Recently much interest has been shown in the notion of intelligible species in the thought of Thomas Aquinas. Intelligible species supposedly explain humanknowing of the world and universals. However, in some cases, the historical context and the philosophical sources employed by Aquinas have been sorely neglected. As a result, new interpretations have been set forth which needlessly obscure an already controversial and perhaps even philosophically tenuous doctrine. Using a recent article by Houston Smit as an example of a novel and (...) anachronistic modern interpretation of Aquinas’s abstractionism, this paper shows that Aquinas follows the intentional transference of Averroes who proposes a genuine doctrine of abstraction of intelligibles from experienced sensible particulars. The paper also shows that Aquinas uses the doctrine of primary and secondary causality from the Liber de causis when he asserts that human abstractive powers function only insofar as they are a participation in Divine illumination. Boxers and healthcare workers alike should be able to exercise their rightsAlthough there are calls elsewhere to ban boxing, the Australian Medical Association advocates a less restrictive rule. Professional boxers would submit to brain scans and MRIs—but what to do with the results of such tests? Critics say that boxers should decide which risks they take, but boxers are not the only ones in the debate. Healthcare workers understandably want some say in which risks people take, because the hospital is (...) where boxers go when injuries occur . These issues of ethics and obligation are not made easier to resolve by the many disputed comparisons in this debate. Is boxing like other risk taking behaviour? Are physicians like other public employees? Until such questions are answered, a compromise would have check ups made mandatory, without forcing boxers to act on any knowledge gained.There is no shortage of comparisons in the debate over boxing. Boxing, we hear, is like fast food: dangerous yes, but it does offer some benefits. No, the opposing side contends, boxing is like a pistol duel: once considered sophisticated, it is now just a ritualistic violence. Perhaps boxing is like smoking: inform boxers of the risks and let them at it. Then again, if boxing is like smoking, people who do not realise how dangerous it is need protection from it. Depending on who you listen to, boxing is an expression of individualism and personal sacrifice—the next best thing to running your own country—or it illustrates the danger in letting concern for autonomy overstretch the social fabric. Despite the prominence of healthcare-relatedconcerns in public debate, the ground remainsinfertile for the idea of conscripting citizensinto medical research. Reluctance to entertainthe thought of a system where nearly everyonecould be selected for service might reflectuncertainty about what the project wouldinvolve. There might also be a fear that themore crucial issue is how to protect researchsubjects within current, voluntary systems. Nodoubt reluctance to explore a system ofuniversal service results from the common hopethat each of us might avoid research in anycapacity besides (...) researcher. A system of fullcivic participation might, however, avoid manyof the usual objections. Ethics regulations,including informed-consent guidelines, couldfor the most part remain in force. Though thesystem would compel people to serve, it couldremain responsive to principles of autonomy andjustice if it centered on broad publiceducation, community representation, and alottery-type selection process. The systemcould draw from the largest possiblecross-section of society, and offer conscriptsthe widest possible range of service. Post-war Japan has seen profound and rapid social change and transformation. One of the most visible areas of change in Japan has been medicine, and particularly the ethical practices and policies that guide medical decision-making. The formal discipline of bioethics, Seimei Rinri in Japanese, has grown by leaps and bounds since the late 1970s, when it began to appear in the curriculum and professional activities of Japanese medical schools and philosophy departments. The introduction of bioethics to Japan was timely, as (...) innovation in medicine and technology was evolving in ways that revealed that the intersection of medicine, traditional Japanese values, and new cultural trends was an area of great moral complexity. In its infancy, bioethics in Japan was more or less an import from the United States, where the discipline took its roots. Quickly, however, it became clear that Japan's history and tradition would call for a different approach, and the engagement of slightly different ethical issues. Organ transplantation, for example, sparked much greater controversy in Japan than it ever did in the United States. Today, Japan has one of the most dynamic bioethics programs in the world, and it is one that reflects both traditional Japanese culture and the need for inter-cultural engagement in an increasingly global world. Through a series of original chapters written by bioethicists and covering a range of ethical issues, this anthology shows that, in contrast to previous assumptions, Japanese bioethics has, in fact, taken on an identity that is undoubtedly separate from its American origins. Rich philosophical questions raised by medicine, human subjects research, and psychiatric care are being posed by scholars in a way that reflect Japanese tradition and is no longer simply reflective of, or shaped by, American traditions and philosophical problems. The book highlights and showcases these trends through a series of chapters written by some of the leading scholars in contemporary Japanese bioethics, many of whom were pioneers of the field when it began and are now nearing retirement. A focus of criticism on methodological and ethical grounds, the undercover or `covert' approach to fieldwork persists as a useful technique in certain settings. Questions remain about the credibility of the published findings from such work. Covert researchers nearly always protect the anonymity of their subjects and locations. Other researchers cannot validate the covert researcher's claims, yet ethical guidelines often insist that researchers demonstrate the benefits that derive from a covert study. If researchers cannot show that their studies will prove (...) beneficial, ethical standards will weigh against the study, on the presumption that the omission of informed consent should be counterbalanced by the scientific rewards of the research. An attempt to open the results to greater peer investigation might place subjects at risk of unwanted notoriety or even danger. There does not seem to be a way that covert research can meet ethical guidelines unless we adjust our conceptions of research, ethics, or both. In debate over the ethics of deceptive experiments in American psy chology, commentators often provide an inaccurate history of these experiments. This happens especially where writers portray experi mental deception as a necessary accompaniment to human experiments, rather than a conscious choice based on values attached to persons and scientific inquiry. Compounding the error, commentators typically give a misleading portrayal of psychologists' attitudes and procedures. Commentators frequently cite Stanley Milgram's work in the 1960s as a harbinger of changed attitudes towards (...) deception, and suggest that today's psychologists abide by more enlightened ethical practices. It is difficult to find evidence to support this portrayal. (shrink)

Experimental psychology often involves the intentional deception or manipulation of human subjects. Psychologists typically defend deceptive experiments by first presupposing either the innocuousness of the deception or the importance of science. As I will show, psychologists have yet to justify deceptive experiments in terms that are not themselves contingent on value claims regarding such things as the freedom of inquiry or the role of scientific knowledge in Western societies. This dissertation offers a reexamination of deceptive psychology experiments, combined with an (...) understanding of their historical and social background. My conclusions have implications for other areas of human-subject research, and the theory of informed consent. In that sense, I mean my discussion to show the need to ground all human-subject research within a common ethical framework. (shrink)

In pseudo-patient study (PPS), fieldworkers cloak their identities and intentions and pose as This enables them to observe the practice of healthcare from within a naturalistic, nonreactive research setting. Rosenhan and his assistants conducted the most famous PPS, where they faked symptoms of schizophrenia so that they could gain admittance to a mental-health facility and observe the treatment that genuine patients were receiving. More subtle pseudo-patients might arrange over the phone, after reporting varying levels of health insurance. Others might provide (...) dummy lab specimens or test a physician's response to technical questions. Although deceptive psychology experiments receive less attention than some forms of medical research, they pose similar moral challenges. These challenges mainly concern the use of human subjects and intentional deception. Psychologists provide an argument to justify this deception. But what is an essentially utilitarian argument too often includes faulty comparisons and dubious accounts of risks and benefits. Commentators in other areas of humansubject research might examine this argument and the assumptions behind it. Bioethics commentators seem especially well-positioned for this task.

A well-known thought experiment has us ponder a lottery system that selects one person as the source of transplantable organs for two others. The organs are forcibly harvested and the “donor” dies, whereas the other two patients live. The Survival Lottery is supposed to get at the distinction between killing and letting die, but it is also a challenge to beliefs about moral duties: what are my obligations if my life could be used to save yours and another person's as (...) well? A less extreme version of this thought experiment might have us imagining that officials of the public healthcare system would devise a similar lottery in the aftermath of a large-scale medical emergency. We could imagine that a natural disaster or an attack using biological weapons, for example, has so diminished the ability to provide public health care that in some communities, officials might consider implementing a lottery. To avoid the concerns about outright killing of selectees, officials might offer a wide range of participation in medical practice and research, not just organ allocation. Officials could ensure that no significant risks are involved, and selectees could in various ways be compensated. Would it be possible to ethically justify this “Healthcare Lottery” on the grounds that it was a temporary, yet necessary, infringement on autonomy? (shrink)

Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. En este artículo describiremos la vitalidad del sistema fonológico del mapudungun hablado por escolares pewenches de la Provincia del Biobío, VIII Región. Específicamente, nos hemos propuesto: a) Determinar los fonos/fonemas, y su fonotaxis, que se relevan como indicadores de vitalidad, b) Identificar las transferencias fonético-fonológicas presentes en la fonología del pewenche hablado por estos escolares y c) Interpretar las transferencias encontradas en términos del grado de vitalidad de la fonología de la lengua. La muestra está conformada por un grupo de (...) 20 escolares bilingües de entre 12 y 15 años de edad, que se encuentran cursando 7° y 8° año básico en escuelas rurales pertenecientes a dos comunidades pewenches del valle del Queuco, en la comuna de Alto Biobío. Para la recolección del material fonológico, se aplicó a los participantes una lista léxica de 65 ítems, material que se complementó con la narración oral en mapudungun de un cuento. Según nuestros datos, hemos podido constatar la existencia de una serie de rasgos fónicos en el mapudungun hablado por los escolares pewenches que obedece a la influencia de las estructuras fonológicas del castellano. Sin embargo, el grado y la difusión de los fenómenos de transferencia se desarrollan de manera heterogénea en ambas comunidades en estudio, debido, entre otros factores, a la intensidad del contacto. In this article we will describe the vitality of the phonological system Mapudungun spoken by Pewenche schoolchildren from the Biobío province, VIII Region. We intend: a) To determine the phones/phonemes, and their phonotactics, which are revealed as vitality markers. b) To identify the phonetic-phonological transferences which are present in the Pewenche spoken by these schoolchildren, and, c) To interpret the transferences found in terms of the degree of the language phonological vitality. The sample is composed of 20 bilingual schoolchildren from 12 to 15 years old, who are in 7th and 8th grade in rural primary schools belonging to two Pehuenche comunities from Valle del Queuco, in the city of Alto Biobío. To collect the phonological material, we applied a 64-item lexical list, which was complemented with the oral narration of a tale in Mapudungun. According to our data, we have been able to verify the existence of a series of phonic features in the Mapudungun spoken by Pewenche schoolchildren, which originate because of the influence of the Spanish phonological structure. However, the degree and spread of the transference phenomena develop in a heterogeneous way in both of the studied communities. due to the contact intensity, among other possible factors. (shrink)

This research analyses the influence of the perception of Corporate Social Responsibility (CSR image) on consumer–company identification (C–C identification). This analysis involves an examination of the influence of CSR image on brand identity characteristics which provide consumers with an instrument to satisfy their self-definitional needs, thereby perceiving the brand as more attractive. Also, the direct and mediated influences (through their effect on brand attitude), of CSR-based C–C identification on purchase intention are analysed. The results offer empirical evidence that CSR generates (...) more C–C identification because it improves brand prestige and distinctiveness; brand coherence is also a powerful antecedent of brand attractiveness in the context of CSR communication. Finally, CSR-based C–C identification is able to generate directly better attitude towards the brand and greater purchase intention. (shrink)

Le titre est évidemment emprunté au célèbre ouvrage de Paul Veyne, mais le choix de la forme interrogative signale d’entrée le caractère exploratoire de l’entreprise. Dans leur efficace synthèse introductive, les organisateurs du colloque mettent en valeur un paradoxe : alors que l’histoire constitutionnelle fait l’objet, dans de nombreux pays, d’un engouement remarquable, la question de son domaine, de sa (...) méthode et de ses enjeux n’a suscité en France que peu de réflexions approfondies. There’s only one YOU. Others may have your name, but not your identity. They may share your birth date and hospital, but not your parents. They may share your parents, but not your name. Do you see what I’m getting at here? Therefore how can a ‘one-size fits all’ religion, education or philosophy possibly answer the question to your meaning of life? In fact, the case focused on by Herrera as an example (...) of activism producing space and creating change in the name of social justice is not the only top-quality contribution to Latinx geographies to be found in this book. Herrera’s conceptualization of “cartographic memory” builds on the intertwining of Latinx writers and historians with traditional spatial thought from the history of geography. His definition of “cartographic memory” as a “political remaking of urban geography and therefore a selective mapping” adds to the broader oeuvre of activism and space coming out in recent years (14).The geographic location for Cartographic Memory comes from the author’s long history of working in and around Fruitvale as both a volunteer and community member. As a new resident of the Oakland area, Herrera mistakenly navigated himself to Fruitvale, where he found the elements of the place clearly speaking to a cultural aesthetic of Latin-idad. Intrigued, Herrera began volunteering in the area, and learned more of the long activist history of the space. That activist history, Herrera argues, has long been under-studied, or even forgotten, in Chicano activist history, and merits recognition. Herrera’s efforts with [End Page 139] this book go a long way to gathering together that spatial history and reconstructing it for the reader through interviews and oral histories with numerous activists, extensive archival research, and ethnography focusing on the 1960s and 1970s Mexican-American activist mobilization in support of the Chicano movement.The power of the focus on Fruitvale must be recognized, as Herrera also makes space for intently peeling apart the layers of nonprofit funding, social movements, and community-building and support. The chapter, “Revolution Interrupted,” is about the funding situation of the Unity Council in Fruitvale and how the funding structure was constructed over time in the context of the political and economic opportunities of the 1960s. It speaks to how this had a profound effect on the organizers and community given the shift from grassroots to institutional funding. This chapter opens the book with a focus on the national scope of funding opportunities for organizations in the 1960s that focused on race and ethnicity. Through this lens are explored the effects of local political actions—such as the 1969 speech by San Antonio-based Mexican American Youth Organization (MAYO) leader Jose Angel Gutierrez—on funding at the federal level. Because of the perceived militancy of these remarks, the U.S. Congress became concerned, and eventually passed the 1969 Tax Reform bill, limiting the types of projects that could be funded philanthropically. This type of multi-scale understanding of Fruitvale activism is threaded throughout the entire book, from chapter 1, “Making Place,” in which Herrera summarizes activist perspectives on Fruitvale as emphasizing “not only how the neighborhood itself [produced] a geography of activism but also how it was interconnected to other places of struggle throughout the United States” (emphasis in original; 33).Herrera also navigates the interactions of race, ethnicity, and space, tracing how coalitions, influences on political efforts, and collaboration took place throughout Fruitvale and Oakland during this period. His second chapter, “The Other Minority,” identifies where Black Panther Party-related work occurred; the marketization that began to occur of a non-threatening, non-Black “Latino” identity; the effect that this had on activist efforts; and more. Two Approaches to the EarthIn several postwar texts, the earth increasingly receives attention from Carl Schmitt.1 In The Nomos of the Earth, the most important of these texts, he refers to Friedrich Hölderlin, a much earlier, very different author, who also considers the subject of the earth. Even though the positions of both are, ultimately, quite similar, they maintain significant terminological differences. Schmitt and Hölderlin both employ the word “nomos,” but in very different ways. Hölderlin regards “nomos” as “law” (...) in the sense of “positive” norm or “Gesez.”2 This use of “nomos” as “Gesez” differs from a second notion of law as the meaning operating at the basis of what Hölderlin calls the “sphere.” The sphere is a meaningful whole in which man originally exists. Law is here the very relations of the sphere as a meaningful whole. Hölderlin calls it the law in a “negative” sense.3 This second notion of law by Hölderlin (negative law or law as the meaning at the basis of the sphere) coincides precisely with the Schmittian idea of “nomos” as an “order of meaning [Sinnreich],”4 what he also calls the law in an “ontonomous and existential” sense.5 The first use of law as “nomos” or “Gesez” by Hölderlin coincides with Schmitt’s use of “Gesetz”: of law as “positive” law. La pregunta por la posibilidad de la verdad retorna en un contexto en el que el pluralismo semiótico y la conducción mediática son dos elementos que rigen y ordenan la sociedad actual, (...) sociedad que se caracteriza por la abundancia de información y la omnipresencia de los medios de comunicación como tecnologías de poder. Desgranar su significado y vínculo nos conduce directamente al estudio del poder y el signo en relación con los efectos de la verdad de la posverdad. La relación entre los medios de comunicación y los acontecimientos, además, se encuentra atravesada por el concepto de interpretación, donde la capacidad de comprender y la habilidad para reconstruir narrativas son elementos que determinan la comprensión y el sentido de lo que ocurre en nuestro mundo. Pasado un siglo y medio desde entonces, el filósofo y esteta francés emérito de la Universidad de París VIII y European Graduate School Jacques Rancière, en un ejercicio característico de la filosofía de la educación, publica en 1987 El maestro ignorante a partir de la experiencia de Jacotot.
