This paper begins by describing recent controversies over cross-contamination of crops in the United States and European Union. The EU and US are both applying the principle of freedom of cropping to resolve these conflicts, which is based on an individualistic philosophy. However, despite the EU and the US starting with the principle of freedom of cropping they have very dissimilar regulatory regimes for coexistence. These contradictory policies based upon the same principle are creating different sets of winners (...) and losers. In the US the organic industry claims the system of coexistence is unfair and in the EU the biotech industry claims the system is unfair. It seems that states, despites claims to neutrality and freedom of choice, are prejudicing one system of agriculture over another in resolutions to the conflict over cross contamination. In this paper I will argue that if states cannot remain neutral in coexistence policies, there are conditional reasons for favoring the organic industry over the biotech industry in coexistence policies based in communitarian moral philosophy. The article explores the demands that the conflictual dimension of globalization poses for a cosmopolitan education. Such an emphasis seems necessary in times where the populations who undertake inter- and intra-national border crossings are increasingly those who are forced to: those trying to escape unbearable poverty, atrocious wars, the disenfranchised and victims of racist, sexist or religious persecution. Reflecting on the experiences articulated in the two graphic novels, Persepolis and American Born Chinese, the dimension of the globalizing world and its (...) impact and demands on its future world citizens which comes to the fore is one that highlights the necessity for learning how to take a critical and political stance rather than the search for how education can facilitate a smooth adaptation to a new mobile order. Stanley Cavell’s examination of the relationship between autobiography, philosophy, and the founding of a self-reliant voice will be reconsidered in light of its contribution to re-thinking the meaning of a cosmopolitan education between critical self-appropriation and developing a transformative political vision of a new societal order. No one who reads Derrida closely could accuse him of “technophobia.” More than any other contemporary thinker, on the contrary, he has shown the limit of attempts to protect thinking and even being itself from technē. Yet, Derrida nevertheless insists that “deconstruction” is neither a “technique” nor the technology of thinking that modern philosophy calls “method.” What allows Derrida to exclude “technique” and “method” when he himself shows, in relation to Heidegger above all, that a certain technicity and methodicity always (...) remain irreducible? After outlining its stakes (§I), this article seeks to raise this question by reconstructing Derrida’s engagement with Heidegger concerning the questions of technology (§II) and of method (§III) before turning to the techno-methodicity that Derrida attempts to dissociate from deconstruction in turn (§IV). Reductionists about dispositions must either say the natural properties are all dispositional or individuate properties hyperintensionally. Lewis stands in as an example of the sort of combination I think is incoherent: properties individuated by modal profile + categoricalism.

The High Middle Ages were remarkable for their coherent sense of 'Christendom': of people who belonged to a homogeneous Christian society marked by uniform rituals of birth and death and worship. That uniformity, which came under increasing strain as national European characteristics became more pronounced, achieved perhaps its most perfect intellectual expression in the thought of the western Christian thinkers who are sometimes called 'scholastic theologians'. Resolving to finish reading a novel, staying true to your punk style, or dedicating your life to an artistic project: these are examples of aesthetic commitments. I develop an account of the nature of such commitments, and I argue that they are significant insofar as they help us manage the temporally extended nature of our aesthetic agency and our relationships with aesthetic objects. At the same time, focusing on aesthetic commitments can give us a better grasp on the nature of (...) aesthetic normativity; this is because, in making aesthetic commitments, we are capable of giving aesthetic concerns the weight of obligation. I argue that appealing to aesthetic commitments allows us to account for the existence of aesthetic obligations as well as their grounding. I conclude by arguing that, although the aesthetic domain is a domain of play and freedom of choice, there is nevertheless an important place in it for both aesthetic commitments and the aesthetic obligations they generate. Most recent discussions of reasons in art criticism focus on reasons that justify beliefs about the value of artworks. Reviving a long-neglected suggestion from Paul Ziff, I argue that we should focus instead on art-critical reasons that justify actions—namely, particular ways of engaging with artworks. I argue that a focus on practical rather than theoretical reasons yields an understanding of criticism that better fits with our intuitions about the value of reading art criticism, and which makes room for a nuanced (...) distinction between criticism that aims at universality and criticism that is resolutely personal. This article explains and defends a novel idea about how people can be misled by a discussion topic, even if the discussion itself does not explicitly involve the making of false claims. The crucial aspect of this idea is that people are liable to infer, from the fact that a particular topic is being discussed, that this topic is important. As a result, they may then be led to accept certain beliefs about the state of the world they consider necessary (...) for the topic’s importance. What the article calls “importance misrepresentation” occurs when these beliefs about the state of the world are false or otherwise mistaken. The article explores different ways in which importance misrepresentation can occur, and it uses this idea to help clarify and strengthen some well‐known criticisms of the topic choices of academic philosophers. Attempts to capture the distinction between categorical and dispositional states in terms of more primitive modal notions – subjunctive conditionals, causal roles, or combinatorial principles – are bound to fail. Such failure is ensured by a deep symmetry in the ways dispositional and categorical states alike carry modal import. But the categorical/dispositional distinction should not be abandoned; it underpins important metaphysical disputes. Rather, it should be taken as a primitive, after which the doomed attempts at reductive explanation can be transformed (...) into circular but interesting accounts. (shrink)

The period from Thomas Aquinas to Duns Scotus is one of the richest in the history of Christian theology. The Metaphysics of the Incarnation aims to provide a thorough examination of the doctrine in this era, making explicit its philosophical and theological foundations. Medieval theologians believed that there were good reasons for supposing that Christ's human nature was an individual. In the light of this, Part 1 discusses how the various thinkers held that an individual nature could be united to (...) a divine person. Part 2 shows how one divine person could be incarnate without any other. Part 3 deals with questions of Christological predication, and Part 4 shows how an individual nature is to be distinguished from a person. The work begins with a full account of the metaphysics presupposed in the medieval accounts, and concludes with observations relating medieval accounts to modern Christology. (shrink)

It is uncontroversial that our engagement with artworks is constrained by obligations; most commonly, these consist in obligations to other persons, such as artists, audiences, and owners of artworks. A more controversial claim is that we have genuine obligations to artworks themselves. I defend a qualified version of this claim. However, I argue that such obligations do not derive from the supposed moral rights of artworks – for no such rights exist. Rather, I argue that these obligations are instances of (...) duties of love: obligations that one incurs in virtue of loving some object, be it a person or, in this case, an artwork. (shrink)

Objectives—This study examined the issue of confidentiality in relation to i) undergraduate curriculum content in physiotherapy, and ii) the awareness, experiences and attitudes of clinical physiotherapists.Design—Postal survey of universities and focus group interviews with physiotherapists.Setting—Twenty-five universities in the UK and Ireland and 44 therapists in five hospitals in southern England.Results—The survey of universities indicated that legal and ethical aspects of confidentiality featured in virtually all preregistration courses that responded. However, whereas its inclusion was rated as extremely important, the degree of (...) coverage of confidentiality varied considerably between courses. Within the focus groups, 35 informants recollected coverage of confidentiality in their preregistration education, and 12 in postregistration in-service training; in neither case was this coverage in great detail. Informants identified environmental factors and working practices as barriers to preserving confidentiality. Disclosure to others also gave rise to difficulties. Informants were only aware in general terms of the relevant sections of the Chartered Society of Physiotherapy's Rules of Professional Conduct.Conclusions—Aspects of hospital-based physiotherapy practice were seen to create specific problems in relation to confidentiality. More detailed sources of education and guidance on this issue appear to be required. (shrink)

Richard Cross provides the first full study of Duns Scotus's theory of cognition, examining his account of the processes involved in cognition, from sensation, through intuition and abstraction, to conceptual thought. Cross places Scotus's thought clearly within the context of 13th-century study on the mind, and of his intellectual forebears.

The Christian doctrine of the Incarnation maintains that the second person of the Trinity became a human being, retaining all attributes necessary for being divine and gaining all attributes necessary for being human. As usually understood, the doctrine involves the claim that the second person of the Trinity is the subject of the attributes of Jesus Christ, the first-century Jew whose deeds are reported in various ways in the New Testament. The fundamental philosophical problem specific to the doctrine is this: (...) how is it that one and the same thing could be both divine and human. Most of the philosophical effort devoted to the specifics of the doctrine has centered on this issue, which is the focus of this article. (shrink)

A selection function based semantics is offered for the 'can' of ability based on the idea that 'John can run a four minute mile' is true iff John would do so under the right conditions, meaning that he would do so under at least one appropriately chosen test condition. Completeness is proved for an axiom system and semantics based on this idea, and the logic turns out to be interestingly different from any standard system of modal logic.

Macphail’s ‘null hypothesis’, that there are no differences in intelligence, qualitative or quantitative, between non-human vertebrates has been controversial. This controversy can be useful if it encourages interest in acquiring a detailed understanding of how non-human animals express flexible problem-solving capacity (‘intelligence’), but limiting the discussion to vertebrates is too arbitrary. As an example, we focus here on Portia, a spider with an especially intricate predatory strategy and a preference for other spiders as prey. We review research on pre-planned detours, (...) expectancy violation and a capacity to solve confinement problems where, in each of these three contexts, there is experimental evidence of innate cognitive capacities and reliance on internal representation. These cognitive capacities are related to, but not identical to, intelligence. When discussing intelligence, as when discussing cognition, it is more useful to envisage a continuum instead of something that is simply present or not; in other words, a continuum pertaining to flexible problem-solving capacity for ‘intelligence’ and a continuum pertaining to reliance on internal representation for ‘cognition’. When envisaging a continuum pertaining to intelligence, Daniel Dennett’s notion of four Creatures (Darwinian, Skinnerian, Popperian, Gregorian) is of interest, with the distinction between Skinnerian and Popperian Creatures being especially relevant when considering Portia. When we consider these distinctions, a case can be made for Portia being a Popperian Creature. Like Skinnerian Creatures, Popperian Creatures express flexible problem solving capacity, but the manner in which this capacity is expressed by Popperian Creatures is more distinctively cognitive. The vast majority of experimental studies of music to date have explored music in terms of the processes involved in the perception and cognition of complex sonic patterns that can elicit emotion. This paper argues that this conception of music is at odds both with recent Western musical scholarship and with ethnomusicological models, and that it presents a partial and culture‐specific representation of what may be a generic human capacity. It argues that the cognitive sciences must actively engage with the (...) problems of exploring music as manifested and conceived in the broad spectrum of world cultures, not only to elucidate the diversity of music in mind but also to identify potential commonalities that could illuminate the relationships between music and other domains of thought and behavior. In his 1947 British Academy lecture on Naturalistic Ethics, Mr. W. F. R. Hardie is concerned to ask himself whether a naturalistic theory of ethics can give a “satisfactory account of our moral knowledge or convictions,” or whether some form of non-naturalism is demanded by our moral experience. It will be remembered that after a careful sifting and examination of certain features of our moral knowledge or convictions, Mr. Hardie suspends judgment between naturalism and non-naturalism, observing that “on the one (...) hand philosophers who start from the ostensible facts of our moral experience and thinking, and are most careful and accurate in their rendering of these facts, have tended to be led to objectivist and anti-naturalistic conclusions. Where they least carry conviction is in the moral epistemology which they assume or defend. When we reflect, with the epistemological issue in mind, on the actual process in ourselves of moral reflection and decision, we are more inclined to sympathize with a ‘moral sentiment’ theory than we ought to be if the rationalists are wholly in the right.” In what follows I wish to consider another feature of our moral experience which Mr. Hardie did not examine in his lecture and which appears to be of considerable importance, namely the situation where, to put it very roughly for the moment, we find ourselves at variance with another person or persons on a moral issue, where, for instance, I hold that a certain course of conduct is right, and the other person or persons hold that it is wrong, or vice versa , and where further we may pursue divergent courses of action accordingly. I wish to ask myself whether the naturalistic commentary on this situation of ethical disagreement is altogether satisfactory when we consider it in the light of “the ostensible facts of our moral experience and thinking,” whether, in fact, to use another phrase of Mr. Hardie's, it squares altogether with “our fundamental moral convictions” in regard to such a situation. The naturalistic commentary with which I am primarily concerned is that which is now sometimes labelled “the emotive theory of ethics,” and is to be found admirably developed, for example, in Professor Stevenson's book Ethics and Language.
