In November 2018, the practice of health care ethics consultation crossed a major threshold when 138 candidates took the inaugural Healthcare Ethics Consultant Certification Examination. This accomplishment, long in the making, has had and continues to have both advocates and critics. The Healthcare Ethics Consultant Certification Commission, a functionally autonomous body created and funded by the American Society for Bioethics and Humanities, was charged with overseeing creation of the certification process, developing the exam, and formulating certification standards and policies to (...) assess candidates’ qualifications. In this essay, as members of the commission, we describe the process of developing, administering, and scoring the certification examination as well as the historical context and the outlook for certification. By detailing the decisions and actions of the commission, we aim to provide a transparent account of the commission's efforts to develop a psychometrically sound, reliable, and secure examination through a deliberative, fair, and data‐driven process. This reexamination of documents purporting to show that Henry of Ghent served on a commission of 16 theologians that compiled the 219 articles condemned in 1277 produces a different picture. It shows that Henry did not serve on a special commission appointed by bishop Tempier but was present at a meeting of all masters, who condemned the articles. It also shows that Tempier did not bypass masters in the faculty of theology, but had them vote on the articles.

In this book, Spinoza's political theory is examined through an analysis of his engagement with the practical politics of his day in the United Provinces. 17th-century Dutch history, political life and political thought, and in particular Dutch republicanism, represent an important context in which to discuss Spinoza's political philosophy. The significance of Spinoza's republicanism is highlighted in a comparison with English political thought and its presuppositions in the 17th century.

We explore contested meanings around care and relationality through the under-explored case of caring after death, throwing the relational significance of ‘bodies’ into sharp relief. While the dominant social imaginary and forms of knowledge production in many affluent western societies take death to signify an absolute loss of the other in the demise of their physical body, important implications follow from recognising that embodied relational experience can continue after death. Drawing on a model of embodied relational care encompassing a ‘me’, (...) a ‘you’ and an ‘us’, we argue that after death ‘me’ and ‘us’ remain (though changed) while crucial dimensions of ‘you’ persist too. In unravelling the binary divide between living and dead bodies, other related dichotomies of mind/body, self/other, internal/external, and nature/social are also called into question, extending debates concerning relationality and openness between living bodies. Through an exploration of autobiographical accounts and empirical research, we argue that embodied relationality expresses how connectedness is lived out after death in material practices and felt experiences. This article investigates the forms of respect and responsiveness that must be present in the process of practical reason. Drawing upon Jürgen Habermas’ discourse theory and his incidental remarks about aesthetics, I identify two modes of respect. The first is the mutual respect and equality that emerges in the process of coming to agreement on proposed norms; the second is the call to infinite responsibility that emerges in opening to the transcendent character of others. However, Habermas makes an error in (...) treating these two types of response as appropriate for different classes of beings when he suggests that mutual respect is appropriate for humans, but asymmetry is appropriate when humans deal with animals or others who are incapable of communicative action. Rather, drawing upon the work of Emmanuel Levinas, I argue that both responses are always present in all encounters with the world. There is therefore an aporia at the heart of the process of practical reason: the responsiveness required in the exercise of practical reason demands that participants be open not just to another's opinions and claims, but also to precisely that which is not understood, which entails the idea of infinite responsibility. It is the movement between these orientations that enacts the main features of ethical life. (shrink)

The way metrologists conceive of measurement has undergone a major shift in the last two decades. This shift can in great part be traced to a change in the statistical methods used to deal with the expression of measurement results, and, more particularly, with the calculation of measurement uncertainties. Indeed, as we show, the incapacity of the frequentist approach to the calculus of uncertainty to deal with systematic errors has prompted the replacement of the customary frequentist methods by fully Bayesian (...) procedures. The epistemological ramifications of the Bayesian approach merge with a deep empiricist mood tantamount to an “epistemic turn”: measurement results are analysed in terms of degrees of belief, and central concepts such as error and accuracy are called into question. We challenge the perspective entailed by this epistemic turn: we insist on the centrality of the concepts of error and accuracy by underlining the intentional character of measurement that is intimately linked to the process of correction of experimental data. We further circumvent the difficulties posed by the classical analysis of measurement by stressing the social rather than the epistemic dimension of measurement activities. (shrink)

We describe the ethics consultation service (ECS) at the Cleveland Clinic and report on its activities over a 24-month period in which 478 consultations were performed. To our knowledge, this is the largest case series of ethics consultations reported to date. Established more than 25 years ago, the ECS at the Cleveland Clinic is staffed by multiple consultants with advanced training in bioethics. Several of these ethicists work closely with specialized clinical units and research departments, where they participate in multidisciplinary (...) meetings and provide specialized assistance. This combination of historical experience, large numbers of consultation requests, and specialized clinical ethicists suggests that the experience at the Cleveland Clinic may be helpful to ethicists and others who may be considering how to structure and sustain a vibrant ECS. Our results highlight the diversity of activities performed by a high-volume ECS at a tertiary care facility. Our hope in sharing the inner workings of the ECS at the Cleveland Clinic is to promote dialogue on common practices and approaches across medical institutions that support ethics consultation. The paper argues that Leviathan can be interpreted as employing a constructionist approach in several important respects. It takes issue with commentators who think that, if for Hobbes man is not naturally social, then man must be naturally unsocial or naturally purely individual. First, Hobbes's key conceptions of the role of artifice and nature-artifice relations are identified, and uncontroversially constructionist elements outlined, most notably Hobbes's conceptualisation of the covenant. The significance of crucial distinctions in Leviathan, between the civil and the (...) social, between science and philosophy, between mankind's nature and the human condition, is developed. A constructionist reading of the argument of Leviathan is then advanced. The interpretation focuses on the contribution of nature-artifice relations, and of Hobbes's notion of civil philosophy, in understanding the critical issues of the state of nature and individual subjectivity. This reconstruction of the meaning of the text highlights the necessarily social character of human life in Leviathan, expressed in the way that the social' gives meaning to the 'natural', as well as because for Hobbes we live in a mind-affected world of perception and ideas. Leviathan can be interpreted as, in particular, a political social construction, because both social and individual identity logically require the social order and arrangements that only a strong government can supply. The social world, in Leviathan, cannot exist prior to the generation of a political framework, in civil society, the commonwealth, and law. (shrink)

It is generally accepted that appropriate documentation of activities and recommendations of ethics consultants in patients’ medical records is critical. Despite this acceptance, the bioethics literature is largely devoid of guidance on key elements of an ethics chart note, the degree of specificity that it should contain, and its stylistic tenor. We aim to provide guidance for a variety of persons engaged in clinical ethics consultation: new and seasoned ethics committee members who are new to ethics consultation, students and trainees (...) in clinical ethics, and those who have significant experience with ethics consultation so that they can reflect on their practice. Toward the goal of promoting quality charting practices in ethics consultations, we propose recommendations on a broad array of questions concerning clinical ethics consultation chart notes, including whether and when to write a chart note, and practical considerations for the tenor, purpose, and content of a chart note. Our broader aim is to promote discussion about good charting practices in clinical ethics, with the hope of contributing to clear standards of excellence in clinical ethics consultation. (shrink)

Experimental Semiotics (ES) is the study of novel forms of communication that communicators develop in laboratory tasks whose designs prevent them from using language. Thus, ES relates to pragmatics in a “pure,” radical sense, capturing the process of creating the relation between signs and their interpreters as biological, psychological, and social agents. Since such a creation of meaning-making from scratch is of central importance to language evolution research, ES has become the most prolific experimental approach in this field of research. (...) In our paper, we report the results of a study on the scope of recent ES and evaluate the ways in which it is relevant to the study of language origins. We coded for multiple levels across 13 dimensions related to the properties of the emergent communication systems or properties of the study designs, such as type of goal (coordination versus referential), modality of communication, absence or presence of turn-taking, or the presence of vertical vs. horizontal transmission. We discuss our findings and our classification, focusing on the advantages and limitations of those trends in ES, and in particular their ecological validity in the context of bootstrapping communication and the evolution of language. Systems of units still fail to attract the philosophical attention they deserve, but this could change with the current reform of the International System of Units. Most of the SI base units will henceforth be based on certain laws of nature and a choice of fundamental constants whose values will be frozen. The theoretical, experimental and institutional work required to implement the reform highlights the entanglement of scientific, technological and social features in scientific enterprise, while it also invites a philosophical (...) inquiry that promises to overcome the tensions that have long obstructed science studies. HIV stigma, a social-medical problem, continues to confound researchers and health professionals, while undermining outcomes. Empathy may reduce stigma; its absence may predict stigma. This research investigates: How does Kafka’s _Metamorphosis_ advance understandings of HIV stigma in medical health education? _Metamorphosis_ amplifies the sociological-relational mechanisms fostering HIV stigma. It offers a multi-disciplinary, responsive space for ethical, humanistic and clinical inquiry to meet: enabling students to consider how social structures shape health inequities, moral, social experience, and their professional identity within. _Metamorphosis_ (...) may ultimately promote medical health humanities’ social mission—allowing literature to unfold such revelations towards greater equity in health. The philosophical significance attached to the construction of systems of units has traditionally been confined to the notion of convention, while their adoption was considered to be the exclusive province of the history and sociology of science. Against this tradition, a close articulation between history, philosophy, and sociology of science is needed in order to analyse the recent reform of the International system of units. In the new SI, units are redefined on the basis of certain fundamental constants of nature, (...) established by physical theories, whose values are fixed without uncertainty. The purpose of this article is to show that the redefinition of SI units, far from being a convention, involves a holistic reconstruction of our concepts of quantities from accepted theoretical laws. Fixing the values of the defining constants stabilizes these laws within the framework of physics through a twofold adjustment procedure that ensures both a semantic coordination between theory and world and an intersubjective coordination between human agents required by social activities. This double adjustment implies a treatment of uncertainties that results in closely entwining the pursuit of truth as correspondence and truth as coherence which turn out to be complementary, thus highlighting the anthropological underpinnings of scientific realism. Conceptions of citizenship which rest on an abstract and universal notion of the individual founder on their inability to recognize the political relevance of gender. Such conceptions, because their ‘gender-neutrality’ has the effect of excluding women, are not helpful to the project of promoting the full citizenship of women. The question of citizenship is often reduced to either political citizenship, in terms of an instrumental notion of political participation, or social citizenship, in terms of an instrumental notion of economic (in)dependence. (...) The paper argues for the recognition of citizenship as gendered, and as an ethical, that is non-instrumental, social status which is distinct from both political participation and economic (in)dependence. What unites us as citizens, in our equal membership of the political community, need not rely on a conception of us as ‘neutral’ (abstract, universalized, genderless) individuals undertaking one specific activity located in the public realm, but can take account of the diverse ways in which we engage in ethically-grounded activities on the basis of our different genders, ethnic and cultural backgrounds and other differences, in both the public and private realms. A convincing feminist conception of citizenship necessarily involves a radical redefinition of the public/private distinction to accommodate the recognition of citizenship practices in the private realm. The paper builds on the observation that the concept of ‘citizenship’ is broader than the concept of ‘the political’ (or ‘the social/economic’), and contends that feminism provides us with the emancipatory potential of gendered subjectivity, which applies to both men and women. The recognition of gendered subjectivity opens the way to the recognition of the diversity of citizenship practices. It is not that women need to be liberated from the private realm, in order to take part in the public realm as equal citizens, but that women – and men – already undertake responsibilities of citizenship in both the public and the private realms. The authors work in a variety of clinical ethics consultation services (CECSs) that employ a range of methods and approaches. This article discusses the approach to ethics consultation at the Center for Medical Ethics and Health Policy at Baylor College of Medicine and describes the development and transformation of the authors’ CECSs. It discusses how one CECS shifted from a nascent program with only fifty consultations a year to a vibrant, heavily staffed service with five hundred ethics consultations a year.

There is a debate in philosophy and cognitive science over whether concepts – the building blocks of thought—are couched in a perceptual modality or are amodally represented. The empirical evidence so far collected seems not to have adjudicated this question yet, as reinterpretation of the same set of evidence by both supporters of modalism and amodalism have been provided. I offer a critique of such reinterpretations, arguing that they ultimately derive from theoretical problems in the definition of a modal representation. (...) In particular, I will review three criteria which have been offered to distinguish amodal concepts from modal ones: the isomorphism criterion, the neural location criterion, and the input specificity criterion. I will explain how these criteria often lack theoretical clarity, making it possible in most cases to propose a parsimonious explanation of the same set of data from both an amodalist and a modalist perspective. As a result, it becomes impossible to empirically discriminate between the two interpretations. My conclusion is that the main problem with the discussed criteria is that they frame the question on the format of concept as an either/or debate, by overlooking more interesting empirical questions. The article argues that Spinoza's principle of political order represents a conception of sovereignty which is both historically intelligible and analytically coherent.The appropriateness of four meanings of sovereignty to Spinoza's political theory is considered. Then, after examining Spinoza's use of Hobbes's still influential touchstone for the modern theory of sovereignty, Spinoza's conception is discussed in the light of the role that customary practice and republicanism play in his political theory. The analysis of sovereignty also prompts engagement with a range of (...) meanings of the notions of constitutionalism and absolute rule.The argument demonstrates that while Spinoza employs some different criteria, he establishes a conception of sovereignty which needs to be recognised as no less internally consistent than Hobbes's. Moreover, both conceptions contain problems. Although Hobbes demonstrates the abstract logic of authority, the theoretical consequence he draws concerning sovereignty entailing a unitary state has been successfully challenged. Spinoza's conception of sovereignty is based on the logic of customary practice, but the manner in which customary practice is ultimately unsusceptible of analytical justification renders his notion also vulnerable to challenge. While valuable work has been done addressing clinical ethics within established healthcare systems, we anticipate that the projected growth in acquisitions of community hospitals and facilities by large tertiary hospitals will impact the field of clinical ethics and the day-to-day responsibilities of clinical ethicists in ways that have yet to be explored. Toward the goal of providing clinical ethicists guidance on a range of issues that they may encounter in the systematization process, we discuss key considerations and potential challenges in (...) implementing system-wide ethics consultation services. Specifically, we identify four models for organizing, developing, and enhancing ethics consultation activities within a system created through acquisitions: train-the-trainer, local capacity-building, circuit-riding, and consolidated accountability. We note each model’s benefits and challenges. To our knowledge, this is the first paper to consider the broader landscape of issues affected by consolidation. We anticipate that clinical ethicists, volunteer consultants, and hospital administrators will benefit from our recommendations. (shrink)

The sex and gender equity in research guidelines provide instruction for addressing sex and gender within five sections of a manuscript.MethodsWe examined whether the 89 journals published by the American Psychological Association provide explicit instruction for authors to address sex and gender within these five sections. Both authors reviewed the journal instructions to authors for the words “sex,” and “gender,” and noted explicit instruction pertaining to these five (...) sections.ResultsOnly 8 journals instructed authors to address sex/gender within the abstract, introduction, and/or methods sections. No journals instructed authors to address sex and gender in the results or discussion sections.ConclusionThese journals could increase sex/gender equity and improve the reproducibility of psychological science by instructing authors to follow the SAGER guidelines.
