The dissertation concerns F. A. Hayek’s critique of legislation. The purpose of the investigation is to clarify and assess that critique. I argue that there is in Hayek’s work a critique of legislation that is distinct from his well-known critique of social planning. Further that the main claim of this critique is what I refer to as Hayek’s legislation tenet, namely that legislation that aims to achieve specific aggregate results in complex orders of society will decrease the welfare level. The (...) legislation tenet gains support; from the welfare claim – according to which there is a positive correlation between the utilization of knowledge and the welfare level in society; from the dispersal of knowledge thesis – according to which the total knowledge of society is dispersed and not available to any one agency; and from the cultural evolution thesis – according to which evolutionary rules are more favorable to the utilization of knowledge in social cooperation than are legislative rules. More specifically, I argue that these form two lines of argument in support of the legislation tenet. One line of argument is based on the conjunction of the welfare claim and the dispersal of knowledge thesis. I argue that this line of argument is true. The other line of argument is based on the conjunction of the welfare claim and the cultural evolution thesis. I argue that this line of argument is false, mainly because the empirical work of political scientist Elinor Ostrom refutes it. Because the two lines of argument support the legislation tenet independently of each other, I argue that Hayek’s critique of legislation is true. In this dissertation, I further develop a legislative policy tool as based on the welfare claim and Hayek’s conception of coercion. I also consider Hayek’s idea that rules and law are instrumental in forging rational individual action and rational social orders, and turn to review this idea in light of the work of experimental economist Vernon Smith and economic historian Avner Greif. I find that Smith and Greif support this idea of Hayek’s, and I conjecture that it contributes to our understanding of Adam Smith’s notion of the invisible hand: It is rules – not an invisible hand – that prompt subjects to align individual and aggregate rationality in social interaction. Finally, I argue that Hayek’s critique is essentially utilitarian, as it is concerned with the negative welfare consequences of certain forms of legislation. And although it may appear that the dispersal of knowledge thesis will undermine the possibility of carrying out the utilitarian calculus, due to the lack of knowledge of the consequences of one’s actions – and therefore undermine the legislation tenet itself – I argue that the distinction between utilitarianism conceived as a method of deliberation and utilitarianism conceived as a criterion of correctness may be used to save Hayek’s critique from this objection. For three decades Jeremy Holmes has been a leading figure in psychodynamic psychiatry in the UK and across the world. The threat to the survival of humankind posed by nuclear weapons has been a frightening and essential focus of public debate for the last four decades and must continue to be so if we are to avoid destroying ourselves and the natural world around us. One unfortunate result of preoccupation with the nuclear threat, however, has been a new kind of "respectability" accorded to conventional war. To talk of a logic of mysticism may sound distinctly odd. If anything, mysticism is alogical; it would be uncharitable if not false, on mature consideration, to call it illogical—though many, without due deliberation, might be tempted to use that term. Wittgenstein comes close to calling it illogical. In his lecture on ethics he draws attention to the logical oddity of statements of absolute value. But he does not accuse the mystics or prophets or religious teachers of contradicting themselves or (...) of invalid reasoning. What he accuses them of may be something worse, namely, talking nonsense, of not giving sense to the words they use or the expressions they utter. What were the historical and cultural processes by which Cyril of Alexandria was elevated to canonical status while his opponent, Nestorius, bishop of Constantinople, was made into a heretic? In contrast to previous scholarship, Susan Wessel concludes that Cyril's success in being elevated to orthodox status was not simply a political accomplishment based on political alliances he had fashioned as opportunity arose. Nor was it a dogmatic victory, based on the clarity and orthodoxy of Cyril's doctrinal claims. (...) Instead, it was his strategy in identifying himself with the orthodoxy of the former bishop of Alexandria, Athanasius, in his victory over Arianism, in borrowing Athanasius' interpretive methods, and in skilfully using the tropes and figures of the second sophistic that made Cyril a saint in the Greek and Coptic Orthodox Churches. Some years ago I came across the following question thrown out almost casually in the course of discussion: How many of us, it was asked, want to call a ‘bad work of art’ a ‘work of art’? The question was clearly rhetorical; the author quite obviously did not consider that anyone in his right mind would suggest that a bad work of art was a work of art. This struck me as rather odd. Surely there can be good and bad (...) works of art, just as there can be good and bad apples or good and bad men. An apple does not cease to be an apple just because it is bad, unless perhaps it has become thoroughly rotten; but the gardener who says ‘The Coxes are bad this year’ does not mean that they have grown rotten on the trees, much less that they are not apples at all. Moreover, if so-called bad works of art are not works of art, what are they? You may not think highly of the works in the Royal Academy Summer Exhibition but they are not totally dissimilar to some works in Bond Street next door which are highly regarded. (shrink)
It is over forty years since Merleau-Ponty published his first major work, Le structure de comportement and a quarter of a century since he died. He belongs, therefore, with Sartre and Marcel, to the first post-War generation of French philosophers. Like his friend Sartre's, his philosophy may be regarded as dated, passé, of no interest or relevance to truly contemporary thought. In philosophical terms forty years are nothing; in terms of trends, fashions and novelties they are an eternity. But perhaps (...) the work of Merleau-Ponty has not dated because it was never in vogue. He did not write plays and novels, or take part in political demonstrations, though he was involved in politics, or win a Nobel prize and refuse to receive it. He was very much a philosopher's philosopher, eminent in his field, well known in academic circles in France but hardly a household name. In this country he is hardly known even in philosophical circles, except by name. More is the pity, since his philosophical approach and manner of philosophizing have much in common with certain modes of British philosophizing, as I hope to show. (shrink)

The everyday novelties of contemporary society require emotional reflexivity, but how can it be researched? Joint interviews can give more insight into the relational and embodied nature of emotional reflexivity than analysis of text-based online sources. Although textual analysis of online sources might be useful for seeing how people relationally negotiate what to feel when feeling rules are unclear, interviews allow observation of emotional reflexivity as done in interaction, especially if there is more than one interviewee. This highlights not only (...) the relational, but the embodied aspects of emotional reflexivity, and shows how it is a useful concept for researching aspects of emotionality not well addressed by other concepts such as “emotional intelligence” and “emotion work.”. Learning grammar requires practice and practicing grammar can be boring. We examined whether an instructional game with intrinsically integrated game mechanics promotes this practice: compared to rote learning through a quiz. We did so “in the field.” Tens of thousands children visited, in their leisure time, a public website with tens of attractive online games for children during a 6-week-long period. Of these children, 11,949 picked voluntarily our grammar training intervention. Thereafter, unbeknown to them, they were assigned either to the (...) game or the quiz condition. By means of learning analytics, we examined variables related to participants’ persistence and performance. The results showed large participant drop-out before completing the first level in both conditions, confirming the boringness of the topic. More children completed at least one level in the game compared to the quiz. However, more children completed the intervention with the quiz. In the game, children answered fewer questions correctly and made more errors compared to the quiz. These findings suggest that even if a game initially catches user attention, it may not hold it. Plus, even if it is a minimalistic game with intrinsic integration of learning and playing, it may be distractive. We conclude that persistence in practicing grammar may be driven by other means than by a game’s shooting mechanics; for instance, by a desire to learn the topic and a feeling of achievement or by quizzing mechanics. Dans cet article, je discute d’abord les différentes notions de temps qu’il faut distinguer pour bien analyser les simulations puis je montre sur cette base que, pour être de bonnes représentations scientifiques, les simulations ne doivent pas en général ressembler du point de vue temporel aux objets qu’elles représentent.Simulations often give the impression of being similar to the systems they represent. This enables me to argue that, in order to serve correctly their purpose as scientific representations, simulations must not in general be similar from a temporal point of view to the systems they represent. Allan Franklin has identified a number of strategies that scientists use to build confidence in experimental results. This paper shows that Franklin's strategies have direct analogues in the context of computer simulation and then suggests that one of his strategies—the so-called 'Sherlock Holmes' strategy—deserves a privileged place within the epistemologies of experiment and simulation. In particular, it is argued that while the successful application of even several of Franklin's other strategies (or their analogues in simulation) may not be sufficient for (...) justified belief in results, the successful application of a slightly elaborated version of the Sherlock Holmes strategy is sufficient. Game theory and rules are deeply intertwined for at least two reasons: first, in many cases rules are necessary to break the indeterminacy that surrounds most of the games; second, in the past 30 years game theory has been increasingly used as a major tool to build a theory of social rules. Interestingly, though the concept of rules is now part of most game theorists' tool box, none of them has explicitly entertained the important distinction between regulative rules and constitutive (...) rules. This distinction, which finds its roots in Ludwig Wittgenstein's profound discussion of ‘language games’, is at the core of modern philosophy of social sciences. This article asks whether game theory can account for constitutive rules. I distinguish between three game-theoretic accounts of rules: the rules-as-behavioral-regularities account, the rules-as-normative-expectations account, and the rules-as-correlated-devices account. I show that only the latter two are able to make sense of constitutive rules by giving up.. (shrink)
The question of how to frame agential preferences in economics finds one caught between Scylla and Charybdis. If preferences are framed in as minimal and deflationary a manner as revealed preference theory recommends, the theory falls prey to objections about its predictiveness and explanatory power. Alternatively, if too many cognitive and causal intricacies are incorporated into the preference concept, revealed preference models will violate pragmatic norms of model construction, surrendering model simplicity and generality. In the debates regarding the ethics of human organoid biobanking, the locus of donor autonomy has been identified in processes of consent. The problem is that, by focusing on consent, biobanking processes preclude adequate engagement with donor autonomy because they are unable to adequately recognise or respond to factors that determine authentic choice. This is particularly problematic in biobanking contexts associated with organoid research or the clinical application of organoids because, given the probability of unforeseen and varying purposes for which (...) a donor’s organoids could be employed and given the different ways in which a donor can relate to her biospecimens, a donor can value her organoids differently in different contexts and her reasons for autonomously permitting use of her cells and tissues in one case may not support an autonomous decision in another. In response, this paper has three aims: firstly, to make the case for why organoid biobanks ought to respect donor autonomy conceived as authentic choice; secondly, to explore the autonomy-respecting limits of established and widely prevalent models of biobank consent; and thirdly, to propose certain conditions that organoid biobanks ought to support or facilitate in order to respect donor autonomy. Use of the imagination is a key aspect of successful psychotherapeutic treatments. Psychotherapy helps clients get in touch with, awaken, and learn to trust their creative inner life, while therapists use their imaginations to mentalise the suffering other and to trace the unconscious stirrings evoked by the intimacy of the consulting room. Working from this premise, in _The Therapeutic Imagination_ _Jeremy Holmes_ argues unashamedly that literate therapists make better therapists. Drawing on psychoanalytic and literary traditions both classical and contemporary, Part (...) I shows how poetry and novels help foster therapists’ understanding of their own imagination-in-action, anatomised into five phases: attachment, reverie, logos, action and reflection. Part II uses the contrast between secure and insecure narrative styles in attachment theory and relates these to literary storytelling and the transformational aspects of therapy. Part III uses literary accounts to illuminate the psychiatric conditions of narcissism, anxiety, splitting and bereavement. Although considered a figure of great importance and influence by his contemporaries, Edmond Holmes has been consigned to relative obscurity in the progressive educational tradition. This book reinstates Holmes as a key figure in the history of progressive education, both as a School Inspector and educational thinker, who was instrumental in forming a set of ideas and principles which continue to resonate in education today. Working as Chief Inspector, Holmes scorned mechanical obedience in the classroom and was appalled by the (...) inability of teachers to allow pupils to express themselves freely and imaginatively. His seminal publications positioned him at the vanguard of educational reforms and he became a notable contributor to the New Education Fellowship. His work, however, was not exclusively educational, and in later life Holmes published on religion, philosophy, poetry and literature, subsuming his educational viewpoint into a much wider ‘philosophy of life’. His spiritual leanings and call for an improved education system which would draw out the potential for development already within the child inspired successive generations of progressive educators. Combining biographical detail and key critical analysis, this book will contribute to current debates surrounding creativity and the curriculum, along with the need for alternative educational voices within the state system of regulation. The question of when we have justification for overriding ordinary, everyday decisions of persons with dementia is considered. It is argued that no single criterion for competent decision-making is able to distinguish reliably between decisions we can legitimately override and decisions we cannot legitimately override.
ABSTRACTDeliberative and decisional groups play crucial roles in most aspects of social life. But it is not obvious how to organize these groups and various socio-cognitive mechanisms can spoil debates and decisions. In this paper we focus on one such important mechanism: the misrepresentation of views, i.e. when agents express views that are aligned with those already expressed, and which differ from their private opinions. We introduce a model to analyze the extent to which this behavioral pattern can warp deliberations (...) and distort the decisions that are finally taken. We identify types of situations in which misrepresentation can have major effects and investigate how to reduce these effects by adopting appropriate deliberative procedures. We discuss the beneficial effects of holding a sufficient number of rounds of expression of views; choosing an appropriate order of speech, typically a random one; rendering the deliberation dissenter-friendly; having agents express fined-grained views. These applicable procedures help improve deliberations because they dampen conformist behavior, give epistemic minorities more opportunities to be heard, and reduce the number of cases in which an inadequate consensus or majority develops.
