 1991, sperm donors in the UK have had the legal right to withdraw consent for the use of their sperm in fertility treatment. This has the potential to adversely affect patients. It may mean that previous recipients of a donor’s sperm cannot have further children who are full biological siblings to an existing child, and that embryos created from the donor’s sperm and a patient’s eggs must be destroyed.

In this paper, I argue that Simone de Beauvoir’s discussion of festivals appropriates Jean-Jacques Rousseau’s own account of the festival and its place in understanding freedom. I begin with a brief summary of Rousseau’s conflicting accounts of the festival from his Discourse on the Origin of Inequality Among Mankind and the Letter to M. D’Alembert. The contrast of these two texts reveals Rousseau’s conception of freedom as circumscribed by the community. Although Rousseau has an idealized virtuous community in mind, the (...) central insight regarding a community’s involvement in the development of freedom is nevertheless echoed in Beauvoir’s description of the festival in the Ethics of Ambiguity. I explore some of the implications of reading Beauvoir’s account of freedom and the festival as influenced by Rousseau and suggest how doing so impacts our understanding of Beauvoirian politics. How does an object persist through change? How can a book, for example, open in the morning and shut in the afternoon, persist through a change that involves the incompatible properties of being open and being shut? The goal of this reader is to inform and reframe the philosophical debate around persistence; it presents influential accounts of the problem that range from classic papers by W. V. O. Quine, David Lewis, and Judith Jarvis Thomson to recent work by contemporary philosophers. (...) The authors take on the question of persistence by examining three broad approaches: perdurantism, which holds that change over time is analogous to change over space; exdurantism, according to which identity over time is analogous to identity across possible worlds; and endurantism, which holds that ordinary objects persist by enduring. Each of these approaches appears to be coherent, but each also has its own metaphysical problems. Persistence includes papers that argue for perdurantism, exdurantism, or endurantism, as well as papers that explore some metaphysical difficulties challenging each account. In Re D is the most recent in a line of cases to raise problems with the determination of legal fatherhood under s.28(3) of the Human Fertilisation and Embryology Act 1990. The judgments in In Re D are interesting in particular because they demonstrate the growing currency of the idea that a child has a right to ‘genetic truth’. They also further evidence the ‘fragmentation of fatherhood’. Following a Consultation exercise conducted by the Lord Chancellor's Department, the U.K. Government has announced its intention to amend the Children Act 1989 so that the unmarried father who jointly registers the birth with the mother will acquire parental responsibility automatically. In this paper, I draw on the responses made to the L.C.D. Consultation, in order critically to evaluate the arguments for and against reform. A poverty of relevant empirical research makes it impossible to reach a properly informed view on (...) the positive or negative impacts of implementing the proposal. However, the principled arguments: that unmarried fathers and their children are subject to discrimination, or that it is unfair for men to pay child support, yet have no automatic rights with regard to their children, are ultimately unconvincing. I also attempt a more explicitly sociological exploration of the Consultation and reform process, focusing on what it can tell us about evolving social attitudes towards the statuses of `father' and `family' and how they should be valued and protected. Our students ought to know about the history of formal hospital segregation and desegregation. To that end, this article urges those who teach foundational health law and policy courses to do three things. First, to teach the Simkins case. Second, to swap out the usual Medicare signing ceremony picture for one that includes W. Montague Cobb, M.D., Ph.D. Third, to highlight how the implementation of that program for the elderly led, in a matter of months, to the desegregation of hospitals (...) throughout the country. This paper argues that the concept and role of ‘institutional racism’ in contemporary discussions of race should be reconsidered. It starts by distinguishing between ‘intrinsic institutional racism’, which holds that institutions are racist in virtue of their constitutive features, and ‘extrinsic institutional racism’, which holds that institutions are racist in virtue of their negative effects. It accepts intrinsic institutional racism, but argues that a ‘disparate impact’ conception of extrinsic conception faces a number of objections, the most serious being that it (...) has no plausible account of what it is that makes extrinsically racist institutions racist. It also argues that claims about the explanatory indispensability of institutional racism are overstated (individual racism is at least as important), critiques structural approaches to racial inequality, and suggests that there is reason to doubt whether institutional reform can provide us with all that morality may require in the racial domain. John Sallis of Duquesne University has edited this fine collection of essays on Heidegger as a tribute to the latter on the occasion of his eightieth birthday. Some of the contributions are papers that were read at a Heidegger Symposium at Duquesne in October, 1966. There is a brief letter by Heidegger addressed to Arthur Schrynemakers, chairman of the Symposium, in which Heidegger submits a set of questions for the consideration of the Symposium participants. Sallis contributes an article which responds (...) to these questions. Zygmunt Adamczewski's contribution is a commentary and elaboration of some issues, e.g., the translation of Wesen, which he discussed personally with Heidegger in 1968. Edward Ballard gives a very clear-headed account of Heidegger's critique of science. There is an excellent account of the "Ereignis" by Theodore Kisiel and of "Time and Being" by André Schuwer. Other contributors include C. D. Keyes, Thomas Langan, Ralph Powell, Anna-Teresa Tymieniecka and John Wild. The volume is lacking in two respects. Except for a brief piece by Langan and for certain implications of Powell's study, there is no really sustained and well-developed critique of Heidegger either internal or external, sympathetic or unsympathetic, a failure not uncommon among Heideggerians. Moreover, there is no index of any kind--of topics, of names, or of texts of Heidegger--which impairs the book's usefulness. --J. D. C. (shrink)

Nurse philosopher Sally Gadow (1999) has proposed the relational narrative between patient and nurse as a ‘postmodern turn’ for nursing ethics. She has conceptualized this moral approach as the construction by patient and nurse of a coauthored narrative describing the good they are seeking, as well as the means to achieve this good. The purpose of this article is to provide an elaboration of Gadow's seminal conceptualization of relational narrative based on her writings and those of other philosophers. The (...) article will further develop relational narrative's foundations in relationship and narrative and will explore engagement as a dimension essential to its creation and growth. The elaboration first builds on the notion of relationship as foundational to this postmodern moral perspective. Narrative then is advanced as being at the heart of the patient–nurse relationship and their relational narrative, based on an exploration of narrative's role in the moral realm as an epistemology for patient and nurse. Finally, the dialogic and embodied engagement expressed by a relational narrative is developed as a critical element of the ethic. (shrink)

With the exception of three articles, all of the pieces collected here by Ballard and Scott appeared in the Winter, 1970 issue of The Southern Journal of Philosophy commemorating Heidegger’s 80th birthday. The opening essay by Poeggeler, "Heidegger Today," masterfully reviews the state of Heideggerian scholarship, sketching the direction which Heidegger’s interpretations have taken, and outlining his own unitary view of Heidegger’s development. This is followed by an interesting essay from the Heidegger critic Karl Löwith who, after some revealing personal (...) recollections about Heidegger, takes up the question of the relationship of Dasein, which stands out from and transcends nature, with the natural world, a question Heidegger himself omits. There is also a close exposition by Joseph Kockelmans of the all-important "Time and Being" lecture of 1962 and of its relationship to Being and Time. Hans-Georg Gadamer contributes a philosophical essay—not a piece of Heideggerian scholarship—on the nature of "empty" time, i.e., the temporal project which we hope to "fill up," and of the "transition" into fulfillment. Editor Scott gives an account of Dasein in Being and Time by an analogy with Leibniz’s monad as a self-originating, purposeful unit of activity. Theodore Kisiel differentiates the mathematical a priori, described by Heidegger as the root conception of modern science, from Heidegger’s own "hermeneutical" a priori. There are three studies of language: Volmann-Schluck discusses language and myth, while John Sallis studies how language and the reversal are intertwined in Heidegger’s thinking; Don Ihde differentiates "existential" phenomenology as a phenomenology of perception from "hermeneutic" phenomenology as a phenomenology of meaning, signification, and language. In addition to essays by A. V. Schoenborn, F. J. Smith, and Edward Ballard, there is also a concluding contribution by Jean Beaufret who offers a portrait of Heidegger "as seen from France."—J.D.C. Concentrating on Teilhard's Christological interests, this book, written by a fellow Jesuit, is eminently successful in showing the essentially theological character and motivation behind Teilhard's speculations. Christology permeates the supposedly scientific theory of evolution. In Teilhard's universe, Christ is the physical center for mankind and for the material world. This vision of Teilhard's, almost Pauline in scope, is the fascination and the consternation of both theologians and scientists. A concluding chapter treats of some of the theological "risks" implicit in Teilhard's (...) attempted synthesis. Mooney is always helpful in his expositions and gracious in his criticisms. Recent, more radical theological sallies make Teilhard appear surprisingly orthodox but rather more profound. Mooney has done us a service with his book, but one emerges feeling the need for a detailed critique of Teilhard's works.—D. J. B. (shrink)

I arrived at Compound XX, TIF Defender, Camp Bucca Iraq and discovered that SFC XXXX and CPL XXXX had, in contravention of standard operating procedure and the requirements of Combined Joint Task Force 134 General Orders, entered Compound XX without first securing all detainees in the Salat, and walked to the rear fenceline through the occupied Compound, many times within deadspace [outside the] guard force's line of sight, and back through the sally port.1 SFC XXXX (...) and CPL XXXX were unmolested during this entry. No prior coordination was performed with the other members of the guard force, other than PFC XXXX who was ordered by SFC XXXX to open the sally port to allow entry. SFC XXXX and CPL XXXX were in a Compound occupied at the time by approximately 1038 Iraqi Security Detainees, and could have been harmed or taken hostage with little warning, leaving the guard force few options other than to attempt to defend SFC XXXX and CPL XXXX by lethal means, as these were the only weapons available that had the range and accuracy required?
