The adoption of the new International Health Regulations in May 2005 represents an historic development for international law and public health. This article describes the IHR revision process and analyzes why the new IHR constitute an advance in global health governance.

This paper examines the implications of the context-sensitivity of counterfactuals for the correctness of emotions and attitudes towards death. I argue that the correctness of an attitude such as fear must be explained by appeal to its causal relations to certain preferences.

T. H. Green was a leading member of the British Idealist movement, which adopted the continental philosophy of Hegel and Kant while rejecting utilitarianism. As well as being a prominent philosopher, Green was an influential educational reformer and an active member of the Liberal party. Green's writings can be placed into three categories: religion, philosophy and politics. This work was the most complete statement of Green's philosophy, although it remained unfinished at his death. Edited by A. C. Bradley, a (...) former student and brother of Green's fellow Idealist F. H. Bradley, the book, which contains four parts, was published posthumously in 1883. This paper explores some aspects of the relation between different ways of achieving a consensus on the judgemental values of a group of indviduals; in particular, aggregation and deliberation. We argue firstly that the framing of an aggregation problem itself generates information that individuals are rationally obliged to take into account. And secondly that outputs of the deliberative process that this initiates is in tension with constraints on consensual values typically imposed by aggregation theory, at least when deliberation is modelled (...) as process of learning from others compatible with Bayesian updating principles. In Chapter 6 of Objects of Credence, Anna Mahtani argues that the opacity of credence raises difficulties for the Principal Principle and proposes a revised principle relating credence and chance that avoids it. In this comment on her book, I both defend Mahtani’s proposed principle against a charge of triviality and argue that the opacity of belief does not threaten the role of chance in guiding credence.

If an agent believes that the probability of E being true is 1/2, should she accept a bet on E at even odds or better? Yes, but only given certain conditions. This paper is about what those conditions are. In particular, we think that there is a condition that has been overlooked so far in the literature. We discovered it in response to a paper by Hitchcock (2004) in which he argues for the 1/3 answer to the Sleeping Beauty problem. (...) Hitchcock argues that this credence follows from calculating her fair betting odds, plus the assumption that Sleeping Beauty’s credences should track her fair betting odds. We will show that this last assumption is false. Sleeping Beauty’s credences should not follow her fair betting odds due to a peculiar feature of her epistemic situation. (shrink)

As readers of this journal can attest to, although philosophers and economists are somewhat used to talking to and learning from each other, it tends to be the subset of philosophers working in decision theory, philosophy of science, and particular areas of ethics and political philosophy that contribute to our interdisciplinary field of research. The book that is the subject of this review symposium, Anna Mahtani’s The Objects of Credence (Oxford University Press, 2024), is a wonderful exemplar of what can (...) be learned when a different branch of philosophy is brought to bear on central questions in this field. Both philosophers and economists talk about and work with credences, or degrees of belief, all the time. These are usually modelled as probabilities, which are in turn usually thought of as attaching to propositions. But it has long been argued by philosophers of language that propositions cannot be the objects of credence. Mahtani’s book is an investigation into all that begins to unravel once we accept this insight. The results have profound implications both for rational choice modelling and for welfare economics. Constitutional interpretation in Canada is dominated by the metaphor of the “living tree”. Living tree constitutional interpretation is usually defined in terms of its incompatibility with what is understood in Canada to be the central commitment of originalist interpretation: that the constitution is, in some sense, “frozen” at the moment of adoption. But the tenets of originalism that are used as a definitional contrast are not widely held by originalist constitutional scholars today, and are in fact expressly rejected in the (...) new originalist theories that have been developed principally in the United States over the past 20 years. There has not been a meaningful engagement in Canada with contemporary schools of originalist interpretation. The originalism rejected by the Supreme Court of Canada in 1985 , is not the new originalism, and a rejection of this new family of interpretive theories does not necessarily follow from the fact of the Supreme Court of Canada’s rejection of original intent originalism. Unfortunately, the Canadian courts have continued to affirm living tree constitutional doctrine and denounce originalism without providing much of an account of what they are accepting or rejecting. This paper is a prefatory study to an engagement with new originalist scholarship. I attempt a statement of the current commitments in Canadian living constitutional doctrine and, in passing, note the Supreme Court’s attitudes towards originalism. My purpose is to determine what the central commitments of living tree constitutional doctrine are, as a preliminary step towards a later study to determine the extent to which Canadian doctrine is truly incompatible with orginalist interpretation. I explore what I observe to be the four central commitments to living tree constitutionalism in Canada: the doctrine of progressive interpretation; the use of a purposive methodology in progressive interpretation; the absence of any necessary role for the original intent or meaning of framers in interpreting the constitution; and the presence of other constraints on judicial interpretation. Monothematic delusions are delusions whose contents pertain to a single subject matter. Examples include Capgras delusion, the delusion that a loved one has been replaced by an impostor, and Cotard delusion, the delusion that one is dead or does not exist. Two-factor accounts of such delusions hold that they are the result of both an experiential deficit, for instance flattened affect, coupled with an aberrant cognitive response to that deficit. In this paper we develop a new expressivist two-factor account of (...) delusion. In contrast to existing endorsement and explanationist accounts, which treat delusions as either explanations or endorsements of the contents of these disordered experiences, we hold that delusional beliefs have an expressive function: they characterize, in impressionistic terms, what the subject’s experience is like for them. We show how our account improves upon existing two-factor views in explaining the central features of monothematic delusions, in particular the way in which delusional subjects fall short of the ideal of rationality. The World Health Assembly adopted the new International Health Regulations on May 23, 2005. The new IHR represent the culmination of a decade-long revision process and an historic development for international law and public health. The new IHR appear at a moment when public health, security, and democracy have become intertwined, addressed at the highest levels of government. The United Nations Secretary-General Kofi Annan, for example, identified IHR revision as a priority for moving humanity toward “larger freedom.” This article analyzes (...) the new IHR and their implications for global health and security in the 21st century.The WHA instructed the WHO Director-General to revise the IHR in 1995 because the Regulations did not provide an effective framework for addressing the international spread of disease. Doubts about the IHR's effectiveness had, however, been present long before 1995. The critiques identified the narrow scope of the regulations, the lack of compliance by states, and the absence of a strategy for responding to rapid changes in public health's global economic and technological environments. I argue that two of the standard axioms of the AGM theory of belief revision stand in the way of it serving as the basis for an adequate account of defeasible reasoning, because they respectively disallow the adoption of beliefs not logically entailed by those previously learned and the abandonment of those not contradicted by them.

The incident in May-June 2007 involving a U.S. citizen traveling internationally while infected with drug-resistant tuberculosis involved the U.S. federal government's application of its quarantine and isolation powers. The incident and the isolation order raised numerous important issues for public health governance, law, and ethics. This article explores many of these issues by examining how the exercise of quarantine powers provides a powerful lens through which to understand how societies respond to and attempt to govern threats posed by dangerous, contagious (...) pathogens. The article considers historical aspects of governmental power to quarantine and isolate individuals and groups; analyzes the current state of quarantine and isolation law in the United States in light of the recent incident with drug-resistant tuberculosis; and explores global aspects of public health governance and law highlighted by this incident. Dramatic events involving dangerous microbes often focus attention on isolation and quarantine as policy instruments. The incident in May-June 2007 involving Andrew Speaker and drug-resistant tuberculosis joins other communicable disease crises that have forced contemplation or actual application of quarantine powers. Implementation of quarantine powers, which encompasses authority for both isolation and quarantine actions, is important not only for the handling of a specific event but also because the use of such authority provides a window on broader issues of public (...) health and the legal rules, ethical principles, and governance systems that support it. Debates about quarantine powers reflect political and social attitudes about public health that often tell us more about this policy endeavor than acts of isolation and quarantine themselves. Such a comparative law approach would be interested in, for example, how the public health laws of the United States and South Africa differ in connection with regulating tobacco consumption. Does stakeholder theory’s “arrival” mean continued dynamism, refinement, and relevance, or stasis? How will superior stakeholder theory continue to develop? In light of these and related questions, the authors of these essays conducted an ongoing dialogue on the current (...) state and future of stakeholder thinking. Beginning with a review of research and theory that has developed since the major stakeholder theorizing efforts of the 1990s, the authors individually offer their perspectives on the key issues relevant today to stakeholder thinking, and to suggest possible approaches that might lead toward and enable the continuing development of superior stakeholder theory. Defense of Scientific Hypothesis: From Reproducibility Crisis to Big Data sets out to explain and defend the scientific hypothesis. Alger's mission is to counteract the misinformation and misunderstanding about the hypothesis that even seasoned scientists have concerning its nature and place in modern science. Most biological scientists receive little or no formal training in scientific thinking. Further, the hypothesis is under attack by critics who claim that it is irrelevant to science. In order to appreciate and evaluate scientific controversies like (...) global climate change, vaccine safety, etc., the public first needs to understand the hypothesis. Defense of Scientific Hypothesis begins by describing and analyzing the scientific hypothesis in depth and examining its relationships to various kinds of science. Alger then guides readers through a review of the hypothesis in the context of the Reproducibility Crisis and presents survey data on how scientists perceive and employ hypotheses. He assesses cognitive factors that influence our ability to use the hypothesis and makes practical and policy recommendations for teaching and learning about it. Finally, Alger considers two possible futures of the hypothesis in science as the Big Data revolution looms: in one scenario, the hypothesis is displaced by the Big Data Mindset that forgoes understanding in favor of correlation and prediction. In the other, robotic science incorporates the hypotheses into mechanized laboratories guided by artificial intelligence. But in his illuminating epilogue, Alger envisions a third way, the Centaur Scientist, a symbiotic relationship between human scientists and computers. (shrink)

Historically confined to the disadvantaged ranks of the stratification system, evangelical Christians have increasingly joined the corporate elite, eliciting concern from some and sanguinity from others. Quantitative studies of the effects of religion on executive behavior have thus far shown mixed and inconclusive effects, and those few qualitative analyses that have focused on evangelical business leaders have generally emphasized conflict between religion and business but failed adequately to explore areas of consonance. While evangelical executives do, in fact, experience conflict associated (...) with their professional contexts, this tension arises not because business and religion are inherently opposed, as some have argued, but because evangelical business leaders are made to feel like second-class citizens by members of their own faith communities. Indeed, in cases of apparent conflict between faith and business, evangelical executives insist that it is faith, not business, that must be reconceived. Equipped with an array of strategies for demonstrating that business is a sacred institution and a worthy occupation, evangelical business leaders hope to restore faith in business as they apply their faith in business. In these evangelical executives and their accounts, the "spirit of capitalism," defined by Max Weber as a positive attitude toward both work and wealth, finds ongoing embrace and new expression, with implications for understanding the so-called faith at work movement, evangelicalism, and the role of religion among elites. The prominence of Bayesian modeling of cognition has increased recently largely because of mathematical advances in specifying and deriving predictions from complex probabilistic models. Much of this research aims to demonstrate that cognitive behavior can be explained from rational principles alone, without recourse to psychological or neurological processes and representations. We note commonalities between this rational approach and other movements in psychology – namely, Behaviorism and evolutionary psychology – that set aside mechanistic explanations or make use of optimality assumptions. Through (...) these comparisons, we identify a number of challenges that limit the rational program's potential contribution to psychological theory. Specifically, rational Bayesian models are significantly unconstrained, both because they are uninformed by a wide range of process-level data and because their assumptions about the environment are generally not grounded in empirical measurement. The psychological implications of most Bayesian models are also unclear. Bayesian inference itself is conceptually trivial, but strong assumptions are often embedded in the hypothesis sets and the approximation algorithms used to derive model predictions, without a clear delineation between psychological commitments and implementational details. Comparing multiple Bayesian models of the same task is rare, as is the realization that many Bayesian models recapitulate existing (mechanistic level) theories. Despite the expressive power of current Bayesian models, we argue they must be developed in conjunction with mechanistic considerations to offer substantive explanations of cognition. We lay out several means for such an integration, which take into account the representations on which Bayesian inference operates, as well as the algorithms and heuristics that carry it out. We argue this unification will better facilitate lasting contributions to psychological theory, avoiding the pitfalls that have plagued previous theoretical movements. (shrink)

One might well wonder—is there a category under which every thing falls? Offering an informative account of such a category is no easy task. For nothing would distinguish things that fall under it from those that don’t—there being, after all, none of the latter. It seems hard, then, to say much about any fully general category; and it would appear to do no carving or categorizing or dividing at all. Nonetheless there are candidates for such a fully general office, including (...) thing, being, entity, item, existent, and—especially—object.[ It is not obvious that there is any fully general category (whether object or otherwise). Accordingly, not all accounts of object assign it to a fully general category, instead allowing that there are non-objects. On those views, object does indeed divide. Accounts of object, then, differ with respect to whether there are non-objects. And this is not the only fault line. Other dimensions of difference include what objects there are and what objects are. Accordingly, this entry will survey three broad questions about the category object: What, if any, is its contrast or complement? What is its extension? What is its nature? (shrink)

Killing bin Laden: A Moral Analysis is a short treatise on the possible ethical justification for the U.S. mission to kill Osama bin Laden. After rejecting the standard justifications most commonly used in support of the killing, Strawser ultimately argues that the killing was ethically permissible as an act of defensive harm on behalf of innocents. The book contends bin Laden was morally responsible for a collection of unjust threats such that he was liable to be killed. Moreover, the many (...) unique features of the bin Laden case -such as the use of pre-emptive harm and the collective agency of al-Qaeda - do not defeat that liability. The monograph also includes discussions of the apparent violation of Pakistan's sovereignty and the morally dubious celebrations of bin Laden's death, among other morally relevant issues. (shrink)

This book is an exploration of Žižek's theory of freedom. By examining key passages in Žižek's work the aim is to provide a functional, serviceable philosophy of power and ideology and show how this philosophy of power relates to freedom. Although some, like Noam Chomsky, have criticized Žižek's work as having no guiding principles, it is suggested that this misses the fact that Žižek's philosophy utilizes a dialectical methodology that often appears contradictory. Though a highly astute reader with a background (...) in the philosophical texts he frequently cites (the German Idealists, Freud, and modern philosophers), it becomes clear that there is a uniquely Zizekian philosophy that mobilizes a radical hermeneutics of freedom. The lesson to be learned from the paradoxical St. Petersburg game and Pascal’s Mugging is that there are situations where expected utility maximizers will needlessly end up poor and on death’s door, and hence we should not be expected utility maximizers. Instead, when it comes to decision-making, for possibilities that have very small probabilities of occurring, we should discount those probabilities down to zero, regardless of the utilities associated with those possibilities.
