More has been said about the Hart-Fuller debate than can be considered healthy or productive even within the precious world of jurisprudential scholarship – too much philosophising about how law has revelled in its own abstractness and narrowness. But the mission of this book is distinctly and determinedly different – it is not to rework these already-rehashed ideas, but to reject them entirely. Rather than add to the massive jurisprudential literature that has been generated by all and sundry, the book (...) criticises and abandons the project that Hart and Fuller set in motion. It contends that the turn that was taken in 1957 has led down a series of cul-de-sacs, blind alleys, and dead-ends to nowhere useful or illuminating. It is more than past time to leave their debate behind and strike out in an entirely new and more promising direction. This work is a generalization of the López-Ruiz, Mancini, and Calbet (LMC) and Shiner, Davison, and Landsberg (SDL) complexity measures, considering that the state of a system or process is represented by a continuous temporal series of a dynamical variable. As the two complexity measures are based on the calculation of informational entropy, an equivalent information source is defined by using partitions of the dynamical variable range. During the time intervals, the information associated with the measured dynamical variable is (...) the seed to calculate instantaneous LMC and SDL measures. The Three Papers comprising this series, together with my earlier [34] also published in this journal, constitute an attempt to set out the major issues in the theoretical domain of reduction and to develop a general theory of theory reduction. The fourth paper, [34], though published separately from this trio, is integral to the presentation and should be read in conjunction with these papers. Even so, the presentation is limited in scope – roughly, to intertheoretic reduction among empirical theories (...) – and informal in presentation – not least because a satisfying formal account of theories has yet to be offered. And despite the length, the treatment is still condensed; often corroborating and/or intuitively helpful detail has had to be consigned to footnotes or omitted. I approach the problem from within my own naturalistic realist philosophy of science and formal analysis of abstract hierarchy in theory. Jung, then president of the International Psychoanalytic Association, set out his critique and reformulation of the theory of psychoanalysis in a series of lectures in New York, ideas that were to prove unacceptable to Freud, thus creating a schism in the Freudian school. Jung challenged Freud's understandings of sexuality, the origins of neuroses, dream interpretation, and the unconscious, and Jung also became the first to argue that every analyst should themselves be analyzed. In numerous texts Leibniz claimed that while metaphysical necessity is inconsistent with free choice, moral necessity is not. A question naturally arises concerning what Leibniz took moral necessity to be. In a series of recent articles Michael Murray has argued that the concept of moral necessity Leibniz utilized is one developed and deployed by a group of 17th century Spanish Jesuits. This chapter argues that Leibniz's commitment to certain deep metaphysical principles suggests otherwise.

Aristotle’s claim that poetry is ‘a more philosophic and better thing’ than history (Poet 9.1451b5-6) and his description of the ‘poetic universal’ have been the source of much scholarly discussion. Although many scholars have mined Poetics 9 as a source for Aristotle’s views towards history, in my contribution I caution against doing so. Critics of Aristotle’s remarks have often failed to appreciate the expository principle which governs Poetics 6-12, which begins with a definition of tragedy and then elucidates the terms (...) of that definition by means of a series of juxtapositions. The juxtaposition between poetry and history is one such instance which seeks to elucidate what sort of plot exemplifies a causal unity such that the events of a play unfold with likelihood or necessity. Within that context, Aristotle compares history and poetry in order to elucidate the object of poetic mimesis rather than criticize history as a discipline. Viewing Aristotle as antagonistic towards history fails to appreciate the expository structure of the Poetics and obscures the resource which history provides to the poet, a point which I explore by considering what Aristotle would have thought of an ‘historical’ tragedy like Aeschylus’ Persians. The need to regulate access to genetic resources and ensure a fair and equitable sharing of any resulting benefits was at the core of the development of the Convention on Biological Diversity (CBD). The CBD established a series of principles and requirements around access and benefit sharing (ABS) in order to increase transparency and equity in the international flow of genetic resources, yet few countries have been able to effectively implement them and ABS negotiations are often paralysed by differing (...) interests. -/- This book not only examines these complex challenges, but offers workable, policy-oriented solutions. A philosophical theory of explanation should provide solutions to a series of problems, both descriptive and normative. The aim of this essay is to establish the claim that this can be best done if one theorizes in terms of explanatory games rather than focusing on the explication of the concept of explanation. The position that is adopted is that of an explanatory pluralism and it is elaborated in terms of the rules that incorporate the normative standards that guide the (...) processes of discovery and justification of explanations as well as the modes of their communication, dissemination, and adoption. They constitute the rules of the explanatory game that the participants are playing. The philosophical project consists in describing and normatively appraising the rules that constitute these games. This volume in the Reason & Religion series provides an explanation and defense of a view of faith and reason found in the writings of Soren Kierkegaard and others that is often called "fideism", a belief in faith beyond reason.

The publication of the latest contribution to the alcohol-in-pregnancy debate, and the now customary flurry of media attention it generated, have precipitated the renewal of a series of ongoing debates about safe levels of consumption and responsible prenatal conduct. The University College London (UCL) study’s finding that low levels of alcohol did not contribute to adverse behavioural outcomes—and may indeed have made a positive contribution in some cases—is unlikely to be the last word on the subject. Proving a negative (...) correlation is notoriously difficult (technically, impossible), and other studies have offered alternative claims. The author is not an epidemiologist, and the purpose of this article is not to evaluate the competing empirical claims. However, the question of what information and advice healthcare practitioners ought to present to pregnant women, or prospectively or potentially pregnant women, in a situation of uncertainty is one to which healthcare ethicists may have a contribution to make. In this article, it is argued that the total abstinence policy advocated by the UK’s Department of Health, and even more stridently by the British Medical Association, sits uneasily with recent data and is far from ethically unproblematic. In particular, the “precautionary” approach advocated by these bodies displays both scant regard for the autonomy of pregnant and prospectively pregnant women and a confused grasp of the principles of beneficence and non-maleficence. Why do people act morally – when they do? Moral philosophers and psychologists often assume that acting morally in the absence of incentives or sanctions is a product of a desire to uphold one or another moral principle (e.g., fairness). This form of motivation might be called moral integrity because the goal is to actually be moral. In a series of experiments designed to explore the nature of moral motivation, colleagues and I have found little evidence of moral integrity. (...) We have found considerable evidence of a different form of moral motivation, moral hypocrisy. The goal of moral hypocrisy is to appear moral yet, if possible, avoid the cost of being moral. To fully reach the goal of moral hypocrisy requires self-deception, and we have found evidence of that as well. Strengthening moral integrity is difficult. Even effects of moral perspective taking – imagining yourself in the place of the other (as recommended by the Golden Rule) – appear limited, further contributing to the moral masquerade. (shrink)

Recent studies of historical synthesis have denied the possibility of "truth" in historical narratives, which they state impose meaning on a series of events. An historian is, however, capable of writing a true history, true in the sense that his or her narrative provides a fair representation of its central subject. Descriptions represent the world when they give us an idea that resembles part of the world itself. A subject can be said to be fairly represented if an author (...) follows certain procedures: events must be presented chronologically; the main changes that occurred in the subject must be described; there must not be descriptions or omissions which might give a misleading impression of the subject; and the subject should be explained at a consistent level of generality and with a consistent level of detail. An historian motivated by preconceptions rather than the desire to represent a subject fairly, will not write a true history. Preconceptions are not incompatible with writing true histories, however, as long as they are discarded when an historian learns that they are incompatible with a fair representation. Analysis can be supplementary to, but is never a substitute for, accurate historical representation of a subject. (shrink)

Systematic sampling of communities gives rise to large contingency tables summing up possible changes in the assemblages' structure. Such tables are generally analysed by multivariate statistical methods, which are ill-suited for simultaneously analysing rare and common species (Field et al., 1982). In order to separately process species belonging to either of these categories, we propose a statistical method to select common species in a sequence of ecological surveys. It is based on a precise definition of rarity, and depends on a (...) rarity parameter. In this work, this parameter will be optimised so that the sub-table of common species captures the essential features of the complete table as well as possible. In this way we analysed the spatio-temporal evolution of macrobenthic communities from the Algiers harbour to study the pollution influence during a year. The examination of the communities' structuring was done through Principal Components Analysis (PCA) of the species proportions table. Environmental variables were simultaneously sampled. We show that the data structure can be explained by about 25% of the total number of present species. Two environmental gradients were brought to the fore inside the harbour, the first one representing pollution, and the second one representing hydrological instabilities. (shrink)

ABSTRACTAn essential and yet often neglected motivation of Bernard Suits’ elevation of gameplay to the ideal of human existence is his account of capacities along perfectionist lines and the function of games in eliciting them. In his work Suits treats the expression of these capacities as implicitly good and the purest expression of the human telos. Although it is a possible interpretation to take Suits’ utopian vision to mean that gameplay in his future utopia must consist of the logically inevitable (...) replaying of activities we conduct in the present for instrumental reasons, because gameplay for Suits is identical with the expression of sets of capacities specifically elicited by game rules, it is much more likely that he intends utopian gameplay to be an endless series of carefully crafted opportunities for the elicitation of special capacities, and thus embody his ideal of existence. In this dialogue the view of Paul Hoyningen-Huene as defended in Systematicity. The Nature of Science is presented and criticized. The approach is developed dialectically by the two interlocutors, a series of critical points are debated and an alternative view is introduced. The dialogical form is intended to honor the general philosophical approach of the author summarized in the last sentence of the book, where he states that he sees philosophy as an ongoing, open-ended dialogue.

The distinction between clinical practice and surgical research may seem trivial, but this distinction can become a complex issue when innovative surgeries are substituted for standard care without patient knowledge. Neither the novelty nor the risk of a new surgical procedure adequately defines surgical research. Some institutions tacitly allow the use of new surgical procedures in series of patients without informing individuals that they are participating in a scientific study, as long as no written protocol or hypothesis exists. Institutions (...) can justify this practice by viewing human research in narrow terms as an activity outlined in a formal protocol. Application of limited definitions, however, erodes patients' rights and risks losing public confidence in how biomedical research is conducted. I propose an operational definition of human research also be recognised. Enforcing more rigid and less ambiguous guidelines of human research may curtail enrolment into some studies, but it will also protect patients from being used as subjects without their knowledge. Since 1995, thousands of people in Taiwan have pledged each year to donate their cadavers to the medical college run by the Buddhist Tzu Chi (Ciji) Foundation. The “surge of cadavers” seems intriguing in a society where ancestor worship continues to be salient. Drawing on my fieldwork in 2012–2013 and 2015, the purpose of this paper is to describe a series of practices involving the transformation of a cadaver into a Buddhist moral subject: the donor, the family, and the (...) medical school engage in various endeavors and rituals involving “emotional practices” to honor the deceased; situate the donation as a “good death”; and fulfill the family's obligations to ancestor worship. I argue what makes the ritual transformation efficacious is the dominant currency of emotional practices. Emotional practices “authenticate” the ritual transformation. The main ethic for commemorating the cadaver donation is not generosity or dāna but equanimity. (shrink)

Vladimir Vladimirovich Nabokov is a distinctive representative of Russian literature in the 20th century. His works are studied by many famous artists in many countries. The conciseness and beauty of his language are unique characteristics of Nabokov’s creation. His works show great philosophical depth, high moral values, and aesthetic accomplishments. His erudition has also attracted the attention of the world. This paper mainly expounds his metaphysical ideas: Nabokov’s metaphysics is mainly expressed in his great understanding of the world and his (...) ability to understand and his longing for something grand and incomparable. His philosophical, ethical and moral ideas have incorporated the views of various literary schools, formalism, and structuralism at home and abroad. In addition, this article analyzes the relationship between philosophy, ethics, linguistics, reality and non-reality, reality and lies through the study of many works of the author; it clearly defines the distinction between “game” and “acting”; explained a series of problems of the author’s creation techniques; summed up the themes such as “time and permanence”, “memory and memories” in Nabokov’s works. These are all reflected frequently in Nabokov’s works. It is precisely because of this that his works have also been studied as metaphysical works for the public. (shrink)

The Parmenides is notorious for the criticisms it directs against Plato's own Theory of Forms, as presented in the middle period. But the second and major portion of the dialogue has generally been avoided, despite its being offered as Plato's response to the problems; the text seems intractably obscure, appearing to consist of a series of bad arguments leading to contradictory conclusions. Carefully analyzing these arguments and the methodological remarks which precede them, Meinwald shows that to understand Plato's response (...) we need to recognize his important distinction between two kinds of predication. Read in the light of this distinction, the arguments can be seen to be sound, and the contradictions merely apparent. Meinwald then proceeds to demonstrate the direct application of Plato's crucial innovation in solving the problems of the first part of the dialogue, including the infamous Third Man. On Meinwald's interpretation, the new distinction is associated with developments in metaphysics which take Plato well beyond the problems commonly thought to tell against Platonism. (shrink)
