Unearthing the Dark Side of the Law. Narratives of Law and Authority in the Tatarbunar Trials.Cosmin Sebastian Cercel - 2024 - History of Communism in Europe 14:111-130.
This article examines a series of events that are generally known in historiography as the “Tatarbunar Uprising” – an armed rebellion that took place over ten days in September 1924 in south-eastern Bessarabia. I am also interested in the aftermath of those events as well as in their legal and memorial afterlife. My attempt is to reason through and to clarify the legal and historiographical construction of narratives of sovereign power as they emerge from the archives of the trial as (...)

Legal form: Pashukanis and the Marxist critique of law.Gian-Giacomo Fusco, Przemysław Tacik & Cosmin Sebastian Cercel (eds.) - 2025 - New York, NY: Routledge.
A century after the publication of Evgeny Pashukanis's pivotal book General Theory of Law and Marxism, this collection presents a comprehensive account and analysis of his key concept of legal form. Evgeny Pashukanis's General Theory, born amidst the fervour of the first socialist revolution, remains still a crucial reference point in Marxist theories of the law and critical legal theory. Its theoretical depth paved the way for new understandings of the relationship between Marxism and the law. Its crucial virtue continues (...)

Left-Wing Radical Politics and Emergency Powers in Interwar Europe.Corneliu Pintilescu & Cosmin Cercel - 2024 - History of Communism in Europe 14:7-16.
This argument aims to provide an overview of the historical context and main factors shaping the relation between left-wing radical politics and emergency powers in interwar Europe. It also brings to the fore how left-wing radical movements fuelled, reacted to and were connected with the multiple crises of the time span between the two world wars. The main argument is that emergency powers had the potential and were turned into a vehicle for an authoritarian drive, as several cases of that (...)

Measuring spiritual, religious, and existential constructs in children: A systematic review of instruments and measurement properties.Sebastian Boesgaard Bloch, Tobias Anker Stripp, Ricko Damberg Nissen, Johan Albert Wallin, Niels Christian Hvidt & Dorte Toudal Viftrup - forthcoming - Archive for the Psychology of Religion.
Sparse knowledge exists about measuring spiritual, religious, and existential (SRE) constructs in children. Well-validated questionnaires measuring such concepts are necessary when researchers want to quantitatively investigate the spiritual lives of children. We aimed to identify questionnaires measuring SRE constructs in children and assess their psychometric properties. We conducted literature searches in four electronic databases. Studies were included if they described the use of a questionnaire measuring SRE constructs in children under 12 years. Systematic data extraction and assessment of the studies (...)

Generative AI and medical ethics: the state of play.Hazem Zohny, Sebastian Porsdam Mann, Brian D. Earp & John McMillan - 2024 - Journal of Medical Ethics 50 (2):75-76.
Since their public launch, a little over a year ago, large language models (LLMs) have inspired a flurry of analysis about what their implications might be for medical ethics, and for society more broadly. 1 Much of the recent debate has moved beyond categorical evaluations of the permissibility or impermissibility of LLM use in different general contexts (eg, at work or school), to more fine-grained discussions of the criteria that should govern their appropriate use in specific domains or towards certain (...)

  9. Sartre, intersubjectivity, and German idealism.Sebastian Gardner - 2005 - Journal of the History of Philosophy 43 (3):325-351.
Introduction: This paper has two, interrelated aims. The first is to clarify Sartre's theory of intersubjectivity. Sartre's discussion of the Other has a puzzling way of going in and out of focus, seeming at one moment to provide a remarkably original solution to the problem of other minds and at the next to wholly miss the point of the skeptical challenge. The nature of his argument is equally uncertain: at some points it looks like an attempt to mount a transcendental (...)

Is Leibniz's Principle of the Identity of Indiscernibles Necessary or Contingent?Sebastian Bender - 2019 - Philosophers' Imprint 19.
The Principle of the Identity of Indiscernibles —the principle that no two numerically distinct things are perfectly similar—features prominently in Leibniz’s metaphysics. Despite its centrality to his philosophical system, it is surprisingly difficult to determine what modal status Leibniz ascribes to the PII. On many occasions Leibniz appears to endorse the necessity of the PII. There are a number of passages, however, where Leibniz seems to imply that numerically distinct indiscernibles are possible, which suggests that he subscribes to a merely contingent (...)

This article describes a process of developing, implementing and evaluating a clinical ethics support service intervention with the goal of building up a context-sensitive structure of minimal clinical-ethics in an oncology department without prior clinical ethics structure. Scholars from different disciplines have called for an improvement in the evaluation of clinical ethics support services for different reasons over several decades. However, while a lot has been said about the concepts and methodological challenges of evaluating CESS up to the present time, (...)

Although Bohr’s Correspondence Principle (CP) played a central role in the first days of quantum mechanics, its original version seems to have no present-day relevance. The purpose of this article is to show that the CP, with no need of being interpreted in terms of the quantum-to-classical limit, still plays a relevant role in the understanding of the relationships between the classical and the quantum domains. In particular, it will be argued that a generic version of the CP is very (...)

This paper attempts in the first instance to clarify the application of the personal/sub-personal distinction to psychoanalysis and to indicate how this issue is related to that of psychoanalysis" epistemology. It is argued that psychoanalysis may be regarded either as a form of personal psychology, or as a form of jointly personal and sub-personal psychology, but not as a form of sub-personal psychology. It is further argued that psychoanalysis indicates a problem with the personal/sub-personal distinction itself as understood by Dennett (...)

Currently, we need to find out what features of the former educational system, especially those institutionalized, maintained by the school and society, are highlighted here to be eliminated and what is their authentic value in the system. Introduction.Sebastian Bender & Dominik Perler - 2019 - In Dominik Perler & Sebastian Bender (eds.), Causation and Cognition in Early Modern Philosophy. London: Routledge. pp. 1-17.
Early modern philosophers took the phenomena of causation and cognition to be closely related. United in their opposition to Aristotelian accounts of cognition, they developed a wide range of competing theories to explain which causal processes lead to cognitions. Somewhat surprisingly, some early modern authors also made cognition a requirement for causation, on the assumption that every cause needs to cognize its effect. This introductory chapter explores both directions of explanation—from causation to cognition and vice versa—and surveys the various early (...)

The relationship between chemistry and physics from the perspective of Bohmian mechanics.Sebastian Fortin, Olimpia Lombardi & Juan Camilo Martínez - unknown
Although during the last decades the philosophy of chemistry has greatly extended its thematic scope, the main difficulties appear in the attempt to link the chemical description of atoms and molecules and the description supplied by quantum mechanics. The aim of this paper is to analyze how the difficulties that threaten the continuous conceptual link between molecular chemistry and quantum mechanics can be overcome or, at least, moderated from the perspective of BM. With this purpose, in “The quantum-mechanical challenges” section (...)

Recent discussions about the microstructure of materials generally focus on the ontological aspects of the molecular structure. However, there are many types of substances that cannot be studied by means of the concept of molecule, for example, salts. For the quantum treatment of these substances, a new particle, called phonon, is introduced. Phonons are generally conceived as a pseudo-particle, that is, a mathematical device necessary to perform calculations but which does not have a “real” existence. In this context, the aim (...)

This book argues that Adorno's writings allow us to address what is arguably the central challenge of modern philosophy: how to picture a world beyond suffering and injustice without betraying its vital impulse. By re-appraising his writings on politics, philosophy, and art, Sebastian Truskolaski reconstructs Adorno's overall project from a radically new perspective. Taking his 'standpoint of redemption' at its starting point, whilst also dealing with his recurrent reference to the Old Testament ban on images, this book brings Adorno's (...)

This paper argues that even Crane’s modified account of belief doesn’t do justice to all varieties of religious belief. Particularly beliefs associated with ritual behavior don’t seem to match the criteria of Crane’s alternative account. So, the question remains whether these beliefs should still be called beliefs, or whether the standard model of belief is even more false than Crane suspects.

The paper attempts to clarify how the notions of perception, apperception, reflection, and conscientia are related for Leibniz. More specifically, the paper develops a new reading of section four of the Principles of Nature and Grace, which is a much-discussed passage in Leibniz scholarship.
