The OpenNotes (ON) mandate in the 21st Century Cures Act requires that patients or their legally authorized representatives be able to access their medical information in their electronic medical record (EMR) in real time. Ethics notes fall under the domain of this policy. We argue that ethics notes are unique from other clinical documentation in a number of ways: they lack best-practice guidelines, are written in the context of common misconceptions surrounding the purpose of ethics consultation, and often answer questions (...) of a different nature than other documentation. Thus, we believe the clinical ethics community would benefit from clarification on when the withholding of ethics notes is justified. We provide recommendations for excluding information from ethics documentation based on the likelihood and magnitude of harm that may occur with particular disclosures and suggest approaches to decrease the potential harms that may occur. We define and explain six types of reasons to exclude information from ethics notes based on significant harms that are not addressed in the ON policy: (1) harmful revelations from a protected chart note; (2) negative emotional effects on patients or families; (3) the purpose of the consultation is undermined by harmful consequences; (4) avoidable negative impact on interpersonal dynamics; (5) inappropriate labeling or disclosure of medical, social, or financial information; and (6) inclusion of biasing or otherwise unfair information. We also suggest approaches to mitigate harm when excluding, including, reframing, or delaying release of information that is perceived to be relevant to an ethics case. Overall, we hope our analysis and recommendations will initiate a much-needed discussion about the impact of the ON mandate on clinical ethics documentation. (shrink)

Food is a challenging subject. There is little consensus about how and what we should produce and consume. It is not even clear what food is or whether people have similar experiences of it. On one hand, food is recognized as a basic need, if not a basic right. On the other hand, it is hard to generalize about it given the wide range of practices and cuisines, and the even wider range of tastes. Incoherence is usually regarded as a bad thing. Incoherence suggests irrationality, confusion, paradox. Incoherentism disagrees: incoherence is not always a bad thing, sometimes we ought to be incoherent. If correct, Incoherentism has important and controversial implications. It implies that rationality does not always require coherence. Dilemmism and Incoherentism both embrace conflict in epistemology. After identifying some important differences between these two ways of embracing conflict, I offer some reasons to prefer Incoherentism over Dilemmism. Namely, that Incoherentism allows us to deliberate (...) about what we ought to believe using ordinary epistemology, and it does a better job of accommodating the positive features of incoherence. Since the late 1970s, theologians have been attempting to integrate mimetic theory into different fields of theology, yet a distrust of mimetic theory persists in some theological camps. Les auteurs anciens sont de peu de secours pour démêler l’écheveau de l’histoire politique de cette région, sise aux confins des territoires (...) argien, arcadien et spartiate, aux ve et ive s. : ils la mentionnent rarement, celle‑ci étant demeurée hors des grands conflits. Aussi, les sources archéologiques prennent‑elles toute leur importance. Cette contribution s’efforce de prolonger les enquêtes topographiques conduites par nos aînés en recourant à l’étude des fortifications, source de choix pour appréhender l’histoire régionale. Ainsi, l’étude des ouvrages fortifiés de Thyréatide (enceintes urbaines, tours isolées) permet d’éclairer l’histoire de cette région si convoitée ainsi que certains points de l’histoire du Péloponnèse à l’époque classique. De la période archaïque à l’époque hellénistique, la Thyréatide a été à la fois un ensemble cohérent et une partie des confins (eschatiai) d’un ensemble politique plus vaste, une région frontalière, aux marges du territoire lacédémonien ou argien, qui a conduit à l’implantation d’un réseau de villes fortifiés et de tours de guet. Après avoir fait l’inventaire de ces fortifications, leur analyse architecturale comme celle de leur implantation topographique nous ont souvent permis, d’abord d’y distinguer plusieurs phases de construction, ensuite de replacer ces ouvrages dans le réseau fortifié auquel ils appartiennent. Enfin, on a pu proposer parfois qui, de Sparte ou d’Argos, était le commanditaire de ces ouvrages fortifiés et vers quels ennemis ceux‑ci étaient tournés. Nous avons ainsi pu montrer que plusieurs de ceux qui étaient attribués à Sparte sont en fait à considérer plutôt comme argiens. (shrink)

Sometimes, scientific progress conflicts with the prudential value of self‐preservation. Contemporary philosophy is torn between a reliance on the pragmatic meanings of designated objects and a foundation based on formal theory. Although the question is naturally an epistemic one, bridge principles have typically been investigated in isolation from epistemic debates over the correct norms for belief. In this paper we tackle the question of whether logic is normative for belief by proposing a Kripkean model theory accounting for the interaction between logical, doxastic, epistemic and (...) deontic notions and using this model theory to show which bridge principles are implied by epistemic norms that we have independent reason to accept, for example, the knowledge norm and the truth norm. We propose a preliminary theory of the interaction between logical, doxastic, epistemic and deontic notions that has among its commitments bridge principles expressing how logic is normative for belief.
