Mental content normativists hold that the mind’s conceptual contents are essentially normative. Many hold the view because they think that facts of the form “subject S possesses concept c” imply that S is enjoined by rules concerning the application of c in theoretical judgments. Some opponents independently raise an intuitive objection: even if there are such rules, S’s possession of the concept is not the source of the enjoinment. Hence, these rules do not support mental content normativism. Call this the (...) “Source Objection.” This paper refutes the Source Objection, outlining a key strand of the relationship between judgments and their contents in the process. Theoretical judgment and mental conceptual content are equally the source of enjoinment; norms for judging with contents do not derive from one at the expense of the other. (shrink)

When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

Two experiments using a realistic version of the selection task examined the relationship between participants' probability estimates of finding a counter example and their selections. Experiment 1 used everyday categories in the context of a scenario to determine whether or not the number of instances in a category affected the estimated probability of a counter-example. Experiment 2 modified the scenario in order to alter participants' estimates of finding a specific counter-example. Unlike Kirby 1994a, but consistent with his proposals, both studies (...) showed that probability estimates significantly predicted selection. Overall results point to the value of understanding selections in terms of their subjective expected utility. (shrink)

Using data from a randomized field experiment within a Deliberative Poll, this paper examines deliberation’s effects on both policy attitudes and the extent to which ordinal rankings of policy options approach single-peakedness (a help in avoiding cyclical majorities). The setting was New Haven, Connecticut, and its surrounding towns; the issues were airport expansion and revenue sharing – the former highly salient, the latter not at all. Half the participants deliberated revenue sharing, then the airport; the other half the reverse. This (...) split-half design helps distinguish the effects of the formal on-site deliberations from those of other aspects of the treatment. As expected, the highly salient airport issue saw only a slight effect, while much less salient revenue-sharing issue saw a much larger one. (shrink)

The paradox of rule-following that Saul Kripke finds in Wittgenstein’s Philosophical Investigations purports to show that words and thoughts have no content—that there is no intentionality. This paper refutes the paradox with a dilemma. Intentional states are posited in rational explanations, which use propositional attitudes to explain actions and thoughts. Depending on which of the two plausible views of rational explanation is right, either: the paradox is mistaken about the a priori requirements for content; or, a fatal flaw in content (...) ascription alleged by the paradox is not a flaw at all, but a necessary component of the proper method of propositional-attitude ascription. More than three decades after its advent in political science, rational choice theory has yet to add appreciably to the stock of knowledge about politics. In Pathologies of Rational Choice Theory we traced this failure to methodological defects rooted in the aspiration to come up with universal theories of politics. After responding to criticisms of our argument, we elaborate on our earlier recommendations about how to improve the quality of rational choice applications. Saul Kripke's influential ‘sceptical paradox’ of semantic rule-following alleges that speakers cannot have any justification for using a word one way rather than another. If it is correct, there can be no such thing as meaning anything by a word. I argue that the paradox fails to undermine meaning. Kripke never adequately motivates its excessively strict standard for the justified use of words. The paradox lacks the resources to show that its standard is truly mandatory or that speakers do not (...) frequently satisfy the well-motivated competitor I offer. So the paradox fails. (shrink)

Feminist scholars adopt wide-ranging views of self-sacrifice: their critiques claim that women are inordinately affected by Christianity's valorization of self-sacrifice and that this traditional Christian value is inherently misogynistic and necrophilic. Although Søren Kierkegaard's Works of Love deems Christian love essentially sacrificial, love, in his view, sets significant limits on the role of self-sacrifice in human life. Through his proposed response to one who requests forgiveness, “Do you now truly love me?” Kierkegaard offers a model of forgiveness that subverts traditional (...) ideals of the self-sacrificing and submissive woman while keeping love central. The question asserts self-love, involves redoubling and double danger, and expresses a refusal to imitate Christ's suffering. I propose a reading in keeping with Grace Jantzen's vision for a feminist philosophy of religion, which reads against the grain and “seeks to break through to new ways of thinking that may open up divine horizons.” My reading is further supported by Kierkegaard's contention that everything essentially Christian bears a double meaning. In light of the subversive potential found in the discrepancy between apparent love and actual love, as well as the duty to name the sin of one who has behaved in an unloving manner, I argue that Kierkegaard's philosophy of love resists simplistic understandings of self-sacrificing love. Christian Piska, one of the leading Austrian authorities in constitutional and administrative law, published a seventh revised edition of his Casebook—Introduction to Legal Studies in 2019. The work is intended to assist first-year law students in dealing with the challenging of the Written Module Examination Introduction to Legal Studies (“Schriftliche Modulprüfung ‘Einführung in die Rechtswissenschaften’” (University of Vienna, Faculty of Law. 2024). This reflective essay focuses not only on the question what is taught and exemplified as the foundations of legal (...) skills and knowledge first-year law students are expected to acquire, but also how and to which degree Piska’s Casebook is likely to achieve the goal it sets, i.e. to provide strategic guidance in preparing for one of the most challenging entrance examinations at the University of Vienna. We find that Piska’s Casebook constitutes a useful resource for students seeking to prepare for the Module Entrance Examination at the University of Vienna but also for legal educators and legal language teachers in legal literacy programmes. We find that the work lives up to its purpose of providing strategic guidance in preparing for the entrance examinations at the University of Vienna. We recommend integrating the growing body of research in applied legal linguistics, legal semiotics and in legal language teaching in future editions of the work which would likely enhance its educational value for students of law and those interested in advancing legal language teaching, legal language learning and legal language assessment. This paper develops the view that in arguing informally individuals construct a dual representation in which there is a coupling of arguments and the structure of the qualitative (mental) causal model to which these refer. Invited to consider a future possibility, individuals generate a causal model and mentally simulate the consequences of certain actions. Their arguments refer to the causal paths in the model. Correspondingly, faced with specific arguments about a policy option they generate a model with particular causal paths (...) and mentally simulate the outcomes. The results of Experiment 1 are consistent with this notion. Decisions on the percentage of funds to be allocated to genetically modified (GM) crop research depended on the structure of the arguments elicited in response to imagining a future state of affairs. Specifically, the presence of a dissuasive argument eliminated the impact of any persuasive argument. The non-monotonic properties of everyday informal argument can then be seen as a corollary of change to causal structure in the model. The dual representation view predicts that the impact of a dissuasive argument will depend on the structure of the causal model. Experiment 2 tested and confirmed this prediction by requiring individuals to judge the relative persuasiveness of two cases referring either to a model with two independent causal paths or to a model in which one causal path depended on the other. In contrast to Experiment 1, prior opinion on GM crop research did not affect allocation decisions. An advisory role in contrast to a participant role may encourage a more decontextualised mode of thinking. According to the dual representation view, ease of mental simulation should exert wide-ranging effects on judgements and the rhetoric of arguments should also be important. DBS Think Tank IX was held on August 25–27, 2021 in Orlando FL with US based participants largely in person and overseas participants joining by video conferencing technology. The DBS Think Tank was founded in 2012 and provides an open platform where clinicians, engineers and researchers can freely discuss current and emerging deep brain stimulation technologies as well as the logistical and ethical issues facing the field. The consensus among the DBS Think Tank IX speakers was that DBS expanded in (...) its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. After collectively sharing our experiences, it was estimated that globally more than 230,000 DBS devices have been implanted for neurological and neuropsychiatric disorders. As such, this year’s meeting was focused on advances in the following areas: neuromodulation in Europe, Asia and Australia; cutting-edge technologies, neuroethics, interventional psychiatry, adaptive DBS, neuromodulation for pain, network neuromodulation for epilepsy and neuromodulation for traumatic brain injury. Abstract In order to be a general theory of human cognition, the theory of mental models needs to accommodate a variety of forms of reasoning in addition to deduction. The mental model theory of induction is a crucial step in establishing generality. After suggesting that the theory of mental models can also account for abduction and analogy, the paper points out that inductive performance is likely to be constrained both by the nature of the representation used and by strategic factors. (...) Since human cognition involves the communication of arguments, a final section explores the relationship between the theory of mental models and the notion of an argument. Like philology one hundred years ago, academic literary study today—at least at the most eminent universities and in the most prestigious journals—is a highly esoteric activity, unlikely to appeal to anyone outside its own "professional" boundaries, anyone whose foremost interest in works of literature is simply to read them. It is, therefore, an endeavor that could hardly exist outside the university's institutional protection, and it is most strikingly concerned not with the appreciation of the intrinsic qualities of literature but with the historical and cultural "knowledge" that can be acquired from works of literature through a special kind of analysis. The effort, chronicled by Gerald Graff in Professing Literature, to make "literature itself" the focus of academic study and to establish "aesthetic criticism" as the primary mode of literary study must surely be judged a failure, the current academic scene clearly dominated by the sort of scholars Graff terms "investigators." 1But of course the motives for rejecting the merely literary as a focus of study are quite different among current scholarly investigators as compared to the philologists of 1901. The attitude of the latter can probably be captured in the words of one of them quoted by Graff: "Why then waste time and brains in thrashing over again something which is after all only subjective opinion? Mere aesthetic theorizing [End Page 62] should be left to the magazine writer or to the really gifted critic" (p. 124). Such "researchers" did not deny the value of reading works of literature; they simply considered this value to be essentially "subjective," not an appropriate object of academic scrutiny. While these remarks do imply some condescension toward the "really gifted critic" and this critic's "mere aesthetic theorizing," they do not repudiate the very idea of an aesthetic approach to literature. The present generation of academics engaged in the investigation of literature, on the other hand, have repudiated the aesthetic approach, either explicitly, through the well-publicized critiques of the canon, of the very notion of the great work, or of the remaining approaches still associated with New Criticism, or implicitly through the gradual establishment of cultural investigation as the new norm for the professional training of graduate students and as the dominant mode of analysis in the influential journals. Moreover, the primary motive behind the renunciation of the aesthetic has more to do with politics than with methodology: for these scholars, the aesthetic is literally useless, quite irrelevant to the paramount goal of "intervening" in a continuing ideological struggle that is thought to be the main business of the university scholar.In the context of the history of modern literary criticism (as opposed to the history of the American university), the current situation mirrors that which prompted the emergence of The New Criticism in the 1930s. Although Vincent Leitch identifies "the evocative mode of Impressionist criticism, the moralism of Neo-Humanism, the anti-modernist cultural criticism of Mencken and Van Wyck Brooks," as well as the "sociologizing" of Marxist criticism" as the collective bêtes noires of the New Critics, it was clearly the latter they considered to be the most unwelcome. Mammalian sperm undergo discharge of a single, anterior secretory granule following their attachment to the zona pellucida surrounding the oocyte. This secretory discharge is known for historical reasons as the acrosome reaction. It fulfils a number of purposes and without it, sperm are unable to penetrate the zona pellucida and fuse with the oocyte. In this review, we focus on the role of the acrosome reaction in the development of fusion competence in sperm. Any naturally occurring membrane fusion has two (...) major sequential steps: a docking or adhesion step, in which two membranes adhere, and a fusion step, in which their lipid bilayers are destabilized and merged and a cellular compartment is either created or destroyed. Recent evidence suggests that there is an important role for oocyte integrins and sperm‐bound disintegrins in mammalian sperm/oocyte adhesion and fusion. The fusion mechanism employed by sperm remains poorly understood, however, and circumstantial evidence suggests it is more complex than the interaction between a single protein species and its target. Sperm/oocyte fusion is probably the most accessible eukaryotic model for intercellular fusion currently available, partly because it is temporally separated from gene expression. Elucidation of the mechanism of sperm/oocyte fusion may throw light on the mechanism of other intercellular fusions such as myoblast fusion, and the evolutionary relationship of intercellular membrane fusion to intracellular membrane fusion. Functional imaging studies of neurologically intact adults have demonstrated that the right posterior cerebellum is activated during verb generation, semantic processing, sentence processing, and verbal fluency. Studies of patients with cerebellar damage converge to show that the cerebellum supports sentence processing and verbal fluency. However, to date there are no patient studies that investigated the specific importance of the right posterior cerebellum in language processing, because: case studies presented patients with lesions affecting the anterior cerebellum, and group studies combined patients (...) with lesions to different cerebellar regions, without specifically reporting the effects of right posterior cerebellar damage. Here we investigated whether damage to the right posterior cerebellum is critical for sentence processing and verbal fluency in four patients with focal stroke damage to different parts of the right posterior cerebellum. We examined detailed lesion location by going beyond common anatomical definitions of cerebellar anatomy, and employed a recently proposed functional parcellation of the cerebellum. All four patients experienced language difficulties that persisted for at least a month after stroke but three performed in the normal range within a year. In contrast, one patient with more damage to lobule IX than the other patients had profound long-lasting impairments in the comprehension and repetition of sentences, and the production of spoken sentences during picture description. Spoken and written word comprehension and visual recognition memory were also impaired, however, verbal fluency was within the normal range, together with object naming, visual perception and verbal short-term memory. This is the first study to show that focal damage to the right posterior cerebellum leads to language difficulties after stroke; and that processing impairments persisted in the case with most damage to lobule IX. We discuss these results in relation to current theories of cerebellar contribution to language processing. Overall, our study highlights the need for longitudinal studies of language function in patients with focal damage to different cerebellar regions, with functional imaging to understand the mechanisms that support recovery. We examine how opinion on a controversial real-world issue shifts as a function of reading relevant arguments and engaging in a specific mental simulation about a future, fictional state of affairs involving the target issue. Individuals thought either counterfactually about a future event (“if only X had not happened …”) or semifactually about it (“even if X had not happened …”). In Experiment 1, as expected, individuals became more in favour of a course of action (the electronic tagging of children) (...) after reading relevant supporting arguments. They also became more in favour after they thought counterfactually how a negative future event could have been avoided if only electronic tagging had not been banned some years earlier. The effects of argument relevance and type of mental simulation were additive. Using a similar procedure but a different target issue (whether the UK should join the Economic Monetary Union), Experiment 2 confirmed that the type of mental simulation exerts a substantial effect on the impact of relevant arguments. Much weaker effects arose when the mental simulation was not relevant to the target issue. We set and discuss our results in terms of dual-processing theory. (shrink)
