Background The first COVID-19 wave started in February 2020 in France. The influx of patients requiring emergency care and high-level technicity led healthcare professionals to fear saturation of available care. In that context, the multidisciplinary Ethics- Support Cell (EST) was created to help medical teams consider the decisions that could potentially be sources of ethical dilemmas. Objectives The primary objective was to prospectively collect information on requests for EST assistance from 23 March to 9 May 2020. The secondary aim was (...) to describe the Cell’s functions during that period. Research design This observational, real-time study of requests for Cell consultations concerned ethical dilemmas arising during a public health crisis. The EST created a grid to collect relevant information (clinical, patient’s/designated representative’s preferences and ethical principles strained by the situation), thereby assuring that each EST asked the same questions, in the same order. Participants and research context Only our university hospital’s clinicians could request EST intervention. Ethical considerations The hospital Research Ethics Committee approved this study (no. CER-2020-107). The patient, his/her family, or designated representative was informed of this ethics consultation and most met with EST members, which enabled them to express their preferences and/or opposition. Findings/results 33 requests (patients’ mean age: 80.8 years; 29 had COVID-19: 24 with dyspnea, 30 with comorbidities). 17 Emergency Department solicitations concerned ICU admission, without reference to resource constraints; others addressed therapeutic proportionality dilemmas. Discussion Intervention-request motives concerned limited resources and treatment intensity. Management revolved around three axes: the treatment option most appropriate for the patient, the feasibility of implementation, and dignified care for the patient. Conclusions COVID-19 crisis forced hospitals to envisage prioritization of ICU access. Established decision-making criteria and protocols do not enable healthcare professionals to escape ethical dilemmas. That acknowledgement highlights ethical risks, enhances the added-value of nursing and encourages all players to be vigilant to pursue collective deliberations to achieve clear and transparent decisions. This article examines how the action logics associated with the stages of consciousness development of organizational leaders can influence the meaning, which these leaders give to corporate greening and their capacity to consider the specific complexities, values, and demands of environmental issues. The article explores how the seven principal action logics identified by Rooke and Torbert (2005, Harvard Business Review 83 (4), 66–76; Opportunist, Diplomat, Expert, Achiever, Individualist, Strategist and Alchemist) can affect environmental leadership. An examination of the strengths and (...) limitations of these action logics reveals the relevance of the so-called post-conventional stages of consciousness to the recognition and effective management of complex environmental issues. The objective of this paper is to explore how the various stages of consciousness development of top managers can influence, in practical terms, their abilities in and commitment to environmental leadership in different types of SMEs. A case study based on 63 interviews carried out in 15 industrial SMEs showed that the organizations that displayed the most environmental management practices were mostly run by managers at a post-conventional stage of consciousness development. Conversely, the SMEs that displayed less sustainable environmental management (...) practices were all run by managers at conventional stages of development. Drawing upon diverse examples of environmental leadership, this paper analyzes the reasons why the stages of post-conventional consciousness development of top managers seem to foster corporate greening in SMEs. The study also sheds light on the key values and abilities associated with both environmental leadership and the upper-stages of consciousness development, which include a broader and systemic perspective, long-range focus, integration of conflicting goals, collaboration with stakeholders, complexity management, collaborative learning, among others. Taxonomy Based modeling was applied to describe drivers’ mental models of variable message signs (VMS’s) displayed on expressways. Progress in road telematics has made it possible to introduce variable message signs (VMS’s). Sensors embedded in the carriageway every 500m record certain variables (speed, flow rate, etc.) that are transformed in real time into “driving times” to a given destination if road conditions do not change.VMS systems are auto-regulative Man-Machine (AMMI) systems which incorporate a model of the user: if the traffic (...) flow is too high, then drivers should choose alternative routes. In so doing, the traffic flow should decrease. The model of the user is based on suppositions such as: people do not like to waste time, they fully understand the displayed messages, they trust the displayed values, they know of alternative routes. However, people also have a model of the way the system functions. And if they do not believe the contents of the message, they will not act as expected.We collected data through interviews with drivers using the critical incidents technique (Flanagan, 1985). Results show that the mental models that drivers have of the way the VMS system works are various but not numerous and that most of them differ from the“ideal expert” mental model. It is clear that users don’t have an adequate model of how the VMS system works and that VMS planners have a model of user behaviour that does not correspond to the behaviour of the drivers we interviewed. Charles Sanders Peirce (1839-1914) est sans doute le plus grand philosophe americain. Pere du pragmatisme, de la semiotique, d'une phenomenologie originale, d'une metaphysique en rupture totale avec la tradition et membre du cercle tres restreint des fondateurs de la logique contemporaine, Peirce semble avoir defriche et renouvele ce qui etait appele a constituer le coeur de la philosophie contemporaine. Son enseignement bouleversa la pensee de ses contemporains (James, Dewey), mais demeura pourtant longtemps largement incompris. C'est au cours de la (...) seconde moitie du XXe siecle que son oeuvre fut redecouverte et travaillee, notamment sous l'impulsion de Quine, Habermas, Apel, Descombes, et bien d'autres. Cet ouvrage n'est pas un hommage, mais une celebration de l'homme et de la fecondite contemporaine de l'oeuvre. La vie et le travail de Peirce furent animes par la passion du vrai et l'amour de la science, nuances par le rejet de la certitude et la decouverte de la nature sociale de toute signification. Son enseignement subtil, depassant les antagonismes classiques (norme et nature, certitude et scepticisme) renouvela profondement la relation entre la pensee et le reel. (shrink)

Le positivisme semble fournir une solution non philosophique pour la fondation du jugement esthétique, surtout si l’on s’en tient à l’« esthétique d’en bas » de Fechner, qui contredit l’esthétique idéaliste : l’esthétique positiviste consiste dans le fait de mesurer les sensations de plaisir sans prétendre élucider la nature de la beauté. Comme les formes régulières, et symétriques, ou non contradictoires offrent le plus de jouissance, elles sont naturellement préférées par les hommes. La théorie évolutionniste explique comment ce plaisir naturel (...) est lié avec la lutte pour la survie (Spencer). Combinant la loi de l’économie de pensée (Ernst Mach) avec la loi de la conservation, le jugement esthétique positiviste est une part du processus d’adaptation de la vie. De ce point de vue, la théorie dynamogénique de Charles Henry qui réduit le plaisir à certains types de mouvements ne réussit pas complètement à expliquer la différence entre l’agréable et le beau, et à donner une définition satisfaisante de la beauté. Le positivisme doit encore élargir son hypothèse, en réintroduisant la théorie du jeu, qui est hautement développée dans la théorie de l’empathie illustrée par K. Gross et T. Lipps. Hans KELSEN, le plus célèbre philosophe du droit issu du rang des juristes, est surtout connu pour avoir fondé une école juridique (l'Ecole de Vienne) qui radicalise la doctrine du positivisme juridique. Il a défendu, sa vie durant, une conception normativiste du droit et la thèse d'une stricte séparation entre le droit et la science du droit. Si l'on connaît bien en France son ouvrage programmatique sur la Théorie pure du droit, dans sa deuxième édition traduite par Charles Eisenmann, (...) on sait au moins que cette seconde édition, publiée en 1960, n'est pas l'expression définitive de sa pensée. La traduction de la Théorie générale des normes, qui est un ouvrage posthume et inachevé, donne au lecteur français l'occasion de découvrir cette pensée dans ses derniers développements qui rompent en partie avec ceux de l'œuvre précédente. Le Maître viennois y poursuit l'analyse de la norme juridique, entamée dans la Théorie pure du droit, mais il l'approfondit sur certains points et l'infléchit sur d'autres. Il introduit ainsi de nouvelles réflexions sur la signification de la norme et sur ses fonctions, sur l'application et l'interprétation de la norme et également sur le rapport entre la norme et le langage, insistant notamment sur la distinction entre la norme et l'énoncé sur la norme. Par ailleurs, il considère la religion et le droit comme deux ordres normatifs similaires, ce qui le conduit à proposer une théorie vraiment " générale " des normes et non pas seulement une théorie juridique des normes. Il avance une nouvelle interprétation de la norme fondamentale en recourant à l'idée de fiction juridique. Enfin, dans la dernière partie du livre, Kelsen donne le dernier état de sa pensée sur le problème majeur de l'application de la logique au droit. Rompant avec son logicisme antérieur, il nie l'existence d'une logique spécifique au droit et conteste l'application de la logique syllogistique au processus d'application du droit, renouant ainsi avec un volontarisme juridique qu'il avait rejeté au début de son œuvre. Dans cet ouvrage, sous couvert de bâtir une théorie générale des normes, Kelsen construit une théorie de l'interprétation des normes. Il propose donc une herméneutique juridique originale qui intéressera tous ceux qui étudient les sciences normatives (juristes, mais aussi théologiens et spécialistes de l'éthique). Il engage un dialogue avec les représentants anglo-américains de la philosophie du droit, de l'éthique ou de la logique, et il renoue le dialogue avec les auteurs influents à Vienne au début du siècle. In teasing out the diverse origins of our “modern, ecological understanding of epidemic disease” Greater than the parts: holism in biomedicine, 1920–1950, Oxford University Press, Oxford, 1998), historians have downplayed the importance of parasitology in the development of a natural history perspective on disease. The present article reassesses the significance of parasitology for the “invention” of medical ecology in post-war France. Focussing on the works of microbiologist Charles Nicolle and on that of physician and zoologist Hervé Harant, I argue (...) that French “medical ecology” was not professionally insulated from some major trends in parasitology, especially in Tunis where disciplinary borders in the medical sciences collapsed. This argument supports the claim that ecological perspectives of disease developed in colonial context but I show that parasitologists such as Harant built on the works of medical geographers who had called attention to the dynamic and complex biological relations between health and environment in fashioning the field of medical ecology in the mid-1950s. As the network of scientists who contributed to the global emergence of “disease ecology” is widening, both medical geography and parasitology stand out as relevant sites of inquiries for a broader historical understanding of the multiple “ecological visions” in twentieth-century biomedical sciences. Pourtant une lecture attentive des textes pragmaticistes montre que les considérations de théorie sociale et politique ne sont pas absentes de la pensée du philosophe américain. L’article met en avant certains développements relatifs à la critique de l’individu, à la notion de communauté et aux institutions, et tente de surmonter les difficultés philologiques pour fournir une interprétation cohérente.

In 1826, the Pasha of Egypt offered to the King Charles X an unusual present: a living giraffe. While offering remarkable animals was a common practice among monarchs, the choice of a giraffe was somewhat extraordinary since it was the first representative of its kind to set foot in France. The Royal Menagerie of the Paris Muséum national d'histoire naturelle was asked to oversee the transportation of this precious mammal and Étienne Geoffroy Saint-Hilaire, one of its professors, was sent (...) to Marseilles to fetch it on foot all the way back to the capital. The whereabouts of this exotic procession stirred passions throughout the country, generating a fashion craze "à la girafe." The so-called Pasha's giraffe, King's giraffe or French giraffe is also -- and perhaps more importantly -- Geoffroy's giraffe. The giraffe episode is representative of Geoffroy's larger scientific career. Because of its Egyptian flavor, its adventurous aspect, its political and diplomatic undertones, as well as the popular attention and educational opportunities it afforded, that mission was ideally suited for the flamboyant naturalist. So close were the animal's and the French zoologist's fates, that they passed away a couple months apart and both fell into relative oblivion. But even dead and dissected, Geoffroy's giraffe could not easily be dissociated from its companion. The afterlife of its "saintly" relics mirrors the popular and scholarly revival of Étienne Geoffroy Saint-Hilaire, portrayed by some as a forgotten "prophet.". (shrink)

It is well-known that racism is encoded into the social practices and institutions of medicine. Less well-known is that racism is encoded into the material artifacts of medicine. We argue that many medical devices are not merely biased, but materialize oppression. An oppressive device exhibits a harmful bias that reflects and perpetuates unjust power relations. Using pulse oximeters and spirometers as case studies, we show how medical devices can materialize oppression along various axes of social difference, including race, gender, class, (...) and ability. Our account uses political philosophy and cognitive science to give a theoretical basis for understanding materialized oppression, explaining how artifacts encode and carry oppressive ideas from the past to the present and future. Oppressive medical devices present a moral aggregation problem. To remedy this problem, we suggest redundantly layered solutions that are coordinated to disrupt reciprocal causal connections between the attitudes, practices, and artifacts of oppressive systems. Can one refute Berkeleyan phenomenalism by arguing that sensory objects seem mind-independent, and that, according to Berkeley, experience is to be taken at face value? Relying on Mackie’s recent discussion of the issue, I argue, first, that phenomenalism cannot be straightforwardly refuted by relying on perceptual or bodily experience of mind-independence together with the truthfulness of experience. However, I maintain, second that phenomenalism can be indirectly refuted by appealing to the bodily experience of resistance. Such experience presents us with the (...) causal activity of the resisting physical object. If experience is truthful, as the phenomenalist has it, physical objects are causally active. But then their effects no longer depend on our perceiving them, on pain of overdetermination. (shrink)

Reporting and investigating research misconduct can lead to disciplinary proceedings being initiated, and ultimately to disciplinary sanctions being imposed on convicted scientists. The conversion of research misconduct findings into disciplinary sanctions is poorly understood. This article analyses all the disciplinary decisions handed down on appeal by the Conseil national de l'enseignement supérieur et de la recherche (CNESER) between 1991 and 2023, concerning breaches of research integrity by academics and doctoral students ( n = 333). Three findings are highlighted. Firstly, the (...) article describes how the CNESER sanctioned research misconduct even before the notion of research integrity became part of French law, by monitoring scientists’ compliance with “deontological rules”. Secondly, we show that assessing disciplinary fault involves evaluating a much broader set of circumstances than the mere existence of research misconduct, which can explain why the latter do not result in disciplinary sanctions or lighter sanctions. Thirdly, the research highlights situations where research misconduct is intertwined with other allegations, blurring the relative importance of these motives in the awarding of disciplinary sanctions. The article concludes with a call for greater accessibility to the disciplinary decisions handed down by universities in the first instance, as a key next step in gaining a better understanding of the disciplinary response to research misconduct. Derrida récuse avec force cette dernière pour montrer qu’elle dissimule une conception théologico-politique du sujet, accomplissant sur le plan politique la thèse métaphysique du logocentrisme. Mais, à partir de Psychè. Inventions de l’autre, cette vision est infléchie pour développer la signification positive de ce qu’il finit par appeler « l’invention du même » qui constitue l’un des courants majeurs de l’invention (...) techno-scientifique au sens moderne. Solidaire d’une certaine « politique de la recherche », Descartes voit l’une de ses inventions, la « langue universelle », être pour la première fois « contresignée » par Derrida. Cette reconnaissance ne doit pas toutefois cacher un désaccord où se révèle l’originalité de la pensée derridienne de l’invention : résolument anticartésienne, elle propose une inventio qui, en tant qu’elle confond avec le jeu même de la « différance », s’exclut de la cogitatio. Événement immanent à la res extensa qui, pour cette raison, ne saurait être entièrement rationalisé et qui, c’est significatif, en même temps qu’il s’ouvre à la chance, renvoie à une autre conception de l’être-ensemble. Dans cette these publiee en 1989, Olivier Chedin propose une lecture originale de la troisieme Critique de Kant, qui retrace la genese transcendantale des facultes theoriques dans le jugement esthetique. Il s'agit avant tout d'eclaircir le rapport d'un pouvoir theorique de representation avec une faculte esthetique de juger: d'exhiber, dans l'exercice du jugement de gout, l'inauguration d'un pouvoir de connaitre. On comprendra alors comment le sentiment esthetique surgit d'une harmonie originaire des facultes. Mais la Critique du jugement, qui opere (...) d'abord une critique du sentiment, propose aussi une critique de la liberte pure: du beau, je suis en effet seul juge, sans loi ni imperatif, en face d'une promesse de bonheur qui fait, en moi-meme, acte de liberte. Sensible a l'apparition d'une presence ou s'inaugure l'exercice d'un pouvoir de representation, l'auteur applique enfin la these kantienne a l'elucidation des oeuvres d'art - tant celles de l'art classique que celles de l'art non-figuratif le plus contemporain -, suggerant que l'esthetique de Kant n'aurait peut-etre pas trouve en son temps l'art qu'elle meritait? This study examines to what extent different types of CEOs in family firms influence external and internal stakeholder-related CSP as compared to CEOs in nonfamily firms. Linking family CEO and nonfamily CEO with CSR outcomes, we provide evidence that family CEOs are positively associated with both external and internal CSR, whereas nonfamily CEOs within family firms tend to be negatively associated with both external and internal CSR. We show that the incumbent CEO’s age moderates the above relationships, indicating the existence (...) of shifting family priorities and suggesting a tendency toward CSR conformity as the salience of succession concerns increases. This paper defends hedonic intentionalism, the view that all pleasures, including bodily pleasures, are directed towards objects distinct from themselves. Brentano is the leading proponent of this view. My goal here is to disentangle his significant proposals from the more disputable ones so as to arrive at a hopefully promising version of hedonic intentionalism. I mainly focus on bodily pleasures, which constitute the main troublemakers for hedonic intentionalism. Section 1 introduces the problem raised by bodily pleasures for hedonic intentionalism and (...) some of the main reactions to it. Sections 2 and 3 rebut two main approaches equating bodily pleasures with non- intentional episodes. More precisely, section 2 argues that bodily pleasures cannot be purely non-intentional self-conscious feelings, by relying on Brentano’s objection to Hamilton’s theory of pleasure. Section 3 argues that bodily pleasures cannot be non-intentional sensory qualities by relying on Brentano’s objections to Stumpf’s theory of pleasure. Section 4 develops a brentanian view of the intentionality of bodily pleasures by claiming bodily pleasures are directed at a sui generis class of sensory qualities. Section 5 presents an objection to Brentano’s later theory of pleasure according to which all sensory pleasures are directed at sensing acts. (shrink)

En este corto volumen, J. Adam Carter propone que sí. En particular, Carter argumenta que obliga a que consideremos la necesidad de una condición adicional en nuestras caracterizaciones del concepto de conocimiento: además de ser una forma de creencia verdadera justificada, que satisface una condición anti-Gettier, como aceptan la mayoría de los enfoques contemporáneos (en (...) particular desde la perspectiva de la epistemología de las virtudes), el conocimiento debe satisfacer una condición de autonomía. In this paper, I sketch a new model for the format of the content of understanding states, Compressible Graph Maximalism (CGM). In this model, the format of the content of understanding is graphical, and compressible. It thus combines ideas from approaches that stress the link between understanding and holistic structure (like as reported by Grimm (in: Ammon SGCBS (ed) Explaining Understanding: New Essays in Epistemollogy and the Philosophy of Science, Routledge, New York, 2016)), and approaches that emphasize the connection between (...) understanding and compression (like Wilkenfeld (Synthese 190(6):997–1016, 2018)). I argue that the combination of these ideas has several attractive features, and I defend the idea against some challenges. (shrink)

Counterpossibles, counterfactuals conditional with impossible antecedents, are notoriously contested; while the standard view makes them trivially true, some authors argue that they can be non-trivially true. In this paper, I examine the use of counterfactuals in the context of games, and argue that there is a case to be made for their non-triviality in a restricted sense. In particular, I examine the case of retro problems in chess, where it can happen that one is tasked with evaluating counterfactuals about illegal (...) positions. If we understand illegality as a type of restricted impossibility, those counterfactuals are non-trivial counterpossibles. I suggest that their non-triviality stems from their role in practices of rule coordination and revision, and suggest that this model could be generalized to counterpossibles in different domains. I then compare the approach to the accounts of Vetter 2016 and Locke 2019. (shrink)

This new edition of Charles Fried's 'Medical Experimentation' includes a general introduction by Franklin Miller and the late Alan Wertheimer, a reprint of the 1974 text, an in-depth analysis by Harvard Law School scholars I.
