Contemporary discussions of information overload have important precedents during the years 1550-1750. An examination of the early modern period in Europe, including work of humanism, science, theology, and popular encyclopedias demonstrates that perceptions of information overload have as much to do with the ways in which knowledge is represented as with any quantitative measurers in the production of new texts, ideas, or facts. Key figures in this account include Francis Bacon, Conrard Gesner, Francesco Sacchini, Johann Heinrich Alsted, Casoar Bauhin, Rempert (...) This paper examines footraces that are paced and unpaced, and runners who are pre-arranged, designated pacers and those who are not. Although pacesetting is commonplace in footraces today, the practice challenges our conception of sport competition, the nature of competitors and the meaning of records. For example, Bale calls paced races as ‘staged experiments’ to set world records and argues that pacers were crucial in the running career of Roger Bannister. In 2011, the International Association of Athletics Federation banned women’s (...) world records in mixed gender running events, like major marathons, because women were paced by male runners. By examining these cases and others, the authors here will claim paced footraces are qualitatively different than unpaced competitions, pacers introduce peculiar motives and intentions as competitors, women should not be denied opportunities to excel and perform at their very best, and the 2011 IAAF policy is unjustified. In this paper we describe the development of the Interaction Space Theory developed as part of the SANE project. EU framework 5 IST project sustainable accommodation for the new economy, IST 2000-25-257 The EU funded project provided an inter-disciplinary context for the study of interactions in the hybrid workplace where physical work environment is enhanced with information and communication technologies (ICT) which enable collaboration with remote partners. We explain how the theoretical approach, empirical work and methodological strategy employed by SANE (...) researchers contribute toward the social intelligence design approach through the development of the methodology for identification of workplace requirements for mobile knowledge workers. In addition, we demonstrate how empirical findings, based upon our theoretical approach, can lead to development of novel methods and techniques for evaluating the impact of new and emerging technologies in the workplace. This paper presents a conceptual framework for the study of social intelligence in a real-life environment. It is focussed on the dialogue organisation in argumentation, in particular how our understanding of dialogue phenomena in mediated communication may help us to support natural interaction in classroom debates. Dialogue organisation is explored in terms of the cohesive structure of dialogue that emerges as the result of information maintenance and change, specified locally by the adjacency pair and turn-taking, and globally by topic threads. We give a descriptive analysis of their interplay in real chat debates, based on lexical chains of repeated words in an attempt to clarify what feedback participants in the debate require in order to reflect on their contributions to the debate. We then show how this analysis can be used as a basis for conceptual design of a feedback adviser tool to automatically search for topics in student chat debates. Much of the data used in our analysis has been generated as part of the SCALE project SCALE (Internet-based intelligent tool to support collaborative argumentation-based learning in secondary schools) – EU Framework V project. focussed on specifying tools for computer supported argumentation in the classroom. In this paper we present recent research into computer-mediated communication with special emphasis on the use of collaborative tools in shared task environment. In order to explain the regularities and uniformities in people’s behaviour obtained through quantitative study of interaction among groups of students engaged in structured debates, we have developed an experimental approach that enables us to measure and quantify several key aspects of computer-mediated communication in this context.

This essay discusses unlimited insurance subrogation (UIS) as a means of improving the deterrence and compensation results of medical malpractice law. Under UIS, health care insureds could assign their entire potential medical malpractice claims to their first-party commercial and government insurers. UIS should improve deterrence by establishing first-party insurers as plaintiffs to confront liability insurers on the defense side, leading to more effective prosecution of meritorious claims and reducing meritless and unnecessary litigation. UIS should improve compensation outcomes by converting litigation (...) cost- and risk- laden “tort insurance” into cheaper and enhanced first-party insurance. UIS also promises dynamic benefits through further reforms by contract between the first-party and liability insurers that would take charge of system. No UIS-related costs are apparent that would outweigh these benefits. (shrink)

The general consensus is that reform of medical malpractice law should be part of the health care system's overhaul. Medical malpractice litigation results in the expenditure of tens of billions annually, largely paid out of health care insurance funds and mostly paid to defendants' and plaintiffs' lawyers. By all accounts, this tort law regime ill serves the basic deterrence and compensation goals of civil liability. The causes and magnitude of these failings are disputed, and many typical reform proposals sidestep the (...) basic problems and may do more harm than good. In contrast, we advance a straightforward way to improve both deterrence and compensation. Essentially, the proposal is to remove current legal limitations on the scope of insurance subrogation that bar private and public health care insurers from “buying” the whole of their insureds' potential medical malpractice claims in exchange for lower premiums and taxes and expanded insurance coverage. Our proposal’s benefits accrue regardless of the cause and magnitude of the failings of malpractice law or the further reforms that might be adopted. (shrink)

To achieve more cost-effective deterrence of unreasonable risktaking through civil liability, I propose and demonstrate previously unrecognized benefits of using simple random sampling to resolve multiple claims against a business or government defendant in the aggregate. I show that counter to intuition and prevailing assumptions and practice, simple sampling will enhance, not compromise, deterrent results regardless of the number of claims and the variety and significance of differences among them. Indeed, it can be used to resolve multiple claims that bear (...) no resemblance to one another except for targeting the same defendant. The proposal can thus be employed to increase the efficiency of resolving relatively similar claims in class and consolidated actions and, by extending the application of such collectivizing processes, lower the cost of resolving all other claims that would be adjudicated as separate actions. I close by sketching a design for a reformed civil liability system that fully integrates and exploits the law enforcement benefits of sampling to better achieve the primary social objectives of accident risk deterrence and insurance. In his discussions on literature, Merleau-Ponty often turns to the notion of deviation as a constitutive principle of literary language. Deviation indicates the capacity of a literary work to transgress against its own limits and to offer an experience of otherness, or alterity. This alterity is not given in the work, but is constituted by the recipient through the more visceral and physical aspects of literary language. The recipient of the work thus adopts a second voice: that of the author (...) or creator of the work, which is absent from the text yet is reconstructed by the reader in a post hoc manner. The analysis of Merleau-Ponty’s ideas is complemented using the aesthetic insights of Paul Valéry, from which the philosopher was greatly inspired. The essay further explores the way in which the notion of literature as deviation illuminates other aspects in Merleau-Ponty’s theory of language.Dans son examen de la littérature, Merleau-Ponty se penche souvent sur la notion d’écart considérée en tant que principe constitutif du langage littéraire. L’écart indique la capacité d’une oeuvre littéraire de dépasser ses propres limites et d’offrir une expérience d’autrui, de l’altérité. Cette altérité n’est pas donnée dans l’oeuvre, mais elle est constituée par le destinataire à travers les aspects les plus viscéraux et les plus physiques du langage littéraire. Le destinataire de l’oeuvre adopte ainsi une deuxième voix : celle de l’auteur ou du créateur de l’oeuvre, qui est absente du texte mais est reconstituée après coup par le lecteur. L’analyse de la réflexion de Merleau-Ponty est complétée à partir des intuitions esthétiques de Paul Valery, dont le philosophe a été largement inspiré. Così il destinatario dell’opera adotta una seconda voce, quella del creatore o dell’autore, che è assente dal testo e tuttavia è ricostruita dal lettore a posteriori. L’analisi delle riflessioni merleau-pontiane è integrata a partire dalle intuizioni estetiche di Paul Valery, da cui il pensiero del filosofo fu ampiamente ispirato. Il saggio esplora inoltre il modo in cui la nozione di letteratura come scarto ci consenta di illuminare altri aspetti della riflessione merleau-pontiana sul linguaggio. (shrink)

This paper examines a single relevant source regarding Edmund Husserl’s transcendental phenomenology and his attempt to explain how we perceive and experience the Other. In the fifth chapter of the Cartesian Meditations, Husserl describes our encounters with others through a process of non-inferential analogy and details the ways we ‘appresent’ the Other. This unique and admittedly narrow approach to understanding intersubjectivity, I submit, offers significant insights regarding the nature of interactions between competing athletes and the meanings these experiences generate. The (...) descriptive-explanatory account of the ‘appresentation’ of the Other in sport presented here will not be exhaustive. But it will, I anticipate, be informative, supplement existing works in the phenomenology of sport, and appeal intuitively to some of our intersubjective experiences in competitive sport. (shrink)

The essay analyses the development of Joseph de Maistre’s ideas on war and peace. Commonly seen as advocating militarism and bloodshed, Maistre’s insights and propositions on the nature of war are in fact highly modern and original. As a witness to the European upheaval of 1792-1815, Maistre emphasizes the indeterminacy and unpredictability of modern war, and its irreducibility to a science or a doctrine. In order to regulate and restrain warfare, Maistre argues, it is necessary to cultivate public opinion, an (...) elusive and difficult process which can only be sustained by informal cultural institutions. The essay also examines the legacy of Maistre’s ideas on war and peace in political thought. (shrink)

In this paper recent research involving interdisciplinary ethnography is presented as an exploration of its contribution to studies of people and technology in the workplace. Three main patterns of interaction between ethnography and ‘the others’ are examined. First, the influence of ethnography in promoting people-oriented perspectives of technology is discussed with reference to workplace studies in manufacturing. Second, ethnography contribution to the development of hybrid methods for the design and implementation of technology for use in the workplace is illustrated by (...) several examples of such frameworks. Third, the influence of ethnographic research to providing a theoretical basis for computer-mediated communication is explored and documented by analyses of design teams working together as part of construction projects. From a practical point of view, this exploration has resulted in a brief discussion of the broad range of ‘users’ in the real-life workplace who benefit from ethnographic research. Future work in this area will rely on a reflexive stance on the part of the ethnographer in relation to both users of technology and users of ethnography. (shrink)
