It is widely held that our beliefs can be epistemically faultless despite being morally flawed. Theories of moral encroachment challenge this, holding that moral considerations bear on the epistemic status of our attitudes. According to attitude-based theories of moral encroachment, morality encroaches upon the epistemic standing of our attitudes on the grounds that we can morally injure others with our epistemic practices. In this paper, I aim to show that current attitude-based theories have asymmetric mechanisms: moral features only make it (...) harder for attitudes to secure epistemic merits. I argue that, if attitudes can incur moral injury, failure to form attitudes can too. To make sense of this, I contend, attitude-based accounts require symmetric mechanisms, allowing that moral considerations make it both harder and easier for attitudes to attain epistemic merits. I maintain that, once we recognize this, attitude-based encroachment views must soon concede that they sometimes demand we believe against the evidence. (shrink)

The historian Caroline Walker Bynum, who solicited and organized this set of five case studies, explains in her introduction to them that their intent is to bypass the currently popular and unsupported claim that the humanities have practical relevance and, instead, to offer ruminative descriptions of what happens when teachers and students meet to discuss texts and objects. Die Verknüpfung von Alter und Weisheit wird in der antiken paganen und biblischen Literatur so ambivalent beurteilt, dass Zustimmung sowie Ablehnung des Konzepts stets nebeneinander existierten. Während sich die Vorstellung der Altersweisheit in der antiken Literatur als stabil und variabel zugleich erwies, blieb deren systematische Untersuchung in der Forschung bisher lückenhaft. Die Dissertation gibt nicht nur einen Überblick über die Bedeutungsnuancen der antiken Weisheitsvorstellung und die variablen Altersbilder, sondern beschäftigt sich besonders mit der Frage, inwiefern die spätantiken Bischöfe Ambrosius und (...) Paulinus pagane und biblische Traditionen zur Vorstellung der Altersweisheit aufgreifen und zu christlichen Konzepten umarbeiten. Mögliche Kontinuitäten, Modifikationen und Neuerungen im Umgang mit den tradierten Motiven werden so als spezifisch spätantik-christlich eruiert. Beide Bischöfe trugen zur Etablierung der christianisierten Verknüpfung von sapientia und senectus bei, sodass die Konstruktion der Altersweisheit auch in der Spätantike zu einem Stück antiker Geistesgeschichte wurde, anhand derer sich gesellschaftliche und sprachliche, philosophische und religiöse Konventionen, Strömungen und Wandlungen nachzeichnen lassen. Bisher ist die Rolle von Ethikkomitees und Ethikberatenden als Ressource im Umgang mit der Covid-19-Pandemie ungeklärt. Im vorliegenden Beitrag wird diskutiert, worin spezifische Herausforderungen bei der ethischen Bewertung von Fragen an Ethikkomitees im Pandemiekontext bestehen und welche möglichen Aufgaben für Ethikberatende identifiziert werden könnten. Dabei wird die Ansicht vertreten, dass es für die kompetente, professionelle Bearbeitung dieser Fragen hilfreich wäre, das theoretische Grundverständnis der Ethikberatung für den Pandemiekontext zu reflektieren, die begründungstheoretischen, normativen Argumente aktueller Publikationen und Stellungnahmen der Fachgesellschaften zu (...) diskutieren und Weiterbildungspotenzial sowie Kompetenzgrenzen zu identifizieren. Für werden zur Kompetenzerweiterung Public-Health-Ethik und Ethik der Menschenrechte vorgeschlagen, psychische Entlastung bei ‚moralischem Stress‘ wird als ethisch-psychologischer Kooperationsbereich diskutiert und die explizite Abgrenzung vom juristischen Bereich wird empfohlen. Ethikberatung könnte den konstruktiven Umgang mit ethischen Fragen im Pandemiekontext fördern, die Qualität von Entscheidungs- und Bewertungsprozessen verbessern und in der Versorgungspraxis pragmatische, konkrete Hilfestellung anbieten. Patientenverfügungen werden häufig als Ausdruck eines Bestrebens verstanden, ausschließlich selbst über die eigene Behandlung am Lebensende oder in anderen medizinisch kritischen Situationen entscheiden zu wollen. Kritische Stimmen wenden sich gegen eine Marginalisierung von Angehörigen oder ein verkürztes Verständnis von Autonomie, welches von der Relationalität als Grundgegebenheit menschlicher Existenz abstrahiert. Im vorliegenden Beitrag wird zunächst der rechtliche Rahmen beschrieben, der die Praxis bezüglich Patientenverfügungen und Stellvertretern in der Schweiz bestimmt. Zudem werden in der Schweiz verfügbare Patientenverfügungsformulare hinsichtlich der darin vorgesehenen Rolle (...) von Angehörigen bzw. nahe stehenden Personen analysiert. Abschließend soll gefragt werden, ob Patientenverfügungen, wie sie derzeit im Schweizer Kontext genutzt werden, wirklich als Instrumente rein individualistischer Selbstbestimmung verstanden werden können. Angesichts der kulturellen und religiösen Vielfalt zeitgenössischer multikultureller Gesellschaften sowie der von ihren Minderheiten erhobenen Forderungen nach Anerkennung geben weder der klassische Republikanismus noch der L iberalismus eine befriedigende Antwort auf die Frage, wie eine dieser neuen sozialen Realität angemessene politische Erziehung auszusehen hätte. Die Schule kann nur dann ihrer Aufgabe gerecht werden und zur Beilegung unvermeidlicher sozialer Konflikte beitragen, wenn politische Erziehung überdacht und geprüft wird, wie sie das Zusammenleben unterschiedlicher Kulturen fördern kann. Die Bewegung des Transhumanismus strebt die Verschmelzung von Mensch und Technik an, d. h. die technologische Transformation des Menschen in ein posthumanes Wesen. Mithilfe der technologischen Wissenschaft soll erreicht werden, was bisher im religiösen Glauben erhofft wurde: ewiges Leben. Durch das transhumanistische Weltbild ist die Theologische Anthropologie herausgefordert: Stellt eine Verschmelzung von Technik und Mensch den neuen entwicklungstechnologischen Gang oder Untergang des Menschen dar? Nicht allein eine kritische Stellungnahme steht hierbei im Fokus, sondern ebenso das selbstreflexive Überdenken, ob durch die (...) voranschreitende Technologisierung und Digitalisierung der Anthropologie Leerstellen innerhalb des Diskurses der Theologischen Anthropologie aufgedeckt werden. Der Aufsatz sondiert das geisteswissenschaftliche Feld einer Theorie von Praktiken mit dem Fluchtpunkt der Literaturwissenschaften. In der germanistischen Forschung hat der Fokus auf Praktiken zur Neujustierung der Literatursoziologie geführt, der eine dezidierte praxeologische Begründung fehlt. Die ›Ursprünge‹ praxeologischer Theoriebildung liegen in der Soziologie, deren aktuelle Positionierungen die Analyse von Praktiken mit poststrukturalistischen Theoremen zu verbinden suchen. Dabei werden Michel Foucaults Diskurskonzept und dessen Arbeiten zu den antiken Praktiken des Selbst in ein kultursoziologisches Programm integriert (Reckwitz). Der Beitrag argumentiert, dass dies (...) Foucaults eigenem Verständnis von Praktiken zuwiderläuft. Denn anders als die sozialtheoretische Praxeologie denkt Foucault Praktiken nicht als ein zwischen agency und structure vermitteln- des Handlungsterrain. Sein doppelter Praktikenbegriff stellt eine unhintergehbare Interdependenz von Prozessen der Disziplinierung und ästhetischer Formung, von Norm und Freiheit zentral und bringt so einen genuin ethischen Gehalt von Praktiken ins Spiel. Foucaults Ausführungen zur ästhetischen Form von Praktiken sind aber so wenig spezifisch, dass hier ein Einsatzpunkt für die Literaturwissenschaften liegt, den ›späten‹ Foucault für eine Revision der Dynamiken von Ethik und Ästhetik produktiv zu machen. In dieser Perspektive lassen sich die Künste nicht als Zirkulationsräume ethischen Wissens, sondern als praktische Erprobungsfelder moralischer Formungsprozesse verstehen, in denen sich Normerfüllung und agency verbinden. Anvisiert wird dergestalt ein Beitrag zur Theorie des Zusammenhangs von Ethik und Ästhetik, der es ermöglicht, die ästhetische Formung praktischer Moralität und in diesem Sinne das ethos, ja die konkreten Tugendübungen der Literatur zu untersuchen. Kants Ethik ist gut begründbar, es fehlt ihr aber anscheinend an Motivationskraft. Wie soll man nach Kant dazu bewegt werden, moralisch zu sein? Seine ethischen Schriften problematisieren, was die Anthropologie zu lösen versucht: Motivation zum moralischen Handeln. Diese "Lösung" steht in einer Tradition europäischer Moralistik, in der es darum geht, Moral anthropologisch zu reflektieren. Sie beschreiben einen Handlungsraum, in dem Regeln der Klugheit, Manieren und Höflichkeit und ein Konzept des "moralischen Scheins" das selbstbestimmte Individuum leiten. Die Aufgabe des vorliegenden Buches (...) ist es, Kant systematisch, also nicht allein historisch, durch die Leitfrage nach Motivation und Begründung in den Horizont moralistischer Ethik einzufügen. Die theoretische Verortung von Kants Moralsystem und seine Einordnung in die "historische Semantik" von Moral und Anthropologie nimmt Maß an Niklas Luhmanns Ansätzen zu diesem Thema.. (shrink)

Wie kann eine auf Erhaltung angelegte konservatorische Praxis den Aufführungen des Verfalls als einer zeitgenössischen Vanitas-Darstellung gerecht werden? Die enge Verknüpfung der konservatorischen Handlungen und Reflexionen mit dem Einsatz ephemerer, auf den Ablauf in der Zeit hin gedachten Materialien wird von der These flankiert, dass es in diesen Werken um die fortwährende Präsenz des Vanitas-Gedankens geht.

Spannungsverhältnisse zwischen Natur und Mensch prägen unseren Alltag, unsere Sprache und öffentliche Diskurse im Themenspektrum der Nachhaltigkeit. Letztere entfaltet normatives Potential, steht bildungs- und wirtschaftspolitisch im Zentrum und bildet sich in der Literatur ab. Natur, Umwelt und Nachhaltigkeit sind Themen, die viele Wissensdomänen berühren – von naturwissenschaftlichen Fragen über rechtliche Aspekte bis zu Überlegungen der Sprachkritik. Sie bedürfen einer Betrachtung aus verschiedensten Fachdisziplinen, wie es etwa auch im Rahmen der Environmental Humanities gefordert wird. Um in diesem Zuge die Relevanz sprachbezogener (...) We report on an unpublished and previously unknown manuscript of John von Neumann and contextualize it within the development of the theory of shock waves and detonations during the nineteenth and twentieth centuries. Von Neumann studies bombs comprising a primary explosive charge along with explosive booster material. His goal is to calculate the minimal amount of booster needed to create a sustainable detonation, presumably because booster material is often more expensive and more volatile. In service of this goal, he formulates (...) and analyzes a partial differential equation-based model describing a moving shock wave at the interface of detonated and undetonated material. We provide a complete transcription of von Neumann’s work and give our own accompanying explanations and analyses, including the correction of two small errors in his calculations. Today, detonations are typically modeled using a combination of experimental results and numerical simulations particular to the shape and materials of the explosive, as the complex three dimensional dynamics of detonations are analytically intractable. Although von Neumann’s manuscript will not revolutionize our modern understanding of detonations, the document is a valuable historical record of the state of hydrodynamics research during and after World War II. Nearly five centuries have elapsed since Apollonia von Freyberg departed from her convent in Mülhausen. Little is known about this Poor Clare nun who witnessed the dissolution of her conventual shelter in the midst of her community’s protracted financial struggles as well as spiritual conflict catalyzed by the emerging Reformation. It is fortuitous, however, that documents related to Apollonia are preserved at the National Gallery of Art in Washington, DC and at the Archives de Mulhouse, in Mulhouse, France. Die öffentliche Diskussion um die „personalisierte Medizin“ legt nahe, dass mit diesem medizinischen Ansatz hohe Erwartungen an einen Beitrag zur klinischen Versorgung verbunden werden. Über die Wahrnehmungen und Bewertungen klinisch tätiger Ärzte ist jedoch wenig bekannt. Die vorliegende qualitative Interviewstudie gibt einen Einblick bezüglich des Einflusses „personalisierter Medizin“ auf die klinische Praxis aus ärztlicher Perspektive. Die Ärzte im vorliegenden Sample nehmen „personalisierte Medizin“ zwar als einen medizinischen Fortschritt wahr, sehen allerdings keine grundsätzliche Veränderung der bisherigen medizinischen Praxis. Als zentrales Problem (...) wird die Handhabung und Verwertung von molekulargenetischen Informationen für Diagnose und Therapie in der klinischen Praxis thematisiert. In Anbetracht der Ergebnisse muss infrage gestellt werden, ob „personalisierte Medizin“ nicht das Gegenteil von dem, was ihr Name nahe legt – eine personenorientiertere Medizin – bewirkt. Die Strategien im Umgang mit den Informationsmassen produzieren selbst neue Herausforderungen, die ein Hindernis für eine personenorientierte Medizin darstellen könnten. (shrink)

Diese Studie zeichnet die Entwicklung von Moralpolitiken in Deutschland seit den 1960er Jahren bis heute nach und analysiert moralpolitische Regulierungsmuster. Im Fokus stehen die Biopolitik (embryonale Stammzellforschung, Schwangerschaftsabbruch und Sterbehilfe), die Sexualpolitik (Homosexualität, Gleichgeschlechtliche Partnerschaften, Pornographie und Prostitution), die Suchtpolitik (Drogenkonsum und Glücksspiel) und die Waffenpolitik.

Als einer der prominentesten Vertreter seines Faches hat Horst Bredekamp nicht nur die Kunst- und Bildgeschichte tiefgehend geprägt, sondern auch in Kultur und Politik gewirkt. Dabei hat er es geschafft, belastbare Brücken zwischen diesen oft weit auseinander liegenden Bereichen zu schlagen. Ein Porträt Bredekamps als Gelehrter und disziplinübergreifender Vermittler scheint aufgrund dieser Fülle an Handlungsebenen nur über ein Tableau von Berichten derjenigen möglich, die mit ihm über die Jahre im Austausch standen, ihn begleitet und geprägt, mit ihm diskutiert und gestritten (...) haben. Dabei sind die Fragen an diese Wegbegleiter auch gleichzeitig an den Wissenschaftsbetrieb des 21. Zusammenfassung Ausgehend von den Erfahrungswerten sechs Klinischer Ethiker*innen an Universitätsklinika in Deutschland wurde eine strukturierte Auseinandersetzung mit dem Arbeitsfeld der Fortbildungen im Rahmen der Klinischen Ethikarbeit vorgenommen. Die Zusammenarbeit wurde von der Fragestellung geleitet, was bei der Konzeption einer Ethik-Fortbildung innerhalb einer Einrichtung zu berücksichtigen ist. Der methodische Zugang zur Beantwortung der explorativen Fragestellung bestand in einem mehrstufigen, deskriptiven Verfahren, das alternierend in gemeinsamen Arbeitssitzungen und individueller Arbeit zwischen den Sitzungen umgesetzt wurde. Als Resultat zeigt der Aufsatz eine Übersicht über (...) die Bandbreite möglicher Fortbildungsformate auf, die denjenigen Hilfestellung bieten kann, die in ihrer Einrichtung Fortbildungen zu ethischen Themen konzipieren und durchführen wollen. Darüber hinaus bietet er einen Überblick über die bei der Umsetzung jeweils zu berücksichtigenden _direkt strukturierenden_ sowie _indirekt strukturierenden_ Merkmale. Es wird an Beispielen aufgezeigt, welche Formatvarianten sich in Kombination mit welchen direkt strukturierenden Merkmalen in den ausgewählten Universitätsklinika bewährt haben. Der Beitrag liefert eine Diskussionsgrundlage, um die strukturierte Auseinandersetzung mit konzeptionellen Fragen ethischer Fortbildung in der Klinik zu befördern. (shrink)

Although to what extent Oswald Spengler served as a forerunner or precursor of National Socialism remains controversial, scholars unanimously agree that he was a virulent antidemocratic thinker. Indeed, the mere mentioning of his name immediately conjures up among students of German political philosophy associations of intense antidemocratic sentiment. The epithet of virulent opponent of democracy is certainly well-deserved for the period in his political-philosophical development when he was famous, spanning 1919, the year the heated controversy surrounding his major work The (...) Decline of the West erupted, to his untimely death in 1936. Yet what about the little-known, but important phase in the evolution of Spengler's political thought, the years immediately before the shocking military collapse of Imperial Germany and the outbreak of socialist revolution in the fall of 1918 aroused the hostility of the entire right against Germany's first democracy? These were years when Spengler, as an unknown private scholar industriously composing his chef-d'oeuvre, was politically inactive. Was Spengler passionately anti-democratic before he became an embittered man? The following investigation of this rather obscure but important period in his thought, which draws heavily upon his private papers in the Spengler Archives, surprisingly reveals that he was not vehemently antidemocratic during this time and was, in fact, a cynical and opportunistic conservative advocate of the idea of the quasi-democratization of the Second Reich. Spengler scholars, it should be noted, including among others Anton Mirko Koktanek, Gilbert Merlio, H. Stuart Hughes, Klemens von Klemperer, Horst Moller, Walter Struve and Detlef Felken, do not argue this novel position as they are not of the opinion that any significant changes in his attitude towards democratization in Germany took place in his intellectual career. Engineers encounter difficult ethical problems in their practice and in research. In many ways, these problems are like design problems: they are complex, often ill-defined; resolving them involves an iterative process of analysis and synthesis; and there can be more than one acceptable solution. This book offers a real-world, problem-centered approach to engineering ethics, using a rich collection of open-ended scenarios and case studies to develop skill in recognizing and addressing ethical issues.

It is widely held that free speech is a distinctive and privileged social kind. But what is free speech? In particular, is there any unified phenomenon that is both free speech and which is worthy of the special value traditionally attached to free speech? We argue that a descendent of the classic Millian justification of free speech is in fact a justification of a more general social condition; and, via an argument that 'free speech' names whatever natural social kind is (...) justified by the best arguments, that free speech is therefore this more general condition. This condition involves not merely the orthodox freedom (in some sense) of speakers to distribute words, but also two less frequently acknowledged dimensions of free speech: audience understanding and consideration. We conclude with some discussion of the policy implications of this conception of free speech. (shrink)

A cause is proportional to its effect when, roughly speaking, it is at the right level of detail. There is a lively debate about whether proportionality is a necessary condition for causation. One of the main arguments against a proportionality constraint on causation is that many ordinary and seemingly perfectly acceptable causal claims cite causes that are not proportional to their effects. In this paper, I suggest that proponents of a proportionality constraint can respond to this objection by developing an (...) idea that is present in Yablo’s early work on proportionality, but which has strangely been ignored by both Yablo and others in the subsequent debate. My suggestion is that proportionality—and, indeed, causation itself—is relative to a domain of events. At the metaphysical level, this means that the causal relation has an extra relatum—namely, a domain of events. At the level of language, it introduces a new way in which causal claims are context-sensitive: what is expressed by a causal claim depends on the contextually relevant domain of events. As I argue, this suggestion allows us to accommodate the truth of ordinary causal claims while extending the explanatory benefits of a proportionality constraint. (shrink)

In this paper I outline an “agent-centered” approach to learning ethics. The approach is “agent-centered” in that its central aim is to prepare students toact wisely and responsibly when faced with moral problems. The methods characteristic of this approach are suitable for integrating material on professional and research ethics into technical courses, as well as for free-standing ethics courses. The analogy I draw between ethical problems and design problems clarifies the character of ethical problems as they are experienced by those (...) who must respond to them. It exposes the mistake, common in ethics teaching, of misrepresenting moral problems as multiple-choice problems, especially in the form of ‘dilemmas’, that is, a forced choice between two unacceptable alternatives. Furthermore, I clarify the importance for responsible practice of recognizing any ambiguity in the problem situation. (shrink)

This paper examines the way in which causal relations are understood in the dominant model in contemporary medicine. It argues that the causal relation is not definable in terms of the condition relation, but that in general for conditions of an occurrence to be among its causes they must answer instrumental interests in a certain way, and there are further criteria for distinguishing 'the' cause of a disease (i.e., its etiological agent) from other causal factors, which are based upon instrumental (...) interests peculiar to medicine. It also argues that diseases are complex processes of which both clinical and underlying patho-physiological manifestations are proper parts (as contrasted with effects). (shrink)

Solving actual moral problems is not simply a matter of choosing the “best” of several possible responses. It is also a matter of devising possible responses. Design practice in engineering affords important lessons about addressing practical problems.

There is currently a growing interest in the philosophy and political thought of Baruch de Spinoza following many years of comparative neglect, particularly within political philosophy. The focus of this paper is Spinoza's major work, the Ethics, and its relation to his political writings. It explores Spinoza's distinctive formulations of imagination and affect and considers some of the ways in which these impact upon his political thought, specifically via his reflections upon democracy and knowledge. The discussion draws particular attention to (...) the aporetic status of imagination and its tendency towards ambivalence. It argues that this dynamic account of imagination introduces provisionality and contingency into Spinoza's reflections upon politics that may, in turn, enrich discussions seeking to introduce an awareness of the affective resonances of communication and identification to democratic theory. We typically judge that hasteners are causes of what they hasten, while delayers are not causes of what they delay. These judgements, I suggest, are sensitive to an underlying metaphysical distinction. To see this, we need to pay attention to a relation that I call positive security-dependence, where an event E security-depends positively on an earlier event C just in case E could more easily have failed to occur if C had not occurred. I suggest that we judge that an (...) event C is a cause of a later event E only if E security-depends positively on C. This explains our causal judgements in typical cases of hastening and delaying as well as in atypical cases, where we judge that hasteners are not causes of what they hasten or that delayers are causes of what they delay. This article reports on a method of group mentoring to strengthen responsible research conduct. A key feature of this approach is joint exploration of the issues by trainees and their faculty research supervisors. These interactions not only help participants learn about current ethical norms for research practice, but also draw on the accumulated experience of faculty and staff about practical problems of research conduct, and help to make faculty more articulate about responsible research conduct and so better able to guide (...) their trainees. By working with departments or laboratories as a whole the method facilitates the formulation of specific norms appropriate to particular research situations and to strengthen the group’s ability to support appropriate behavior and deal with new issues as they arise. It also gives students more ways to ask questions about research practice and to benefit from the experience of all members of their department or group as well as their own research supervisors. The method is well tested and has been well received by a wide variety of departments and research groups. It provides the means for a constructive and enjoyable response to the Public Health Service’s (PHS) new Policy on Instruction in the Responsible Conduct of Research (RCR) that requires education in the responsible conduct of research for all those funded by PHS funds, including faculty and staff as well as trainees. Background: Family members and healthcare providers play an integral role in a person’s assisted dying journey. Their own needs during the assisted dying journey are often, however, unrecognized and underrepresented in policies and guidelines. Circumstances under which people choose assisted dying, and relational contexts such as the sociopolitical environment, may influence the experiences of family members and healthcare providers. Ethical considerations: Ethics approval was not required to conduct this review. Aim: This scoping review aims to identify the relational influences on (...) the experiences of family members and healthcare providers of adults who underwent assisted dying and of those unable to access assisted dying due to the loss of capacity to consent. Methods: A literature search was conducted in four databases, including MEDLINE, EMBASE, Cumulative Index to Nursing and Allied Health Literature (CINAHL) and PsycINFO. The search retrieved 12,074 articles, a number narrowed down to 172 articles for full-text screening. Thirty-six articles met the established inclusion criteria. A feminist relational framework guided the data analysis. Results: Five key themes on the influences of family members’ and healthcare providers’ experiences throughout the assisted dying process were synthesized from the data. They include (1) relationships as central to beginning the process, (2) social and political influences on decision making, (3) complex roles and responsibilities of family members and healthcare providers, (4) a unique experience of death, and (5) varying experiences following death. Conclusion: The feminist relational lens, used to guide analysis, shed light on the effect of the sociopolitical influences and the relationships among patients, families, and healthcare providers on each other’s experiences. Addressing the needs of the family members and healthcare providers is vital to improving the assisted dying process. Including families’ and healthcare providers’ needs within institutional policies and enhancing collaboration and communication among those involved could improve the overall experience. (shrink)
