Political realism points out that politics is to create and sustain a legitimate order in a context of persistent disagreement, with the possible surge of conflicts, and where political power inevitably uses coercion. Political realists contend that modus vivendi is a contingent political arrangement at the level of the political constitution that allows diverse groups of people to coexist peacefully. Proposals of modus vivendi do not say enough about how to manage disagreements and conflicts. In this paper, I argue that (...) proposals of agonistic democracy supply this lack. I contend that agonistic democracy proposals share the premises of political realism and contribute to the sustainment of a liberal modus vivendi. (shrink)

El artículo analiza cómo la revista Medicina e Morale ha afrontado en su historia el tema de la ética en la experimentación clínica, que representa una parte muy amplia y compleja de la bioética y también de la deontología médica. Los aspectos que esta temática comprende son ya numerosos y la literatura producida ingentísima. La ética de la experimentación ha recibido particular impulso y atención a continuación de diversas experimentaciones no éticas que han turbado profundamente la opinión pública y hecho (...) necesario una fuerte reconsideración en el ámbito de la investigación clínica. En general, de los años 60's a los años 80's del siglo XX, ha prevalecido en la literatura un intenso empeño e interés en la elaboración de los principios de referencia y en la reflexión teórica relativa a varias cuestiones . De los años 90 en adelante se ha en cambio intensificado -probablemente por las exigencias nacidas en seno de los Comités de ética que precisamente en aquel período han iniciado a difundirse masivamentela elaboración de códigos, reglamentos, líneas-guía que han orientado el desarrollo de la disciplina más en sentido de procedimiento y con un acercamiento ético-deontológico. En particular, Medicina e Morale, ha estado siempre en estas temáticas, desde los inicios de su historia, constituyendo una voz original en el debate, además que un instrumento de difusión de documentos nacionales y sobre todo internacionales. La Revista ha representado, sobre todo en los últimos treinta años, un verdadero punto de referencia a nivel nacional y en algunos casos también internacional, proponiendo a veces orientaciones originales, que han sido luego acogidas en el ámbito de líneas-guía y de normativas.The article deals with how the journal Medicina e Morale has faced ethics in clinical trials, which represents a very large and complex bioethical issue, but also deontological one. This area comprises many questions and the literature is huge. It has risen after unethical clinical trials that have shocked the public and have produced a big rethinking about it. In general, from the '60s to the '80s of the XXth century, an intense commitment and interest have prevailed on the elaboration of the reference principies and on theoretical reflection on various issues, such as informed consent, the ethical significance of clinical research, the protection of vulnerable people, the risk acceptability). Since the '90s onwards the development of codes, regulations, guidelines -that have guided the development of the discipline in a procedural and also deontological sense- has increased, probably due to the large diffusion of ethics committees. Particularly, the journal "Medicina e Morale" has always been present on these issues, since the beginning of its history, creating an original voice in the debate, as well as a dissemination tool of national and especially international documentabon. The journal has been, especially in the last thirty years, a real national, and sometimes international, be nchmark, offering original suggestions which are then accepted in guidelines and regulations. The authors report the first Italian experience of a research ethics committee (REC) audit focused on the evaluation of the REC’s compliance with standard operating procedures, requirements in insurance coverage, informed consent, protection of privacy and confidentiality, predictable risks/harms, selection of subjects, withdrawal criteria and other issues, such as advertisement details and justification of placebo. The internal audit was conducted over a two-year period (March 2009–February 2011) divided into quarters to better value the influence of the new insurance coverage regulation (...) that came into effect in March 2010 (Ministerial Decree of 14 July, 2009) and expand the requirements to safeguard participants in clinical drug trials including other critical items as information and consent and the risks to benefits ratio. Out of a total of 639 REC’s opinions and research studies, 316 were reviewed. Regarding the insurance policy requirements, Auditor/REC non-compliance occurred only in one case. The highest number of Auditor/REC non-compliance was in regard to information and consent, which should have incurred a suspended decision rather than a favorable opinion. This internal audit shows the importance and the difficulty of the review process. For this reason, specific courses for members of the research ethics committee and for those who aspire to become auditors will be provided. There may also be efforts to improve the standard operating procedures already in place. (shrink)

Este artículo analiza la crisis de la República romana tardía, atribuida por los antiguos autores a la decadencia moral y a los vicios orientales y cómo Cicerón, defensor de las instituciones republicanas y de los boni, se enfrentó a los populares que buscaban reformas estructurales. Se destacan sus conflictos con Catilina, Clodio, Pisón y, especialmente, con Antonio. A lo largo de su carrera, Cicerón defendió su dignitas y argumentó que las virtudes cardinales propuestas por Platón y Panecio eran clave para (...) alcanzar la verdadera gloria. En las Filípicas, atacó a Antonio y apoyó a Octaviano, aunque este último terminó traicionándolo. Estos discursos polarizaron la política romana, mostrando, según Bruto, la falta de visión política de Cicerón. Para defenderse de los ataques por su condena a los catilinarios y promover reformas estatales, Cicerón recurrió a la filosofía y defendió los principios platónicos y estoicos, abogando por la creencia en una providencia divina, la importancia de las virtudes cardinales, el uso de la razón y la superioridad del derecho natural de inspiración divina sobre la ley humana. También criticó a los epicúreos por su rechazo a la política, negación de la providencia divina y búsqueda del placer. (shrink)

Nella storia della fortuna di Cicerone, l’età della Controriforma è un periodo non specificamente indagato, benché la presenza dell’oratore sia fondamentale nella formazione di molti protagonisti del rinnovamento cattolico e poi nei nuovi sistemi educativi elaborati per formare un clero più qualificato. L’articolo intende mettere in luce il ruolo centrale assunto da Cicerone in tale delicata fase storica, concentrandosi in particolare sulla figura esemplare di Girolamo Ragazzoni, commentatore delle Epistulae ad Familiares e volgarizzatore delle Filippiche. Ragazzoni, da giovane umanista in (...) stretto contatto con Paolo Manuzio e Carlo Sigonio, parteciperà al Concilio, tenendone l’orazione conclusiva, per poi diventare nel 1577 vescovo di Bergamo: lì, operando in collaborazione con Carlo Borromeo, si rivelerà uno dei più solerti esecutori dell’opera di riforma interna alla Chiesa, in particolare nel settore pedagogico e scolastico. El artículo expone en detalle el texto agustiniano de conf. 12,37 y explica cómo el obispo ha hablado aparentemente acerca del Génesis: en realidad, ha disertado sobre su obra y ha indicado lo que puede ser de provecho para el lector, desarrollando con amplitud una fuente clásica, un pasaje de Cicerón (Top. 33).

Montaigne never got to think that Cicero was a teacher of thought and life. First, Montaigne held a very negative position with respect to Cicero. Later than 1588, he arrived at one more balanced position. According Montaigne Cicero belongs to one world that separate the culture from the life, which represents the field where the truth of a being is pronounced and the ethical values are made concretely. Montaigne did not want to admit that Cicero also rejected the separation of (...) word, thought and action. When after 1588 Cicero is used by Montaigne extensively, the Cicero’s appointments are interpreted in a very personal way. For Montaigne, Cicero was simultaneously an egocentric and a republican orator, while the author of the Essais preferred an aristocratic ethics and praised the authoritarian regimes. (shrink)

Para entender completamente los diálogos de Casiciaco de san Agustín, es preciso comprender cómo se relacionan con las obras filosóficas de Marco Tulio Cicerón. En concreto, "Contra Academicos" de Agustín es una respuesta a "Academica" de Cicerón. "De beata uita" es una respuesta a los ciceronianos "De finibus" y "Tusculanae disputationes". Su "De ordine" es una respuesta a la trilogía de Cicerón sobre la providencia: "De natura deorum", "De diuinatione" y "De fato". Reconocer la conexión entre estas obras arroja luz (...) nueva sobre el sentido e importancia de los diálogos de Casiciaco. (shrink)

His ideas, very present in the moral and political philosophy of the Middle Ages, continue being a key for contemporary world views.

As a result of his philosophy, Greek moral philosophy was received in Latin culture. Cicero is, in his life and his works, the refusal of the moral, anthropological and political nihilism. His ideas, very present in the moral and political philosophy of the Middle Ages, continue being a key for contemporary world views.

This article studies Cicero and the rhetoric, and the controversy generated around his figure, in particular in XIX century. Three steps are followed: first, it is tried to make clear how the figure of Cicero orator appeared in cases specially controverted; secondly the modern critic of Cicero is discussed; and, finally, an assessment of the oratorian practice of Cicero is offered from the per-spective of present science.

Considerations about the evolution of the concept of "friendship", just as Cicero understands it, along the history (individual, social, political and religious friendship). Repetitions and interpretations of his definition and of other ciceronian texts. His influence on several authors (such as Augustinus, Isidorus Hispalensis, Rabanus Maurus, Petrus Venerabilis) and, above all, on the mediaeval treaties De amicitia written by Aelredus Rievallensis and Petrus Blessensis.

This paper shows how the republican model of Cicero has been transmitted fragmentarily, through the Italian civic humanist tradition (Maquiavelo), the English republican humanism of XVI, XVII and XVIII centuries, and the republicanism of the American patriots, ("neo-republicanism"). The proposals of Pettit and Brugger are analyzed, and a great variety of positions that some consider "republican" are summarily reckoned. Finally, it is maintained that the classic republican model is present in a very fragmented way in contemporary political theories, for these (...) theories are incapable to accept some strong anthropological, ethical and metaphysical theses. Cicero's model of republicanism appears to us like in a large scale copy or replica, precisely in the political and legal reality of the contemporary world, in its practices and institutions, and in the political function of its theoretical reflections. Tal como reconoce el propio Montesquieu, este escrito de juventud no se compara con las obras maestras de su pensamiento ni tampoco revela lo esencial de él. Por ello, este texto tendría poco valor si con él pretendiésemos estudiar y comprender la filosofía y el pensamiento montesquiano. No obstante, el valor que tiene el Discurso sobre Cicerón para nuestra compresión de la recepción, la valoración y la inluencia de la filosofía ciceroniana en la Modernidad, fue la razón por la cual (...) decidí realizar por primera vez una traducción al español de este texto. El estudio de la pervivencia del pensamiento ciceroniano en la Historia de la Filosofía es un campo de estudio relativamente reciente en la historiografía de la filosofía: después de ser condenada al olvido, tan sólo a partir de la década de los años 90 la filosofía ciceroniana ha empezado a ser revalorada y estudiada. En el caso de la Modernidad, la cuestión es bastante difusa. La mayoría de los estudiosos han tenido que esforzarse por hacer explícita la impronta ciceroniana, tratando de remediar la escasez y muchas veces la ausencia de referencias directas a Cicerón en las obras de los modernos. De ahí que el Discurso de Cicerón sea una pequeña joya y una pieza fundamental para comprender la presencia de Cicerón en la Modernidad. Por otra parte, el elogio que este discurso hace a la filosofía ciceroniana contrasta con la airmación de un contemporáneo de Montesquieu, el filósofo escoces David Hume: “la filosofía abstracta de Cicerón ha perdido su crédito, pero la vehemencia de su oratoria aún es objeto de nuestra admiración” (2005, p. 503). Vemos, así, como este discurso poco conocido nos ayuda a percibir los contrastes con los que se presenta la figura de Cicerón en la Modernidad. (shrink)

The author examines the outstanding texts in Saint Augustine's works about hapiness -specially in De beata uita, Confessiones, and De Trinitate-, in order to establish interlinking points with the Ciceronian books related to this subject. The Hortensius (specially frg. 36, 39 and 79 Müller), is a reiterated and coincident reference in the different Augustine's works. It also acts as a key into other many passages of the classical philosophical tradition. On the other hand, Augustin modifies and perfects elements there contained, (...) because of his assimilation of the New Testament tradition related to this topic. (shrink)

If Cicero's Republic and Agustine's City of God are studied in parallel, and the Somnium Scipionis is specifically compared to De civitate Dei XXII, and the theme of the souls' immortality and of justice is also examined, it seems possible to show that Cicero's Republic contributed decisively to the general design of the City of God. Both republics, moreover, in a more general way, share with Plato's Republic certain common characteristics that are here pointed out.

This book provides the first critical edition of the first French translation of Cicero's De officiis. Anjourrant Bourré's Livre des offices offers a new perspective on the reception of Cicero's moral and political thougth in late medieval and early Renaissance France. The critical edition, based upon all surviving testimonies, provides, besides the edited text, a study of the textual transmission, an analysis of the linguistic aspects as well as of the translation process, a glossary, explicative notes and an index.

Sobre la risa puede hablarse de muchas maneras; cabe, por ejemplo, una aproximación fisiológica, otra psicológica o una tercera sociológica, que los antiguos no desatendieron por completo, si bien Cicerón prefirió investigar sus posibilidades retóricas. A nadie se le oculta la relevancia de chanzas y chistes para disponer a la audiencia de manera favorable o para ridiculizar al adversario; tampoco que esta estrategia, a despecho de su efectividad y por la misma, puede sobrepasar los límites de lo aceptable o de (...) lo provechoso. Cuestión tanto más grave cuanto que el orador puede y debe reírse de asuntos que, considerados en sí mismos, carecen de gracia. La retórica ciceroniana de la risa plantea y desemboca en una ética y una táctica del humor atenta al estudio y posible codificación de los principios rectores de tan poderoso recurso, que debe utilizarse de manera conveniente, adecuada y decorosa, lo cual presupone que no siempre es así y, por lo que interesa en estas páginas, que hay risas indebidas, próximas al vituperio, que pueden acarrear dificultades a quien las provoca, pues siempre es peligroso reírse de los poderosos. Cicerón, sin duda, era un individuo que insultaba mucho, con ingenio, gracia y en ocasiones con extraordinaria agresividad. (shrink)

This article re-analyses in detail the meaning of the expression ludi Graeci which appears in two of Cicero’s letters (Ad Fam. 7,1 and Ad Att. 15,5). A careful examination of the first instance reveals that ludi Graeci indeed referred to theatrical performances in Greek language and not merely to Latin plays that followed Greek models. A brief survey of contemporary epigraphical sources shows that no occurrence excludes this interpretation. The question of the apparent contradiction between Cicero’s philhellenism and his criticism (...) of the ludi Graeci in the two letters is also addressed, in order to demonstrate that the two attitudes are not mutually exclusive. Lʼesposizione, pur essendo densa e breve, offre numerosi e interessanti illustrazioni di esempi di istituti giuridici e di dibattiti processuali, di attuale e particolare interesse per gli studiosi di logica (...) e argomentazione. In this paper I attempt at drawing a philosophical picture about Cicero's ideas on after death survival. In spite of the fact that this issue has not been paid much attention in contemporary discussion, it deserves consideration because of its great humanistic value.
