The Concept of Law is the most important and original work of legal philosophy written this century. First published in 1961, it is considered the masterpiece of H.L.A. Hart's enormous contribution to the study of jurisprudence and legal philosophy. Its elegant language and balanced arguments have sparked wide debate and unprecedented growth in the quantity and quality of scholarship in this area--much of it devoted to attacking or defending Hart's theories. What is the nature of consciousness? How is consciousness related to brain processes? This volume collects thirteen new papers on these topics: twelve by leading and respected philosophers and one by a leading color-vision scientist. All focus on consciousness in the "phenomenal" sense: on what it's like to have an experience. Consciousness has long been regarded as the biggest stumbling block for physicalism, the view that the mind is physical. The controversy has gained focus over the last few decades, and (...) phenomenal knowledge and phenomenal concepts--knowledge of consciousness and the associated concepts--have come to play increasingly prominent roles in this debate. Consider Frank Jackson's famous case of Mary, the super-scientist who learns all the physical information while confined in a black-and-white room. According to Jackson, if physicalism is true, then Mary's physical knowledge should allow her to deduce what it's like to see in color. Yet it seems intuitively clear that she learns something when she leaves the room. But then how can consciousness be physical? Arguably, whether this sort of reasoning is sound depends on how phenomenal concepts and phenomenal knowledge are construed. For example, some argue that the Mary case reveals something about phenomenal concepts but has no implications for the nature of consciousness itself. Are responses along these lines adequate? Developing tools is a crucial aspect of experimental practice, yet most discussions of scientific change traditionally emphasize theoretical over technological change. To elaborate on the role of tools in scientific change, I offer an account that shows how scientists use tools in exploratory experiments to form novel concepts. I apply this account to two cases in neuroscience and show how tool development and concept formation are often intertwined in episodes of tool-driven change. Although philosophical approaches to the self are diverse, several of them are relevant to cognitive science. First, the notion of a 'minimal self', a self devoid of temporal extension, is clarified by distinguishing between a sense of agency and a sense of ownership for action. To the extent that these senses are subject to failure in pathologies like schizophrenia, a neuropsychological model of schizophrenia may help to clarify the nature of the minimal self and its neurological underpinnings. Second, there is (...) good evidence to suggest that although certain aspects of the minimal self are primitive and embodied, other aspects may be accessed only in reflective consciousness. Employing a modified concept of the minimal self, it may be possible to construct a robotic form of non-conscious self-reference that depends on an interaction between the robotic body and its environment. In contrast to the minimal self, the narrative self involves continuity over time and is directly relevant to discussions of memory and personal identity. There is growing consensus among philosophers and cognitive scientists about the importance of narrative and its relation to episodic memory and left-hemisphere functions. There are, however, at least two different views of how the narrative self is structured. On one model it is nothing more than an abstract point. On a more extended view, proposed here, the self is a rich amalgam of narratives that allows for the equivocations, contradictions, and self-deceptions of personal life. The debate about concepts has always been shaped by a contrast between subjectivism, which treats them as phenomena in the mind or head of individuals, and objectivism, which insists that they exist independently of individual minds. The most prominent contemporary version of subjectivism is Fodor's RTM. The Fregean charge against subjectivism is that it cannot do justice to the fact that different individuals can share the same concepts. Proponents of RTM have accepted shareability as a 'non-negotiable constraint'. At the same (...) time they insist that by distinguishing between sign-types and -- tokens the Fregean objection cannot just be circumvented but revealed to be fallacious. My paper rehabilitates the Fregean argument against subjectivism. The RTM response rests either on an equivocation of 'concept'--between types which satisfy the non-negotiable constraint and tokens which are mental particulars in line with RTM doctrine--or on the untenable idea that one and the same entity can be both a shareable type and hence abstract and a concrete particular in the head. Furthermore, subjectivism cannot be rescued by adopting unorthodox metaphysical theories about the type/token and universal/particular contrasts. The final section argues that concepts are not representations or signs, but something represented by signs. Even if RTM is right to explain conceptual thinking by reference to the occurrence of mental representations, concepts themselves cannot be identical with such representations. (shrink)
This paper explores the nature of the concept of truth. It does not offer an analysis or definition of truth, or an account of how it relates to other concepts. Instead, it explores what sort of concept truth is by considering what sorts of thoughts it enables us to think. My conclusion is that truth is a part of each and every propositional thought. The concept of truth is therefore best thought of as the ability to token (...) propositional thoughts. In addition to thin concepts like the good, the bad and the ugly, our evaluative thought and talk appeals to thick concepts like the lewd and the rude, the selfish and the cruel, the courageous and the kind -- concepts that somehow combine evaluation and non-evaluative description. Thick concepts are almost universally assumed to be inherently evaluative in content, and many philosophers claimed them to have deep and distinctive significance in ethics and metaethics. In this first book-length treatment of thick (...) concepts, Pekka Väyrynen argues that all this is mistaken. Through detailed attention to the language of thick concepts, he defends a novel theory on which the relationship between thick words and evaluation is best explained by general conversational and pragmatic norms. Drawing on general principles in philosophy of language, he argues that many prominent features of thick words and concepts can be explained by general factors that have nothing in particular to do with being evaluative. If evaluation is not essential to the sort of thinking we do with thick concepts, claims for the deep and distinctive significance of the thick are undermined. There is a variety of concepts of the divine in the eastern and western theological and philosophical traditions. There is, however, not enough reflection on the logic behind concepts of God and their justification. I clarify some necessary and sufficient conditions any attempt to explicate a concept of God has to take into account. I argue that each concept of God is a cypher for a particular worldview and distinguishes three types of justification frequently used to bestow content (...) on particular concepts of God: philosophical, theological, and scientific. I turn to four fundamental models of the God–world relation and argue that the most promising concept of God is panentheistic, on which the universe is essentially divine but is not exhaustive of the divine being. Human beings shape the landscapes of their individual, social, and political lives entangled in a web of language. Everything that human beings do, the way they act and think, is shaped by the use of language. Charles Taylor explores these anthropological dimensions of language. A number of authors have argued recently that the content of perceptual experience can, and even must, be characterized in conceptual terms. Their claim, more precisely, is that every perceptual experience is such that, of necessity, its content is constituted entirely by concepts possessed by the subject having the experience. This is a surprising result. For it seems reasonable to think that a subject’s experiences could be richer and more fine-grained than his conceptual repertoire; that a subject might be able, (...) for example, to discriminate in experience more shades of colors than he has color concepts. The key move in their argument, therefore, is to articulate the conceptual content of experience using demonstrative, instead of general, concepts. For instance, these authors argue that the content of my perceptual experience of a particular shade of green is properly characterized in terms of the concept expressed by the linguistic utterance “that shade”. Even if I don’t possess a general concept for the shade I’m seeing—a concept of the kind typically expressed using color names like ‘chartreuse’ or ‘lime’—nevertheless, these authors argue, the content of the experience can still be characterized conceptually using a demonstrative concept that I do possess. I discuss Edouard Machery’s claim that philosophers and psychologists when using the term ‘concept’ are really theorizing about different things. This view is not new, but it has never been developed or defended in detail. Once spelled out, we can see that Machery is right that the psychological literature uses a different notion of concept. However, Machery fails to acknowledge that the two notions are not only compatible but complementary. This fits more with the traditional view according to (...) which philosophers and psychologists are merely interested in different aspects of the same kind. The main aim of this paper is then to show how precisely the two notions of ‘concept’ relate. Distinguishing them resolves the long-standing debate on whether concepts can be prototypes and allows me to formulate success conditions of a theory of categorization that are independent of the success conditions of a theory of concepts. BackgroundObstetrics and gynaecology always has reputation for being a highly litigious. The field of obstetrics and gynaecology is surrounded by different circumstances that stimulate the doctors to practice defensive medicine.MethodsThis study was directed to assess the extent and the possible effect of defensive medicine phenomenon on medical decision making among different grades of obstetric and gynaecologic Sudanese doctors, and to determine any experience of medical litigations with respect to sources and factors associated with it.ResultsA total of 117 doctors were approached, (...) their distribution according to job description was as follow: consultants registrars and specialists. The majority 89.7 % had the impression that litigation against doctors are increasing and 27.6 % had a direct experience of litigation. In this study less than one half of the surveyed doctors knew the concept of defensive medicine and 71.8 % reported practicing one or another form of defensive medicine. The different sources of the litigations reported by the doctors included: maternal death, perinatal death, other {misdiagnosis, intra-uterine fetal death, uterine perforation, rupture uterus}, fetal distress, injury to viscera and shoulder dystocia. In this study the experience of medical litigation was significantly observed among those who worked in area of blame culture. In logistic regression model, there was no significant difference between those who knew the concept of defence medicine and those who didn’t.ConclusionThere should be strategic plan to reduce the practice of defensive medicine and medical litigation against doctors.
