The political public sphere is important for democracy, and it is changing – this is how the quintessence of Jürgen Habermas’s monumental study on The Structural Transformation of the Public Sphere (1989) could be summarized in simple words. In the fields of political sociology and social theory, history, but also research on social movements, cultural studies, and media and communication studies, his conception of the public sphere as a sphere mediating between the state and civil society has had a decisive (...) influence on the debate about the potential of collective reason for modern democracy. In this introduction we give a short overview of Habermas’s arguments on the rise and fall of the bourgeois public sphere, demonstrate the necessary link between the public sphere and democracy and, referring to the contributions to this special issue, sketch current transformations of the public sphere along three basic processes – digitalization, commodification, and globalization. The article critically analyses the gaps and the analytical potential in Jürgen Habermas’s The Structural Transformation of the Public Sphere concerning corporate discourses and debates. It is shown that Habermas only analyses the field of work in abstract terms, neglecting in particular corporate public spheres. In contrast, corporate public spheres are developed as an analytical concept, expressed by companies in the form of institutionalized co-determination, situationally granted opportunities for participation and self-willed public spheres of workers. These three fields are discussed (...) using empirical examples. It is shown that corporate public spheres are eroded by precarization and instrumentalized by management. Furthermore, digitalization is working towards a comprehensive algorithmic control of corporate public spheres by companies, but also towards new autonomous communication networks that establish proletarian public spheres, so that both refeudalization and revitalization of corporate public spheres can be observed. Under what conditions are people responsible for their choices and the outcomes of those choices? How could such conditions be fostered by liberal societies? Should what people are due as a matter of justice depend on what they are responsible for? For example, how far should healthcare provision depend on patients' past choices? What values would be realized and which hampered by making justice sensitive to responsibility? Would it give people what they deserve? Would it advance or hinder equality? The (...) explosion of philosophical interest in such questions has been fuelled by increased focus on individual responsibility in political debates. Political philosophers, especially egalitarians, have responded to such developments by attempting to map out the proper place for responsibility in theories of justice. Carl Schmitt and the Problem of the Realization of Law 1. The famous pithy aphorisms that Carl Schmitt used to open his major works - 'the sovereign is he who decides on the exception', 'the concept of the state presupposes the concept of the political', etc. - have become a part of the common discourse of contemporary scholarship on politics and the law. The theoretical framework that animates these slogans, however, has remained somewhat opaque. It has often been (...) argued that there is no such framework, that Schmitt was a situational thinker whose works are best understood as interventions in concrete political debates that do not add up to a grand theoretical vision. This article argues that, suitably modified, the method of reflective equilibrium is a plausible way of selecting moral principles. The appropriate conception of the method is wide and radical, admitting consideration of a full range of moral principles and arguments, and requiring the enquiring individual to consider others' views and undergo experiences that may offset any formative biases. The individual is not bound by his initial considered judgments, and may revise his view in any way whatsoever. It is appropriate to (...) describe the method as a balance between coherentism and fallibilist foundationalism. With these points in mind, various criticisms, including the claims that considered judgments are not initially credible and are shaped by prejudice, and that the method itself fails to determine principle selection, are challenged. Obese people consume significantly greater amounts of health resources. This study set out to determine if health resource utilization by obese people decreases after losing weight in a comprehensive medically supervized weight management programme. Four hundred and fifty-six patients enrolled in a single-centred, multifaceted weight loss programme in a universal health care system were studied. Patient information was anonymously linked with administrative databases to measure health resource utilization for 1 year before and after the programme. Mean body mass index (BMI) (...) decreased by more than 15%. The mean annual physician visits (pre = 9.6, post = 9.4) did not change significantly after the programme. However, patients saw a significantly fewer number of different physicians per year following the programme (pre = 4.5, post = 3.9; P < 0.001). Mean annual number of emergency visits (pre = 0.2; post = 0.2) and hospital admissions (pre = 0.05; post = 0.08) did not change. Neither baseline BMI, nor its change during the programme, influenced changes in health resource utilization. Our study suggests that weight loss in a supervized weight management programme does not necessarily decrease short-term health resource utilization. Further study is required to determine if patients who maintain their weight loss experience a decrease in health utilization. (shrink)

Racial preferences are among the most contentious issues in our society, touching on fundamental questions of fairness and the proper role of racial categories in government action. Now two contemporary philosophers, in a lively debate, lay out the arguments on each side. Carl Cohen, a key figure in the University of Michigan Supreme Court cases, argues that racial preferences are morally wrong--forbidden by the 14th Amendment to the Constitution, and explicitly banned by the Civil Rights Act of 1964. He (...) also contends that such preferences harm society in general, damage the universities that use them, and undermine the minorities they were intended to serve. James P. Sterba counters that, far from being banned by the Constitution and the civil rights acts, affirmative action is actually mandated by law in the pursuit of a society that is racially and sexually just. The same Congress that adopted the 14th Amendment, he notes, passed race-specific laws that extended aid to blacks. Indeed, there are various kinds of affirmative action--compensation for past discrimination, remedial measures aimed at current discrimination, the guarantee of diversity--and Sterba reviews the Supreme Court cases that build a constitutional foundation for each. Affirmative action, he argues, favors qualified minority candidates, not unqualified ones. Both authors offer concluding comment on the University of Michigan cases decided in 2003. Half a century after Brown v. Board of Education, issues pertaining to racial discrimination continue to grip American society. Ideal for courses in political, social, ethical, and legal philosophy, this penetrating debate explores the philosophical and legal arguments on all sides of affirmative action, but also reveals the passions that drive the issue to the forefront of public life. I argue that Quine’s naturalization of Lewis’s Kantian pragmatism should be understood in terms of Lewis’s attempt to de-psychologize pragmatist epistemology. Lewis wants epistemology to be a priori in order to be distinct from psychology. Quine’s criticisms of Lewis result in a picture that weakens the distinction between epistemology and psychology. Nevertheless, Quine’s naturalized Kantian pragmatism remains far more Kantian than is widely recognized, due to what Quine retains from Lewis.

This book offers a bold new theoretical understanding of the current ecological crisis via the Frankfurt School. Focusing on key notions of dialectics, natural history, and materialism, a critical theory of nature is outlined in favor of a more traditional Marxist theory of nature, albeit one which still builds on Marxist concepts to confirm humanity's centrality in manufacturing environmental misery. The recent accumulation of environmental crises poses a radical challenge to the conceptual organization of the modern Western political imaginary and the history of political thought by unsettling its ontological understanding of ‘nature’. Specifically, to the extent that they rely on such troublesome understandings, this means the central notions we use to orient ourselves politically, such as labor, can no longer straightforwardly serve this purpose. This paper has argued a paradoxical return to Locke against Locke, and the insight into the (...) entanglements of labor, property, and nature this enables, can provide us with a way of holding together the complexity of this predicament. The first part recovered from the critical scholarship on Locke of the past 50 years the manifold ways in which Lockean ideas about labor are caught up with specific assumptions about colonialism, gendered hierarchies, and nature. The second part argued no singular conceptual reconstruction of labor can do justice to its hybrid character, which the present predicament has revealed. The third part argued, by recovering what the Lockean heritage has obscured, the critical scholarship gives us a way into the knotty problems of the organization of labor and the structure of the political collective. In our text, we follow the traces of a (1) paradox, (2) an ambivalence and (3) a dialectic that constitute digitalized public spheres and discuss the resulting tensions in discourse-ethical and political-theoretical perspectives using the blocking of Donald J. Trump’s Twitter account as an example. Starting from this, we determine the conditions of constitution of the digital public sphere and locate the dynamics of its development in the dialectical tension between private and public: The fact that the two other relations (...) of autonomy and heteronomy, intensification and polarization come to such a head is based on an insufficient socialization of all those means of production that produce the current digital public sphere. Using the example of Donald J. Trump’s recently suspended Twitter account and with a view to Habermas’s discourse ethics, we illustrate the extent to which Trump’s partly racist and conspiracy-theoretical post violates discourse ethics standards and is also highly problematic with regard to the political; however, banishment from a part of the digital public sphere is certainly not an act that should be incumbent on a private company. Von den Zeitgenossen teils mit grosser Begeisterung aufgenommen, tragen sie wesentlich zur Etablierung der ersten Kant-Bewegung bei. Durch ihr Bestreben, die Vernunftkritik als Theorie der moralisch-religiosen Erneuerung zu prasentieren, gelten sie als die brisanteste unter den damaligen philosophischen Neuerscheinungen. Sie sind wegweisend fur einen Kantianismus, der sich im Laufe der 1790er Jahre als eine die politischen Umwalzungen in Frankreich flankierende Geistesrevolution begreift. Der neu herausgegebene Band enthalt (...) zwolf Briefe, welche die auffallendsten Resultate von Kants Vernunftkritik ausgehend von den dringendsten wissenschaftlichen und moralischen Bedurfnissen unserer Zeit darstellen. Der Adressat erfahrt, dass mit Kants Erkenntniskritik und moralischer Neubegrundung der speziellen Metaphysik ein taugliches Mittel zur Bewaltigung gegenwartiger Grundlagenkrisen im Gebiete von Moral, Naturrecht, Theologie und Asthetik bereitsteht. Mit Nachdruck wird das problemlosende Potential von Kants moraltheologischen Resultaten hervorgehoben. In Kants Vernunftglauben und Statuierung eines moralischen Erkenntnisgrundes fur das Dasein Gottes und die Unsterblichkeit der Seele sieht Reinhold die besten Voraussetzungen fur die Beendigung einer Reihe aufklarungshemmender Debatten. Im Visier steht allem voran der als Pantheismusstreit beruhmt gewordene Disput zwischen Mendelssohn und Jacobi, in dessen Einflussbereich ein wenig ergiebiger Kampf zwischen Naturalisten und Supernaturalisten dominant werden sollte. Die Darstellung geschichtlicher Kontexte zur Idee der Unsterblichkeit der Seele und die eingehende Auseinandersetzung mit den antiken Seelenlehren kulminieren in der These, durch Kants Kritik und Neufundierung der rationalen Psychologie konne auch der bisherige, Antike und Neuzeit durchziehende Gegensatz zwischen Spiritualisten und Materialisten als aufgelost gelten. Wiederholt wird zu Reflexionen uber die Geschichte der Menschheit angesetzt, die deutlich machen, dass Reinhold das Geschichtsbild der Illuminaten mehr und mehr in Anlehnung an Lessings Idee einer kommenden Menschheitsepoche des dritten Evangeliums sowie an Kants Vision eines weltburgerlichen Endzustandes vortragt. Die Neuedition ist mit einer ausfuhrlichen Einleitung und einem Kommentar versehen. In diesen Teilen wird unter anderem auf die Entstehungsgeschichte der Briefe, auf Reinholds Kant-Rezeption sowie auf sein Kant-Verstandnis, das mit der damals gangigen Ansicht uber den Alleszermalmer kontrastiert, eingegangen. In this contribution, we argue that critical theories of the public sphere (in Habermas, but also in Negt and Kluge as well as Fraser) leave out the socially central field of labour and labour-political disputes, and that a reactualization and refocusing becomes necessary: We define the dynamics of globalization, commodification and digitalization as sequences of a renewed structural transformation of both social self-understanding and gainful employment. With the help of a multi-level model of labour-political publics and counter-publics, class mobilizations can (...) be examined with a public-theoretical lens and important moments of labour-political disputes can also be reflected on their communicative conditions.
