In considering a wide range of themes in the fields of constitutional law, public finance, and legal reform, Bentham places the problem of official corruption at the centre of his analysis. He contrasts his own recommendations for good administration, which he (...) had fully developed in his magisterial Constitutional Code, with the severe deficiencies he saw in English practice. The core of the volume consists of four major essays directed against the principles and policies of four leading statesmen: Edmund Burke, George Rose, Robert Peel, and Lord Chancellor Eldon. Of particular concern to Bentham were the abuses sanctioned by the judges and their officials in the Westminster Hall courts, which, he argues, resulted in the denial of justice to the majority of the population. In this article, I defend the idea that Bentham's international political theory entails a cosmopolitan dimension. First, I explain that Bentham rejects two pillars of internationalism, namely, the sovereign's unconstrained autonomous power and authority in international politics, and the legal and moral personality of the state in the international realm. This critique leads Bentham to construct a complex international political theory which places the issue of states’ responsibility at its centre. Bentham's international theory articulates a (...) minimalist international system of cooperation between states and an institutional model of public officials’ responsibilities that together play the crucial role in securing the greatest happiness of the greatest number in the world. In this last part, I explain how Bentham's international political theory relies heavily on the responsibilities of states, a set of responsibilities that encompasses both national and cosmopolitan responsibilities that public officials in each state hold. When examining the relevance of Bentham’s thinking to debates on cultural value, we should look, first of all, at the significance of utility as an independent ethical principle. Bentham finds the term ‘utility’ in the philosophy of David Hume, condemns Hume’s use of this term as ambiguous, and establishes utility as an independent ethical principle that is opposed to Hume’s preference for delicacy of sentiment and good taste. I argue that Hume is averse to the very thing that (...) Bentham places at the centre of his ethics, namely a reckoning that we can all make with how pleasure shapes our sense of self. Bentham places us under an obligation to work out what our pleasures mean for us, how they situate us in the world, and how others will respond to what gives us the most pleasure. This working hypothesis on what gives each of us the most pleasure, must be conveyed in neutral, non-judgemental terms. Bentham espouses simple amusements, including games of push-pin and solitaire, as examples of how a recalculation of the possibilities for increasing pleasure and diminishing pain can take place, in defiance of cultural evaluations of what is ‘high’ and ‘low’. These distinctions of high and low culture are only one example of how definitions of culture affect the social organization of pleasure, within a broader conception of cultural value. Bentham asks whether definitions of cultural value are equitable and just, when seen in relation to the ethical aim of prolonging pleasure and diminishing pain. (shrink)

Jeremy Bentham was an ardent secularist convinced that society could be sustained without the support of religious institutions or beliefs. This is writ large in the commonly neglected books on religion he wrote and published during the last twenty-five years of his life. However his earliest writings on the subject date from the 1770s, when as a young man he first embarked on his calling as a legal theorist and social reformer. In Secular Utilitarianism, James Crimmins illustrates the nature, extent, and depth of Jeremy Bentham's concern with religion, from his Oxford days of first doubts to the middle years of quiet unbelief, and finally, the zealous atheism and secularism of his later life. Dr Crimmins provides an interpretation of Bentham's thought in which his religious views, hitherto of little interest to Bentham scholars, are shown to be integral: on the one hand intimately associated with the metaphysical, epistemological, and psychological principles which gave shape to his system as a whole, and on the other central to the development of his entirely secular view of society. The first five volumes of the Correspondence of Jeremy Bentham contain over 1,300 letters written both to and from Bentham over a 50-year period, beginning in 1752 (aged three) with his earliest surviving letter to his grandmother, and ending in 1797 with correspondence concerning his attempts to set up a national scheme for the provision of poor relief. Against the background of the debates on the American Revolution of 1776 and the French Revolution of 1789, to which he (...) made significant contributions, Bentham worked first on producing a complete penal code, which involved him in detailed explorations of fundamental legal ideas, and then on his panopticon prison scheme. Despite developing a host of original and ground-breaking ideas, contained in a mass of manuscripts, he published little during these years, and remained, at the close of this period, a relatively obscure individual. Nevertheless, these volumes reveal how the foundations were laid for the remarkable rise of Benthamite utilitarianism in the early nineteenth century. Bentham’s early life is marked by his extraordinary precociousness, but also family tragedy: by the age of 10 he had lost five infant siblings and his mother. The letters in this volume document his difficult relationship with his father and his increasing attachment to his surviving younger brother Samuel, his education, his interest in chemistry and botany, and his committing himself to a life of philosophy and legal reform. Bentham's best-known book stands as a classic of both philosophy and jurisprudence. The 1789 work articulates an important statement of the foundations of utilitarian philosophy — it also represents a pioneering study of crime and punishment. Bentham's reasoning remains central to contemporary debates in moral and political philosophy, economics, and legal theory.

The new critical edition of the works and correspondence of Jeremy Bentham is being prepared and published under the supervision of the Bentham Committee of University College London. In spite of his importance as jurist, philosopher, and social scientist, and leader of the Utilitarian reformers, the only previous edition of his works was a poorly edited and incomplete one brought out within a decade or so of his death. Eight volumes of the new Collected Works, five of correspondence, (...) and three of writings on jurisprudence, appeared between 1968 and 1981, published by the Athlone Press. Further volumes in the series since then are published by Oxford University Press. The overall plan and principles of the edition are set out in the General Preface to The Correspondence of Jeremy Bentham, vol. 1, which was the first volume of the Collected Works to be published.An Introduction to the Principles of Morals and Legislation, Jeremy Bentham's best-known work, is a classic text in modern philosophy and jurisprudence. The material in this volume constitutes a philosophical commonplace book, compiled by Bentham in the mid-1770s, in which he worked out the foundational ideas for his new science of legislation. One of Bentham's central concerns was the development of an adequate ontological and epistemological basis for legal terminology, and the replacement of the traditional terminology of English law with that of universal jurisprudence. The Panopticon project for a model prison obsessed the English philosopher Jeremy Bentham for almost 20 years. In the end, the project came to nothing; the Panopticon was never built. But it is precisely this that makes the Panopticon project the best exemplification of Bentham’s own theory of fictions, according to which non-existent fictitious entities can have all too real effects. There is probably no building that has stirred more philosophical controversy than Bentham’s Panopticon. The Panopticon is (...) not merely, as Foucault thought, “a cruel, ingenious cage”, in which subjects collaborate in their own subjection, but much more—constructing the Panopticon produces not only a prison, but also a god within it. The Panopticon is a machine which on assembly is already inhabited by a ghost. The following sheets were, as the note on the opposite page expresses, printed so long ago as the year 1780. The design, in pursuance of which they were written, was not so extensive as that announced by the present title. They had at that time no other destination than that of serving as an introduction to a plan of a penal code in terminus, designed to follow them, in the same volume.

The word utiliarianism was coined by Jeremy Bentham in 1781 in a letter to friend in which he said: "A new religion would be an odd sort of thing without a name." While the doctrine never quite became a religion, its thesis, as expressed by Mill in the first essay in this volume-that the good and right are to be defined as that which promotes happiness-became the dominant naturalistic theory of the nineteenth century and provided the moral basis for (...) classical liberalism. This volume opens with the marginal contents corresponding to Bentham's first sustained discussions, now lost, of political economy and public finance, written in French, probably in 1786, for Projet Matière; three related appendices follow. Defence of Usury was published in 1787, and was well received and quickly translated. In preparing a second edition in 1790, Bentham drafted considerable additional material which is reproduced in five appendices. Also in 1790 Bentham began an introductory handbook Manual of Political Economy, (...) the surviving text of which is supplemented by seven appendices containing preparatory materials. Political Tactics, composed for the Estates General just before the French Revolution, is one of Bentham's most original works. It contains the earliest and perhaps most important theoretical analysis of parliamentary procedure ever written. It was subsequently translated into many languages and has had a far-reaching influence -- as recently as the early 1990s it was reprinted by the Spanish Cortes.

A critical edition of three works of Bentham, Deontology and The Article on Utilitarianism were previously unpublished. Together with An Introduction to the Principles of Morals and Legislation, they provide a comrehensive exposition of Bentham's views. Based entirely on manuscripts by Bentham of his amanuenses, this edition's full introduction linking the three works. Each work is supplemented with detailed and critical notes.
