While legal scholars increasingly recognize that norms as well as law influence social behavior, the nature of these effects is not well understood. A key question concerns the content of norms. Specifically, do they reflect individual interest or do they enhance group welfare? In this paper I describe two general kinds of arguments that support these different views. I then develop predictions about the content of a particular type of norm—controller selection rules. These hypotheses are tested in an experimental setting (...) in which individuals interact with each other over networked computers. The findings are consistent with group welfare explanations. That is, they suggest that norms constrain actions that create negative externalities, and that these norms are stronger in more cohesive groups. They also suggest, however, that such norms may not necessarily produce pro-social behavior. (shrink)

Environmental ethics is apparently caught in a dilemma. We believe in human species partiality as a way of making sense of many of our practices. However as part of our commitment to impartialism in ethics, we arguably should extend the principle of impartiality to other species, in a version of biocentric egalitarianism of the kind advocated by Paul Taylor. According to this view, not only do all entities that possess a good have inherent worth, but they have equal inherent worth, (...) and in particular no species is superior to any other. In this paper, I elaborate a Heideggerian environmental virtue ethics that slips between the horns of the dilemma. Central to this ethics is the relation of “dwelling” and the many virtues of dwelling, according to which the world is seen as “holy” in a variety of ways. This ethics is importantly local in respect of time and place, but also has universalistic aspects. To understand such an ethics, it is necessary to grasp Heidegger’s notion of truth as “aleithia” or opening, which enables us to escape the metaphysical dilemmas besetting ethics in the analytic tradition, including standard virtue ethics. The account of the death of Patroklos occupies a strategic position in the narrative economy of the Iliad: before this event, Achilles has withdrawn from combat out of indignation against Agamemnon; afterwards, his anger turns against Hector, whom he holds responsible for his friend's death. Achilles returns to battle and kills Hector in an act of vengeance that, as we have known from the beginning of the poem, will lead to his own demise, which is not actually recounted in the (...) Iliad. This episode stands out because it is atypical both in the contents of the narration and in the means of expression used (what are generally termed “formulas”). I will give some examples of these oddities and then propose an interpretation. Here is the text, in the translation by Richmond Lattimore:So long as the sun was climbing still to the middle heaven, so long the thrown weapons of both took hold, and men dropped under them; but when the sun had gone to the time for unyoking of cattle, then beyond their very destiny the Achaians were stronger and dragged the hero Kebriones from under the weapons and the clamour of the Trojans, and stripped the armour from his shoulders. And Patroklos charged with evil intention in on the Trojans. Three times he charged in with the force of the running war god, screaming a terrible cry, and three times he cut down nine men; but as for the fourth time he swept in, like something greater than human, there, Patroklos, the end of your life was shown forth, since Phoibos came against you there in the strong encounter dangerously, nor did Patroklos see him as he moved through the battle, and shrouded in a deep mist came in against him and stood behind him, and struck his back and his broad shoulders with a flat stroke of the hand so that his eyes spun. Ethical thought is articulated around normative concepts. Standard examples of normative concepts are good, reason, right, ought, and obligatory. Theorists often treat the normative as an undifferentiated domain. Even so, it is common to distinguish between two kinds of normative concepts: evaluative or axiological concepts, such as good, and deontic concepts, such as ought. This encyclopedia entry discusses the many differences between the two kinds of concepts.

One difficulty in understanding recent debates is that not only have many terms been used to refer to weakness of will – “akrasia” and “incontinence” have often been used as synonyms of “weakness of will” – but quite different phenomena have been discussed in the literature. This is why the present entry starts with taxonomic considerations. The second section turns to the question of whether it is possible to freely and intentionally act against one’s better judgment.

Emotions often misfire. We sometimes fear innocuous things, such as spiders or mice, and we do so even if we firmly believe that they are innocuous. This is true of all of us, and not only of phobics, who can be considered to suffer from extreme manifestations of a common tendency. We also feel too little or even sometimes no fear at all with respect to very fearsome things, and we do so even if we believe that they are fearsome. (...) Indeed, instead of shunning fearsome things, we might be attracted to them. Emotions that seem more thought-involving, such as shame, guilt or jealousy, can also misfire. You can be ashamed of your big ears even though we can agree that there is nothing shameful in having big ears, and even though you judge that having big ears does not warrant shame. And of course, it is also possible to experience too little or even no shame at all with respect to something that is really shameful. Many of these cases involve a conflict between one’s emotion and one’s evaluative judgement. Emotions that are thus conflicting with judgement can be called ‘recalcitrant emotions’. The question I am interested in is whether or not recalcitrant emotions amount to emotional illusions, that is, whether or not these cases are sufficiently similar to perceptual illusions to justify the claim that they fall under the same general heading. The answer to this depends on what emotions are. For instance, the view that emotions are evaluative judgments makes it difficult to make room for the claim that emotional errors are perceptual illusions. Fearing an innocuous spider would simply amount to making the error of judging that the spider is fearsome while it is in fact innocuous. This might involve an illusion of some sort, but it certainly does not amount to anything like a perceptual illusion. In philosophy, the idea that an individual can exist in more than one world is called transworld identity. This volume provides new insights on lying and (intentionally) misleading in and out of the courtroom, a timely topic for scholarship and society. Not all deceptive statements are lies; not every lie under oath amounts to perjury---but what are the relevant criteria? Taxonomies of falsehood based on illocutionary force, utterance context and speakers' intentions have been debated by linguists, moral philosophers, social psychologists and cognitive scientists. Epistemological realists have long struggled to explain perceptual error without introducing a tertium quid between perceivers and physical objects. Two leading realist philosophers, Thomas Reid and Everett Hall, agreed in denying that mental entities are the immediate objects of perceptions of the external world, but each relied upon strange metaphysical entities of his own in the construction of a realist philosophy of perception. Reid added ‘visible figures’ to sensory impressions and specific sorts of mental events, while Hall utilized an array (...) of ways that he maintained properties may participate in the world.
