In 1985, Swiss legal philosopher Walter Ott visited Herbert Hart in Oxford and made this record of their meeting, which casts novel light on some of Hart’s ideas. Ott engaged Hart in a fresh encounter with the legal philosophy of Gustav Radbruch, particularly Hart’s and Radbruch’s reasons for a minimum content of justice in law. They also discussed the grudge informer, state responsibility under laws of an earlier régime, and questions of the definition and falsifiability of legal theories. Hart surprisingly (...) reported Hans Kelsen as stating, when they had met at Berkeley in 1961, that Hume (and not Kant, and certainly not Wittgenstein) was the greatest philosopher who had ever lived. Of all the major philosophical works, Kant's Critique of Pure Reason is one of the most rewarding, yet one of the most difficult. Norman Kemp Smith's Commentary elucidates not only textural questions and minor issues, but also the central problems which arise, he contends, from the conflicting tendencies of Kant's own thinking. Kemp Smith's Commentary continues to be in demand with Kant scholars, and it is being reissued here with a new introduction by Sebastian Gardner to set it in its (...) contemporary context. (shrink)

Reprint of the first edition. This incisive critique was written around 1807 by Tracy [1754-1836], a French philosopher and path-breaking psychologist who was a friend of Jefferson [1743-1826]. Jefferson saw the Commentary when it was still a manuscript and was so impressed that he took pains to have it printed. He even helped with the translation and corrected the page proofs. Although the translation was published anonymously, we can identify the author and translators through a letter by Jefferson dated January (...) 26, 1811. Elsewhere in this letter he commends it for correcting the Spirit of the Laws. While other studies had merely "nibbled only at its errors...This want is now supplied, and with a depth of thought, recision of idea, of language and of logic, which will force conviction into every mind. This commentary further explores some of the ethical issues raised by Prof. Peter Singer in his Lanson Lecture “Pandemic Ethics: Five Lessons”. In the first part, I distinguish a prioritarian approach to the allocation of scarce medical resources, from the utilitarian one advocated by Singer. I suggest that the prioritarian view better matches common intuitions about fair distribution, even though it likely needs to be balanced with other principles if it is to have plausibility in contexts like vaccine allocation. In (...) the second part of the commentary, I take a global perspective (as Singer himself does regarding the ethics of lockdowns), and highlight the controversial implications of adopting a fully cosmopolitan ethical outlook when deciding how to distribute Covid-19 vaccines. I also raise justice-related concerns about Singer’s proposal to use well-being as a single metric for evaluating public health policies. (shrink)

Foundational in its consideration of being and the transcendentals, the Metaphysics of Aristotle is a dense and difficult work on its own. This volume contains the first half of St. Thomas's commentary on the Metaphysics, beginning with discussing the views of Aristotle's predecessors and moving towards a discussion of being.

This study contributes substantially to research on Aristotelian logic in Byzantium. It includes a critical edition of the commentary by Leo Magentenos, the Metropolitan of Mytilene (twelfth c.?) on Book II of the Prior Analytics along with an edition of the syllogism diagram attributed to this work in the manuscript tradition of this work.

Ibn Wasil (d. 1298), perhaps better known today as a historian and an emissary to the court of King Manfred in southern Italy, was also an eminent logician. The present work is a critical edition of his main work in the field, a commentary on his teacher Khunaji's (d. 1248) handbook al-Jumal. The work helped consolidate the logic of the "later scholars" (such as Khunaji). It also shows that commentators did much more than merely explain the original work and instead (...) regularly discussed and assessed received views. Ibn Wasil's work was an influential contribution to a particularly dynamic chapter in the history of Arabic logic. (shrink)

A critical commentary on the article “The Epistemic Harms of Empathy in Phenomenological Psychopathology” by Lucienne Spencer and Matthew Broome (2023) is presented. The authors committed the “fallacy of ambiguous or vague definition” by incorrectly interpreting Karl Jaspers’ conceptualizations, resulting in difficulties following logical arguments and arriving at reasonable conclusions. To overcome this fallacy, the commentary provides conceptual clarifications regarding Jaspers’ empathic understanding (einfühlendes Verstehen), conceived as the foundational concept of his project to develop a phenomenologically oriented psychopathology. Jaspers initially (...) introduced this concept in the article “Die phänomenologische Forschungsrichtung in der Psychopathologie” [The Phenomenological Research Direction in Psychopathology], published in 1912, and extended in his magnum opus “Allgemeine Psychopathologie” [General Psychopathology], published in 1913. The volume collects the most important papers Pierluigi Donini wrote in the last three decades with the aim of promoting a better assessment of post-hellenistic philosophy. The philosophical relevance of post-hellenistic philosophy is now widely (though not yet universally) recognized. Yet much remains to be done. The common practice of focusing each single school in itself detracts from a balanced assessment of the strategies exploited by many philosophers of the period. On the assumption that debates among schools play a major (...) role in the philosophy of the commentators, Donini concentrates on the interaction between leading Aristotelians and Platonists and demonstrates that the developments of both systems of thought were heavily influenced by a continuous confrontation between the two schools.And whereas in cases such as Alcinous and Aspasius this is basically uncontroversial, for other authors such us Alexander, Antiochus and Plutarch the pioneering work of Donini paves the way for a better understanding of their doctrines and definitely confirms the intellectual importance of the first imperial age, when the foundations were laid of versions of both Aristotelianism and Platonism which were bound to influence the whole history of European thought, from Late Antiquity onwards. This is a commentary on Andrea Lavazza and Murilo Vilaça's article "Human Extinction and AI: What We Can Learn from the Ultimate Threat" (Lavazza & Vilaça, 2024). I discuss the potential concern that their proposal to create artificial successors to "insure" against the tragedy of human extinction might mean being too quick to accept that catastrophic prospect as inevitable, rather than single-mindedly focusing on avoiding it. I also consider the question of the value that we might reasonably assign to such (...) a future of artificial successors under the assumption that they do not enjoy phenomenal consciousness. Eine der wichtigen Autoritäten dieser Tradition stellt Leon Magentenos (12. Jh.?) dar. Magentenos war Metropolit von Mytilene sowie ein Gelehrter, der Kommentare zu allen sechs Traktaten des aristotelischen Organon (Categoriae, De Interpretatione, Analytica Priora, Analytica Posteriora, Topica, Sophistici Elenchi) verfasst hat. Hier wird die kritische Edition des Kommentars zum zweiten Buch der Ersten Analytik zusammen mit seiner Übersetzung ins Englische vorgelegt. Untersucht werden auch (...) die dem Kommentar angehängten syllogistischen Diagramme. Kommentare zu Analytica Priora II nach der Spätantike und vor Magentenos waren eher eine Rarität, daher ist sein Kommentar eine wichtige Quelle für alle Forscher, die sich mit der Geschichte der byzantinischen Logik und der aristotelischen Kommentierung befassen. This is the first book-length analysis of the techniques and procedures of ancient mathematical commentaries. It focuses on examples in Chinese, Sanskrit, Akkadian and Sumerian, and Ancient Greek, presenting the general issues by constant detailed reference to these commentaries, of which substantial extracts are included in the original languages and in translation, sometimes for the first time. This makes the issues accessible to readers without specialized training in mathematics or in the languages involved. Vatsyayana's Commentary on the Nyaya-sutra is one of classical India's most important philosophical works.

Moira Kloster suggests the frailty of argument across differences in circumstances of disagreement. My aim is to take a step back and consider what she takes to be the purpose of argumentative bridges. I explain my understanding of Kloster’s position that we must attend to the variable places that cooperation and trust have in argumentation, especially how these attitudes are sometimes institutionalized in such a way that a cooperative individual disposition becomes dysfunctional. Kloster’s considerations are quite sound for arguments in (...) the institutional contexts that concern her; her observation about the dependence of an argument’s value on the purpose of its institutional context is considered in light of further purposes that argumentation serves inside and outside of institutions. I agree that we need to consider how social contexts and institutions affect the various successes of argumentation, but I think we need to consider also the range of purposes that arguments and argument forums may have, what values they may support, and what interests they may serve.
