Background: Family members and healthcare providers play an integral role in a person’s assisted dying journey. Their own needs during the assisted dying journey are often, however, unrecognized and underrepresented in policies and guidelines. Circumstances under which people choose assisted dying, and relational contexts such as the sociopolitical environment, may influence the experiences of family members and healthcare providers. Ethical considerations: Ethics approval was not required to conduct this review. Aim: This scoping review aims to identify the relational influences on (...) the experiences of family members and healthcare providers of adults who underwent assisted dying and of those unable to access assisted dying due to the loss of capacity to consent. Methods: A literature search was conducted in four databases, including MEDLINE, EMBASE, Cumulative Index to Nursing and Allied Health Literature and PsycINFO. The search retrieved 12,074 articles, a number narrowed down to 172 articles for full-text screening. Thirty-six articles met the established inclusion criteria. A feminist relational framework guided the data analysis. Results: Five key themes on the influences of family members’ and healthcare providers’ experiences throughout the assisted dying process were synthesized from the data. They include relationships as central to beginning the process, social and political influences on decision making, complex roles and responsibilities of family members and healthcare providers, a unique experience of death, and varying experiences following death. Conclusion: The feminist relational lens, used to guide analysis, shed light on the effect of the sociopolitical influences and the relationships among patients, families, and healthcare providers on each other’s experiences. Addressing the needs of the family members and healthcare providers is vital to improving the assisted dying process. Including families’ and healthcare providers’ needs within institutional policies and enhancing collaboration and communication among those involved could improve the overall experience. (shrink)

This essay interprets the controversy over Richard Serra's monumental sculpture, Tilted Arc , which was designed for a public plaza in downtown Manhattan in 1979 and then torn down five years later after intense public outcry. Levine reads this controversy as characteristic of contemporary debates over the arts, which continue the tradition of the nineteenth century avant-garde, pitting art against a wider public, and insisting that art must deliberately resist mainstream tastes and values in favor of marginality and innovation. This (...) definition of art has posed a lasting dilemma for democratic societies: how, after all, should a democracy deal with art that represents an intentional rejection of the majority? The problem becomes even more intractable when it comes to avant-garde art commissioned for public spaces, where the art object can challenge public tastes and movements in a way that is inescapable for those who must live and work in the space. Disturbed by the imposition of a massive and incomprehensible art object in a public plaza, Serra's opponents argued that Tilted Arc frustrated a whole range of socially beneficial activities, labor and leisure alike. And they claimed that Serra's supporters were dangerously anti-democratic. But despite the avant-garde's challenge to majority tastes, this essay makes the case that it remains a democratic value to continue to sponsor avant-garde art in public spaces. (shrink)

Understanding the day/night cycle requires integrating observations of the sky (an Earth-based perspective) with scientific models of the solar system (a space-based perspective). Yet children often fail to make the right connections and resort to non-scientific intuitions – for example, the Sun moving up and down – to explain what they observe. The present research explored whether children’s gestures indicate their conceptual integration of Earth- and space-based perspectives. We coded the spontaneous gestures of 85 third-grade children in U.S. public schools (...) (Mage = 8.87 years) as they verbally explained the overall cause of the day/night cycle, the cause of sunrise, and the cause of sunset after receiving science instruction as part of a prior study. We focused on two kinds of gestures: those reflecting the Sun’s motion across the sky and those reflecting the Earth’s axial rotation. We found that participants were more likely to produce Earth rotation gestures for a topic they explained more accurately (the overall cause of the day/night cycle), whereas Sun motion gestures were more common for topics they explained less accurately (the causes of sunrise and sunset). Further, participants who produced rotation gestures tended to provide more accurate verbal explanations of the overall cause. We discuss how gestures could be used to measure – and possibly improve – children’s conceptual understanding and why sunrise and sunset may be particularly difficult topics to learn. (shrink)

Caroline Brett Keywords: mysticism, psychosis, values, phenomenology, spiritual emergence. THE PURPOSE OF Marzanski and Bratton's paper is to challenge Jackson and Fulford's (1997) treatment of the area of spiritual experience and psychosis, specifically the perspective of discriminating pathological from spiritual experiences on the basis of action enhancement in contrast to action (...) failure. In my opinion, they are partially successful in this aim, and in their analysis they further the discussion of this complex and controversial area in an interesting and potentially fruitful way. What the paper does not offer, or attempt to suggest, is an alternative way of making a distinction, and in the following discussion I intend to explain why I think that, on the one hand, the status of specific experiences is of practical importance, and on the other hand any distinction should not be conceptualized as mutually exclusive. I also hope to clarify those issues which I perceive as being raised by both Jackson and Fulford's and Marzanski and Bratton's papers. The Critique Marzanski and Bratton's first, and in my opinion strongest, point is to argue that "values and actions alone cannot always discriminate between religious experience and psychopathology." They demonstrate convincingly that the fact that an individual positively evaluates a certain anomalous experience and shows enhanced function as a result of it, does not in itself mean that the experience should be viewed as "spiritual." Their second and third points relate to the way spirituality ought to be regarded, suggesting that Jackson and Fulford are in error to identify spirituality with experience, and moreover that any judgment of genuine spiritual content or value requires reference to an individual's personal history, and also some spiritual tradition or authority. I believe that the former point, although certainly relevant to the issue, is in danger of broadening the debate too far from the consideration of particular anomalous experiences: namely, those that are phemenologically similar or identical to psychotic symptomatology. Marzanski and Bratton also mount an objection to the psychologization of spiritual experience by Jackson and Fulford, although I am not convinced that they represent these authors' opinions fairly. Whose Values? Action or Ethics? The first point, the refutation of the thesis that a spiritual experience can be distinguished from [End Page 373] psychopathology on the basis of a positive evaluation and preservation of functionality, succeeds in that it is shown both that (1) experiences accepted as spiritual within major religious traditions may actually be distressing and/or disabling; and (2) anomalous experiences that are both positively evaluated by the experient and action enhancing nevertheless may not have genuine spiritual characteristics. The argument proceeds through the use of counterexamples, and it is indeed a problem for the Jackson and Fulford account that suffering and periods of social withdrawal or distress do appear to be historically, anthropologically, and theologically associated with the spiritual journey. Bratton and Marzanski use, among other examples, the "dark night of the soul" of mystics, raising the very interesting point that a person may have experiences that, at least at the time of experiencing, are profoundly disturbing or even disabling, socially or functionally, and yet those same experiences may in some way set the scene for a profound transformation or spiritual renewal. To my mind this concept can be seen reflected in the "terrible" forms of the Wisdom Goddess in Advaita Vedanta (as expressed in my own paper), and can be related to the concept of "breaking down to break through" espoused by transpersonal psychologists such as Grof and Grof (1992).Therefore, on closer examination, it appears that Jackson and Fulford's notion of preserved functionality may play some role after all, even if it does require supplementation: if the breaking through aspect of the process is necessary to distinguish from simply breaking down, then action enhancement may remain a criterion determining the spiritual value of an experience. Are animals and humans different in kind or only different in degree when it comes to the mental springs of behavior? The source of this question is Charles Darwin's 1871 The Descent of Man, in which he argued for a difference in degree between animals and humans in mental abilities, rather than a difference in kind. Darwin's opponents in the ensuing debate were theologians and scientific traditionalists who insisted upon human specialness when it came to the mind,even if evolution held (...) sway for explaining the body. In this paper I take up the same question, which has not gone away. Representing the continuity thesis is Donald R. Griffin, a zoologist who founded the field of cognitive ethology in the 1980s, and voicing the discontinuity thesis is Raymond Tallis, a neuroscientist and self-described humanist. Tallis's apparent mission is to protect human dignity from the onslaught of writing and research by evolutionary psychologists and sociobiologists, who claim to be demonstrating the evolutionary basis for all human mental capabilities, including higher reasoning and ethics. To raise humans up, Tallis lowers animals down, making disparaging remarks like, "Chimps are chumps." I defend the chimps by finding serious flaws in Tallis's reasoning. Tallis locates the crux ofthe cognitive difference between humans and nonhumans in the linguistic concept of intentionality. I present and counter his charge of a difference in kind by relying on empirical evidence provided by Griffin and others, and on my logical analysis of Tallis's claims. Theories of embodied cognition assume that concepts are grounded in non-linguistic, sensorimotor experience. In support of this assumption, previous studies have shown that upwards response movements are faster than downwards movements after participants have been presented with words whose referents are typically located in the upper vertical space. This is taken as evidence that processing these words reactivates sensorimotor experiential traces. This congruency effect was also found for novel words, after participants learned these words as labels for novel objects that (...) they encountered either in their upper or lower visual field. While this indicates that direct experience with a word's referent is sufficient to evoke said congruency effects, the present study investigates whether this direct experience is also a necessary condition. To this end, we conducted five experiments in which participants learned novel words from purely linguistic input: Novel words were presented in pairs with real up- or down-words ; they were presented in natural sentences where they replaced these real words ; they were presented as new labels for these real words ; and they were presented as labels for novel combined concepts based on these real words. In all five experiments, we did not find any congruency effects elicited by the novel words; however, participants were always able to make correct explicit judgements about the vertical dimension associated to the novel words. These results suggest that direct experience is necessary for reactivating experiential traces, but this reactivation is not a necessary condition for understanding the corresponding aspects of word meaning. In 1978 and 1979 around 6.770 women in the GDR were infected with the hepatitis C virus after they had received a contaminated Anti-D-Immunprophylaxis. This prophylaxis was used after delivery, abortion or miscarriage. Until September 1979 2.769 women came down with Hepatitis. The reaction of the state showed how closely medicine and politics were linked in the GDR and what kind of influence governmental decisions had on medical action. The state wanted to keep everything as a secret. The producer of (...) the Anti-D-Immunglobulin in the GDR was sentenced as a pawn sacrifice in a non-public trial. The Ministry of State Security was also involved. Many of the infected women were traumatized by not being informed what had happened and had to fight for recognition and compensation until today. Baudrillard's quixotic effort to be recognized by the French intellectual establishment may have been doomed to failure, but this text immediately became a pinnacle to his work, a mid-career assessment that looked both forward and back. While 23andMe aspires to be “the world's trusted source of personal genetic information,” the U.S. Food and Drug Administration (FDA) believes that the company's advertising practices have been anything but trustworthy. Last November, a harshly worded FDA “warning letter” demanded that the direct‐to‐consumer genetic testing company immediately discontinue marketing its unapproved “medical device.” The tussle between 23andMe and the FDA has attracted more attention than a typical disagreement between a company and a government agency. Larry Downes and Paul Nunes identify (...) 23andMe as a “Big Bang Disruption”: an invention that revolutionizes the existing market, foiling both industry incumbents and unprepared regulators. The outcome of the FDA's current review to hold the answer to the million‐dollar question: how will DTC genetic testing be regulated in the future? Ideally, the FDA's regulations should not pose undue burdens on consumers seeking personal genetic information but, rather, help consumers make a transition out of the consumer setting and into the medical setting. Background Informed consent is one of the key principles of conducting research involving humans. When research participants give consent, they perform an act in which they utter, write or otherwise provide an authorisation to somebody to do something. This paper proposes a new understanding of the informed consent as a compositional act. This conceptualisation departs from a modular conceptualisation of informed consent procedures. Methods This paper is a conceptual analysis that explores what consent is and what it does or does (...) not do. It presents a framework that explores the basic elements of consent and breaks it down into its component parts. It analyses the consent act by first identifying its basic elements, namely: a) data subjects or legal representative that provides the authorisation of consent; b) a specific thing that is being consented to; and c) specific agent(s) to whom the consent is given. Results This paper presents a framework that explores the basic elements of consent and breaks it down into its component parts. It goes beyond only providing choices to potential research participants; it explains the rationale of those choices or consenting acts that are taking place when speaking or writing an authorisation to do something to somebody. Conclusions We argue that by clearly differentiating the goals, the procedures of implementation, and what is being done or undone when one consent, one can better face the challenges of contemporary data-intensive biomedical research, particularly regarding the retention and use of data. Conceptualising consent as a compositional act enhances more efficient communication and accountability and, therefore, could enable more trustworthy acts of consent in biomedical science. (shrink)

On 7 April 2022 – coinciding with World Health Day – the British Medical Association launched its new report, Health and human rights in the new world order.1 Written during the global upheaval triggered by the COVID-19 pandemic, and published just weeks after the Russian invasion of Ukraine, the report responds to a range of emerging and intensifying threats to health-related human rights globally. As the report establishes, human rights in health and healthcare matter because human suffering, and its relief, (...) are fundamental moral issues. As relief of human suffering is the primary purpose of medicine, it follows that doctors and other health professionals are often active in times of human challenge and extremity. During conflict, humanitarian crises, and, as we have so recently seen, global public health emergencies, health professionals are essential to the response. But these crises – and the response to them – can put fundamental human rights and interests under pressure. The Russian invasion of Ukraine has seen sustained indiscriminate shelling of civilian infrastructure. Whether health facilities were directly targeted is moot – the indiscriminate nature of the assault means they will inevitably be hit. Not only is this a violation of the Geneva Conventions, it undermines fundamental human rights, not least of which the right to health. Destroying health infrastructure drives further suffering and delays post-conflict recovery. Public heath emergencies can rightly require draconian measures – social distancing, enforced isolation, location tracking, economic shutdown. Although we saw their necessity during the COVID-19 outbreak, concerns were raised about disproportionate restrictions on basic rights, including rights to privacy and liberty. Human Rights Watch drew attention to the way governments unlawfully exploited COVID-19 to crack down on fundamental rights.2 Although conflicts and public health emergencies are not new, the report also tracks a number of …. ### Challenge to the abortion act 1967 dismissed In September, the High Court dismissed a judicial review of the Abortion Act 1967 that sought a judgement of incompatibility with the European Convention on Human Rights.1 The case focused on a clause in the Act which permits abortion in England, Scotland and Wales after 24 weeks if there is a substantial risk that, if the child were born, it would suffer from ‘such physical or mental abnormalities as to be seriously handicapped’. The case was brought by three parties: Heidi Crowter, a 24 year old woman living independently with Downs Syndrome and a campaigner for disability rights; a 2 year old boy with DS; and his mother who, when pregnant with him, felt pressure to terminate the pregnancy. The claimants sought a declaration that the clause was incompatible with the right to life; freedom from torture, inhuman or degrading treatment; right to private and family life; and protection from discrimination. Further to this it was also argued that the Act does not permit abortion on the basis that an unborn child has been diagnosed with a non-fatal fetal disability such as DS and that such abortions should not be funded by the state. In dismissing the claim, the judges focused on the ‘margin of appreciation’ that the European law allows domestic states on this issue and the fact that a foetus has never been deemed to have personhood status under the ECHR. The judges noted the ability to provide for a disabled child would vary significantly and that some conditions would only be found late in a pregnancy, after 24 weeks. Stating that the case by its nature did not permit the Court to hear from other perspectives, including women who may be affected by any change to the law and further criminalisation of abortion, the judges emphasised …. This essay offers a Deleuzian reading of Drift, a multilingual project by the cross-disciplinary artist Caroline Bergvall. It argues that the text- and performance-project promotes forms of deterritorialization that give radical witness to the contemporary humanitarian crisis in the Mediterranean where thousands of people drown each year as they try to reach Europe. In breaking down barriers between languages, the artistic work employs non-representational modes of address to reflect on what it means to lack citizenship and recognition in the (...) context of the crisis. Close readings challenge postcolonial accusations that the writings of Deleuze and Guattari are at best utopian and at worst politically naive and without purchase on the real-life catastrophes of Fortress Europe. Instead, Deleuzian strategies are shown to enable Bergvall to actualize a multilingual politics of speech and performance that points towards the historical and contemporary imbrications of the West in mass-drownings of recent... In the first edition of The Gay Science (GS), Nietzsche proposes that we treat knowledge as unconditionally valuable and life as a tragic quest for truth. In the second edition of GS, he seems to retract this proposal, suggesting that we substitute “incipit parodia” for “incipit tragœdia.” But Nietzsche does not say what he means by “parody,” or what role he believes it should play in our evaluative lives. This article proposes that by introducing parody into GS, Nietzsche intends not (...) only to correct the original text by mocking his earlier treatment of science as tragic, but also to designate parody as a basis for new tasks, duties, and values beyond what science can offer. This article speculates that parodic value creation might consist in the imitation of behaviors and practices associated with preexisting values without the reproduction of the beliefs and feelings corresponding to those practices. We are deeply grateful for lapidary and attentive responses to our paper (...) from Caroline Brett and Stephen Sykes, in which each have affirmed the value of this conversation, but also indicated the issues that need to be thought through in greater depth. Sykes makes the point, quite rightly in our view, that the language of both theology and psychiatry are needed to illuminate the gray area between spirituality and mental disorder. Part of the difficulty, perhaps, has been the tendencies of theologians and psychiatrists alike either to speak past each other's shoulders or to refuse to engage in conversation at all (Watts 2002).Both commentators have accurately represented the core arguments of our thesis: that genuine spirituality may involve ego disablement and that positively evaluated psychotic, action-enhancing experiences are not, by definition, spiritual. They also both agree that religious traditions may offer resources that help discrimination at the borderlands of theology and psychiatry, beyond the reach of descriptive psychopathology. However, Brett has helpfully drawn attention to a number of possible weak spots that deserve further reflection:the distinction between breaking downand breaking throughand the possible continuing value of using the criterion of preserved or enhanced functionality; our failure to appreciate the precision with which Jackson and Fulford use the language of psychosis; and the uncertain clinical value of a schema that only allows an assessment of the contribution of an experience to spiritual reorientation after the event.Although it is not appropriate in the form of a final response to engage with these issues in depth, we thought that a few brief observations might be in order. Breaking Down and Breaking Through Brett's distinction between breaking down and breaking through is helpful but may disintegrate where the breaking down itself is considered to be constitutive of spiritual experience. The Pauline insight "for when I am weak; then I am strong" (2 Cor. 12:10, New Revised Standard Version [NRSV] 1989) finds vivid expression, for example, in the life of the Abbe Marie-Joseph Huvelin (Williams 1994). This Parisian curate, with chronic [End Page 383] and debilitating ill health and an almost unrelieved sense of personal worthlessness that bordered on despair, managed to transmit hope to an astonishing range of people who came to him for spiritual direction. There was no obvious, schematic breaking through the rigors of ego disablement to sunlit uplands of ethical conviction or renewed sense of vocation. It is by no means clear that he would have wished his predicament on anyone else, let alone himself, notwithstanding the fruitfulness of his ministry. The breaking down was arguably part of his life-long vocation and it perhaps stretches the meaning of action enhancement a little too far to use it encompass the often paradoxical nature of sanctity. The Language of Psychosis An important feature of good conversation is mindfulness in the way language is used and guardedness against misrepresenting the position of one's conversation partner. The expression of our discomfort with the application of the language of psychosis to spiritual experience was perhaps designed primarily to signpost our concern with certain reductive and assimilating tendencies in modern psychiatry. Perhaps psychotic may be used with precision and designed to draw attention to the complexities of discriminating at the borderlands of theology and psychiatry. Words, nonetheless, have resonance—philosophically and culturally—that radiate well beyond the boundaries of precise usage. The same could be said of Brett's use of anomalous, which might refer to a range of phenomena that most people would regard as abnormal: hallucinations, synesthaesia, out-and of-body, past-life, and near-death experiences. It is legitimate, we contend, to draw attention to these resonances even if they stray... (shrink)

Les frontières mêmes du sujet (...) sont malléables, dépendantes des contrées extérieures auxquelles il se frotte sans cesse. Aussi, le sujet lui-même est un sujet en mouvement dans une société toujours plus rapide, plus performante, plus financiarisée. Cependant, l'agitation ou le frémissement qui habite le sujet n'a pas pour seule origine un univers sociétal économique, les espaces ou objets esthétiques, naturels ou méditatifs influent également. Ainsi, en tant que créateur ou spectateur, le sujet se confronte à l'oeuvre d'art. S'il peut être touché, provoqué parfois, par l'extérieur, il est aussi travaillé de l'intérieur. Les arts et la littérature sont ici convoqués pour penser le rapport du sujet à son identité et au monde ; des études de cas porteront donc sur les démarches des artistes. En effet, en quoi les arts visuels et les récits contribuent-ils à la construction du sujet? En quoi la rencontre avec l'oeuvre agit-elle sur l'identité du sujet? The practice of relationship itself is seen to be the central vehicle through which human beings learn and understand themselves, others, and the world around them. The politics of sexual difference insists that the flourishing of sexual difference in both women and men, girls and boys, relies, ultimately, on both sexes taking up the challenge to rethink themselves and the world. This chapter explores the emergence of a whole new philosophical idea, brought into being by Luce Irigaray in the context (...) of the women's movements of the 1960s and 1970s in Europe. It then outlines how this idea was developed in Italy and Spain to restore the work of the mother to the origins of what we understand as education and philosophy, emphasising the need to bring relationship itself as the vehicle for this process onto centre stage and keep it there. Almost a quarter-century after the Carnegie report, Scholarship Reconsidered, the scholarship of teaching remains a contested idea, celebrated by some and critiqued by others. This new book is particularly relevant now however as it explores the notion of the scholarship of teaching through the lens of authenticity, a complex, intriguing and particularly striking and distinctively helpful notion which has caught the attention of several authors in adult and higher education. However, those writing about authenticity do not always make explicit what (...) it is that they mean by this notion, nor are they clear about the philosophical foundations underpinning it. In developing the notion of the scholarship of teaching as an 'authentic practice', the author draws on several complementary philosophical ideas to explore the nature of this practice, why it is imperative for universities to engage in it, what meaningful engagement wold look like and the conditions under which it might qualify as 'authentic'. Core constructs employed include practice virtue communicative action 'being', 'power', critical reflection and transformationThe scholarship of teaching is described as a practice sustained through critical reflection and critical self-reflection. Being a scholar of teaching is viewed as an ongoing transformative learning process, a process of becoming authentic, the latter ultimately aimed at both helping students to become authentic and creating a better world in which to teach, learn and live. Although explored as a practice in its own right, the scholarship of teaching is seen to be strengthened by being situated within a wider integrated notion of academic practice. The book combines the author's previous research on authenticity with earlier work on the meaning of the scholarship of teaching, offering a provocative, fresh and timely perspective on the scholarship of teaching and professional learning in our times but also providing guidance on how to create a better world in which to learn, teach and live. Mathematics stand in a privileged relationship with aesthetics: a relationship that follows two main directions. The first concerns the introduction of mathematical considerations into aesthetic discourse. For instance, it is common to mention the mathematical architecture of certain artistic productions. The second leads from aesthetics to mathematics. In this case, the question is that of the role and meaning that aesthetic considerations may assume in mathematics. It is indeed a widely held view among mathematicians, of whatever socio-historical context, not only (...) to see their discipline as presenting a strong aesthetic dimension, but also to consider that this dimension plays a fundamental role in the process of developing and understanding mathematics. The main ambition of this paper is to show how Nelson Goodman’s aesthetics can be used to justify this point of view and to propose a thesis concerning the aesthetic functioning of mathematics. This first result allows to resituate Goodman’s aesthetics within a very classical tradition that will be described. Finally, the underlying ambition is to show the keys provided by Goodman’s theory for the philosophy of mathematics. (shrink)

Biologists, climate scientists, and economists all rely on models to move their work forward. In this book, I explore the use of models in these and other fields to introduce readers to the various philosophical issues that arise in scientific modeling. I show that paying attention to models plays a crucial role in appraising scientific work. -/- After surveying a wide range of models from a number of different scientific disciplines, I demonstrate how focusing on models sheds light on many (...) perennial issues in philosophy of science and in philosophy in general. For example, reviewing the range of views on how models represent their targets introduces readers to the key issues in debates on representation, not only in science but in the arts as well. Als wahrscheinlich älteste vollständige Überlieferung des Buddhismus reflektiert der Pali-Kanon in literarisch-narrativer Form die Auseinandersetzung mit religiös,Anderen' aus emischer Perspektive. Die Suttas berichten nicht nur, wie der Buddha Mitglieder seines Ordens belehrt, sondern auch, wie er Vertretern anderer religiöser Gruppierungen begegnet und mit ihnen diskutiert haben soll. Caroline Widmer untersucht, inwiefern in diesen Begegnungen religiöse Abgrenzung im Sinne eines Otherings literarisch dargestellt wird, und behandelt diese religionswissenschaftliche Fragestellung im Bereich des Buddhismus erstmals durch eine literaturwissenschaftlich angelegte Analyse der narrativen (...) Gestaltung der Pali-Suttas. Die Texte spiegeln jedoch nicht wie oftmals angenommen in erster Linie Toleranz oder Offenheit gegenüber anderen religiösen Ansichten wider; vielmehr sind durch einen hohen Grad an Selbstdarstellung und einem exklusiven Anspruch auf Wahrheitsbesitz geprägt. Erzählerisch wird diese Spannung so aufgelöst, dass der,Andere' das,Eigene' annimmt und dadurch seine,Andersheit' verliert. Die Untersuchung eröffnet einen neuen Zugang zu religionsgeschichtlichen Quellen, erlaubt detaillierte Einblicke in diesen systemspezifischen Prozess des Selfings und erläutert seine Funktion innerhalb der buddhistischen Überlieferung. La limite peut être entendue dans deux sens dont les implications sont différentes, voire opposées. Elle peut être considérée comme un horizon indépassable, un mur infranchissable qui borne très distinctement des domaines d'étude et des champs d'action. Dans une seconde acception, la limite est, au contraire, la ligne qui peut être franchie et par extension, la limite devient amovible : elle peut être déplacée, même légèrement, en fonction des événements. Le thème de ce colloque nous invite non pas à étudier (...) "la limite du droit", comme le suggèrerait le premier sens du mot limite. Cette idée n'aurait pas de sens, sauf à considérer un système pur de droit, isolé de tous les autres paramètres qui peuvent graviter autour de lui. Nous sommes, à l'inverse, amenés à nous rendre "Aux limites du droit", dans cette zone d'interférence, de superposition, d'interpénétration non seulement des disciplines théoriques mais aussi des circonstances ponctuelles dont l'enchevêtrement donne à la pratique de la science juridique toute son ampleur. Les limites du droit font donc référence à un lieu de communication et de négociation où la recherche d'un équilibre spontané est autant permanente qu'impossible à pérenniser. En effet, les divers facteurs qui entrent dans les limites du droit sont si riches et pourtant si mouvants qu'il paraît judicieux de tenter, tant que faire se peut, de cerner leur essence. Can we describe certain sonic experiences as “homely,” even when they take place outside of a traditional home-space? While phenomenological accounts of home abound, with writers detailing a rich spectrum of the felt characteristics of the homely including safety, familiarity, and affective “warmth,” there is a scarcity of research into sonic experience that engages with such literatures. With specific interest in the experience of embodied space, I account here for what might be termed feelings of “sonic homeliness” as they emerge (...) during headphone listening. After forming a conceptual model of homeliness that draws from phenomenological philosophy, I investigate its applicability to experiences of headphone listening. Through analysis of primary interview data, I consider how headphones may be said to territorialize space for listeners, analyzing how sonic “boundaries” are experienced in relation to the body, as well as how some listeners describe their experiences as interiorized, comforting, and “wombic.”. Feminists are often "up against Foucault" because he questions key conclusions in feminism regarding the nature of gender relations, and men's possession of power.
