ArgumentThis paper explores how the Belgian mathematician Paul Mansion became interested in probability theory. In comparison to many other countries at the time, probability theory had a much stronger presence in Belgium. In addition, Mansion, who was an avowed Catholic militant, had found probability theory to be a useful means of reflecting on certain problems pertaining to determinism and randomness that were arising in scientific debates at the time. Mansion’s work took place during a time of consolidation of mathematical (...) education in Belgium, as well as a new interest in probabilistic results and the foundation of the Institute for Philosophy in Louvain by his friend Désiré Mercier. Following considerable debate, the practice of euthanasia was legalized in Belgium in 2002, thereby making Belgium one of the few places in the world where this practice is legal. In 2014 the law was amended for the first time. The 2014 amendment makes euthanasia legally possible for all minors who repeatedly and voluntarily request euthanasia and who are judged to possess “capacity of discernment”, as well as fulfil a number of other criteria of due care. This extension of (...) the 2002 euthanasia law generated a lot of national and international debate and has been applauded by many and heavily criticized by others. This evolution is clearly of interest to end-of-life debates in the entire world. This paper will therefore describe how this amendment came to get passed using official documents from Belgium's Senate and Chamber of Representatives where this amendment was discussed and subsequently passed. Next, some of the most commonly given arguments in favour of the law are identified, as well as the arguments most often voiced against the amendment. All these arguments will be expanded upon and it will be examined whether they hold up to ethical scrutiny. Analysing the official documents and identifying the most commonly voiced arguments gives valuable insight into how Belgium came to amend its euthanasia law and why it did so in 2014. It also becomes clear that although the current amendment is often seen as far-reaching, more radical ideas were proposed during the drafting of the law. Also, in analysing those arguments in favour of the amendment and those against, it is clear that the validity of some of these is questionable. (shrink)

Not much has been written on the foreign assistance policy of Belgium, but work that focuses on it singly or in comparison with other cases tends to charge that Belgium lacks a coherent foreign assistance policy. This study examines the rhetoric of Belgian decision makers and the policy behavior of the state, utilizing a framework of four national role conception profiles, each bringing together a set of perceptions regarding the role decision makers perceive their state to play in (...) this issue area.Parliamentary debates for the period 1975-90 are coded for mention of themes associated with these profiles, white OECD data regarding the foreign aid expenditures for the same period provide insight into the policy behavior. It concludes that Belgian decision makers do not perceive foreign assistance as a separate issue area, but as inextricably linked with foreign policy. (shrink)

In 2002 with the passing of the Euthanasia Law, Belgium became one of the few countries worldwide to legalize euthanasia. In the 18 years since the passing of the law, much has changed. We argue that in Belgium a widening of the use of euthanasia is occurring and that this can be ethically and legally problematic. This is in part related to the fact that several legal requirements intended to operate as safeguards and procedural guarantees in reality often (...) fail to operate as such. We focus on three kinds of safeguards or procedural guarantees: the legally defined due care criteria for eligibility for euthanasia; the consultation of a second physician; and the reporting of euthanasia cases to the Federal Control and Evaluation Commission for Euthanasia. We will show how each of these three safeguards can exhibit shortcomings in theory and practice. (shrink)

This article starts from the observation that the Belgian level of adaptation to the requirements posed by its membership of the European Union is surprisingly low. Following an institutionalist line of thinking, it is argued that the impact of the European Union is seriously constrained by the characteristics of the Belgian federal system. This results into defining both cultural and structural indicators for the degree of Europeanisation: European opinions and awareness of political elites and the general public and the Belgian (...) domestic organisation of European co-ordination mechanisms. The article more concretely argues that the European opinions and European awareness of the political elites and the public opinion are coloured by an inwards-looking mentality that stems from the dominant focus on the ongoing federalisation process. In addition, it is also found that the limited Europeanised installation and outcomes ofthe European co-ordination mechanisms are at least partly shaped by hard and soft federal elements. (shrink)

Are fragile majorities capable of opening themselves to deep-rooted and new ethnic and cultural pluralism? What role does education play in this process? Based on ten years of comparative research, Fragile Majorities and Education is a nuanced study of ethnic dominance, linguistic integration of immigrants, and diversity in education. Ethnic relations are often depicted in an oversimplified framework where a clear dominant majority exercises power over various minorities. In many societies worldwide, however, this model does not hold true. In some (...) countries, two or more groups possess relatively equal power to control the state and impose their definitions of the nation, as is the case with Flemish speakers and French speakers in Belgium, and with Catholics and Protestants in Northern Ireland. In other instances, such as in Quebec or Catalonia, clearly identifiable majorities are nonetheless minorities at a larger nation-state level, which creates a situation of ambiguous ethnic dominance. ArgumentThis article contributes to a global history of relativity, by exploring how Einstein’s theory was appropriated in Belgium. This may sound like a contradiction in terms, yet the early-twentieth-century Belgian context, because of its cultural diversity and reflectiveness of global conditions (the principal example being the First World War), proves well-suited to expose transnational flows and patterns in the global history of relativity. The attempts of Belgian physicist Théophile de Donder to contribute to relativity physics during the 1910s and (...) 1920s illustrate the role of the war in shaping the transnational networks through which relativity circulated. The local attitudes of conservative Belgian Catholic scientists and philosophers, who denied that relativity was philosophically significant, exemplify a global pattern: while critics of relativity feared to become marginalized by the scientific, political, and cultural revolutions that Einstein and his theory were taken to represent, supporters sympathized with these revolutions. Belgium is one of very few countries where euthanasia on the basis of psychiatric illness is legally possible. Three physicians involved in the euthanasia of a 38-year-old woman suffering from psychiatric illness recently faced a criminal trial for “murder by poisoning”, for allegedly having failed to comply with several requirements of the Belgian Euthanasia Law. Although none of the physicians were convicted, the case generated extensive debate, in the media and the general public as well as in the medical (...) profession and among policy makers. In this chapter, we take this trial as the starting point for a critical analysis of the clinical-psychiatric, ethical, and legal issues involved in evaluating euthanasia requests in cases of complex psychiatric disorders. In these cases, the requirements of the Belgian Euthanasia Law could be improved by mandating the advice of two psychiatrists, who are experts in the treatment of the specific condition of the person requesting euthanasia. Simultaneously with the process of evaluating the euthanasia request, there should be a parallel treatment track in which all therapeutic and recovery-oriented options are explored. These two tracks should not be in the hands of the same physician. (shrink)

The Belgian health care system has a few features that may havecontributed to the rising costs of health care: patients' freechoice of physicians, large clinical freedom of physicians, essentiallya fee-for-service remuneration for medical specialists in which the feesare agreed between insurance funds and physicians. The increased medicalconsumption and costs have prompted the state and insurance companies totake measures that limit the professional autonomy of the physicians.Access to medical education, free until 1997, is now restricted. Themedical profession is organized in the (...) Order of Physicians that hasestablished a code of professional ethics that has moral but not legalforce. So far, there is no special legislation for thepatient–physician relationship, though laws on specific issueslike organ transplantation contain duties for physicians. In recentyears a debate is taking place on patients' rights, of which informedconsent is central and gaining importance in medico-legal publications.An analysis of (ethical and legal) regulations concerning thewithholding or withdrawal of treatment by physicians demonstrate thatthe profession still enjoys a large clinical autonomy, though duediscussion with the patient has become more explicitly required. Therespect for professional autonomy is not primarily due to any formalpower that the Order of Physicians would have, but is rather grounded inthe generally high quality of the patient–physician relationshipthat in ethical terms is considered essentially as a confidencerelationship rather than a contractual relationship. This article analyzes the dual process occurring in the field of Fair Trade organizations (FTOs) in Belgium. On the one hand, there has been a gradual diversification of the organizational landscape over time from pioneering volunteer-based non-profit organizations to a broader array including cooperatives, group structures, businesses and individual entrepreneurs exclusively devoted to FT. On the other hand, a process of networking is currently taking place among the various types of FTOs in the context of the creation of a (...) Belgian Fair Trade Federation (BFTF). Drawing on neo-institutional theory, including institutional entrepreneurship, this article examines how and why these two processes have taken place. A qualitative field study in the Belgian FT sector, including interviews with 15 FTOs, offers rich empirical material which illustrates the diverse patterns of these organizations. Based on the observed combinations of different variables among Belgian FTOs, a taxonomy reflecting diverse means of conceiving and organizing FT activity is suggested. The different categories of FTOs and the evolution of these categories over time seem linked to the broader institutional evolutions of FT at the international as well as at the Belgian level. Finally, several factors are reviewed to explain why the diversity among Belgian FTOs has not been an obstacle to their collaboration. (shrink)

Less well known, however, is that he also introduced evolutionary morphology – and indeed evolutionary theory as such – in the Belgian academic world. The introduction of this research programme cannot be understood without taking both the international and the national context into account. It was clearly the German example of the Jena University that inspired van Beneden in his research interests. The actual launch of evolutionary morphology (...) at his University of Liège was, however, also connected with the dynamic of Belgian university reforms and the local rationale of creating a research “school.” Thanks to his networks, his mastering of the rhetoric of the “new” biology, his low ideological profile and his capitalising on the new academic élan in late-19th century Belgium, van Beneden managed to turn his programme into a local success from the 1870s onwards. Two decades later, however, the conceptual underpinnings of evolutionary morphology came under attack and the “Van Beneden School” lost much of its vitality. Despite this, van Beneden’s evolutionary morphology was prototypical for the research that was to come. The percentage of accidental pregnancies, the Pearl pregnancy rate and the life-table method have all been used to study the effectiveness of contraception in Belgium, using data from the Second National Fertility Survey (1971), which covered 3397 Belgian women in the age group 30–34 years. Though all three methods yield generally similar results, it is only by using the third method that we can obtain in an optimum way changes in contraceptive effectiveness by birth order and birth interval.

This article analyses the relationship between the Belgian government and the national Nuclear Research Centre (SCK CEN) in the renegotiation of the mission and organization of Big Science in Belgium. While the founding decades of nuclear laboratories are often characterized by ever-increasing budgets and the establishment of large infrastructure, I show that downsizing or transforming Big Science demanded a new form of politics on the organization of science. Drawing on archival material, this article will demonstrate how the mission and (...) management of SCK CEN were critically followed by a variety of stakeholders. Furthermore, the Belgian government explicitly aimed to allow corporate principles to guide the reorganization of the research centre by hiring consultants from Arthur Andersen. This episode in the history of nuclear research invites historians of science to reflect upon both the politics of Big Science in an era in which its original principles were fundamentally questioned and the historical development of new norms and expectations attached to this phenomenon. Access to public healthcare services for Belgium’s undocumented migrants is regulated through a parallel, administrative procedure within the legal framework of Urgent Medical Aid. This imposes several constraints on their access to healthcare services. Drawing on empirical-ethical methodologies, we show how this procedure impacts on the relationship between patients with undocumented status and healthcare workers. We use the concept of relational autonomy to show how the imposed legal constraints reduce the formal treatment options available to healthcare workers, but simultaneously (...) lead to informal care practices, and how the latter increase the discretionary power of the healthcare workers. We argue that in this context, provision becomes unpredictable and arbitrary, with undocumented migrants tending to value strong personal relations with one particular, trusted healthcare worker. Although this leads to increased dependence, it also increases patients’ options and autonomy by providing access to wider professional networks attached to that healthcare worker. (shrink)

This article analyses domestic and foreign reactions to a 2008 report in the British Medical Journal on the complementary and, as argued, synergistic relationship between palliative care and euthanasia in Belgium. The earliest initiators of palliative care in Belgium in the late 1970s held the view that access to proper palliative care was a precondition for euthanasia to be acceptable and that euthanasia and palliative care could, and should, develop together. Advocates of euthanasia including author Jan Bernheim, independent (...) from but together with British expatriates, were among the founders of what was probably the first palliative care service in Europe outside of the United Kingdom. In what has become known as the Belgian model of integral end-of-life care, euthanasia is an available option, also at the end of a palliative care pathway. This approach became the majority view among the wider Belgian public, palliative care workers, other health professionals, and legislators. The legal regulation of euthanasia in 2002 was preceded and followed by a considerable expansion of palliative care services. It is argued that this synergistic development was made possible by public confidence in the health care system and widespread progressive social attitudes that gave rise to a high level of community support for both palliative care and euthanasia. The Belgian model of so-called integral end-of-life care is continuing to evolve, with constant scrutiny of practice and improvements to procedures. It still exhibits several imperfections, for which some solutions are being developed. This article analyses this model by way of answers to a series of questions posed by Journal of Bioethical Inquiry consulting editor Michael Ashby to the Belgian authors. (shrink)

In 2011, Frank Van Den Bleeken became the first detainee to request euthanasia under Belgium’s Euthanasia Act of 2002. This article investigates whether it would be lawful and morally permissible for a doctor to accede to this request. Though Van Den Bleeken has not been held accountable for the crimes he committed, he has been detained in an ordinary prison, without appropriate psychiatric care, for more than 30 years. It is first established that VDB’s euthanasia request plausibly meets the (...) relevant conditions of the Euthanasia Act and that, consequently, a doctor could lawfully fulfill it. Next, it is argued that autonomy-based reasons for euthanizing VDB outweigh complicity-based reasons against doing so, and that, therefore, it is also morally permissible for a doctor to carry out the euthanasia request. In historiography there is a tendency to see the Great War as marking the end of scientific optimism and the period that followed the war as a time of discord. Connecting to current (inter)national historiographical debate on the question of whether the First World War meant a disruption from the pre-war period or not, this article strives to prove that faith in scientific progress still prevailed in the 1920s. This is shown through the use of Belgium as a case (...) study, which suggests that the generally adopted cultural pessimism in the post-war years did not apply to the public rhetoric of science in this country. Diverse actors—scientists, industrialists, politicians, the public opinion and the military staff—declared a confidence in science, enhanced by wartime results. Furthermore, belief in science in Belgium was not affected by public outcry over the use of mustard gas, unlike in the former belligerent countries where the gas became an unpleasant reminder of how science was used during the war. Even German science with its industrial applications remained the norm after 1918. In fact, the faith in science exhibited during the pre-war years continued to exist, at least until the 1920s, despite anti-German sentiments being voiced by many sections of Belgian society in the immediate aftermath of the war. The Low Countries (Belgium and the Netherlands) have their own traditions when it comes down to sports. Sports such as football, cycling (Belgium) or skating (the Netherlands) take center stage with the sports-minded public, and are a central element in popular culture, somewhat similar to the way cricket is part of the British culture. Since many years now, social scientists and philosophers in this countries have started to think about the impact of sports on everyday society and the (...) different aspects involved in it. At first, in the eighties, topics like physicality, game, fair play and the definition of sport were discussed; later on, and especially from the beginning of the 20th century the debate on doping, enhancement in general and the relationship of sports and technology became more prominent; today, also themes like sports and nationality or sports and the value of sports are at the centre of the debates. In this article, we present an overview of the development of the philosophy of sports in the Low Countries in the last two decades. We sketch the main strains of interest, and focus on the most relevant topics. In particular we concentrate on the characteristic features and issues of philosophy of sports in the Low Countries: what are these features and issues? How can they be explained and appreciated, and how do they contribute to the international, largely Anglo-American and analytical debate in philosophy of sports. (shrink)

In order to be lawful in these jurisdictions, a valid request must precede the provision of assistance to die. Non-adherence to the criteria for valid requests for assisted dying may be a trigger for civil and/or criminal liability, as well as disciplinary sanctions where the assistor is a medical professional. In this article, we review the criteria and evidence in respect (...) of requests for assisted dying in the Netherlands, Belgium, Oregon, and Switzerland, with the aim of establishing whether individuals who receive assisted dying do so on the basis of valid requests. We conclude that the evidence suggests that individuals who receive assisted dying in the four jurisdictions examined do so on the basis of valid requests and third parties who assist death do not act unlawfully. However, further research on the elements that may undermine the validity of requests for assisted dying is warranted. More research on the reasons why requests for assisted dying are refused is also desirable. (shrink)

In Memory of Ed PellegrinoEuthanasia in Belgium is not limited to terminally ill patients. It may be applied to patients with chronic degenerative diseases. Currently, people in Belgium wish to make it possible to euthanize incompetent patients who suffer from dementia. This article explains the Belgian law and then explores arguments for and against euthanasia of patients with dementia. It probes the dementia paradox by elucidating Dworkin’s distinction between critical and experiential interests, arguing that at the end-of-life this (...) distinction is not clearcut. It argues against euthanasia for patients with dementia, for respecting patients’ humanity and for providing them with more care, compassion, and good doctoring. (shrink)

Shared genetic inheritance results in a high correlation in the heights of brothers, but experiences in childhood and adolescence can intervene. Poor diet, disease, and heavy labor can prevent the achievement of height potentials. If families cannot control variations in these conditions, the heights of brothers will be less strongly correlated. We use heights measured at military conscription examinations from three communities in nineteenth-century Belgium. The Generalized Estimating Equation procedure allows us to estimate effects of covariates on mean heights (...) as well as the correlations within families. Both average height and the correlation of brothers’ heights differed by socioeconomic status. Members of the local elite were taller and the heights of brothers in those families were more strongly correlated. This suggests that elite families were much better able to control the environmental challenges faced by their offspring. (shrink)

This paper describes the matrimonial and reproductive behaviour of Italians who migrated to Belgium after the Second World War. Migrants were either already married, or later became married, to other Italians. Among the children of migrants, men equally chose Italian or Belgian wives but women tended to prefer Italian partners. Italian-Belgian marriages were more frequent among the better educated groups. Family size is smaller among migrants marrying after migration and in heterogamous marriages. Significant differences in birth intervals are found (...) when marriage occurred before or after migration, between generations, and between homogamous and heterogamous marriages. (shrink)

Objectives To examine the frequency and characteristics of decisions to forgo artificial nutrition and/or hydration at the end of life.Design Postal questionnaire survey regarding end-of-life decisions to physicians certifying a large representative sample of Belgian death certificates in 2007.Setting Flanders, Belgium, 2007.Participants Treating physicians of deceased patients.Results Response rate was 58.4%. A decision to forgo ANH occurred in 6.6% of all deaths . Being female, dying in a care home or hospital and suffering from nervous system diseases or malignancies (...) were the most important patient-related factors positively associated with a decision to forgo ANH. Physicians indicated that the decision to forgo ANH had had some life-shortening effects in 77% of cases. There had been no consultation with the patient in 81%, mostly due to incapacity . The family, colleague physicians and nurses were involved in decision making in 76%, 41% and 62%, respectively.Conclusions A substantial number of deaths are preceded by a decision to forgo ANH in Belgium. These decisions, ethically laden and involving a considerable chance of life shortening, are mostly not preceded by discussion with the patient despite existing patient rights legislation. It is recommended that physicians and patients and their families alike dedicate ample time to the discussion of treatment options and communication about the possibility of forgoing ANH and that this discussion takes place earlier as part of overall end-of-life care planning rather than at the very end of life. Individual differences in moral views are often explained as the downstream effect of ideological commitments, such as political orientation and religiosity. Recent studies in the U.S. suggest that moral views about recreational drug use are also influenced by attitudes toward sex and that this relationship cannot be explained by ideological commitments. In this study, we investigate student samples from Belgium, The Netherlands, and Japan. We find that, in all samples, sexual attitudes are strongly related to views about recreational drug (...) use, even after controlling for various ideological variables. We discuss our results in light of reproductive strategies as determinants of moral views. (shrink)
