This paper presents a justification counterpart for dyadic deontic logic, which is often argued to be better than Standard Deontic Logic at representing conditional and contrary-to-duty obligations, such as those exemplified by the notorious Chisholm’s puzzle. We consider the alethic-deontic system (E) and present the explicit version of this system (JE) by replacing the alethic Box-modality with proof terms and the dyadic deontic Circ-modality with justification terms. The explicit representation of strong factual detachment (SFD) is given and finally soundness (...) and completeness of the system (JE) with respect to basic models and preference models is established. Some obligations are conditional such that act A is morally optional, but if one chooses A, one is required to do act B rather than some other less valuable act C. Such conditional obligations arise frequently in research ethics, in the philosophical literature, and in real life. They are controversial: how does a morally optional act give rise to demanding requirements to do the best? Some think that the fact that a putative obligation has a conditional (...) structure, so defined, is a strike against its being a genuine obligation. I argue that conditional obligations are to be expected in a moral theory that has moral options. (shrink)

There are plenty of classic paradoxes about conditional obligations, like the duty to be gentle if one is to murder, and about “supererogatory” deeds beyond the call of duty. But little has been said about the intersection of these topics. We develop the first general account of conditional supererogation, with the power to solve familiar puzzles as well as several that we introduce. Our account, moreover, flows from two familiar ideas: that conditionals restrict quantification and that supererogation emerges (...) from a clash between justifying and requiring reasons. (shrink)

The crucial feature of obligation sentences to which the puzzles point is that such sentences, and evaluative sentences more generally, are defeasible. They may be warranted, given some information, only to be defeated by further information. A theory that recognizes this no longer needs to see conditional obligation as anything more than a simple combination of unary obligation and the conditional.

This paper investigates the semantic treatment of conditional obligation, explicit permission (often called positive permission), and prohibition based on models with agents and branched time. In such models branches (rather than moments) are taken as basic, and the branching provides a way to represent the indeterminism which is normally presupposed by talk of free will, responsibility, action and ability. Careful treatment of the relation between ability and responsibility avoids many common problems with accounts of conditional obligation. (...) Recognition of the generality often involved in conditional obligations makes possible a sensitive way of expressing some kinds of general prohibitions, which in turn makes it possible to account for the special role of explicit permission. It seems that you can be in a position to rescue people in mortal danger and yet have no obligation to do so, because of the sacrifice to you that this would involve. At the same time, if you do save anyone, then you must not leave anyone to die whom it would cost you no additional sacrifice to save. On the basis of these claims, Theron Pummer and Joe Horton have recently defended a ‘conditional obligation of (...) effective altruism’, which requires one to give to the most cost-effective charity if one is going to make a charitable donation at all, all other things equal. Appealing to a distinction between 'thoroughgoing' and 'half-hearted' non-consequentialism, I argue that their inferences don’t go through, and moreover that this sort of argument in general is unlikely to work as a way to defend effective altruism. If doing good is often beyond the call of duty, instances of the All or Nothing Problem abound. I have argued elsewhere that we should solve this problem by accepting a principle that I call Optimific Altruism, which has interesting implications both for the correct account of supererogation and for our obligations to give to charity. However, Theron Pummer and Daniel Muñoz have argued that we should instead solve this problem by rejecting an inference rule that I call Conditional (...) Obligation. Suppose that John has a moral obligation to stop smoking given that smoking is dangerous to his health. Suppose further that smoking is dangerous to his health. Does it follow that John has a moral obligation to stop smoking? Although intuition inclines one to answer in the affirmative, recent developments in deontic logic apparently call this inference into question. The issue at hand is whether unconditional obligations are detachable from conditional obligations on the basis of purely factual (...) considerations. I believe that they are not. In the course of arguing for this position I defend a novel restricted rule of detachment which is constructed out of both factual and normative components. (shrink)

Stewart Shapiro has objected to the epistemicist theory of vagueness on grounds that it gives counterintuitive predictions about cases involving conditional obligation. This paper details a response on the epistemicist’s behalf. I first argue that Shapiro’s own presentation of the objection is unsuccessful as an argument against epistemicism. I then reconstruct and offer two alternative arguments inspired by Shapiro’s considerations, and argue that these fail too, given the information-sensitive nature of conditional obligations.

We present a formal argumentation system for dealing with the detachment of prioritized conditional obligations and permissions. In the presence of facts and constraints, we answer the question whether an unconditional obligation or permission is detachable by considering arguments for and against its detachment. For the evaluation of arguments in favour of detachment, we use a Dung-style argumentation-theoretical semantics. We illustrate how violations and contrary-to-duty scenarios are dealt with in our framework and pay special attention to conflict-resolution via (...) priorities. (shrink)

Lou Goble proposed powerful conditional deontic logics (CDPM) that are able to deal with deontic conflicts by means of restricting the inheritance principle. One of the central problems for dyadic deontic logics is to properly treat the restricted applicability of the principle “strengthening the antecedent”. In most cases it is desirable to derive from an obligation A under condition B, that A is also obliged under condition B and C. However, there are important counterexamples. Goble proposed a weakened (...) rational monotonicity principle to tackle this problem. This solution is suboptimal as it is for some examples counter-intuitive or even leads to explosion. The paper identifies also other problems of Goble’s systems. For instance, to make optimal use of the restricted inheritance principle, in many cases the user has to manually add certain statements to the premises. An adaptive logic framework based on CDPM is proposed which is able to tackle these problems. It allows for certain rules to be applied as much as possible. In this way counter-intuitive consequences as well as explosion can be prohibited and no user interference is required. Furthermore, for non-conflicting premise sets the adaptive logics are equivalent to Goble’s dyadic version of standard deontic logic. (shrink)

I present a novel account of unconditional obligation and of its relationship to conditional obligation and bring this account to bear upon Chisholm's puzzle concerning contrary-to duty obligation.

In this paper, we consider two different ways in which modus-ponens type reasoning with conditional obligations may be formalized. We develop necessary and sufficient conditions for the validity of each, and make some philosophical observations about the differences between the minor premises that each formalization requires. All this is done within the context of the Belnap-Perloff stit theory.

The paper considers two kinds of medieval obligational disputations and the medieval genre of sophismata in relation to the kinds of inferences accepted in them. The main texts discussed are the anonymous Obligationes parisienses from the early 13th century and Richard Kilvington’s Sophismata from the early 14th century. Four different kinds of warranted transition from an antecedent to a consequent become apparent in the medieval discussions: the strong logical validity of basic propositional logic, analytic validity based on conceptual containment, merely (...) semantic impossibility of the antecedent being true without the consequent, and intuitively true counterfactual conditionals. As these different kinds of consequences are spelled out by means of obligational disputations, it appears that the genre of obligations is indeed useful for the “knowledge of consequences,” as the anonymous Obligationes parisienses claims. The preventative paradigm of preconception care is receiving increasing attention, yet its boundaries remain vague in three respects: temporally; agentially; and instrumentally. Crucially, it remains unclear just who is to be considered a ‘potential parent’, how soon they should take up preconception responsibilities, and how weighty their responsibilities should be.

Family obligation, which has an exceptionally high salience in traditional Chinese society, continues to be significant in contemporary China. In family relations in particular sentiments and practices morphologically similar to those associated with xiao remains intact in so far as an enduring set of expectations concerning age-based obligation continues to structure behavior toward others. Researchers pursuing the theme of “individualization” in Chinese society, on the other hand, argue that family obligations and filial sentiments have substantially weakened. The present (...) paper will show that under conditions of cultural and social change in China filial behavior through family obligation continues to play an important role even though the conventions associated with the relevant expectations, attitudes and emotions have undergone significant change. The paper argues that the culture-system develops not merely through an internal dynamic and that family obligation must be understood in terms of the social and material context in which it operates and the nature of the motivations and imagery of the people that practice it. The principal aim of this book is to develop and defend an analysis of the concept of moral obligation. The analysis is neutral regarding competing substantive theories of obligation, whether consequentialist or deontological in character. What it seeks to do is generate solutions to a range of philosophical problems concerning obligation and its application. Amongst these problems are deontic paradoxes, the supersession of obligation, conditional obligation, prima facie obligation, actualism and possibilism, dilemmas, supererogation, (...) and cooperation. By virtue of its normative neutrality, the analysis provides a theoretical framework within which competing theories of obligation can be developed and assessed. This study is a major contribution to metaethics that will be of particular interest to all philosophers concerned with normative ethical theory. (shrink)

We show that Carmo and Jones’ condition 5 conflicts with the other conditions on their models for contrary-to-duty obligations. We then propose a resolution to the conflict.

Argues that role obligations are not marginal, "that they are central to morality and should be taken seriously." "A 'role obligation' is a moral requirement, which attaches to an institutional role, whose content is fixed by the function of the role, and whose normative force flows from the role." Rejects what he calls the doctrine of perfect adequacy which holds that role obligations are both comprehensive and transparent. Although this may have been plausible at earlier times, it is clearly (...) implausible now. It is the implausibility of this doctrine which has led theorists to accept the standard view: which holds that role obligations that are noncontractual are extremely problematic. Once we reject the doctrine of perfect adequacy, however, we can see the significance of role obligations more clearly. [The content of role obligations, Hardimon admits, is indeterminate in the sense that it is subject to constructive interpretation. This suggests, however, that the obligations are not the source of their normative power, rather it is their justifying value which explains why some role requirements are obligatory. This is confirmed by the rest of the article.] One thing that should lead us to question the notion that we do not have obligations of this sort by considering what it would be like to have no noncontractual role obligations. [This, however, does not establish that the force of role obligations flows from the obligations themselves.] One objection to NCR obligations is that they may require acting in accordance with an unjust institution. However, the solution here is the same as with contractual obligations: unjust institutions and contracts do not bind. Moves on to identity. "What I am assuming is that most of us do at least tacitly conceive of ourselves as family members and citizens, that these self-understandings are central to our own general self-conception, and that we can, through reflection come to recognize that we do in fact conceive of ourselves in these ways. If this is correct, then abandoning the idea that we have noncontractual role obligations would require radical revision of our self-conception, for we cannot give up the idea of nonctractual role obligation without also ceasing to conceive of ourselves as family members and citizens. What, after all, would it mean to say that we conceive of ourselves as family members but regard oursleves as having no familial obligations whatsoever?...The upshot of the last two paragraphs is that the cost of abandoning our conception of ourselves as family members and citizens would be enormous." [The moral significance of identity is unclear here - is the only normative element loss of identity with rejection of role obligations? What of the case when one's identity is caught up in a role which requires one to act immorally in other ways?] If impressment is our concern, it shouldn't be, for role obligations are not like impressment - one is born into them, not impressed [how does this make a difference?]. Role must be reflectively acceptable to produce genuine obligations. "Determining whether a given social role is reflectively acceptable involves stepping back from that role in thought and asking whether it is a role people ought to occupy and play. Determining that a given social role is reflectively acceptable involves judging that it is meaningful, rational, or good." [Hence, some independent value is going to do all the work for role obligations - the normative force of a role does not flow from the role itself.] Concerning voluntary roles - even if we agree that voluntary acceptance is essential, this omits important elements of role identification. "The key component of the idea of identifying with a role is that of conceiving of oneself as someone for whom the norms, that is, the evaluative standards associated with a role, its rights, duties, virtues, ideals, and supererogations, have reason-giving force. Here is the idea. If you identify with a role, its norms will function for you as reasons. If you are a judge who identifies with the role of judge, the fact that this is something judges do will give you a reason for doing it." [Clearly a non-sequiter - conceiving of oneself as having a reason does not give oneself a reason for doing - there must actually be a reason for doing something. Moreover, the content of the role may be in question - and here we are to engage in constructive interpretation, which is just to say that we are to identify some underlying value and this will serve to justify and determine the content of the role. Refers to usage of "look, its your job" as basis for substantiating claims about the normative force of identity. "But here a basic point of similarity emerges between contractual and noncontractual role obligations. People can and do identify with their noncontractual roles and not just with their contractual roles. And when they do, assuming that the appropriate background moral conditions are in place, the fact taht they occupy these roles will provide them with reasons for carrying out the tasks of their noncontractual roles...The basic form of motivation provided by identification with contractual and noncontractual role obligations is the same.". If group members aim to fulfill a collective obligation, they must act in such a way that the composition of their individual actions amounts to a group action that fulfills the collective obligation. We study a strong sense of joint action in which the members of a group design and then publicly adopt a group plan that coordinates the individual actions of the group members. We characterize the conditions under which a group plan successfully coordinates the group members' (...) individual actions, and study how the public adoption of a plan changes the context in which individual agents make a decision about what to do. Shared Decision Making (‘SDM’) is one of the most significant developments in Western health care practices in recent years. Whereas traditional models of care operate on the basis of the physician as the primary medical decision maker, SDM requires patients to be supported to consider options in order to achieve informed preferences by mutually sharing the best available evidence. According to its proponents, SDM is the right way to interpret the clinician-patient relationship because it fulfils the ethical imperative of respecting (...) patient autonomy. However, there is no consensus about how decisions in SDM contexts relate to the principle of respect for autonomy. In response, I demonstrate that in order to make decisions about what treatment they will or will not receive, patients will be required to meet different conditions depending on the approach proponents of SDM take to understanding personal autonomy. Due to the fact that different conceptions of autonomy yield different obligations, I argue that if physicians and patients satisfied all the conditions described in standard accounts of SDM, then SDM would undermine patient autonomy. Our moral obligations can sometimes be collective in nature: They can jointly attach to two or more agents in that neither agent has that obligation on their own, but they – in some sense – share it or have it in common. In order for two or more agents to jointly hold an obligation to address some joint necessity problem they must have joint ability to address that problem. Joint ability is highly context-dependent and particularly sensitive to shared (...) (or even common) beliefs. As such, joint ability can be deliberately generated in a given collection of agents by providing information related to collective goals and contributory actions. As moral agents, we regularly face problems wherein the outcome of our actions depends on how others choose. There are two ways of deliberating about our own choices in such cases. We can either think of our choices as best responses to others’ choices (I-mode reasoning). Or we can think of our own choices as contributions to the collectively best option (even when we do not know how others are (likely) to choose) (we-mode reasoning). In deliberating about the right (individual) course of action vis-à-vis collective action problems, agents regularly we-frame the case at hand, that is, they include options in their deliberation that are only collectively available, and they we-reason with regard to their individual contributory actions. It is a necessary condition for collective obligations that potential collaborators facing a joint necessity case have grounds to privilege we-reasoning over reasoning in I-mode. (shrink)

When Derek Parfit in Reasons and Persons, examined whether the Non-Identity Problem could be solved with the Impersonal Total Principle, he assumed perfect equality in the future population outcomes under his consideration. His thinking was that this assumption could not distort his reasoning, but would make it more simple and clear. He then reasoned that the best future population outcome, according to the Impersonal Total Principle, would be an enormous population, whose members have lives only barely worth living, as a (...) slight lowering in quality of life, according to the principle, can always be more than compensated for by an increase in the number of future people. He found this result impossible to believe and dubbed it the Repugnant Conclusion, concluding that his attempts had ended in failures and that the Non-Identity Problem continues to undermine our beliefs of our obligations to the future. The purpose of this paper is to examine the implications of the Impersonal Total Principle in real-world circumstances where the inevitability of inequality is taken into account. What, if anything, will this imply regarding the Repugnant Conclusion, the indirect version of the Non-Identity Problem and our abilities to ground our moral responsibilities to posterity in an ethical theory? First, the paper argues that there are conditions under which TNCs have obligations to fulfill a limited duty of assistance toward those living in developing economies, even though the duty is normally understood to fall on the governments (...) of developed economies. Second, by extending Rawls’s account to include a right to protection against arbitrary interference, the paper argues that TNCs can be said to have negative and positive obligations in the areas of human rights, labor standards, and environmental protection, as outlined in the U.N. Conditional logics were originally developed for the purpose of modeling intuitively correct modes of reasoning involving conditional—especially counterfactual—expressions in natural language. While the debate over the logic of conditionals is as old as propositional logic, it was the development of worlds semantics for modal logic in the past century that catalyzed the rapid maturation of the field. Moreover, like modal logic, conditional logic has subsequently found a wide array of uses, from the traditional (e.g. counterfactuals) to the (...) exotic (e.g. conditional obligation). Despite the close connections between conditional and modal logic, both the technical development and philosophical exploitation of the latter has outstripped that of the former, with the result that noticeable lacunae exist in the literature on conditional logic. My dissertation addresses a number of these underdeveloped frontiers, producing new technical insights and philosophical applications. -/- I contribute to the solution of a problem posed by Priest of finding sound and complete labeled tableaux for systems of conditional logic from Lewis' V-family. To develop these tableaux, I draw on previous work on labeled tableaux for modal and conditional logic; errors and shortcomings in recent work on this problem are identified and corrected. While modal logic has by now been thoroughly studied in non-classical contexts, e.g. intuitionistic and relevant logic, the literature on conditional logic is still overwhelmingly classical. Another contribution of my dissertation is a thorough analysis of intuitionistic conditional logic, in which I utilize both algebraic and worlds semantics, and investigate how several novel embedding results might shed light on the philosophical interpretation of both intuitionistic logic and conditional logic extensions thereof. -/- My dissertation examines deontic and connexive conditional logic as well as the underappreciated history of connexive notions in the analysis of conditional obligation. The possibility of interpreting deontic modal logics in such systems (via embedding results) serves as an important theoretical guide. A philosophically motivated proscription on impossible obligations is shown to correspond to, and justify, certain (weak) connexive theses. Finally, I contribute to the intensifying debate over counterpossibles, counterfactuals with impossible antecedents, and take—in contrast to Lewis and Williamson—a non-vacuous line. Thus, in my view, a counterpossible like "If there had been a counterexample to the law of the excluded middle, Brouwer would not have been vindicated" is false, not (vacuously) true, although it has an impossible antecedent. I exploit impossible (non-normal) worlds—originally developed to model non-normal modal logics—to provide non-vacuous semantics for counterpossibles. I buttress the case for non-vacuous semantics by making recourse to both novel technical results and theoretical considerations. (shrink)

End-of-life medical decision making presents a major challenge to patients and physicians alike. In order to determine whether it is ethically justifiable to forgo medical treatment in such scenarios, clinical data must be interpreted alongside patient values, as well as in light of the physician's ethical commitments. Though much has been written about this ethical issue from religious perspectives , little work has been done from an Islamic point of view. To fill the gap in the literature around Islamic bioethical (...) perspectives on the matter, we derive a theologically rooted rubric for goals of care. We use the Islamic obligation for Muslims to seek medical treatment as the foundation for determining the clinical conditions under which Muslim physicians have a duty to treat. We next link the theological concept of accountability before God to quality-of-life assessment. Using this construct, we suggest that a Muslim physician is not obligated to maintain or conti..
