L’accueil dans les services de soin de personnes issues de la migration est un enjeu de santé mentale et éthique et relève d’une réflexion sur la prise en compte de leur vulnérabilité, a fortiori quand des enjeux de parentalité s’en mêlent. Cet article est un témoignage de l’équipe de pédopsychiatrie de Caen qui a adapté ses dispositifs de soins pour mieux accueillir ces publics spécifiques que sont les familles migrantes. Après un rappel sur les notions de migration, de culture et (...) de périnatalité en contexte migratoire, les deux dispositifs seront présentés et explicités au regard de leur fondation théorique qu’est la clinique transculturelle. This article analyzes the educational impasse potentially posed by the confrontation between a present in crisis and a past narrated as a victorious conquest of the principles of modernity (progress, development, freedom). Posed as contemporary values to be defended rather than as contextualized ideas and choices, these principles establish the school narrative of a harmonious link between sociopolitical freedom and industrial economic growth, even if it means locking students into a present that is dysfunctional but cannot be called into question. Based on a reflection centered on the school narrative surrounding the Industrial Revolution in French high schools, this article analyzes the existence of « presentism » within the prescribed curriculum in order to shed light on the aporias of this type of history teaching in a crisis context. This critical analysis then provides an opportunity to propose some didactic avenues based on contemporary epistemological reflections and on recent historiographical developments in order to transform the fatalistic narration of the crisis into a problematization allowing us to weave echoes of intelligibility between the past, the present, and the future. In this essay, I shall explore a reading of the Republic which does not buy into, but rather specifically brackets out and excludes, the institutional structure of the ideal state -- and by ‘institutional structure’ here I mean such things as the way the guardians live, the place and ownership of private property, the way the family is demoted, the fact that philosophers as such are the rulers, and the hierarchical social order as this is exemplified in, for example, the (...) distinction between guardians, auxiliaries and ordinary citizens. Much of the commentary on Plato's Republic focuses on just these elements. Many recent and contemporary commentators on the Republic are given to asking questions like, Is the ideal state totalitarian? Interesting as these issues and questions about the ideal state and its explicit institutions may be, they are for my purposes the least useful. To focus too much on these is to obscure other important elements in the Republic. (shrink)

The article revisits the theory of hegemony of Ernesto Laclau and Chantal Mouffe and shows how a normative injunction, which according to Laclau is not compatible with the hegemonic logic, is not only possible but a necessary condition for hegemony to function. The article claims that the path to demonstrate this involves rethinking the relationship between the theory of hegemony and Derridean deconstruction. Following criticisms that the theory of hegemony overlooks the aporetic nature of Derridean undecidability that it nevertheless relies (...) upon, the hegemonic logic is submitted to a deconstructive reading, which reveals an internal aporia in it. It is further argued that the unaccounted aporia in the logic of hegemony explains the theory’s inability to satisfactorily account for its essential theoretical underpinning, the radical exclusion. However, the article also demonstrates that the aporia does not destroy hegemonic logic but, instead, supplements it by a normative dimension, by a demand of opening to the other as other. (shrink)

Legitimacy is a concept that has been largely forgotten by the deconstructive discourse on law and politics. This article seeks, on the one hand, to reassess the role of legitimacy in deconstruction and, on the other hand, to bring deconstructive thinking to bear on the concept of legitimacy. By re-reading Derrida’s “Declarations of Independence” through the lenses of his later texts on sovereignty and (counter)signature, it is argued that, rather than being deconstructible, legitimacy is deconstructing any self-founding of law and (...) power. As such, legitimacy functions not as an evaluative concept of law and order but as a constantly insisting demand that facilitates the principles of responsibility and responsiveness. (shrink)

Prior research suggests brokers do not always act in the best interests of clients, although morally obligated to do so. We empirically investigated this issue focusing on trades executed at best execution price, before and after the introduction of electronic limit-order trading, on the London Stock Exchange. As a result of limit-order trading, the proportion of trades executed at the best execution price for the customer significantly increased. We attribute this to a sustained increase in the liquidity of stocks as (...) a result of limit-order trading, regardless of market capitalisation. We discuss the ethical implications of our findings and conclude that market structures that enhance market competitiveness may help reconcile broker and client interests. (shrink)

Background The first COVID-19 wave started in February 2020 in France. The influx of patients requiring emergency care and high-level technicity led healthcare professionals to fear saturation of available care. In that context, the multidisciplinary Ethics- Support Cell (EST) was created to help medical teams consider the decisions that could potentially be sources of ethical dilemmas. Objectives The primary objective was to prospectively collect information on requests for EST assistance from 23 March to 9 May 2020. The secondary aim was (...) to describe the Cell’s functions during that period. Research design This observational, real-time study of requests for Cell consultations concerned ethical dilemmas arising during a public health crisis. The EST created a grid to collect relevant information (clinical, patient’s/designated representative’s preferences and ethical principles strained by the situation), thereby assuring that each EST asked the same questions, in the same order. Participants and research context Only our university hospital’s clinicians could request EST intervention. Ethical considerations The hospital Research Ethics Committee approved this study (no. CER-2020-107). The patient, his/her family, or designated representative was informed of this ethics consultation and most met with EST members, which enabled them to express their preferences and/or opposition. Findings/results 33 requests (patients’ mean age: 80.8 years; 29 had COVID-19: 24 with dyspnea, 30 with comorbidities). 17 Emergency Department solicitations concerned ICU admission, without reference to resource constraints; others addressed therapeutic proportionality dilemmas. Discussion Intervention-request motives concerned limited resources and treatment intensity. Management revolved around three axes: the treatment option most appropriate for the patient, the feasibility of implementation, and dignified care for the patient. Conclusions COVID-19 crisis forced hospitals to envisage prioritization of ICU access. Established decision-making criteria and protocols do not enable healthcare professionals to escape ethical dilemmas. That acknowledgement highlights ethical risks, enhances the added-value of nursing and encourages all players to be vigilant to pursue collective deliberations to achieve clear and transparent decisions. A beautifully written, deeply provocative inquiry into the intersection between animal and disability liberation--the debut of an important new social critic How much of what we understand of ourselves as "human" depends on our physical and mental abilities--how we move (or cannot move) in and interact with the world? And how much does our definition of "human" depend on its difference from "animal"? Drawing on her own experiences as a disabled person, a disability activist, and an animal advocate, author Sunaura (...) Taylor persuades us to think deeply, and sometimes uncomfortably, about what divides the human from the animal, the disabled from the nondisabled--and what it might mean to break down those divisions, to claim the animal and the vulnerable in ourselves, in a process she calls "cripping animal ethics." Beasts of Burden suggests that issues of disability and animal justice--which have heretofore primarily been presented in opposition--are in fact deeply entangled. Fusing philosophy, memoir, and science--including factory farming, disability oppression, or our assumptions of human superiority over animals--Taylor draws attention to new worlds of experience and empathy that will open up important avenues of solidarity across species and ability. Beasts of Burden is a wonderfully engaging and elegantly written work, both philosophical and personal, by a brilliant debut author. (shrink)

The genre of fiction portraying worlds without men is over a century old – and growing. It reaches back to Charlotte Perkins Gilman’s 1910 Herland, through scores of utopias from second wave feminist writers like Joanna Russ and Suzy McKee Charnas to contemporary examples from Lauren Beukes and Sandra Newman. This article asks: if it were in fact possible to create a world without men, for what reasons should we pursue or forgo such a world? Those who have endured patriarchy’s (...) cruelty have good reasons to want to institute such a world. However, I present a biblical warrant for rejecting that utopian vision derived from 1 Corinthians 11, where Paul writes that there is “no woman without man” (χωρὶς ἀνδρὸς, choris andros), and “no man without woman.” At the crux of a text that emphasizes the interdependence of God’s creatures, Paul reminds us that interdependence obtains across lines of sexual difference. In defining man, pre-Qin Confucianists first starts a discussion about the differences between man and beast. This is the Differences between Beast and Man. For the Differences between Beast and Man, pre-Qin Confucianists never analyze the differences between man and other animals from an ontological viewpoint through pure factual elements. Rather, they distinguish between man and beast from a normative viewpoint. The distinction between man and beast leads to a logical conclusion that, as man is (...) fundamentally superior to beast, 'Man is a different species from beast'. Understanding man in this way is common to all pre-Qin Confucianists, although there are some differences. After examining what humane is based on the difference between man and beast, pre-Qin Confucianists discuss the issue of human perfection with a further step. That is a question of the Differences between Sage and Selfhood with respect to how a sage is different from and the same as an ordinary person. Although Confucius states that he cannot set himself up as a sage, Mencius and Xunzi suggest a viewpoint of the Homogeneity of Sage and Selfhood that a sage and an ordinary person (or selfhood) are basically equal. This point is to highlight the universal equality of Sage and Selfhood in which a sage is no different from an ordinary person and any ordinary person can reach the level of a sage through efforts. Thus, pre-Qin Confucianists view man as a being between beast and sage, and, based on that, discuss the issue. In this context, this study intents to analyze the pre-Qin Confucianists' philosophical debate on man based on the viewpoints of the Differences between Beast and Man and the Differences between Sage and Selfhood. Christopher Preston’s Tenacious Beasts: Wildlife Recoveries That Change How We Think About Animals is a timely and nuanced assessment of how some key wild animal populations have been faring in these unprecedented recent decades. The book is carefully crafted and engaging and is certain to educate any reader. In particular, any of its major sections would well serve undergraduate or graduate level courses on environmental ethics, or even a section on that topic in a more general philosophy survey. Robert Frodeman (...) offered a vision of philosophers as those who “best serve[ ] society as professional amateurs, helping communities gain a sense of how the parts of our lives fit together. How . . . the truths that science discovers relate to our lived experiences in the world” (Frodeman “A Sense of the Whole,” in Earth Matters 2000, p. 119). Each section of Preston’s book is a stand-alone testament to that vision. (shrink)

Philosophers have traditionally concentrated on the qualities that make human beings different from other species. In _Beast and Man_ Mary Midgley, one of our foremost intellectuals, stresses continuities. What makes people tick? Largely, she asserts, the same things as animals. She tells us humans are rather more like other animals than we previously allowed ourselves to believe, and reminds us just how primitive we are in comparison to the sophistication of many animals. In this second year of the seminar, originally presented in 2002–2003 as the last course he would give before his death, Derrida focuses on two markedly different texts: Heidegger’s 1929–1930 course The Fundamental Concepts of Metaphysics, and Daniel Defoe’s Robinson Crusoe. As he moves back and forth between the two works, Derrida pursuesthe relations between solitude, insularity, (...) world, violence, boredom and death as they supposedly affect humans and animals in different ways. Hitherto unnoticed or underappreciated aspects of Robinson Crusoe are brought out in strikingly original readings of questions such as Crusoe’s belief in ghosts, his learning to pray, his parrot Poll, and his reinvention of the wheel. Crusoe’s terror of being buried alive or swallowed alive by beasts or cannibals gives rise to a rich and provocative reflection on death, burial, and cremation, in part provoked by a meditation on the death of Derrida’s friend Maurice Blanchot. Throughout, these readings are juxtaposed with interpretations of Heidegger's concepts of world and finitude to produce a distinctively Derridean account that will continue to surprise his readers. Caesar's description of the Germans' social organization andmoresin the sixth book of hisBellum Gallicum(BG6.21–8) has long been the subject of multiple scholarly controversies. Its focus on various seemingly random ethnographical details – above all the description of the Hercynian forest and its fantastical beasts – has so surprised readers that the very authenticity of the passage has been questioned. It has been convincingly argued that interpolation is not likely. However, the internal excursus describing the Hercynian forest, and the final section (...) concerning its fauna in particular, remains a subject of intrigue, as a result of the extraordinary, semi-mythical nature of its contents. It is the latter portion of the excursus, concerning the beasts of the Hercynian forest, and the place and role of their portrayal within the ethnography as a whole, that I wish to elucidate in the present article. While it undeniably possesses great entertainment value, its presence cannot be justified merely on such grounds. (shrink)

The beast and the sovereign are connected, he contends, because neither animals nor kings are subject to the law—the sovereign stands above it, while the beast falls outside the law from below. He then traces this association through an astonishing array of texts, including La Fontaine’s fable “The Wolf and the Lamb,” Hobbes’s biblical sea monster in Leviathan, D. H. Lawrence’s poem “Snake,” Machiavelli’s Prince with its elaborate comparison of princes and foxes, a historical account of Louis XIV attending an elephant autopsy, and Rousseau’s evocation of werewolves in The Social Contract. This article examines three textual moments that might plausibly have found their way into Derrida’s late Beast and Sovereign seminars, but that Derrida appears to avoid or overlook. Aristotle’s discussion in the Politics of the “One Best Man” scenario is placed in the context of his earlier characterizations of the naturally apolitical man as akin either to a beast or to a god; Bataille’s late descriptions of sovereignty as a kind of self-perverting hyperbolic structure are juxtaposed with some (...) of Derrida’s own formulations about sovereign autoimmunity; Heidegger’s discussion, in a seminar nominally about Hölderlin, of a striking formula from Sophocles is shown to capture something of the “outlaw” status of the sovereign as Derrida describes it. Human beings are not only self-conscious minds but embodied and social beings, whose subjectivity is conditioned by their social surroundings. From this point of view, it is natural to suppose that the development and existence of a subject that is distinctively human requires contact with other people. The present contribution discusses medieval ideas concerning the intersubjective constitution of human being by looking at the medieval reception of two ideas, which Aristotle presents at the beginning of his Politics: (1) human beings (...) are political animals by nature, which means that those who live outside of political communities due to their nature are either deficient or above humanity – they are beasts or gods; and (2) human beings are parts of political communities, and as such, comparable to hands in a body. When medieval philosophers consider these ideas from metaphysical and normative perspectives, they distinguish different senses in which human beings are naturally political. In effect, they draw a nuanced picture of the relation between an individual human being and the political community, and in so doing they distance themselves from a literal reading of Aristotle. An analysis of the medieval discussions reveals how the social aspect of human subjectivity emerges in medieval political philosophy and how medieval philosophers conceptualise the Aristotelian distinction into three kinds of beings – the beast, the human, and the god. This chapter commences with an account on the Zillo Beasts. The reawakening of extinct species, or "de‐extinction," has gained massive popular appeal. The chapter explains some facts before delving into the philosophical debate over de‐extinction. Philosophers sometimes use far‐fetched examples to answer the questions that are left after we agree on all the facts. These “thought experiments” are meant to show us what we really believe. What makes a duck a duck, a mammoth a mammoth, or a Zillo Beast (...) a Zillo Beast? This is called the species problem, and it is one of the oldest in the philosophy of biology. Essentialism is the view that permits us to say that the Zillo Beast's clone would be a member of the Zillo Beast species. The New Essentialists argue that essentialism can be compatible with natural selection if one looks beyond organisms' traits for species essences. (shrink)

Plusieurs commentateurs – incluant certains théoriciens des droits des animaux – ont soutenu que les animaux non humains ne peuvent pas être considérés comme des membres du dèmos parce qu’il leur manque les capacités critiques d’autonomie et d’agentivité morale qui seraient essentielles à la citoyenneté. Nous soutenons que cette inquiétude est fondée sur des idées erronées à propos de la citoyenneté, d’une part, et à propos des animaux, d’autre part. La citoyenneté requiert la maîtrise de soi et la sensibilité aux (...) normes partagées, mais ces capacités ne devraient pas être comprises en un sens indûment intellectualisé ou idéalisé. Des études récentes sur l’agentivité morale montrent que les relations civilisées entre les citoyens sont largement fondées, non pas dans la réflexion rationnelle et l’assentiment à des propositions morales, mais dans des comportements intuitifs, irréfléchis et habituels qui s’enracinent dans une gamme d’émotions prosociales (l’empathie, l’amour) et de dispositions prosociales (coopération, altruisme, réciprocité, résolution de conflits). Cinquante ans de recherches éthologiques ont démontré que plusieurs animaux sociaux – particulièrement les animaux domestiques – partagent le type de dispositions et de capacités rendant possible le civisme quotidien. Une fois que nous élargissons notre conception de la citoyenneté pour inclure une compréhension plus riche des bases des relations civiques, il devient évident que les animaux domestiques et les humains peuvent être les co-créateurs d’un monde moral et politique commun. Ever since Schopenhauer´s accusation, it has been disputed whether Kant´s few remarks concerning the ethical human-animal-relationship in the Lectures and in the Doctrine of Virtue fail to support ethical arguments on behalf of animals. One critique that plays a central role is whether Kant would have forbidden cruelty to brutes for educational purposes. In addition to these old objections, Kant´s ethics is charged to be speciesistic by animal ethicists and animal rights philosophers at present.The following article examines especially §17 of (...) the Doctrine of Virtue, which is the only animal ethical text authorized by Kant himself. The interpretation starts by taking the context of §17 into account, particularly the “Episodic Section on an Amphiboly in Moral Concepts”. The systematic output of the cruelty-account and of the duty classes is then analyzed. Central for the understanding of Kant´s argumentation relating to animals are the perfect duties to oneself, which are linked to Kant´s foundation of human dignity. Finally the roles of the physical and emotional needs of brutes and humans in Kant´s ethics are compared with each other. Some conclusions are then drawn concerning human and animal rights in relation to a duty-based argumentation. The article therefore appreciates Kant´s integration of animal suffering into the very core of his virtue ethics, an integration that may be able to open the door for an enlightened animal ethics based on human responsibility. This slender and interesting volume by three Dutch philosophers examines the manner in which eight prominent philosophers dealt with ostensibly paranormal experiences arising both spontaneously and also as the result of hypnosis. Hans Gerding covers both Immanuel Kant and Arthur Schopenhauer; Rico Sneller discusses Friedrich Joseph Schelling, Hans Driesch, and Gabriel Marcel; and Hein van Dongen considers William James, Henri Bergson, and Jacques Derrida. My guess is that JSE readers might already know about Kant’s apparent ambivalence (or perhaps just change (...) of heart) about Swedenborg’s vision of a Stockholm fire (and his other reported experiences), as well as William James’s investigations of mental mediumship (Mrs. Piper in particular) and his experiments with altered states. Nevertheless, I expect they will find much that they didn’t already know in those chapters, as well as in the others of course. (shrink)

Who hasn't wondered what it's like to be a dog or bird? Such questions seem unanswerable because we have no way of getting into an animal's mind. Marc Bekoff's work on animal behavior and mind draws world-wide attention for its originality and its probing into what animals might know as well as what skills are needed to live life successfully as a member of a particular species. The book is about three things. First, how Ancient thinkers perceived humans as like or unlike other animals; second about the justification for taking a humane attitude towards natural things; and third about how moral claims count as true, and how they can be discovered or acquired. Was Aristotle was right to see continuity in the psychological functions of animal and human souls? The question cannot be settled without taking a moral stance. As we can either focus on continuity or (...) on discontinuities, how should natural science draw the boundaries? Moral agents act and react in a world that they see under a certain description, and there is no value free science that can settle what is the correct description. This book asks us to think about where moral justification could come from, and suggests that the supposed ‘moral status’ of the object cannot provide the answer. For the moral status of the object is a product of our own imagination, and once we see that, we also see that there remains the question where we ought to have the will to see it. Furthermore, since the perception of moral truth involves the development of imagination and will, the means to attain it will be better served by engagement with poetry and literature than with enquiries that seek to exclude the engagement of the imagination, or any appeal to the beauty of nature or the love of one's fellow creatures. Non-human animals are as a matter of routine used as means to human ends. They are killed for food, employed for labour or sport, and experimented on in the pursuit of human health, knowledge, comfort and beauty. Lip-service is paid to the obligation to cause no unnecessary suffering, but human necessity is interpreted so generously that this is a negligible constraint. The dominant traditions of Western thought, religious and secular, have provided legitimation of the low or non-existent moral status of (...) beasts. The rival tradition, which includes the Neo-Platonists, Plutarch and Montaigne, is eccentric and archaic. But the teleologies and hierarchies of orthodoxy are equally incredible now and owe their greater respectability and influence to the inertia of custom. Disregard for beasts is supported partly by the vestigial and unowned belief that they are intended for our use, partly by a more recent piece of lore which is not only thought to be compatible with, but is sometimes held to be integral to, an enlightened scientific outlook, namely that beasts are mere complex stimulus—response mechanisms. The latter is a vexatious obstacle to progress but despite that the state of scientific and philosophical knowledge is now enormously more propitious for a re-appraisal of the moral status of beasts. Two moral philosophers, Peter Singer and Stephen Clark, have recently published books in which such a re-appraisal is attempted. Here I try to compare and assess some of the main features of their very different approaches. (shrink)
