This lawsuit threatens to unravel of one of the most significant opportunities to improve public health in United (...) States history. Innovative theories and policy proposals originating in the economics profession have diffused globally over the past several decades, but these models and policy programs transform as they spread. Existing models of change based on the concept of “paradigm shifts” capture the transformation of the economics profession at a high level of abstraction, but analysis of more concrete policy changes and associated ideas requires developing theory at a lower level of abstraction. I propose a field theoretic model of change based on (...) the concept of cycles of polarization and settlement. According to this model, settlements are characterized by multiple cross-cutting axes of competition and debate in a professional field. Moments of contention emerge when field entrepreneurs successfully build professional movements, resulting in polarization. However, contention is episodic and followed by the emergence of “centripetal forces” which lead a gradual return to the center. I develop this model by examining the case of monetary economics and policy in Latin America, a critical case for studies of the policy influence of economic ideas and experts. (shrink)

This study contributes to understanding stakeholder engagement strategies by examining competitive responses alongside sociopolitical implications after a major exogenous shock—the 1998 Master Settlement Agreement (MSA) between the “Big Four” U.S. tobacco firms and 46 state attorneys general. We compare the different stakeholder engagement strategies of the two remaining U.S. tobacco manufacturers, Philip Morris (PM) and R. J. Reynolds (RJR), between 1998 and 2017. Implications for stakeholder theory from a relatively rare natural experiment highlight the importance of simultaneously managing multiple (...) stakeholders, inclusive of domestic and international sociopolitical and value chain stakeholders over time, for sustained value creation. Although PM and RJR initially pursued heterogeneous strategies by re-configuring relationships with relevant stakeholders, each firm’s growth prospects for the first decade post-MSA were exacerbated by various stakeholders through withholding and selective engagement strategies. Implications for how multiple, simultaneous stakeholder relationships can serve as important resources for achieving or limiting sustained growth are discussed. (shrink)

With the end of the Cold War, political and ideological competition has decreased as a stated reason for space exploration. The possibility of establishing a settlement on Mars is being seriously evaluated by state and commercial space agencies, which includes objectives to expand human civilization and ensure the continuity of the human species. The technological challenges associated with space settlement continue to receive significant attention, but the success of space settlement will also depend on other human factors. (...) This study presents a high-level overview of some potential issues that could arise with the development of a permanent populationand a space economyon Mars. This study highlights some of the anticipated problems of overnance, trade, production, and proliferation that will need pragmatic solutions to ensure the sustainability of a martian settlement. An instrument of wealth accumulation and racial segregation in housing markets, the intersections between zoning and labor are often overlooked. Extending theories of space, race, and class, and drawing on historical and archival evidence, I elaborate three ways that American land-use zoning emerged to shape labor markets in the early 20th century: (1) zoning constrained households from engaging in subsistence and direct market activity, acting as a regulatory source of labor commodification; (2) zoning first emerged as a xenophobic tool for (...) regulating labor competition; and (3) zoning introduced racialized boundaries distinguishing formal work from a sphere of economic informality. I illustrate these theoretical-historical propositions with a study of the frontier origins of American land-use zoning laws in late-19th -century Los Angeles. This first and influential approach to residential zoning emerged amid racial dynamics of western settlement and the class politics of a national “free” labor market. I demonstrate how efforts to regulate the settlement and labor practices of poor urban households and Chinese immigrants on in Los Angeles became the direct legal basis for the dichotomous categories of “residential” and “industrial” districts that the city first defended before the U.S. Supreme Court in 1915. By theorizing the intersections of land-use zoning and labor markets, this paper provides a theoretical framework and historical genealogy for future work to consider entanglements of housing and labor politics amid the concurrent flexibilization of work and land use in the present. Since the 1980s, there has been a significant increase in the number of studies concerning Andalusian rural settlements linked to irrigated agriculture, both related to large suburban green belts and to small hydraulic systems. In the vast areas where water is scarce, the settlement apparently would have been concentrated in cities and fortified towns, leaving without population most of the dry lands between them. However, thanks to the intensive survey of one of these regions, La Mancha’s Southeastern area, we (...) are recording a dense rural settlement corresponding to a pattern unknown until now. It consists basically of small villages in plain, devoid of community defense elements, which must have been inhabited by humble peasants, judging by the modesty of the architecture and domestic goods. Surely they make use of the scanty natural resources, which have traditionally oriented the economy of the region towards livestock and rainfed agriculture. In particular, the studied settlement would be related to the demand of wool for the export oriented textile production of the region, within the framework of the commercial expansion of that period. Apparently, most of those villages could have appeared in the eleventh century, disappearing in the middle of the thirteenth century because of the Christian conquest. Their existence would be associated with a general context of population growth that pushed the competition between urban elites and peasants pursuing the privileged agricultural areas, as well as the colonization of less favorable production areas. The importance of the specifi relationship between the US and the EU is determined by the role they play in solving international problems. The purpose of the article is to study the impact of common and distinctive position in US and EU foreign policy on the development of their relations and ability to effectively solve the world’s problems. At the beginning of the XXI century relations between the US and the EU have been developing in various spheres of foreign policy. (...) The priorities were security cooperation, the fiht against international terrorism and the development of economic relations. US and EU are mutually benefiial and priority partners for each other. This is determined in the foreign policy instruments of the United States and the European Union. However, this does not preclude the existence in the United States and the European Union different approaches to solving international problems and competition between them. The biggest differences between the US and the EU are shown in approaches to the settlement of military conflcts, the fiht against global warming and the greenhouse effect. The largest component of competitive relations is manifested in the development of the Arctic region. The US seeks to engage the EU foreign policy implementation taking into account American interests. However, at the beginning of the XXI century the EU had its own foreign policy program. The EU has an unhappy tendency towards US methods of solving world problems and unilateral actions in the international arena. The bipolar system was dominated by bilateral cooperation between the US and individual states of the European Union, but during the presidency of Barack Obama, the United States prefer relations with European politicians who represent the agreed position of 28 EU member states. The US in implementing its foreign policy should take into account the position of individual states and the European Union as a whole entity. This affects the process of solving international problems. Despite the existence of contradictions in the relations of the United States and the European Union, cooperation will continue to contribute to this long-term relationship, similarities in approaches to building political and economic systems and similarities in mentality. Small cities have a unique socio-economic and cultural potential for developing Russian regions, which is manifested in their unique features: com- pactness, historical heritage, the existence of rare industries and the local economy. At the same time, today in Russia the realization of their potential is primarily hindered by the existing system of politi- cal institutions and practices. The purpose of the work is to analyze the economic potential of small cities. The paper explores the potential for the devel- opment (...) of small cities in relation to the Russian context. So, the authors consider the features of small cities and highlight their economic, social and political problems. As illustrated by the successful ones, the potential of small cities in various sectors of the economy (primary, secondary and tertiary) is analyzed. The practical significance of the study lies in the possibility of using the studied experi- ence in developing the potential of small cities in various sectors of the economy in the practice of Russian management. As a result, it is concluded that small cities as such can be economically and socially efficient settlements, that is, they can be a completely competitive urbanized unit. However, the tools for the development of such territories should be focused on supporting the promising areas of development, providing an opportunity for independent and responsible development. Introduction. The article highlights the role and trends of urban development in a single regional space. The authors consider the industrial region, where the economic centers are the cities of monospecialization (metallurgy, mechanical engineering), which form the settlement framework of the regional economic system. At the same time, the connectivity of the regional space was determined by the contacts of cities in infrastructure areas and the possibilities of agglomeration formations. The authors analyze the urban environment of cities in the (...) region, which revealed common problems for them in organizing urban space. It was shown that the competition of cities for a person can be won by offering the population more comfortable working and living conditions, a variety of social services, and the possibility of using agglomeration effects. Scientific novelty of the research. The peculiarity of the author’s research was a new approach to urbanization as an urban way of life, extended to a set of cities of different status and population in the region. At the same time, the zones of attraction and concentration of business and social activity were connected with large cities and centers of agglomerations of the region, which ensure the joint use of resources, transport, and social infrastructure. The purpose of the article is to Identify constraints and opportunities for developing cities in a single regional space, taking into account their connectivity and interaction. Methods. The authors use the information base: statistical data, scientific literature, and expert assessments to clarify the conceptual tools of the research and to analyze the demographic situation in the cities-centers of agglomeration associations of the region. The authors present the assessment of the state of the urban environment, and reveal the disproportions in its organization. The research approaches are tested on the example of the cities of the Chelyabinsk region. (shrink)

This article reviews the contribution of media institutions to modernity and its wider institutional arrangements. It will consider how this relationship has normally been conceived, even mythified, and then, in its second half, review how the institutions that we now call ‘media’ are, potentially, disrupting, even deranging, modernity’s arrangements in profound ways. The article will suggest that, under conditions of increased complexity and radically transformed market competition, the changing set of institutions we call ‘media’ demand a major reinterpretation of how (...) modernity ‘works’ through institutional concentration. The first main section reviews in schematic terms the role which media institutions (the press, radio, television, film, but also infrastructural media such as the telegraph) played in the institutional development of modernity from the late 18th century, stabilising the circulation of information and contributing to the freedom associated with modernity, but in the course of this installing a ‘myth of the mediated centre’. The second section will review how this traditional settlement between media and modernity is now being deranged. This goes beyond the globalization of modernity and the complexification of culture landscapes through media and time-space compression. It is a matter, more fundamentally, of a change in the conditions under which media institutions exist and are able to ‘centralize’ communications flows. Today, communications are becoming centralised less through the production and circulation of elaborate media contents at/from global/national centres throughout the social domain (funded through audience-based advertising or state subsidy) and more through the stimulation to/from everywhere of symbolic interactions within a global information space (the internet, and its related apparatus) funded by the collection and sale of data ‘exhaust’ generated by those interactions. The result, paradoxically, is likely to be an increasing destabilisation of many traditional institutions of modernity, and the normalisation of unfreedom through continuous surveillance, undermining the legitimacy of institutional arrangements on which modernity has conventionally relied. Phylogeography and zooarchaeology are largely separate disciplines, yet each interrogates relationships between humans and commensal species. Knowledge gained about human history from studies of four commensal rats (Rattus rattus, R. tanezumi, R. exulans, and R. norvegicus) is outlined, and open questions about their spread alongside humans are identified. Limitations of phylogeographic and zooarchaeological studies are highlighted, then how integration would increase understanding of species’ demographic histories and resultant inferences about human societies is discussed. How rat expansions have informed the understanding (...) of human migration, urban settlements, trade networks, and intra‐ and interspecific competition is reviewed. Since each rat species is associated with different human societies, they identify unique ecological and historical/cultural conditions that influenced their expansion. Finally, priority research areas including nuclear genome based phylogeographies are identified using archaeological evidence to understand R. norvegicus expansion across China, multi‐wave colonization of R. rattus across Europe, and competition between R. rattus and R. norvegicus. Argument is a critical component in policy deliberations. In this study, negotiation is viewed as a type of policy deliberation, one characterized by attack and defense of proposals, interdependence between disputants, and mixed motives of cooperation and competition. Argument in negotiation, then, functions as a reason-giving activity to enact policy. Employing a category system based on rhetorical stasis, the researchers examine whether bargainers specialize in their use of argument types and whether this specialization remains consistent throughout a teacher-school board negotiation (...) and whether it differs for the type of settlement of agenda items. Results of the study suggest that bargainers specialize in argument types at different times during the bargaining. In the early stages of negotiation, teachers center on harm and workability arguments to prepare their case and justify the merits of their proposals, but in the latter phases of bargaining they switch to arguments on implementation to reaffirm their demands and to prioritize issues. Board members, in the early stages, rely on disadvantage, workability, and implementation arguments to establish resistance points and to refute appeals for change, but in the latter stages of negotiation they employ harm-inherency and disadvantage arguments to weigh the costs of concessions and to rationalize the settlement. This study, then, supports the existence of phase variation in bargaining and argues for a developmental approach in deciphering how negotiators who hold antithetical positions reach mutually satisfactory settlements. This article recounts the backlash against the neoliberal constitutionalism that locked in free trade and capital rights through the multilateral treaty organizations of the 1990s. It argues that we can find important forces in the disruption of the status quo among the elite losers of the 1990s settlement. Undercut by competition from China, the US steel industry, in particular, became a vocal opponent of unconditional free trade and a red thread linking all of Trump’s primary advisers on matters of (...) trade. Steel lobbyists themselves helped frame a critique of actually existing neoliberal globalism, which Trump both adopted and acted on as part of his trade war. By searching for the contemporary attack on neoliberal constitutionalism among the disgruntled corporate elite, we find that our current crisis must be framed as a backlash from above as well as one from below. This article discusses two normative questions raised by cases of colonial settlement. First, is it sometimes wrong to migrate and settle in a previously inhabited land? If so, under what conditions? Second, should settler countries ever take steps to undo wrongful settlement, by enforcing repatriation and return? The article argues that it is wrong to settle in another country in cases where one comes with intent to colonize the population against their will, or one possesses an adequate territorial (...) base somewhere else, lacks an urgent interest in moving, and seeks to settle in a new place under conditions where settlement would severely harm the practices of prior occupants. It also argues for a presumption of repatriation and return in the first generation of wrongful settlement and holds that these remedies may be extended to second and higher generations in some – but not all – cases. In earlier articles, the author developed what is known as the "Supersession Thesis," asserting that historic injustice may be overtaken by changes in circumstances so that a situation that was unjust when it was brought about may coincide with what justice requires at a later time. The Supersession Thesis was developed initially as a tool for considering historic injustice suffered by indigenous peoples in the European settlement of countries like Australia, Canada, New Zealand, and the United States. In this (...) paper, the author explores the application of the Supersession Thesis to issues about the Palestinian right of return and also to Israeli settlements in the Occupied Territories. The paper argues that, while it is not unthinkable that the Supersession Thesis might eventually legitimize the settlements and undermine the Palestinian right of return, there is no guarantee that this will happen. The application of the Supersession Thesis does not depend on the passage of time, but on changes in circumstances that a theory of justice makes relevant. Many of the circumstances that make the Supersession Thesis relevant to the post-colonial situations described do not apply in the Israeli situation. Nevertheless, it is worth considering the possibility of applying the Supersession Thesis in this case, because it enables us to assess the merits of the Thesis more sharply in relation to injustice that is taking place now, as opposed to injustice that took place in the nineteenth century. Games have a complex, and seemingly paradoxical structure: they are both competitive and cooperative, and the competitive element is required for the cooperative element to work out. They are mechanisms for transforming competition into cooperation. Several contemporary philosophers of sport have located the primary mechanism of conversion in the mental attitudes of the players. I argue that these views cannot capture the phenomenological complexity of game-play, nor the difficulty and moral complexity of achieving cooperation through game-play. In this paper, I (...) present a different account of the relationship between competition and cooperation. My view is a distributed view of the conversion: success depends on a large number of features. First, the players must achieve the right motivational state: playing for the sake of the struggle, rather than to win. This article explores governance issues in an area of limited statehood characterized by the combination of state and indigenous institutions. This is done by adopting an institutional lens focusing on three factors—field structures, institutional logics, and actor agency—to analyze governance settlements. The results point to how complex governance settlements in areas of limited statehood hold together with a certain degree of alignment between institutional elements. However, as the field evolves, contestations and misalignments lead to changes in governance settlements. Analyzing these (...) transitions, this study identifies three key processes that have facilitated deeper state penetration in the field, namely, delocalization of field structures, hybridization of institutional logics, and diversification of actor agency. The authors examined cue competition effects in young children using the blicket detector paradigm, in which objects are placed either singly or in pairs on a novel machine and children must judge which objects have the causal power to make the machine work. Cue competition effects were found in a 5- to 6-year-old group but not in a 4-year-old group. Equivalent levels of forward and backward blocking were found in the former group. Children's counterfactual judgments were subsequently examined by asking (...) whether or not the machine would have gone off in the absence of I of 2 objects that had been placed on it as a pair. Cue competition effects were demonstrated only in 5- to 6-year-olds using this mode of assessing causal reasoning. (shrink)

Competition plays a substantial and structural role in philosophy today. It is therefore remarkable that it has received little systematic ethical scrutiny in the literature until now. This paper aims to contribute to establishing a discussion about competition in the discipline of philosophy by arguing (i) that philosophy is not inherently competitive and (ii) that competition tends to corrupt the practice of philosophy. Regarding (i), I argue that philosophy can best be understood as a cooperative endeavour. The idea that philosophy (...) is a matter of competitive adversarial argumentation impedes philosophers from achieving what philosophy is all about, that is, realising what Alasdair MacIntyre calls ‘internal goods’: acquiring greater wisdom and knowledge and getting closer to the truth. I then show that a lot of the competition that characterises today’s practice of philosophy revolves around obtaining external goods, such as money, status, prizes and academic positions. While external goods are needed to sustain and regulate the practice of philosophy, competition for such goods also tends to corrupt the practice (ii), by which I mean that internal goods are seriously compromised. This, in turn, excludes prospective philosophers who are not ‘competitive’ enough, which is also a loss for philosophy generally. (shrink)

The aim of this paper is to elaborate on the phenomenological approach to expertise as proposed by Dreyfus and Dreyfus and to give an account of the extent to which their approach may contribute to a better understanding of how athletes may use their cognitive capacities during high-level skill execution. Dreyfus and Dreyfus's non-representational view of experience-based expertise implies that, given enough relevant experience, the skill learner, when expert, will respond intuitively to immediate situations with no recourse to deliberate actions (...) or mental representations. The paper will subsequently outline some implications and consequences of such an approach and will also examine to what extent Dreyfus and Dreyfus's skill model is capable to resist different attacks that have been made against their view, and in particular regarding the practical application of their approach to the skill domain of competitive sport. Zero-sum aspects of sport have generated a number of ethical concerns and a similar number of defenses or apologetics. The trick has been to find a middle position that neither overly gentrifies sport nor inappropriately emphasizes the significance of winning and losing. One such position would have us focus on the process of trying to win over the fact of having one. It would also ameliorate any harms associated with defeat by pointing out that benefits like achievement, excellence, and moral (...) development are available to winner and loser alike. Relying on the notion of ‘frame’ introduced by Polanyi, I argue that this approach underplays the poignant drama of sport (including the sting of defeat) and thus, seeks redemption at too high a cost. I argue for a version of red-blooded competition that is justified more by transcendence than mitigation, more by a willingness to play again tomorrow than civility during any single contest. I analyze sport in terms of its receptivity to such repetition and find that epistemological uncertainty, enhanced by the presence of chance in sport, renders repeat engagements both sensible and attractive. I conclude that sport verdicts, unlike outcomes in war, business, and love, do not settle things. Rather they invite both winner and loser alike to ‘play again tomorrow’. (shrink)

Hovevei Zion is a collective name for several societies established in Eastern Europe in the 19th century, advocating immigration to the land of Israel, settlement of the land and agricultural work. This article examines the religious approach of several prominent thinkers from among Hovevei Zion and the First Aliya, who shared the perception of farming and settling the land as having religious and even messianic meaning. It was clear to them that the Torah is the foundation of the Jewish (...) people's existence, however, to this they added another value - work. These thinkers strived to change the identity of the exilic Jew, who was occupied only with spiritual religious life and to reinstate the identity of the biblical Jew, who combined a spiritual and a material religious life. The article examines the approach of Hovevei Zion in light of the general rabbinic approach to redemption, settlement and agriculture and the social changes in 19th century Europe.CONTRIBUTION: This article contributes to the journal's multidisciplinary theological perspective, particularly the notion 'historical thought', which covers the textual and oral history and hermeneutical studies, narratives and philosophies behind the Abrahamic religions as expressed in the Hebrew Scriptures and the Rabbinic literature. In this paper, I consider the tutorial conversation in Higher Education. To focus the discussion I use the scenario of a tutorial conversation between a lecturer and a student. I begin by suggesting that the increasing emphasis placed on student satisfaction in certain Higher Education Institutions tends to focus the tutorial conversation towards a form of settlement that I then consider in light of Thoreau's Walden. To explore what other conversation might be possible, I turn to the philosophical writing (...) of Martin Buber. I discuss his ‘life of dialogue’ in relation to the distinction he draws between I and Thou and between I and It and to how Nancy Vansieleghem and Jan Masschelein analyse this in relation to the 2002 film, Le Fils. With reference to the film adaptation of Alan Bennett's The History Boys, I suggest a different starting point for the tutorial conversation. I conclude that the tutorial discussion, seen as an invitation to speak, and as a form of exposition and dialogue, is the possibility of the opening up of a new dimension of thinking and acting. This is the invitation to a conversation in education that is itself truly educative. (shrink)

This paper expands Rami Ali’s dissolution of the gamer’s dilemma (Ethics Inf Technol 17:267-274, 2015). Morgan Luck’s gamer’s dilemma (Ethics Inf Technol 11(1):31-36, 2009) rests on our having diverging intuition when considering virtual murder and virtual child molestation in video games. Virtual murder is seemingly permissible, when virtual child molestation is not and there is no obvious morally relevant difference between the two. Ali argues that virtual murder and virtual child molestation are equally permissible/impermissible when considered under different modes of (...) engagement. To this end, Ali distinguishes between story-telling gameplay and simulation games, discussing both in depth. I build on the dissolution by looking into competitive gameplay in order to consider what the morally relevant difference between virtual murder and virtual child molestation might be when competing in a video game. I argue that when competitors consent to participate in a competition, the rules of the competition supersede everyday moral intuitions. As such, virtual competitions ought to represent such consent from virtual characters. Virtual children cannot be represented as giving consent to be molested because (1) children cannot be represented as giving sexual consent, and (2) consent to be possibly molested cannot be given. This creates a morally relevant difference between murder and molestation. By fully addressing competitive gameplay, I answer Luck’s worry that Ali’s dissolution is incomplete (Ethics Inf Technol 20:157-162, 2018). (shrink)

In the article “Settlement on Lusignan Cyprus after the Latin Conquest: The Accounts of Cypriot and other Chronicles and the Wider Context” the narratives of various chronicles of the thirteenth to the sixteenth centuries on settlement in Cyprus in the years following the Latin conquest, from the end of the twelfth to the early thirteenth century, will be examined and compared. The details provided by the chronicles, where the information given derived from, the biases present in the various (...) accounts, the extent to which they are accurate, especially in cases where they are corroborated or refuted by documentary evidence, will all be discussed. The chronicles that will be referred to are the thirteenth century continuation of William of Tyre, that provides the fullest account of the settlement of Latin Christians and others on Cyprus after the Latin conquest, the fifteenth century chronicle of Leontios Makhairas, the anonymous chronicle of ‘Amadi’ that is probably dateable to the early sixteenth century although for the section on thirteenth century Cypriot history it draws on earlier sources and the later sixteenth century chronicle of Florio Bustron. Furthermore, the Chorogra a and the Description of Stephen de Lusignan, two chronicles postdating the conquest of Cyprus by the Ottoman Turks in 1570, will also be referred to on the subject of settlement in thirteenth century Cyprus. By way of comparison, the final part of the paper examined the extent to which the evidence of settlement in other Mediterranean lands derives chiefly from chronicles or from documentary sources. In conclusion, it can be stated that the various accounts of settlement on Cyprus following its cession to King Guy of Jerusalem in 1192 show differences in terms of the value of the fiefs, the geographical regions from which the settlers came and the types of properties which were granted to them. The Latin kingdom of Jerusalem resembles Cyprus in that the source material for early Latin settlement is narrative, not documentary. But this is not the case for the Venetian Crete and the Hospitaller Rhodes, where the source materials recording the arrival of the first Latin settlers are wholly documentary. (shrink)

The menace of conflicts and natural disasters in different states of the world had spiralled into a global phenomenon of Internally Displaced Persons. These are groups of humans who had helplessly drifted away from their natural and ancestral home due to conflicts and disasters but had not crossed international boundaries into another country. They merely take solace by the protection offered by the spirit and letters of relevant international laws which have domesticated by member states. This paper seeks to answer (...) the question regarding the extent to which the IDPs have become a menace in Nigeria. The paper reveals that many governments’ actions are the primary and the root cause of the IDPs while others are recipient of the domino effect. The paper relies on a panel data elicited from thirteen out of the thirty six states in Nigeria. The paper reveals the need for urgent measures by government to douse the upsurge in the number of IDPs. The political settlement analysis was used to proffer a better way of culminating the crises. Recommendations are directed to the individuals, civil societies and the government at all levels. (shrink)

Large‐scale patterns of correlated growth in development are partially driven by competition for metabolic and informational resources. It is argued that competition between organs for limited resources is an important mesoscale morphogenetic mechanism that produces fitness‐enhancing correlated growth. At the genetic level, the growth of individual characters appears independent, or “modular,” because patterns of expression and transcription are often highly localized, mutations have trait‐specific effects, and gene complexes can be co‐opted as a unit to produce novel traits. However, body parts (...) are known to interact over the course of ontogeny, and these reciprocal exchanges can be an important determinant of developmental outcomes. Genetic mechanisms underlie cell and tissue behaviors that allow organs to communicate with one another, but they also create evolutionarily adaptive competitive dynamics that are driven by physiological and biophysical processes. Advances in the understanding of competitive and closely related coordinative interactions across scales will complement existing research programs that emphasize the role of cellular mechanisms in morphogenesis. Study of the large‐scale order produced by competitive dynamics promises to facilitate advances in basic evolutionary and developmental biology, as well as applied research in fields such as bioengineering and regenerative medicine that aim to regulate patterning outcomes. The “Assyrian Century,” the period of Assyrian rule in the Levant, is usually regarded as an era of prosperity and economic progress. As far as the southern Levant is concerned, this reconstruction more or less reflects the reality on the southern edge of the region—in the areas of Philistia, Judah, and Edom. But what was the situation in the northern part of the country, in the territories of the former kingdom of Israel and adjacent territories, regions that had become Assyrian (...) provinces? It is the aim of this paper to scrutinize the archaeological data from these regions in order to shed light on the settlement and demographic reality in those provinces, and furthermore to reassess Assyrian policy in the west. After summarizing previous research, the article will present the available archaeological data, which will then be compared with that from the southern part of the country in order to enable a reexamination of the Assyrian empire’s policy in the west. In his canonical articles Against Settlement and The Forms of Justice, Owen Fiss argues that the erosion of civil litigation harms the deliberative process and the elucidation of public values in society. By revealing the hidden public dimension underlying not only public law litigation, but also the adjudication of private law disputes, Fiss’s argument can be conceptualized as posing a challenge to the public/ private distinction. At the same time, Fiss’s critique reinforces the public/private divide by placing settlement (...) and civil litigation on either side of the borderline. In this Article, we set out to dispel the prevalent depiction of settlement as inherently private, and to challenge the binary logic of the private/public distinction as it is understood to apply to settlement. We show how settlements have the capacity to fulfill each and every one of the public functions attributed to the civil trial, including the elaboration of norms, the discovery of facts, the facilitation of democratic participation, and the creation of public narratives. The functional, process-oriented approach we offer depicts settlement as a device that does not stand in opposition to the promotion of rule of law values - but rather as an institution that enhances the articulation of public norms. Our discussion progresses against the background of three settlement arenas: settlement in the classic civil suit context, structural reform suits, and transnational Holocaust litigation. (shrink)

The complexity and heterogeneity of causes influencing ecology’s domain challenge its capacity to generate a general theory without exceptions, raising the question of whether ecology is capable, even in principle, of achieving the sort of theoretical success enjoyed by physics. Weber has argued that competition theory built around the Competitive Exclusion Principle (especially Tilman’s resource-competition model) offers an example of ecology identifying a law-like causal regularity. However, I suggest that as Weber presents it, the CEP is not yet a causal (...) regularity. Instead, I argue that the scientific understanding in Tilman’s theory takes a different form. The theory explains through a structure I call “channeling explanation” which does not depend on deduction from general laws, but rather builds on constraints and trade-offs represented in state-space. Recognizing this structure supports the more general point that ecology and other so-called special sciences can reveal novel theoretical approaches to philosophy of science when approached with openness to their uniqueness. Affirmative action is standardly pursued in relation to admissions to prestigious universities, in hiring for prestigious jobs, and when it comes to being elected to parliament. Central to these forms of affirmative action is that they have to do with competitive goods. A good is competitive when, if we improve A’s chances of getting the good, we reduce B’s chances of obtaining the good. I call this Competitive Affirmative Action. I distinguish this from Non-competitive Affirmative Action. The latter has to (...) do with non-competitive goods, e.g., being granted early parole or freedom from arbitrary arrest. I argue that some of the most prominent objections against affirmative action—in particular, the reverse discrimination objection and the merit objection—speak less against Non-competitive Affirmative Action. And that some of the most prominent arguments in favor of affirmative action, insofar as they justify Competitive Affirmative Action, also justify Non-competitive Affirmative Action. (shrink)

The idea of the 'Australian settlement' has been normalized since its popularization by Paul Kelly into the Keating years. This essay responds further to existing discussion of the idea, including attempts to develop it by expanding its descriptive and analytic criteria. It argues for the pluralization of the idea of settlement, rather than for attempts to develop the 'Australian settlement' by adding further exhaustive detail. The real challenge, beyond the controversy, is the adequate specification of the conditions (...) of Australian modernity. Here the idea and institution of arbitration remains central. (shrink)

This chapter re-examines the evidence for local ecclesiastical and other burial sites in pre-Viking Ireland. It compares local churches and cemetery settlements in pre-Viking Ireland with those found in England and Wales. The chapter describes the density of the pre-Viking ecclesiastical sites in Ireland, church density and social structure in Anglo-Saxon England, and the local ecclesiastical sites in Cornwall and Wales.

In his latest work on the social consequences of religious commitment, Jay Newman reveals in clear and concise fashion the extent to which competitiveness is an essential feature of religious life. His assessment charts various classical strategies that have been proposed for either eliminating such competitiveness or directing it into appropriate channels. After a detailed philosophical analysis of the nature and value of competition, the author examines competition between denominations and within denominations, and considers religious competition in some (...) of its less obvious forms. In the process of evaluating the methods for curbing religious competition advocated by such thinkers as Spinoza and Lessing, as well as by modern ecumenists, the author points the way to a general approach to religious competition that minimizes destructive religious conflicts without ignoring the positive value of religious competition. In a recently published article I have suggested an amendment of the textual crux in Suetonius, Tiberius 21. 4 and an interpretation of the passage as providing direct evidence that the arrangement of the marriages of Germanicus and the younger Drusus was integral to Augustus' settlement of 26 June a.d. 4, even if they were not celebrated until early 5. This view differs from the more usual assumption that while the marriages took place in 5, the date of their (...) arrangement was not particularly significant, or from the possibility implied by Levick that Germanicus' marriage may have been arranged to placate the ‘faction’ of the elder Julia after the consolidation in 4 of the position of Livia's descendants. The more precise hypothesis that the marriages were intended as part of the settlement may help us to bring into sharper focus some of the political events of the next few years, and this article attempts to do so; in particular it looks at the internal balance of the settlement; the anomalous separate adoption of Agrippa Postumus; and the decline and fall of Agrippa Postumus and the younger Julia. Countering the claims that competition contradicts and undermines ethical thought processes and actions, Christoph Lütge successfully argues that competition and ethics do not necessarily have to oppose one another. He highlights how intensified competition can in fact work in favour of ethical goals, and that many criticisms of competition stem from an out-dated understanding of how modern societies and economies function.
