This article considers the ethical implications of prospective payment from the perspective of physicians and other health care practitioners. It focuses on the argument that prospective payment creates ethical conflict by giving physicians an economic incentive to do less for their patients. This argument is criticized in two respects. First, available evidence is reviewed which suggests that the incentives actually created by different prospective payment schemes and their effect on "optimal" patterns of practice is uncertain. Further, it is pointed out (...) that ethical conflict originates in the dual role of physicians as agents and suppliers of service. Recognizing that such conflict exists under any payment mechanism, a better focus for the ethical evaluation of prospective payment is suggested that considers whether the incentive to do less is likely to have adverse effects on physician decisions, relative to decisions made under other payment mechanisms. The phenomenon of ‘plant sleep’ – whereby vegetables rhythmically open and close their leaves or petals in daily cycles – has been a continual source of fascination for those with botanical interests, from the Portuguese physician Cristóbal Acosta and the Italian naturalist Prospero Alpini in the sixteenth century to Percy Bysshe Shelley and Charles Darwin in the nineteenth. But it was in 1757 that the topic received its earliest systemic treatment on English shores with the prodigious author, botanist, actor, (...) and Royal Society critic John Hill’s The Sleep of Plants, and Cause of Motion in the Sensitive Plant. As the present article aims to illustrate, Hill and his respondents used this remarkable behaviour, exhibited by certain plants, as a lens through which to reassess the nature of vegetables, and to address pressing questions of wider natural philosophical import, particularly the degree of continuity between the structures and functions of plants and animals and whether similar mechanisms necessarily account for related movements in different life forms. These disputes, this paper contends, also had profound methodological implications regarding the proper way to conduct experiments, the extent to which it was acceptable to extrapolate from observations, and the status of causal explanations. This chapter discusses the nature of software maintenance in light of software’s ontological status. A realist view of software need not commit us to the otiose position that software maintenance is impossible. Many philosophers and computer scientists have been concerned with drawing attention to software’s dual nature, its being both symbolic and physical, abstract and concrete. There are strong connections to be found between this topic and recent investigations in the philosophy of linguistics, particularly the metaphysics of words. It is (...) shown, contra Irmak, that software can be best understood through a realist type-token distinction employing an ontology of composite objects that was put forward by Katz. This approach employs both non-spatiotemporal abstract types and tokens of those types. Further developing Katz’s realist approach can help to make better sense of the dual nature of computational artefacts and their maintenance than the alternatives outlined. Young claims that a prevalent imbalanced view of maintenance as solely conservative is due to a misunderstanding of the nature of artefacts as being realisations of their producers’ intentions. This is a problem for theories of artefacts that employ intentions, such as the one involved with the realist view of software and software maintenance. Software maintenance on this view is not solely conservative but also adaptive and enhancive, constituting a source of counterexamples to Young’s claim. An alternative explanation of the imbalanced view is provided, based on observations by software engineers, especially Sommerville. (shrink)

In the recent literature on the ontology and metaphysics of words, Jerrold J. Katz’ type-realist or ‘Platonist’ view is often mentioned but never spelt out in detail. This is perhaps understandable in light of the fact that his most developed statements on this matter are effectively offshoots of his main discourse in Realistic Rationalism (Katz, 1998a). His direct statements about the metaphysics of words are few and far between and are scattered across the text. This situation has often led to (...) misunderstandings or misconstruals about the exact nature of his view, some of which is buried in footnotes, and some of which must be reconstructed. Hence, criticisms of Katz’ approach have been wide of the mark or otherwise unproductive. In this article, I provide a remedy for this situation by drawing together and abstracting the relevant material regarding the metaphysics of words from its context and reconstructing the theory. I also develop the view further through resolving some potential problems and omissions, and by responding to recent criticism that the approach has received in the burgeoning literature on the philosophy of words. I hope that this will help to clarify the theory and lead to further debate and development on all sides of the discussion. (shrink)

In recent years there has been an explosion of interest in Artificial Intelligence (AI) both in health care and academic philosophy. This has been due mainly to the rise of effective machine learning and deep learning algorithms, together with increases in data collection and processing power, which have made rapid progress in many areas. However, use of this technology has brought with it philosophical issues and practical problems, in particular, epistemic and ethical. In this paper the authors, with backgrounds in (...) philosophy, maternity care practice and clinical research, draw upon and extend a recent framework for shared decision-making (SDM) that identified a duty of care to the client's knowledge as a necessary condition for SDM. This duty entails the responsibility to acknowledge and overcome epistemic defeaters. This framework is applied to the use of AI in maternity care, in particular, the use of machine learning and deep learning technology to attempt to enhance electronic fetal monitoring (EFM). In doing so, various sub-kinds of epistemic defeater, namely, transparent, opaque, underdetermined, and inherited defeaters are taxonomized and discussed. The authors argue that, although effective current or future AI-enhanced EFM may impose an epistemic obligation on the part of clinicians to rely on such systems' predictions or diagnoses as input to SDM, such obligations may be overridden by inherited defeaters, caused by a form of algorithmic bias. The existence of inherited defeaters implies that the duty of care to the client's knowledge extends to any situation in which a clinician (or anyone else) is involved in producing training data for a system that will be used in SDM. Any future AI must be capable of assessing women individually, taking into account a wide range of factors including women's preferences, to provide a holistic range of evidence for clinical decision-making. In this revised edition of his 1979 classic Political Theory and International Relations, Charles Beitz rejects two highly influential conceptions of international theory as empirically inaccurate and theoretically misleading. In one, international relations is a Hobbesian state of nature in which moral judgments are entirely inappropriate, and in the other, states are analogous to persons in domestic society in having rights of autonomy that insulate them from external moral assessment and political interference. Perhaps the most readable and accessible of the great works of scientific imagination, The Origin of Species sold out on the day it was published in 1859. The publication of Darwin's On the Origin of Species in 1859 ignited a public storm he neither wanted nor enjoyed. Having offered his book as a contribution to science, Darwin discovered to his dismay that it was received as an affront by many scientists and as a sacrilege by clergy and Christian citizens. To answer the criticism that his theory was a theory only, and a wild one at that, he published two volumes in 1868 to demonstrate that evolution was (...) obvious to anyone who cared to look at a bull in a pasture or a dog on a hearth. In response to those who insisted that species were distinct since creation, Darwin pointed to breeders of pigs and pigeons. In reply to those who protested that human intervention is one thing and natural selection another, he argued, "If organic beings had not possessed an inherent tendency to vary, man could have done nothing." To counter those who scorned his descriptions of species in exotic places, he submitted local evidence of cabbages and cauliflower. Based on a wide array of sources, from ancient pictographs to Polish roosters, from skins and from skeletons, from scientific journals and breeding manuals, Darwin assembled a mass of proof--and a hypothesis about species reversion that risked his reputation anew. The Variation of Animals and Plants under Domestication is a two-volume compilation of his thorough and intensive research and the revolutionary conclusions that resulted. The first portion of his work is dedicated to a meticulous analysis of various aspects of plant and animal life, including an inventory of varieties and their physical and behavioral characteristics, investigation of the impact of a species' surrounding environment and the role that both natural and forced changes in this environment have had. Gaining ethical clearance to conduct a study is an important aspect of all research involving humans but can be time-consuming and daunting for novice researchers. This article stems from a larger ethnographic study that examined research capacity building in Irish nursing and midwifery. Data were collected over a 28-month time frame from a purposive sample of 16 nurse or midwife research fellows who were funded to undertake full-time PhDs. Gaining ethical clearance for their studies was reported as an early ‘rite (...) of passage’ in the category of ‘labouring the doctorate’. This article penetrates the complexities in Irish clinical research ethics by describing the practices these nurse and midwife researchers encountered and the experiences they had. The key issue of representation that occurred in the context of ‘medicalized’ research ethics is further explored including its meaning for nursing or midwifery research. (shrink)

SCL (TAL1/TCL5) is a member of the helix‐loop‐helix family of transcription factors. Originally identified because of its involvement in a tumour‐specific chromosomal translocation, overexpression of the SCL gene is the most common molecular abnormality found in human T cell leukaemia. Transgenic models have now formally demonstrated that overexpression of SCL within the T cell lineage is capable of causing malignant transformation. Gene targeting experiments have revealed that the SCL gene is crucial for the development of primitive haematopoiesis in the mouse (...) and is also required for the generation of all adult haematopoietic lineages. Biochemical studies have indicated some of the proteins which interact with SCL and this has refined the hypotheses concerning the mechanisms by which SCL plays a role in leukaemogenesis and haematopoietic development. The Tattvasaṃgraha, or Encyclopedia of Metaphysics, is the most influential and most frequently studied philosophical text from the late period of Indian Buddhism. This edition includes verses by Śāntarakṣita (c. 725-788 CE), which are clarified and expounded in the commentary of his student Kamalaśīla (c. 740-795 CE); both of these authors played crucial roles in founding the Buddhist tradition of Tibet. In this book, Charles Larmore develops an account of morality, freedom, and reason that rejects the naturalistic metaphysics shaping much of modern thought. This article considers an interpretative model for the study of Heraclitus, which was first put forward by Alexander Mourelatos in 1973, and draws upon a related model put forward by Julius Moravcsik beginning in 1983. I further develop this combined model and provide a motivation for an interpretation of Heraclitus. This is also of interest for modern metaphysics due to the recurrence of structurally similar problems, including the ‘colour exclusion’ problem that was faced by Wittgenstein. Autonomy is a vital principle in medical law and ethics. It occupies a prominent place in all medico-legal and ethical debate. Charles Babbage was an English mathematician, philosopher and mechanical engineer who invented the concept of a programmable computer. From 1828 to 1839 he was Lucasian Professor of Mathematics at Cambridge, a position whose holders have included Isaac Newton and Stephen Hawking. A proponent of natural religion, he published The Ninth Bridgewater Treatise in 1837 as his personal response to The Bridgewater Treatises, a series of books on theology and science that had recently appeared. Disputing the claim that science disfavours (...) religion, Babbage wrote 'that there exists no such fatal collision between the words of Scripture and the facts of nature'. He argues on the basis of reason and experience alone, drawing a parallel between his work on the calculating engine and God as the divine programmer of the universe. Jerrold J. Katz often explained his semantic theory by way of an analogy with physical atomism and an attendant analogy with chemistry. In this chapter, I track the origin and uses of these analogies by Katz, both in explaining and defending his decompositional semantic theory, through the various phases of his work throughout his career.

I offer an examination of a core element in the reflectiveness of Heraclitus’ thought, namely, his rebuke of polymathy . In doing so, I provide a response to a recent claim that Heraclitus should not be considered to be a philosopher, by attending to his paradigmatically philosophical traits. Regarding Heraclitus’ attitude to that naïve form of ‘wisdom’, i.e., polymathy, I argue that he does not advise avoiding experience of many things, rather, he advises rejecting experience of things as merely many (...) independent things in their manifoldness , and, instead, to understand their unity and thereby to unify our knowledge of them. The three main kinds of theory in normative ethics, namely, consequentialism, deontology, and virtue ethics, are often presented as the ‘palette’ from which we may choose, or use as a starting point for an investigation. However, this way of doing ethics and philosophy, by the palette, may be leading some of us astray. It has led some to believe that all that there is to ethics, and to ethics of AI, is given in terms of these already devised petrified categories (...) of theory. It has also led others to abandon normative ethics and philosophy altogether and to resort to descriptive methods that are then used to justify action. I wish to argue that (1) we should not abandon traditional philosophical approaches, but (2a) this does not entail that the petrified palette should constitute the beginning of our philosophical investigations. Further, (2b) I recommend a non-methodological approach in which it is instead radical questions that spur these investigations, which arise through consideration of the practical actions (potential or otherwise) of machines and their programmers. This paper combines the social psychology concept of moral elevation with the evolutionary concept of traditions as descendant-leaving strategies to produce a new explanation of the role of saints in Christianity. Moral elevation refers to the ability of prosocial acts to inspire people to engage in their own acts of charity and kindness. When morally elevating stories and visual depictions become traditional by being passed from one generation to the next, they can produce prosocial behavior advantageous to survival and reproduction (...) among many generations of descendants. Traditions that increase the number of descendants in future generations can be seen as descendant-leaving strategies. Stories and visual depictions of the sacrifices of saints appear to be designed to produce states of moral elevation, and they have been transmitted from one generation to the next for many centuries. We propose that this ability of sacrificing saints to inspire future generations to engage in prosocial acts has contributed to the continuation and spread of Christianity. (shrink)
