Rationale Treatment guidelines recommend a more conservative surgical approach than mastectomy for early stage breast cancer and a stronger emphasis on adjuvant therapy. Registry data at South Australian teaching hospitals have been used to monitor survivals and treatment in relation to these guidelines.Aims and objectives To use registry data to: (1) investigate trends in survival and treatment; and (2) compare treatment with guidelines.Methods Registry data from three teaching hospitals were used to analyse trends in primary courses of treatment of breast (...) cancers during 1977–2003 (n = 4671), using univariate analyses and multiple logistic regression. Disease-specific survivals were analysed using Kaplan–Meier product limit estimates and multivariable Cox proportional hazards regression.Results The 5-year survival was 79.9%, but with a secular increase, reaching 83.6% in 1997–2003. The relative risk of death (95% confidence limits) was 0.74 (0.62, 0.88) for 1997–2003, compared with previous diagnoses, after adjusting for tumour node metastasis stage, grade, age and place of residence. Treatment changes included an increase in conservative surgery (as opposed to mastectomy) from 51.7% in 1977–1990 to 76.8% in 1997–2003 for stage I (P < 0.001) and from 31.1% to 52.2% across these periods for stage II (P < 0.001). Adjuvant radiotherapy also became more common (P < 0.001), with 20.6% of patients receiving this treatment in 1977–1990 compared with 60.7% in 1997–2003. Radiotherapy generally was more prevalent when conservative surgery was provided, although also relatively common in mastectomy patients when tumour diameters exceeded 50 mm or when there were four or more involved nodes. The proportion of patients receiving chemotherapy increased (P < 0.001), from 19.6% in 1977–1990 to 36.9% in 1997–2003, and the proportion having hormone therapy also increased (P < 0.001), from 34.3% to 59.4% between these periods.Conclusions Survivals appear to be increasing and treatment trends are broadly consistent with guideline directions, and the earlier research on which these recommendations were based. The article presents a model of performative agency in capitalist societies. The first section reconsiders the problem of third-dimensional power as developed by Steven Lukes, focusing on the relationships between universal human needs and social forms. The second section uses the concepts of the ‘self’, ‘I’ and ‘person’ to characterize the relationships between human nature, affect, individual alienation, social institutions and personal judgement. Alienation is argued to be inherent in human agency, rather than being solely created by capitalism. The next (...) section applies this analysis within an agonal theory of civil society that is driven by the individual’s performative participation in associations that compete within institutional settings. Finally the article considers the political ramifications of this model, rejecting contemporary constitutionalist approaches in favour of a revised form of pluralist associationalism. Throughout, the article warns of the dangerous marginalization of emotions (or ‘affect’) by excessively self-conscious, rationalist approaches such as Mead’s social theory, liberal universalism and even some performative theories. Schopenhauer repeatedly claims that suicide is both foolish and futile. But while many commentators have expressed sympathy for his charge of foolishness, most regard his charge of futility as indefensible even within his own system. In this paper, I offer a defense of Schopenhauer’s futility charge, based on metaphysical and psychological considerations. On the metaphysical front, Schopenhauer’s view implies that psychological connections extend beyond death. Drawing on Parfit’s discussion of personal identity, I argue that those connections have personal significance, such (...) that suicide does not allow one, as Hamlet hopes, simply “not to be.” On the psychological front, I argue that a distinction between agents’ intentions and underlying desires makes room for Schopenhauer to claim that paradigmatic suicidal agents ultimately desire the opposite of what suicide accomplishes. I conclude by showing how the resulting account of futility can buttress the charge of foolishness as well. My interpretation still leaves Schopenhauer vulnerable to certain objections, but shows that his account is significantly more defensible than previous commentators have realized. (shrink)

One of our most original thinkers addresses the scientific world's premier question: What is the nature of consciousness?

Discussions of extended cognition have increasingly engaged with the empirical and methodological practices of cognitive science and psychology. One topic that has received increased attention from those interested in the extended mind is music cognition. A number of authors have argued that music not only shapes emotional and cognitive processes, but also that it extends those processes beyond the bodily envelope. The aim of this paper is to evaluate the case for extended music cognition. Two accounts are examined in detail: (...) Joel Krueger’s “musically extended emotional mind” and Tom Cochrane’s “expression and extended cognition.” Each account is evaluated using three “anti-extension” arguments. I argue that Krueger and Cochrane’s accounts offer important steps toward extended music cognition, but that each account remains underdeveloped in various ways. To supplement existing approaches, I propose a complementary extended computational approach to music cognition. The claim is that music cognition forms part of an extended system in virtue of involving computational processes that range across environmental and in-the-head elements. The paper concludes by showing how the ECMC deals with each of the three anti-extension challenges and responds to objections. (shrink)

Colin McGinn presents his latest work on consciousness in ten interlinked papers, four of them previously unpublished. He extends and deepens his controversial solution to the mind-body problem, defending the view that consciousness is both ontologically unproblematic and epistemologically impenetrable. He also investigates the basis of our knowledge that there is a mind-body problem, and the bearing of this on attempted solutions. McGinn goes on to discuss the status of first-person authority, the possibility of atomism with respect to consciousness, (...) extreme dualism, and the role of non-existent objects in constituting intentionality. He argues that traditional claims about our knowledge of our own mind and of the external world can be inverted; that atomism about the conscious mind might turn out to be true; that dualism is more credible the more extreme it is; and that all intentionality involves non-existent objects. These are all surprising positions, but he contends that what the philosophy of mind needs now is 'methodological radicalism' - a willingness to consider new and seemingly extravagant ideas. Kant makes a striking reference to Spinoza in the 1788 Critique of Practical Reason. This chapter begins by investigating whether Kant directly concerned himself with Spinoza, focusing on Omri Boehm's recent affirmative argument. Kant thinks the objective principle yields radical metaphysical conclusions only in conjunction with further claims about specific conditioning relations. Kant's privileging of Spinozism among realist views seems generally detached from Spinoza's actual thought. The chapter deals with points of convergence or near‐convergence between Kant and Spinoza. It identifies (...) two philosophically interesting points on which Spinoza's and Kant's views come surprisingly close: their arguments for the limitations of our sensory knowledge and their arguments for the timelessness of the mind. Spinoza's official argument for the timelessness of the mind appeals to his doctrines of the body's eternal essence, the parallel between bodies and ideas, and the identity of the human mind with God's idea of the human body. Moral relativism attracts and repels. What is defensible in it and what is to be rejected? Do we as human beings have no shared standards by which we can understand one another? Can we abstain from judging one another's practices? Do we truly have divergent views about what constitutes good and evil, virtue and vice, harm and welfare, dignity and humiliation, or is there some underlying commonality that trumps it all? These questions turn up everywhere, from Montaigne's essay on cannibals, (...) to the UN Declaration of Human Rights, to the debate over female genital mutilation. They become ever more urgent with the growth of mass immigration, the rise of religious extremism, the challenges of Islamist terrorism, the rise of identity politics, and the resentment at colonialism and the massive disparities of wealth and power between North and South. Recent years have seen a surge of interest in applying mechanistic thinking to computational accounts of implementation and individuation. One recent extension of this work involves so-called ‘wide’ approaches to computation, the view that computational processes spread out beyond the boundaries of the individual. These ‘mechanistic accounts of wide computation’ maintain that computational processes are wide in virtue of being part of mechanisms that extend beyond the boundary of the individual. This paper aims to further develop the mechanistic account of (...) wide computationalism by responding to two outstanding worries, what are called the parsimony and testability challenges. The first is based on considerations about wide computation’s ontological cost; the second the view’s experimental testability. The argument is that wide mechanistic computationalism can gain the necessary conceptual resources to address the challenges by embracing two further aspects of the mechanistic approach: i) the structural aspect of mechanistic explanation and ii) the notion of constitutive relevance. This chapter wades into the growing discussion surrounding embodied cognition and predictive processing. After surveying a recent debate between Jakob Hohwy and Andy Clark, it articulates two outstanding issues facing discussions of compatibility. It argues that headway on these issues can be made by drawing on the resources of philosophy of science.

It is widely agreed that living kidney donation is permitted but living kidney sales are not. Call this the Received View. One way to support the Received View is to appeal to a particular understanding of the conditions under which living kidney transplantation is permissible. It is often claimed that donors must act altruistically, without the expectation of payment and for the sake of another. Call this the Altruism Requirement. On the conventional interpretation, the Altruism Requirement is a moral fact. (...) It states a legitimate constraint on permissible transplantation and is accepted on the basis of cogent argument. The present paper offers an alternative interpretation. I suggest the Altruism Requirement is a moral fiction—a kind of motivated falsehood. It is false that transplantation requires altruism. But the Requirement serves a purpose. Accepting it allows kidney donation but not kidney sale. It, in short, rationalizes the Received View. (shrink)

Several authors have recently argued that the content of pains (and bodily sensations more generally) is imperative rather than descriptive. I show that such an account can help resolve competing intuitions about phantom limb pain. As imperatives, phantom pains are neither true nor false. However, phantom limb pains presuppose falsehoods, in the same way that any imperative which demands something impossible presupposes a falsehood. Phantom pains, like many chronic pains, are thus commands that cannot be satisfied. I conclude by showing (...) that some of the negative psychological consequences of chronic pain are a direct consequence of their imperative nature. (shrink)

Maher (1988, 1990) has recently argued that the way a hypothesis is generated can affect its confirmation by the available evidence, and that Bayesian confirmation theory can explain this. In particular, he argues that evidence known at the time a theory was proposed does not confirm the theory as much as it would had that evidence been discovered after the theory was proposed. We examine Maher's arguments for this "predictivist" position and conclude that they do not, in fact, support his (...) view. We also cast doubt on the assumptions of Maher's alleged Bayesian proofs. Since the 1980s, there has been a steady growth of interest in the psychological mechanisms that regulate normal emotional experience. In this same period, cognitive-experimental researchers have sought to delineate the information processing biases that characterize emotional disorders. Exciting potential synergies exist between these two areas of investigation. In this article, we consider ways in which reciprocal benefits could be gained by the constructive transfer of theoretical ideas and methodological approaches between emotion regulation researchers and cognitive-experimental investigators. We also discuss (...) how recent innovations within each field can profitably impact upon progress within the other. It is concluded that the overlap in conceptual constructs, and the convergence of complementary investigative techniques, between these two research domains, provide opportunities for creative synthesis that could significantly enrich understanding of normal and abnormal emotion across future years. Genetic enhancement techniques might allow us to prevent or cure a variety of debilitating diseases. Such movements violated the most basic principles of justice. How can society capitalize on the benefits of genetic intervention and (...) yet avoid the injustices of past eugenic movements? What basic moral principles should guide public policy and individual choice concerning the use of genetic interventions? How to imagine the imagination is a topic that draws philosophers the way flowers draw honeybees. From Plato and Aristotle to Wittgenstein and Sartre, philosophers have talked and written about this most elusive of topics--that is, until contemporary analytic philosophy of mind developed. Perhaps it is the vast range of the topic that has scared off our contemporaries, ranging as it does from mental images to daydreams. The guiding thread of this book is the distinction Colin McGinn draws between (...) perception and imagination. Clearly, seeing an object is similar in certain respects to forming a mental image of it, but it is also different. McGinn shows what the differences are, arguing that imagination is a sui generis mental faculty. He goes on to discuss the nature of dreaming and madness, contending that these are primarily imaginative phenomena. In the second half of the book McGinn focuses on what he calls cognitive (as opposed to sensory) imagination, and investigates the role of imagination in logical reasoning, belief formation, the understanding of negation and possibility, and the comprehension of meaning. His overall claim is that imagination pervades our mental life, obeys its own distinctive principles, and merits much more attention. (shrink)

In this chapter, I taxonomize early modern modes of relating self-interest and the common good. I discuss Protestant natural law theory, republicanism, utilitarianism, and—my main focus—Scottish social thought from Adam Smith and others. My aim is twofold. First, historically, I lay out the conceptual field for the early modern relation of self-interest and the common good while giving special attention to Scottish innovations. Second, from a philosophical point of view, I argue that the Scottish theory of the common good offers (...) some of the best conceptual resources for considering the relation of individual and community in present-day large, industrial nation-states and empires. More specifically, I claim that the Scots develop a concept of the common good that is (1) more social and economic than its alternatives, (2) more systemic and less dependent on the psychology and intentions of individuals, and (3) less tied to thick notions of community (including the state) and more amenable to empire. I conclude by bringing out the significance of these claims for our thinking about self-interest, the common good, and community. (shrink)

This edited collection had its origins in a two-day conference held at the Tate Britain, organised collaboratively by research staff and students at Middlesex University and the London Consortium in order to celebrate the 250th Anniversary of the publication of Edmund Burke's famous book on the sublime. The conference was funded by Middlesex University, the London Consortium and the Tate Britain's AHRC-funded "Sublime Object: Nature, Art and Language" research project. The conference set out to critically examine the legacy of the (...) sublime in contemporary art, culture and society and to assess the value and the dangers of this concept as it is articulated in current thought and practice. The book selected from and expanded on the papers delivered at the conference in order to pursue this goal further. It was broken into themed sections (each of which had an introduction), each exploring an different issue around contemporary uses of the sublime. The sections were: 1. Nature, Ecology and the Sublime; 2. The Sublime After Kant; 3. Capitalism, Terror, Art and the Sublime; 4. Baroque and Beyond: Art, Sex and the Sublime; 5. The Cinematic Sublime. The volume reflects the interdisiplinarity of the concept of the sublime today, and includes essays whose appraoches come from aesthetics and ethics, ecological and political thought, psychoanalysis, feminism, film studies, literary studies, art history and popular culture. It includes papers by internationally renowned authors from the UK, America and Europe alongside the new voices of younger academics. Many philosophical views have the surprising implication that, within the boundaries of each human being, there is not just one mind, but many: anywhere from two (the person and their brain, or the person and their body) to trillions (each of the nearly-entirely-overlapping precise entities generated by the Problem of the Many). This is often treated as absurd, a problem of ‘Too Many Minds’, which we must find ways to avoid. It is often thought specifically absurd to allow such a (...) multiplication of conscious subjects, even if we could accept it for physical objects. I consider metaphysical, phenomenological, and moral arguments for this asymmetry, and show that they all fail: many overlapping conscious minds is no more problematic than many overlapping physical objects. Theories that imply such a multiplicity may or may not be true, but they cannot be rejected simply for implying it. (shrink)

This book holds classical liberalism responsible for an American concept of beauty that centers upon women, wilderness, and machines. For each of the three beauty components, a cultural entrepreneur supremely sensitive to liberalism’s survival agenda is introduced. P.T. Barnum’s exhibition of Jenny Lind is a masterful combination of female elegance and female potency in the subsistence realm. John Muir’s Yosemite Valley is surely exquisite, but only after a rigorous liberal education prepares for its experience. And Harley Earl’s 1955 Chevrolet Bel (...) Air is a dreamy expressionist sculpture, but with a practical 265 cubic inch V-8 underneath. Not that American beauty has been uniformly pragmatic. The 1950s are reconsidered for having temporarily facilitated a relaxation of the liberal survival priorities, and the creations of painter Jackson Pollock and jazz virtuoso Ornette Coleman are evaluated for their resistance to the pressures of pragmatism. The author concludes with a provocative speculation regarding a future liberal habitat where Emerson’s admonition to attach stars to wagons is rescinded. (shrink)

This book explores both scientific and humanistic theoretical traditions in anthropology through the lens of ontology. The first part of the book examines different methods for generating valid anthropological knowledge, and proposes a shift in current consensus. Drawing on western scholars of antiquity and the medieval period and moving away from twentieth century theorists, it argues that we must first make ontological assumptions about the kinds of things that can exist (or not) before we can then develop epistemologies that study (...) those kinds of things. The book goes on to apply the ontology-first theory to a set of case studies in modern day conspiracy theories, misinformation, and magical thinking. It asserts that we need to move away from unneeded metaphysical assumptions of conspiracy theories being misinformation, and argues that reconstructing particular historical events can be a fruitful zone for application of quantitative methods to humanistic questions. Theorizing the Anthropology of Belief is an excellent supplementary suitable for upper-level undergraduate and graduate courses in anthropological theory. (shrink)

I offer a major reassessment of Foucault’s philosophico-historical account of the basic problems of modernity. I revise our understanding of Foucault by countering the influential misinterpretations proffered by his European interlocutors such as Habermas and Derrida. Central to Foucault’s account of modernity was his work on two crucial concept pairs: freedom/power and reason/madness. I argue against the view of Habermas and Derrida that Foucault understood modern power and reason as straightforwardly opposed to modern freedom and madness. I show that Foucault (...) held a much more complex view of these pairs, a view encapsulated in his term ‘reciprocal incompatibility’. By revising our interpretation of Foucault’s work on modernity in this way, we open the way to much more effective deployments of his critical apparatus. (shrink)

Wittgenstein held that Russell’s multiple relation theory of judgment fails to explain an atomic judgment’s representation of entities as combined. He demonstrated this failure as follows. Under the multiple relation theory, an atomic judgment is a complex whose relating relation is judgment, the universal, and whose terms include the entities the judgment represents as combined. Taking such a complex we may arrive through the substitution of constituents at a complex whose relating relation is again judgment but whose terms do not (...) include entities which are logically suited for combination. This second judgment complex will not represent any of its terms as combined, for entities that are logically uncombinable are unrepresentable as combined. Russell’s theory does not, however, explain how the original judgment differs from the complex arrived at by the substitution of constituents such that the former but not the latter represents certain of its terms as combined. How to develop the personal and professional skills and behaviours you need to be the best early career teacher you can be.

This article considers Cohen’s claim that the economic structure or base can be conceived independently of the superstructure by adressing his attempt to identify “a rechtsfrei (moralitätsfrei, etc.) economic structure to explain law (morals, etc.)”. It examines his programme of presenting relations of production as a set of (non-normative) powers and constraints that ‘match’ the rights and obligations of property relations. It is argued that, first, Cohen does not carry through this programme rigorously but, second, he could not do so, (...) since it cannot be carried out at all. Three arguments are advanced, the first two against the possibility of a determinate ‘objective’ account of such powers and constraints, the third against the possibility of abstracting norms (constitutive and regulative, formal and informal) from contractual relationships: it is argued that one cannot identify the powers and constraints embodied in norm-governed economic relationships independently of the norms which govern them. Alternative interpretations are considered of Cohen’s programme that might escape these objections, but these are rejected as untrue to his purpose, and in any case ineffective. It is concluded that Cohen fails to distinguish base from superstructure in the manner required. (shrink)

This book shows the surprising dynamism of the field of civil procedure through its examination of a cross section of recent developments within civil procedure from around the world. It explores the field through specific approaches to its study, within specific legal systems, and within discrete sub-fields of civil procedure. The book reflects the latest research and conveys the dynamism and innovations of modern civil procedure - by field, method and system. The book's introductory chapters lay the groundwork for researchers (...) to appreciate the flux and change within the field. The concluding chapters bring the many different identified innovations and developments together to show the field's ability to adapt to modern circumstances, while retaining its coherence even across different legal systems, traditions, fields and analytic approaches. Specifically, in this book the presence of dynamism is explored in the legal systems of the EU, France, the US, Brazil, Australia, the UK and China. So too that dynamism is explored in the contributions' analyses and discussions of the changes or need for change of specific aspects of civil procedure including litigation costs, class actions, derivative actions, pleadings, and res judicata. Furthermore, most of the individual contributions may be considered to be comparative analyses of their respective subjects and, when considered as a whole, the book presents the dynamism of civil procedure in comparative perspective. Those discrete and aggregated comparative analyses permit us to better understand the dynamism in civil procedure - for change in the abstract can be less visible and its significance and impact less evident. While similar conclusions may have been drawn through examinations in isolation, employing comparative analytic methods provided a richer analysis and any identified need for change is correspondingly advanced through comparative analysis. Furthermore, if that analysis leads to a conclusion that change is necessary then comparative law may provide pertinent examples for such change - as well as methodologies for successfully transplanting any such changes. In other words, as this book so well reflects, comparative law may itself usefully contribute to dynamism in civil procedure. This has long been a raison d'être of comparative law and, as clear from this book's contributions, in this particular time and field of study we find that it is very likely to achieve its lofty promise. Colin Starnes radical interpretation of the long-recognized affinity of Thomas More’s Utopia and Plato’s Republic confirms the intrinsic links between the two works. Through commentary on More’s own introduction to Book I, the author shows the Republic is everywhere present as the model of the “best commonwealth,” which More must first discredit as the root cause of the dreadful evils in the collapsing political situation of sixteenth-century Europe. Background: Transgender health care is a subject of much debate among clinicians, political commentators, and policy-makers. While the World Professional Association of Transgender Health (WPATH) Standards of Care (SOC) establish clinical standards, these standards contain implied ethics but lack explicit focused discussion of ethical considerations in providing care. An ethics chapter in the SOC would enhance clinical guidelines. Aims: We aim to provide a valuable guide for healthcare professionals, and anyone interested in the ethical aspects of clinical support for gender (...) diverse and transgender people of all ages. Recognizing that the WPATH is a global association, we address broad challenges. We offer a reflection on general ethical principles, providing conceptual tools for healthcare providers, patients, and families to navigate the specific challenges they might encounter in transgender health care, in line with WPATH’s worldwide mission and scope. Method: This article employs a descriptive analysis, and our framework of reference is the four principles of biomedical ethics: respect for autonomy, beneficence, nonmaleficence, and justice. Results: The article presents a discussion on the four ethical principles as applied to transgender health care. We address issues such as respect for patient autonomy in decision-making, the role of beneficence and nonmaleficence in clinical interventions, and the importance of justice in equitable treatment and access to care. Some of the ethical concerns we address in this article pertain to the current sociopolitical climate, where there has been increasing legal interference, internationally, for transgender and nonbinary people, particularly youth, seeking medical care. Discussion: We highlight the interplay between ethical principles and clinical practice, underscoring the need for ethical guidance in addressing the diverse challenges faced by healthcare providers and patients in transgender health care. We advocate for continuous refinement of ethical thinking to ensure that transgender health care is not only medically effective but also ethically sound. (shrink)

Frege maintains that there are not two distinct acts, assertion and denial; rather, denying p is one and the same as asserting not-p. Wittgenstein appears not to recognise this identity in Frege, attributing to him the contrary view that a proposition may have one of two verbs, "is true" or "is false". This paper explains Wittgenstein’s attribution as a consequence of Frege’s treatment of content as theoretically prior to the act of judgment. Where content is prior to judgment, the denial (...) of p—what is rejected in asserting p—is distinct from the assertion of not-p. Wittgenstein’s own embrace of Frege’s identity is then considered, an embrace explained in part by his repudiation of Frege’s theoretical order. (shrink)
