Evaluation studies of the Bayh-Dole Act are generally concerned with the pace of innovation or the transgressions to the independence of research. While these concerns are important, I propose here to expand the range of public values considered in assessing Bayh-Dole and formulating future reforms. To this end, I first examine the changes in the terms of the Bayh-Dole debate and the drift in its design. Neoliberal ideas have had a definitive influence on U.S. (...) innovation policy for the last thirty years, including legislation to strengthen patent protection. Moreover, the neoliberal policy agenda is articulated and justified in the interest of competitiveness. Rhetorically, this agenda equates competitiveness with economic growth and this with the public interest. Against that backdrop, I use Public Value Failure criteria to show that values such as political equality, transparency, and fairness in the distribution of the benefits of innovation, are worth considering to counter the policy drift of Bayh-Dole. Protection of intellectual property as well as its exploitation for monetary benefit have existed for centuries. However, commercialization of intellectual property had not entered the precincts of academic universities in a significant way until the introduction of the Bayh–Dole Act in the 1980s in the United States. The post–Bayh–Dole era has seen a quantitative increase in patenting activity in universities. This article summarizes the ethical conflicts ushered in by increasing commercialization of academic university research. Activities related (...) to the protection and commercial exploitation of intellectual property have led to changes in academic culture that have given room for debate between the puritans and the modernists. Issues contended by the two groups have been identified, and both sides of the argument are discussed. A substantial portion of biomedical R&D is publicly funded. But resulting medicines are typically covered by patents held by private firms, and priced without regard to the public’s investment. The Bayh-Dole Act provides a possible remedy, but its scope is limited.

There was a time, in the late 1970s and 1980s, when great feats were expected of recombinant DNA biotechnology, some verging on the miraculous. According to both business enthusiasts and sober analysts like the U.S. Congressional Office of Technology Assessment, the new techniques of gene splicing would not only lift the drug industry out of its deep scientific and economic rut (characterized by long-declining introduction rates of genuinely novel medicines), but rejuvenate the American manufacturing sector (Chase 1979; Chemical Week 1987; (...) The filing of patent applications by universities remains a debatable issue in Europe more than 25 years after the Bayh Dole Act in the U.S.A. The European Commission and several national governments are currently exerting pressure on universities to take a more active part in the innovation process.The importance of university research as a source of technology is increasing in the knowledge economy, which is characterized by open innovation. The funding of research may eventually be at stake. Patent (...) applications are essential instruments in the knowledge-transfer process. They enable universities to reconcile their mission of disseminating knowledge with a direct participation in innovation. They contribute to the development of new products, to the funding of more collaborative research with industry, and to the creation of new companies.This article offers guidelines for making the filing of patent applications by universities consistent or even synergistic with their other missions. Yet, despite all these considerations, the propensity of European universities to file patent applications is 5 times lower than in the U.S.A., which is also reflected in the other knowledge-transfer indicators.This article suggests two reasons for this lower propensity: the mindset of the mostly independent European universities based on the Humboldt model and the much less attractive European patent system for universities. The ways in which societies and institutions institutionalize and practice invention management reflects not only how new ideas are valued, but also imaginaries about the role of science and technology for societal development. Often taking the US Bayh-Dole-Act as a model, many European states have recently implemented changes in how inventions at academic institutions are to be handled to optimize their societal impact. We analyze how these changes have been taken up—and made sense of—in regions with different pre-existing (...) infrastructures, practices and semantics of invention management. For doing so, we build on a comparative analysis of continuities and changes in infrastructures, practices and semantics of invention management in North-Rhine Westphalia and Saxony to reflect on how academic institutions have been handling inventions along transforming socio-political contexts. Building on document analysis and qualitative interviews with research managers, we discuss ongoing differences in practices of invention management and the semantic framing of the societal value of inventions in NRW and Saxony, and discuss how this can be understood before the background of their ideological, political and economic separation until reunification in 1990. Joining the conceptual perspectives of path dependencies and sociotechnical imaginaries, we argue that two critical incidents in the history of these states allowed for wide-ranging institutional alignments, but also allowed path dependencies in practices and semantics of invention management to prevail. Upholding public trust in clinical research necessitates that human subjects be protected from avoidable harm and that the design, interpretation and reporting of research results be shielded from avoidable bias. On both counts, managing financial conflicts of interest is critically important, especially in the modern era when the opportunities for investigators to benefit personally from the commercialization of their intellectual property are overtly encouraged and rapidly expanding. Efforts are underway in the United States to provide more useful guidance to universities (...) and medical schools for purposes of strengthening the oversight and management of financial conflicts of interest in clinical research. Justification for public funding of academic research is based on the linear model of technological advance first proposed by Francis Bacon. The model hypothesizes that government subsidized science generates new technology which creates new wealth. Mainstream economics supports Bacons model by arguing that academic research is a public good. The Bayh–Dole Act allows universities to privatize federally funded research and development (R&D) which is in direct conflict with the public good argument. Diminishing returns to university R&D, challenges to (...) Bacons linear model and the labor exploitation of young scientists by research universities suggest that policy makers may want to reconsider the system for allocating federal R&D to universities and colleges. Dale Jacquette charts the development of Schopenhauer's ideas from the time of his early dissertation on The Fourfold Root of the Principle of Sufficient Reason through the two editions of his magnum opus The World as Will and Representation to his later collections of philosophical aphorisms and competition essays. Dole provides a thought-provoking critique for critical religious studies scholars who draw on the work of the 'masters of suspicion', as well as for anyone working in critical theory more broadly. This book revisits Paul Ricoeur's well-known classification of Karl Marx, Friedrich Nietzsche, and Sigmund Freud as the 'masters of suspicion'. Whereas Ricoeur saw suspicion as a mode of interpretation, Andrew Dole argues that the method common to his 'masters' is better understood as a mode of explanation. In (...) place of Ricoeur's 'hermeneutics of suspicion' Dole presents the method of 'suspicious explanation', which claims the existence of 'hidden' phenomena that are bad in some recognizable way, and which each of the 'masters' practiced in his own way. Reconstructing Marx, Nietzsche, and Freud in this way brings their work into conversation with conspiracy theories, which are themselves a type of suspicious explanation. Dole argues that conspiracy theories and other types of suspicious explanation are cognitively ensnaring, to borrow a term from Pascal Boyer, such that 'if they are true they are importantly true, and their truth or falsity can be very difficult to ascertain'. Responding to my claims in ‘Schleiermacher and Otto on religion’, A. D. Smith has argued that there is ‘nothing to distinguish’ Schleiermacher and Otto on the topics of the naturalistic explanation of religion and divine intervention in the natural order. There are respects in which Smith seems not to have understood my arguments, and his most significant challenge to my claims about Schleiermacher rests on a conflation of two different questions at issue in Schleiermacher's discussion of the incarnation. Further, Smith's (...) correct observation that I have misinterpreted Otto on an important matter is itself coupled with a similar misreading on his part. Smith's arguments prompt me to revise my view of Otto, but not to abandon the idea that he and Schleiermacher assumed different positions on the topics at issue. (shrink)

I argue that J. L. Schellenberg's sceptical religion faces two problems of religious adequacy. The first has to do with its relationship to the goal of bringing persons into proper alignment with an ultimate good; the second, with the desideratum of sceptical religion's becoming sufficiently well-established as to be a vehicle for the accomplishment of great things on the stage of history. I argue that actual sceptical religion would need to accommodate itself to the requirements of historical existence, and that (...) such accommodation might well lead to a blurring of the distinctions Schellenberg draws between and sceptical religion. Rudolf Otto is often spoken of as continuing the tradition of reflection on the nature of religion inaugurated by Schleiermacher. I argue that, on the contrary, there are important differences between Schleiermacher's and Otto's accounts of religion. Otto opposed naturalistic analyses of religion which threatened Christianity's claims to truth, and saw Schleiermacher as providing insufficient resources for resisting such analyses. Otto's grounding of his own religious epistemology in the work of Jakob Friedrich Fries provided him with an explicitly supernatural ‘religious (...) a priori’, and thus provided a universal legitimating ground for religion which resists naturalistic analysis. Schleiermacher, in contrast, explicitly ruled out the sort of ‘experience of the holy’ postulated by Otto by denying both the ‘givenness’ of God in experience and supernatural intervention in the natural order. Further, Schleiermacher's appreciation of humanity's embeddedness within ‘the system of nature’ led him to embrace the view that religion, like any natural phenomenon, is an appropriate subject for scientific investigation. Schleiermacher is often credited with elevating the notion of ‘religious experience’ to prominence in theology and the study of religion. But his position on religious experience is poorly understood, largely because he is typically read through the lens of his later appropriators. In this essay I make a set of claims about what ‘religious experience’ amounts to in Schleiermacher’s mature dogmatics, _The Christian Faith_. What is noteworthy about Schleiermacher’s position is its calculated coherence with religious naturalism, understood as the position (...) that religious phenomena have natural causes. I then argue that Schleiermacher’s understanding of religious experience is actually promising for contemporary discussions– partly because it allows for productive conversation with religious naturalists, and partly in virtue of the utility of Schleiermacher’s claim regarding the kind of religious experience at the heart of Christian religious identity. This article proposes a new interpretation of the concept of Kairos in Paul Tillich's theology. It suggests that Tillich gave it exactly the same meaning as that of the Greek New Testament, i.e. the propitious moment in history for the advent of the Son of Man. Tillich's writings offer indications of the metaphysical qualities of this mysterious character.

Is there really a hell? Should we be good simply to avoid punishment in the life hereafter? Just asking these questions theoretically doesn't get us far, George F. Dole suggests, but examining the works of someone who has been there may help. Dole refers to Emanuel Swedenborg, the eighteenth-century Swedish scientist and statesman who over the last twenty-seven years of his life had the privileged status of an observer of non-physical worlds, including hell. There are respects in which Smith seems not to have understood my arguments, and his most significant challenge to my claims about Schleiermacher rests on a conflation of two different questions at issue in Schleiermacher's discussion of the incarnation. Further, (...) Smith's correct observation that I have misinterpreted Otto on an important matter is itself coupled with a similar misreading on his part. Smith's arguments prompt me to revise my view of Otto, but not to abandon the idea that he and Schleiermacher assumed different positions on the topics at issue. (shrink)
