In his role as "American in Berlin," Fraenkel helped shape the foundation of modern comparative government theory. Fraenkel's impressive, and in retrospect exemplary, biography, from being a Jewish labor lawyer in the Third Reich to an emigrant to the United States, allowed for him to be described as a commanding figure of the young field of political science of the Adenauer era. Reinhard Dorn (...) illuminates Fraenkel's integrative state and constitutional understanding in two parts. In the first section, he presents foundations and individual components of constitutional-sociological thought, whereby he focuses particular attention on sociological and policy-sociological aspects. Historians often compare the relationship between humanists and scholastics in the early sixteenth century to a battle. In such accounts, the Parisian Faculty of Theology plays the role of a major combatant keeping humanists away from religious studies. This article paints a different and more harmonious picture of humanists and scholastics in the decade before the Reformation. It draws on hitherto little explored evidence from manuscripts authored by official orators at the University of Paris: their speeches to graduating students at (...) the Faculty of Theology in 1510 and 1512. It will be argued that the speakers celebrated both humanist and scholastic competences and the speeches themselves demonstrate that eloquence had a role to play within the institution. In this way, the article adds nuance to our understanding of how the Faculty of Theology viewed humanists and introduces important new sources to the history of universities. (shrink)

While there has been an increase of Black women faculty in higher education institutions, the academy writ large continues to exploit, discriminate, and uphold institutionalized gendered racism through its policies and practices. Black women have navigated, negotiated, and learned how to thrive from their respective standpoint and epistemologies, traversing the academy in ways that counter typical narratives of success and advancement. This edited volume bridges together foundational and contemporary intergenerational, interdisciplinary voices to elucidate Black feminist epistemologies and praxis. In this paper we attempt to identify which peer collaboration characteristics may be accountable for conceptual change through interaction. We focus on different socio‐cognitive aspects of the peer dialog and relate these with learning gains on the dyadic as well as the individual level. The scientific topic that was used for this study concerns natural selection, a topic for which students’ intuitive conceptions have been shown to be particularly robust. Learning tasks were designed according to the socio‐cognitive conflict instructional paradigm. (...) After receiving a short instructional intervention on natural selection, paired students were asked to collaboratively construct explanations for certain evolutionary phenomena while engaging in dialectical argumentation. Two quantitative coding schemes were developed, each with a different granularity. The first assessed discrete dialog moves that pertained to dialectical argumentation and to consensual explanation development. The second scheme characterized the dialog as a whole on a number of socio‐cognitive dimensions. Results from analyses on the dyadic as well as the individual level revealed that the engagement in dialectical argumentation predicted conceptual learning gains, whereas consensual explanation development did not. These findings open up new venues for research on the mechanisms of learning in and from peer collaboration. (shrink)

In response to the so-called “paradox of deontology,” many have argued that the agent-relativity of deontological constraints accounts for why an agent may not kill one in order to prevent five others from being killed. Constraints provide reasons for particular agents not to kill, not reasons to minimize overall killings. In this paper, I tease out the significance of an underappreciated aspect of this agent-relative position, i.e. it provides no guidance as to what an agent ought to do when faced (...) with the prospect of killing one in order to prevent herself from killing five. After rejecting mere agent-relativity, the view that agents are morally permitted to violate constraints in order to minimize their overall violations, I offer a view that this is both agent- and time-relative, and show how this view exemplifies the underlying motivations for deontological constraints while successfully responding to both the inter- and intra-personal paradoxes of deontology. This article offers a hybrid rhetorical-qualitative discourse analysis of the FDA’s 2011 Avastin Hearing, which considered the revocation of the breast cancer indication for the popular cancer drug Avastin. We explore the multiplicity of stakeholders, the questions that motivated deliberations, and the kinds of evidence presented during the hearing. Pairing our findings with contemporary scholarship in rhetorical stasis theory, Mol’s (2002) construct of multiple ontologies, and Callon, Lascoumes, and Barthe’s (2011) “hybrid forums,” we demonstrate that the FDA’s deliberative procedures elides (...) various sources of evidence and the potential multiplicity of definitions for “clinical benefit.” Our findings suggest that while the FDA invited multiple stakeholders to offer testimony, there are ways that the FDA might have more meaningfully incorporated public voices in the deliberative process. We conclude with suggestions for how a true hybrid forum might be deployed. (shrink)

Metaethical constructivism aims to explain morality’s authority and relevance by basing it in agency, in a capacity of the creatures who are in fact morally bound. But constructivists have struggled to wring anything recognizably moral from an appropriately minimal conception of agency. Even if they could, basing our reasons in our individual agency seems to make other people reason-giving for us only indirectly. This paper argues for a constructivism based on a social conception of agency, on which our capacity to (...) recognize ourselves as having reasons ties us inescapably to others. It argues that mutual recognition is a pervasive feature of linguistic concepts, and builds this into a view called transformative expressivism. (shrink)

This article reports on the development of an instrument to measure the perceived stress that results from the use and ubiquity of digital technology in the workplace. Based upon a contemporary understanding of stress and a set of stressors that is a substantial update to existing scales, the Digital Stressors Scale advances the measurement of digital stress. Initially, 138 items were constructed for the instrument and grouped into a set of 15 digital stressors. Based on a sample of N = (...) 1,998 online questionnaires completed by individuals representative of the US employed population, the scale was refined using exploratory factor analyses and PLS-SEM. The resulting and final scale consists of ten stressor categories reflective of one higher-order construct and a total of 50 items. Through a nomological network that includes important outcome variables of digital stress it was then demonstrated that the DSS provides substantial explanatory power, particularly related to emotional exhaustion and user satisfaction. Thus, the DSS constitutes a state-of-the-art self-report instrument to measure the extent of distress appraisal related to digital technologies in the workplace and helps to explain further how and why information and communication technologies can lead to adverse outcomes in individuals, thereby providing the starting point for job related organizational interventions. Moderate deontologists hold that while it is wrong to kill an innocent person to save, say, five other individuals, it is indeed morally permissible to kill one if, say, millions of lives are at stake. A basic worry concerning the moderate’s position is whether the view boils down to mere philosophical wishful thinking. In permitting agents to ever kill an innocent, moderates require that agents treat persons as means, in opposition to traditional deontological motivations. Recently Tyler Cook argued that deontologists (...) can be moderate. However, there remains a gap in the literature concerning how such a view might function in practice, as well as why a deontologist might (or perhaps, should) hold the view. This paper works to fill these gaps. I first develop the view that agents can be constrained from an action even though there are instances in which an infringement of this constraint is permissible. Crucially, I appeal to the moral emotions that are fitting in cases of constraint infringements. I then go on to show how this view can be grounded in traditional deontological foundations. Respect for the dignity of persons, I argue, requires not only that we not treat others in certain ways, but also that we acknowledge the direct and indirect effects our actions and inactions have on all persons. This deontological motivation, in turn, leads to a moderate constraint on the actions of agents. (shrink)

The flourishing life, summarised by Miroslav Volf and Matthew Croasmun, identifies three interconnected components to human flourishing: the life going well, the life led well, and the life feeling as it should. Further, they, alongside many theologians with a Christocentric focus, propose that Jesus is the epitome of the flourishing life. However, according to the Gospels, life did not always go well for Jesus, nor did it always feel as it should. Despite this, Jesus still embodies the life led well. (...) Yet this raises questions about the extent to which common human beings (those not hypostasised to the second Person of the Trinity) can emulate the kind of life that Jesus leads. To explore the possible similarity and dissimilarity between the life of Jesus and mere humans who are indwelt by the Holy Spirit, this article will utilise a framework from within Self-Determination Theory as it relates specifically to human agency and motivation. The more internalised the motivation, the more agentic the person is, and the better the life is led. Yet this is not a flourishing for its own sake or for its own ends but is agency utilised for the sake of the other. (shrink)

A central claim of the Christian faith is that Jesus is not only fully human (and fully God), but that he reveals true humanity to us. This requires that all of our anthropologies, in some way, ground themselves in Christology, providing a ‘Christological anthropology’. Consequently, any Christological anthropology requires some formulation of Christology proper. In light of this, the main contention of the present paper is that one cannot adequately formulate a Christological anthropology without including a pneumatic Christology. The justification (...) for this necessity can be articulated through the concept of fundamental need. The incarnate Logos, Jesus of Nazareth, fundamentally needed the Spirit in the same way that all human persons fundamentally need the Spirit. ‘Fundamental need’, as a technical concept, can help to clarify both the continuity and discontinuity between Jesus’ likeness to all humanity. This does not collapse the ‘who’ of the incarnation into the many ‘who’s’ of humanity since the incarnate Logos always possessed this Spirit as his own Spirit of Sonship, as opposed to how non-divinely hypostasized human persons must receive the Spirit of Sonship by adoption. The distinctiveness and similarity between Jesus and all of humanity can be most clearly seen by paying special attention to the difference between incarnation and indwelling. Thus, by examining incarnation and in-dwelling, as well as introducing fundamental need into theological discourse, the significance of the Spirit for informing both Christology and anthropology will be made clear. The practice of corporate social responsibility has often been described as a balance of profitability and social or societal responsibility by scholars as well as practitioners. It is assumed that regulations and guidelines of CSR practices link competitiveness and responsibility together. While recognising that formal CSR statements represent a goal-oriented managerial approach to CSR, we argue based on the description of a qualitative case study that the relationship between profitability and social or societal responsibility is not as clear and simple (...) as it is often described. Instead, CSR should be considered as a continuously negotiated process between companies and stakeholders. Hence, the creation of a constructive link between profitability and social or societal responsibility is dependent on the amount of effort that has been put into exploring the concerns of the stakeholders, vis-a-vis the company, while simultaneously accepting changes when they are necessary.
