Emotion regulation (i.e. either up- or down-regulating affective responses to emotional stimuli) has been shown to modulate long-term emotional memory formation. Further, research has demonstrated that the emotional aspects of scenes are preferentially remembered relative to neutral aspects (known as the emotional memory trade-off effect). This trade-off is often enhanced when sleep follows learning, compared to an equivalent period of time spent awake. However, the interactive effects of sleep and emotion regulation on emotional memory are poorly understood. We presented 87 (...) participants with pictures of neutral or negative objects on neutral backgrounds paired with instructions to either increase or decrease their emotional response by altering personal relevance, or to passively view the stimuli. Following a 12 h period of sleep or wakefulness, participants were tested for their memory of objects and backgrounds separately. Although we replicated the emotional memory trade-off effect, no differences in the magnitude of the trade-off effect were observed between regulation conditions. Sleep improved all aspects of memory, but it did not preferentially benefit memory for emotional components of scenes. Irrespective of a period of sleep or wake following encoding, findings suggest emotion regulation during encoding did not influence memory for emotional items at a 12-hour delay. (shrink)

Fears of black-box algorithms are multiplying. Black-box algorithms are said to prevent accountability, make it harder to detect bias and so on. Some fears concern the epistemology of black-box algorithms in medicine and the ethical implications of that epistemology. In ‘Who is afraid of black box algorithms? On the epistemological and ethical basis of trust in medical AI,' Durán and Jongsma seek to allay such fears. While some of their arguments are compelling, we still see reasons for fear.

Forgery in eighteenth-century London was more than a crime of opportunity; it completely undermined the economic, social and political orders of that society. Using the works of authors such as Randall McGowen, John Beattie, Craig Muldrew, and others, this paper examines cases tried in the London Old Bailey from 1700- 1740 in the context of the financial revolution and the rise of the bloody code. The paper looks at the implications this crime had on the greater London society, the changes (...) in legislation that came about as a result of forgery, and the changes in punishment for the crime. Ultimately, it examines at the reasons for the radical change in people‟s perception of this crime in such a short time period. (shrink)

An important objection to signaling approaches to representation is that, if signaling behavior is driven by the maximization of usefulness, then signals will typically carry much more information about agent-dependent usefulness than about objective features of the world. This sort of considerations are sometimes taken to provide support for an anti-realist stance on representation itself. The author examines the game-theoretic version of this skeptical line of argument developed by Donald Hoffman and his colleagues. It is shown that their argument only (...) works under an extremely impoverished picture of the informational connections that hold between agent and world. In particular, it only works for cue-driven agents, in Kim Sterelny’s sense. In cases in which the agents’ understanding of what is useful results from combining pieces of information that reach them in different ways, and that complement one another, maximizing usefulness involves construing first a picture of agent-independent, objective matters of fact. In philosophy of mind, zombies are imaginary creatures that are exact physical duplicates of conscious subjects but for whom there is no first-personal experience. Zombies are meant to show that physicalism—the theory that the universe is made up entirely out of physical components—is false. In this paper, I apply the zombie thought experiment to the realm of morality to assess whether moral agency is something independent from sentience. Algorithms, I argue, are a kind of functional moral zombie, such that thinking (...) about the latter can help us better understand and regulate the former. I contend that the main reason why algorithms can be neither autonomous nor accountable is that they lack sentience. Moral zombies and algorithms are incoherent as moral agents because they lack the necessary moral understanding to be morally responsible. To understand what it means to inflict pain on someone, it is necessary to have experiential knowledge of pain. At most, for an algorithm that feels nothing, ‘values’ will be items on a list, possibly prioritised in a certain way according to a number that represents weightiness. But entities that do not feel cannot value, and beings that do not value cannot act for moral reasons. (shrink)

The proposal of moral enhancement as a valuable means to face the environmental, technological and social challenges that threaten the future of humanity has been criticized by a number of authors. One of the main criticisms has been that moral enhancement would diminish our freedom. It has been said that moral enhancement would lead enhanced people to lose their ‘freedom to fall’, that is, it would prevent them from being able to decide to carry out some morally bad actions, and (...) the possibility to desire and carry out these bad actions is an essential ingredient of free will, which would thus be limited or destroyed—or so the argument goes. In this paper we offer an answer to this criticism. We contend that a morally enhanced agent could lose the ‘freedom to fall’ without losing her freedom for two reasons. First, because we do not consider that a morally well-educated person, for whom the ‘freedom to fall’ is a remote option, is less free than an evildoer, and there is no reason to suppose that bioenhancement introduces a significant difference here. Second, because richness in the amount of alternative possibilities of action may be restored if the stated loss is compensated with an improvement in sensitivity and lucidity that can lead to seeing new options and nuances in the remaining possible actions. Experimental balance is usually understood as the control for the value of the conditions, other than the one under study, which are liable to affect the result of a test. We discuss three different approaches to balance. ‘Millean balance’ requires identifying and equalizing ex ante the value of these conditions in order to conduct solid causal inferences. ‘Fisherian balance’ measures ex post the influence of uncontrolled conditions through the analysis of variance. In ‘efficiency balance’ the value of the antecedent conditions (...) is decided ex ante according to the efficiency they yield in the estimation of the treatment outcome. Against some old arguments by Worrall, we show that in both Fisherian and efficiency balance there are good reasons to randomize the allocation of treatments, in particular when there is no agreement among experimenters as to the antecedent conditions to be controlled for. Perhaps the most widely touted of GPT-4’s at-launch, zero-shot capabilities has been its reported 90th-percentile performance on the Uniform Bar Exam. This paper begins by investigating the methodological challenges in documenting and verifying the 90th-percentile claim, presenting four sets of findings that indicate that OpenAI’s estimates of GPT-4’s UBE percentile are overinflated. First, although GPT-4’s UBE score nears the 90th percentile when examining approximate conversions from February administrations of the Illinois Bar Exam, these estimates are heavily skewed towards repeat test-takers (...) who failed the July administration and score significantly lower than the general test-taking population. Second, data from a recent July administration of the same exam suggests GPT-4’s overall UBE percentile was below the 69th percentile, and $$\sim$$ ∼ 48th percentile on essays. Third, examining official NCBE data and using several conservative statistical assumptions, GPT-4’s performance against first-time test takers is estimated to be $$\sim$$ ∼ 62nd percentile, including $$\sim$$ ∼ 42nd percentile on essays. Fourth, when examining only those who passed the exam (i.e. licensed or license-pending attorneys), GPT-4’s performance is estimated to drop to $$\sim$$ ∼ 48th percentile overall, and $$\sim$$ ∼ 15th percentile on essays. In addition to investigating the validity of the percentile claim, the paper also investigates the validity of GPT-4’s reported scaled UBE score of 298. The paper successfully replicates the MBE score, but highlights several methodological issues in the grading of the MPT + MEE components of the exam, which call into question the validity of the reported essay score. Finally, the paper investigates the effect of different hyperparameter combinations on GPT-4’s MBE performance, finding no significant effect of adjusting temperature settings, and a significant effect of few-shot chain-of-thought prompting over basic zero-shot prompting. Taken together, these findings carry timely insights for the desirability and feasibility of outsourcing legally relevant tasks to AI models, as well as for the importance for AI developers to implement rigorous and transparent capabilities evaluations to help secure safe and trustworthy AI. Selected by the Economist as one of the best books of 2020. -/- Privacy Is Power argues that people should protect their personal data because privacy is a kind of power. If we give too much of our data to corporations, the wealthy will rule. If we give too much personal data to governments, we risk sliding into authoritarianism. For democracy to be strong, the bulk of power needs to be with the citizenry, and whoever has the data will have (...) the power. Privacy, I argue, is not a personal preference; it is a political concern. I also argue that personal data is a toxic asset, and should be regulated as if it were a toxic substance, similar to asbestos. I call for a complete ban to the trade in personal data. The book is at once philosophical and political, and extremely practical and accessible. It discusses liberal democracy, equality, justice, and autonomy. It includes a chapter for policymakers, and one that addresses what ordinary citizens can do to protect privacy. This article discusses the meaning of the notion of virtuality in modern physics. To this end, it develops considerations on the introduction and establishment in nuclear physics of two independent concepts at the turn of the 1920s and 1930s: that of the virtual state, used in the context of neutron scattering studies, and that of the virtual transition, useful for the theoretical understanding of strong nuclear forces, which forms the basis of what are now called virtual particles. Their comparative analysis (...) highlights the theoretical nature of virtual entities and processes in modern physics. It also shows how the virtual has been associated with various purely physical attributes, leading to a form of polysemy of the term, from the beginning of the application of these concepts. This paper proposes a five-part empirical typology of interconnections of race and class. We describe the mechanisms whereby (1) race is a form of class relation; (2) race relations and class relations reciprocally affect each other; (3) race acts as a sorting mechanism into class locations; (4) race acts as a mediating linkage to class locations; and (5) race interacts with class in determining other outcomes. Rather than insisting on one or another mechanism as the overarching framework for conceptualising the (...) interconnections between race and class, we propose a theoretical integration of all five within a functionalist model. The model reconciles the empirical effects of race variables with a class-functionalist explanation of race. Our typology of interconnections is useful for situating concrete empirical phenomena, and our theoretical integration of those interconnections offers a coherent explanatory system that captures the recursive causality of race and class. Limits need to be set on AI’s ability to simulate human feelings. Ensuring that chatbots don’t use emotive language, including emojis, would be a good start. Emojis are particularly manipulative. Humans instinctively respond to shapes that look like faces — even cartoonish or schematic ones — and emojis can induce these reactions.

Ethical codes, ethics committees, and respect for autonomy have been key to the development of medical ethics —elements that digital ethics would do well to emulate.

In this paper, I argue against views that equate privacy with control over self-presentation and explore some of the implications of my criticism for the online world. In section 1, I analyze the relationship between control over self-presentation and privacy and argue that, while they are both tightly connected, they are not one and the same thing. Distinguishing between control over self-presentation and privacy has important practical implications for the online world. In section 2, I investigate self-presentation online and argue (...) that, while there might be an illusion that one can self-present on one’s own terms online, that mirage often reveals itself as unrealistic because of external and internal constraints. I further argue that what is most noteworthy about self-presentation online, in contrast to self-presentation offline, is the pressure to be on display at all times. In section 3, I argue that to combat some of the negative trends we are witnessing online we need, on the one hand, to cultivate a culture of privacy, in contrast to a culture of exposure. On the other hand, we need to readjust how we understand self-presentation online. I argue that in some cases we should understand it in similar terms to how we understand advertisement or fiction. By changing our conventions online, we would be taking away some of people’s control over self-presentation by not taking their online personae at face value. (shrink)

In recent years, the most widespread doctrine about the conflicts between fundamental (usually constitutional) legal rights could be summarized in the following three main theses: (1) The elements in conflict are legal principles, as opposed to legal rules; (2) Those conflicts are not consequences of the existence of inconsistencies or antinomies between the norms involved, but rather depend on the empirical circumstances of the case. In other words, the norms are logically consistent and the conflicts are not determinable a priori (...) or in abstracto , but only in concreto ; and (3) The classical criteria for solving conflicts between norms, such as lex superior , lex posterior and lex specialis , are not suitable to solve conflicts among fundamental legal rights. Indeed, they require a specific method known as ‘weighing and balancing’. Although all three theses could be (and indeed have been) regarded as problematic, in this paper I address mainly the second one. I try to show that there is room for a tertium genus between antinomies (deontic inconsistencies) and conflicts caused by strict empirical circumstances that I call ‘contextual antinomies’. There are situations in which the norms involved are not inconsistent but the conflict arises for logical reasons. My thesis is that many conflicts between fundamental legal rights fall in this category. I offer, in an appendix, a proposal of formalization of this kind of conflict and the elements involved in it. The first few years of the 21st century were characterised by a progressive loss of privacy. Two phenomena converged to give rise to the data economy: the realisation that data trails from users interacting with technology could be used to develop personalised advertising, and a concern for security that led authorities to use such personal data for the purposes of intelligence and policing. In contrast to the early days of the data economy and internet surveillance, the last few years have (...) witnessed a rising concern for privacy. As bad data practices have come to light, citizens are starting to understand the real cost of using online digital technologies. Two events stamped 2018 as a landmark year for privacy: the Cambridge Analytica scandal, and the implementation of the European Union’s General Data Protection Regulation (GDPR). The former showed the extent to which personal data has been shared without data subjects’ knowledge and consent and many times for unacceptable purposes, such as swaying elections. The latter inaugurated the beginning of robust data protection regulation in the digital age. Getting privacy right is one of the biggest challenges of this new decade of the 21st century. The past year has shown that there is still much work to be done on privacy to tame the darkest aspects of the data economy. As data scandals continue to emerge, questions abound as to how to interpret and enforce regulation, how to design new and better laws, how to complement regulation with better ethics, and how to find technical solutions to data problems. The aim of the research project Data, Privacy, and the Individual is to contribute to a better understanding of the ethics of privacy and of differential privacy. The outcomes of the project are seven research papers on privacy, a survey, and this final report, which summarises each research paper, and goes on to offer a set of reflections and recommendations to implement best practices regarding privacy. Anonymity promotes free speech by protecting the identity of people who might otherwise face negative consequences for expressing their ideas. Wrongdoers, however, often abuse this invisibility cloak. Defenders of anonymity online emphasise its value in advancing public debate and safeguarding political dissension. Critics emphasise the need for identifiability in order to achieve accountability for wrongdoers such as trolls. The problematic tension between anonymity and identifiability online lies in the desirability of having low costs (no repercussions) for desirable speech and high (...) costs (appropriate repercussions) for undesirable speech. If we practice either full anonymity or identifiability, we end up having either low or high costs in all online contexts and for all kinds of speech. I argue that free speech is compatible with instituting costs in the form of repercussions and penalties for controversial and unacceptable speech. Costs can minimise the risks of anonymity by providing a reasonable degree of accountability. Pseudonymity is a tool that can help us regulate those costs while furthering free speech. This article argues that, in order to redesign the Internet to better serve free speech, we should shape much of it to resemble an online masquerade. (shrink)

Population obesity and associated morbidities pose significant public health and economic burdens in the United Kingdom, United States, and globally. As a response, public health initiatives often seek to change individuals’ unhealthy behavior, with the dual aims of improving their health and conserving health care resources. One such initiative—taxes on sugar‐sweetened beverages (SSB)—has sparked considerable ethical debate. Prominent in the debate are arguments seeking to demonstrate the supposed impermissibility of SSB taxes and similar policies on the grounds that they interfere (...) with individuals’ freedom and autonomy. Commentators have often assumed that a policy intended to restrict or change private individuals’ consumption behavior will necessarily curtail freedom and, as a corollary, will undermine individuals’ autonomy with respect to their consumption choices. Yet this assumption involves a conceptual mistake. To address the misunderstanding, it’s necessary to attend to the differences between negative liberty, freedom of options, and autonomy. Ultimately, concerns about negative liberty, freedom, and autonomy do not provide strong grounds for opposing SSB taxes. (shrink)

We aim to map out the points of confluence between phronesis and emotion, as well as the nature of this confluence. We do so based on philosophical and psychological explanations of emotions and phronesis. Making sound decisions, which requires phronesis, is an important matter, but its relationship with emotions has only just begun to be studied. We propose that the interplay between phronesis and emotion is possible (rather than inevitable) because both have a cognitive-behavioural structure and because emotions are hierarchical. (...) In the case of emotion, there are no gaps between the cognitive and behavioural dimensions, while phronetic acts can only manifest if cognitive and behavioural aspects are activated simultaneously. The confluence we identify is bidirectional and involves mutual enrichment in this dual dimension. On the one hand, phronesis enriches emotion because it involves extra subjective knowledge and allows emotion to be directed towards higher goals. On the other hand, emotions enrich phronesis because phronesis makes decisions based on sensitive preferences and because emotions confirm correctness in the context of moral decision making. Methodologically, this study is theoretical and interdisciplinary, as our approach is both philosophical and psychological. Philosophy helps us to improve the conceptual foundation of the construct, while psychology provides an analysis of the emotional process, allowing philosophy to understand how emotional evaluation-assessment and motivation lead to decision making. Educational Social Responsibility (EduSR) is the voluntary provision of the educational institution that, as a natural space of social possibilities, favors the deployment of its members towards others, showing it with transparency based on observable indicators. The intention of this book is: a) to try to analyze what is essential that we all share in our respective experiences of EduSR, b) to illuminate so that everyone can make their interpretation in the most accurate way possible and their evaluations in the (...) most reasonable way, c) offer illustrative and convincing arguments, d) invite people to inhabit education with EduSR from their own originality. INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. Valor de lei! Só assim, davam tranqüilidade boa à gente. Por que o Governo não cuida?! Ah, eu sei que não é possível. Não me assente o senhor por beócio. Uma coisa é pôr idéias arranjadas, outra é lidar com país de pessoas, de carne e sangue, de mil-e-tantas misérias... Tanta gente – dá susto de saber – e nenhum se sossega: todos nascendo, crescendo, se casando, querendo colocação de emprego, comida, saúde, riqueza, ser importante, querendo chuva e negócios bons... De sorte que carece de se escolher: ou a gente se tece de viver no safado comum, ou cuida só de religião só. Eu podia ser: padre sacerdote, se não chefe de jagunços; para outras coisas não fui parido. Mas minha velhice já principiou, errei de toda conta. E o reumatismo... Lá como quem diz: nas escorvas. Ahã. Hem? Hem? O que mais penso, testo e explico: todo-omundo é louco. O senhor, eu, nós, as pessoas todas. Por isso é que se carece principalmente de religião: para se desendoidecer, desdoidar. Reza é que sara da loucura. No geral. Isso é que é a salvaçãoda- alma... Muita religião, seu moço! Eu cá, não perco ocasião de religião. Aproveito de todas. Bebo água de todo rio... Uma só, para mim é pouca, talvez não me chegue. Rezo cristão, católico, embrenho a certo; e aceito as preces de compadre meu Quelemém, doutrina dele, de Cardéque. Mas, quando posso, vou no Mindubim, onde um Matias é crente, metodista: a gente se acusa de pecador, lê alto a Bíblia, e ora, cantando hinos belos deles. Tudo me quieta, me suspende. Qualquer sombrinha me refresca. Mas é só muito provisório. Eu queria rezar – o tempo todo. Muita gente não me aprova, acham que lei de Deus é privilégios, invariável. E eu! Bofe! Detesto! O que sou? – o que faço, que quero, muito curial. E em cara de todos faço, executado. Eu não tresmalho! Olhe: tem uma preta, Maria Leôncia, longe daqui não mora, as rezas dela afamam muita virtude de poder. Pois a ela pago, todo mês – encomenda de rezar por mim um terço, todo santo dia, e, nos domingos, um rosário. Vale, se vale. Minha mulher não vê mal nisso. E estou, já mandei recado para uma outra, do Vau-Vau, uma Izina Calanga, para vir aqui, ouvi de que reza também com grandes meremerências, vou efetuar com ela trato igual. Quero punhado dessas, me defendendo em Deus, reunidas de mim em volta... Chagas de Cristo! Viver é muito perigoso... Querer o bem com demais força, de incerto jeito, pode já estar sendo se querendo o mal, por principiar. Esses homens! Todos puxavam o mundo para si, para o concertar consertado. Critics are calling for the decolonization of AI (artificial intelligence). The problem is that this technology is marginalizing other modes of knowledge with dehumanizing applications. What is needed to remedy this situation is the development of human-centric AI. However, there is a serious blind spot in this strategy that is addressed in this paper. The corrective that is usually proposed—participatory design—lacks the philosophical rigor to undercut the autonomy of AI, and thus the colonization spawned by this technology. A more radical (...) or substantial proposal is advanced in this discussion that is known as community-based design. This alternative makes a theoretical maneuver that allows AI design to be directed by human agency, thereby introducing a safeguard that may help to prevent colonization by this technology. (shrink)
