This Article defines four distinct conceptions of cruelty found in underdeveloped form in domestic and international criminal law sources. The definition is analytical, focusing on the types of agency, victimization, causality, and values in each conception of cruelty. But no definition of cruelty will do justice to its object until complemented by the kind of understanding practical reason provides of the implications of the phenomenon of cruelty. -/- No one should be neutral in relation to cruelty. Eminently, cruelty in criminal (...) law, a human-created phenomenon, vigorously calls for responses in the form of preventive and corrective action on the part of private and public actors. It is in this sense that cruelty is a problem of practical reason, one of action preoccupied with its legal or moral obligations, rational grounds, value commitments, and actual consequences. -/- However, the connection between conceptions of cruelty and the implications practical reason can draw from the correct application of a conception of cruelty to phenomena in the world remains too detached to be able to capture and explain people's actual experiences both of seeing cruelty in the world and of confronting the question of what to do about cruelty and how to address its cultural and institutional aspects. Something is missing. -/- What is missing is the integration of conceptions of cruelty and the practical reason implications of detecting cruelty in the world into normative models which operate as meaning matrixes for cognition, meaning, and action. This Article undertakes this explanatory task through an exercise of reconstructing seminal philosophical ideas about cruelty. The result is that the four conceptions of cruelty are placed within three distinct normative models, which ultimately render intelligible legal conceptions of cruelty and legal reactions to it. What is cruelty? How and why does it matter? What do the legal rejection of cruelty and the requirements of mercy entail? This essay asks these questions of Lucius Seneca, who first articulated an agent-based conception of cruelty in the context of punishment. The hypothesis is submitted that the answers to these questions offered in Seneca's De clementia constitute one of the turning points in the evolution of practical reason in law. I conclude, however, by arguing that even the mainstream (...) punitive practices of contemporary western societies fail to meet the modest imperatives of the rejection of cruelty and the unconditionality of mercy propounded by Seneca. In his work, Bernard Suits presents and pursues a stated objective: to define ‘game’ or, more precisely, ‘game-playing’. In The Grasshopper: Games, Life and Utopia, the author seeks a definition not as a ‘commitment to the universal fruitfulness of definition construction’, but rather with the idea ‘that some things are definable, and some are not’. This is something he believed could resolve many of the issues surrounding the debate on ‘game’ and ‘play’, such as those with Huizinga (in Homo Ludens) (...) or proposed by the anti-definitionism of Wittgenstein, a philosopher who did not accept that it was possible to define ‘game’. In this article, we will trace Suits’ definitional steps and aim to critique his resolution as a kind of ‘formalism’, as it tended to prioritize rules. Furthermore, notwithstanding the merit of his theoretical endeavor – seen in the attempt to define a social component that is so complex and the target of the most diverse interpretations and misconceptions –, it seems to us that, with his theoretical unifying element (lusory attitude), the author has summoned another problem to the debate, that of ‘subjectivism’, rather than a solution (especially to his formalism), even subjecting himself to comparisons with other conceptions (e.g. Fichte) that are also problematic. This aspect will also be criticized. The attention of this article will shift to these two lines of critique, drawing on an insightful analysis of Malaby’s work at a specific juncture, aiming to delve further into the subject and taking an additional step. Parler de soi plutôt que de moi implique une rupture franche avec les philosophies qui placent le sujet humain en position fondatrice. Le soi est encore moins une « chose » mais un mode d'être ; le soi n'est pas une donnée mais une conquête dont le devenir est en partie indéterminé. C'est donc sous le signe des épreuves qu'il faut penser les variations (...) phénoménologiques et herméneutiques sur le soi. Si la philosophie reste la discipline dominante des réflexions qui parcourent les contributions du volume, l'originalité de cet ouvrage est d'offrir en même temps au lecteur d'autres variations par lesquelles se décline le soi. Plato's Academy is commonly regarded as the most prestigious and most influential of all educational institutions in antiquity. Founded by one of the greatest thinkers of all times, its activity as a centre of philosophical and scientific research spanned at least three centuries (from ca. 387 to ca. 86 B.C.), while the influence it has exerted on contemporary and later philosophical and scientific thought is almost impossible to overestimate. Set of articles, fruits of research by anthropologists, focused on the health area. First work of its kind in the country, which deepens mental health issues, cosmological view of specific groups, relationships between body, mind and culture and healing issues seen from the perspective of various popular religions. The work contrasts with the efforts of health scholars to approach anthropological approaches, so that it becomes an instrument for understanding the health / disease phenomenon and its complex articulation processes.

According to enactivism all living systems, from single cell organisms to human beings, are ontologically endowed with some form of teleological and sense-making agency. Furthermore, enactivists maintain that: there is no fixed pregiven world and as a consequence all organisms “bring forth” their own unique “worlds” through processes of sense-making. The first half of the paper takes these two ontological claims as its central focus and aims to clarify and make explicit the arguments and motivations underlying them. Our analysis here (...) highlights three distinct but connected problems for enactivism: these arguments do not and cannot guarantee that there is no pregiven world, instead, they end up generating a contradiction whereby a pregiven world seems to in fact be tacitly presupposed by virtue of a reliance on a tacit epistemic perspectivalism which is also inherently representationalist and as a consequence makes it difficult to satisfactorily account for the ontological plurality of worlds. Taking these considerations on board, the second half of the paper then aims to develop a more robust ontologically grounded enactivism. Drawing from biosemiotic enactivism, science and technology studies and anthropology, the paper aims to present an account which both rejects a pregiven world and coherently accounts for how organisms bring forth ontologically multiple worlds. The standard approach to the core phenomenology of thought insertion characterizes it in terms of a normal sense of thought ownership coupled with an abnormal sense of thought agency. Recently, Fernández (2010) has argued that there are crucial problems with this approach and has proposed instead that what goes wrong fundamentally in such a phenomenology is a sense of thought commitment, characterized in terms of thought endorsement. In this paper, we argue that even though Fernández raises new issues that enrich (...) the topic, his proposal cannot rival the version of the standard approach we shall defend. (shrink)

La pedagogía de Freire es un método de cultura popular cuya finalidad inmediata es la alfabetización, y su dimensión más amplia es la educación como práctica de la libertad. En esta dimensión, educadores y educandos son simultáneamente educadores y educandos los unos de los otros; juntos inician como oprimidos la tarea histórica de liberarse a sí mismos y liberar a los opresores.

Experimental results in reference to Brazilian children and adults are presented in the context of current discussions about essentialism and folkbiology. Using an adoption paradigm, we replicate the basic findings of a previous article in this journal concerning the early emergence in children of a birth-parent bias. This cognitive bias supports the claim that causal essentialism cross-culturally constrains the reasoning about the origin, development and maintenance of the characteristics and identity of living kinds. This article examines the evaluative nature of the folk concepts of weakness and strength of will and hypothesizes that their evaluative nature is strongly connected to the folk concepts of blame and credit. We probed how people apply the concepts of weakness and strength of will to prototypical and non-prototypical scenarios. While regarding prototypical scenarios the great majority applied these concepts according to the predictions following from traditional philosophical analyses. When presented with non-prototypical scenarios, people were divided. Some, against traditional (...) analyses, did not apply these concepts, which we explain in terms of a clash of evaluations involving different sorts of blame and credit. Others applied them according to traditional analyses, which we explain in terms of a disposition to be reflective and clearly set apart the different sorts of blame and credit involved. Paulo Margutti e José Crisóstomo discutem sobre a possiblidade ou a impossibilidade de ultrapassar o representacionismo correspondentista e principalmente o eventual linguocentrismo da filosofia contemporânea, pós-virada linguística, em que parece que da linguagem pode-se passar apenas à linguagem, a cujo círculo mágico estaríamos, desse modo, inevitavelmente presos. Sendo assim, o mundo “aí fora” novamente nos escapa e o relativismo, o agnosticismo e o ceticismo de novo nos espreitam. Em Nietzsche, é a linguagem, sempre metafórica, que se adéqua aos nossos (...) modos prático-perspectivistas, corpóreos e afetivos, de “recortar” o mundo, ou é o contrário? E em Maturana, o que vem primeiro? Para Crisóstomo, para quem no começo está o ato, ultrapassamos tudo isso através de nosso emaranhamento prático com o mundo, por meio da natureza sensível criativa de nossas práticas e pela tradução de crenças em condutas. Enquanto que, para Margutti, nada disso parece deslocar a primazia incontornável da linguagem, como prática ela própria. Sobre isso, Margutti pergunta pelo suposto aproveitamento, por Crisóstomo, no seu ponto de vista prático-poiético criativo, em versão alegadamente não idealista nem dualista, da noção de autoconsciência, central no idealismo alemão. Abstract: In a previous article in this journal, Daniel Kelly, Stephen Stich, Kevin Haley, Serena Eng and Daniel Fessler report data that, according to them, foster scepticism about an association between harm and morality existent in the Turiel tradition ( Kelly et al. , 2007 ). This article challenges their interpretation of the data. It does so by explicating some methodological problems in the Turiel tradition that Kelly et al. themselves in a way inherit and by drawing on new evidence (...) coming from a partial replication of their research. Here a wide distribution of meiotic machinery is shown, indicating the occurrence of sexual processes in all major eukaryotic groups, without exceptions, including the putative “asexuals.” Meiotic machinery has evolved from archaeal DNA repair machinery by means of ancestral gene duplications. Sex is very conserved and widespread in eukaryotes, even though its evolutionary importance is still a matter of debate. The main processes in sex are plasmogamy, followed by karyogamy and meiosis. Meiosis is fundamentally a chromosomal process, which implies recombination (...) and ploidy reduction. Several eukaryotic lineages are proposed to be asexual because their sexual processes are never observed, but presumed asexuality correlates with lack of study. The authors stress the complete lack of meiotic proteins in nucleomorphs and their almost complete loss in the fungus Malassezia. Inversely, complete sets of meiotic proteins are present in fungal groups Glomeromycotina, Trichophyton, and Cryptococcus. Endosymbiont Perkinsela and endoparasitic Microsporidia also present meiotic proteins. (shrink)

This paper concerns a recently discovered, puzzling asymmetry in judgments of whether an action is intentional or not (Knobe, Philosophical Psychology 16:309–324, 2003a ; Analysis 63:190–193, b ). We report new data replicating the asymmetry in the context of scenarios wherein an agent achieves an amoral or immoral goal due to luck. Participants’ justifications of their judgments of the intentionality of the agent’s action indicate that two distinct folk concepts of intentional action played a role in their judgments. "Mentoring the Mentor" recreates a Freirian dialogue in a printed format. In this volume, sixteen distinguished scholars engage in a critical and thoughtful exchange with Paulo Freire. While some contributors voice appreciation for Freire's ideas and for what it means to -reinvent Freire- in a North American context, others offer sharp critiques of Freire's philosophy and, of equal importance, of the various interpretations of his work. In this volume, we have chosen to highlight the importance of education to human rights by reprinting two articles written by Paulo Freire in 1970 for the _Harvard Educational Review_. These articles contain many of Freire's original ideas on human rights and education—issues that are central to his work. Freire was a pioneer in promoting the universal right to education and literacy as part of a commitment to people's struggle against oppression. As Jerome Bruner recognized after Freire's death in (...) May 1997, Freire left as a legacy his commitment to basic human rights: "He was a brave man as well as a far-sighted one. O presente trabalho objetiva fazer uma análise sobre algumas das principais temáticas elaboradas pelo pensador argentino Luis Alberto Warat, quais sejam: o antropofagismo waratiano, o reencontro com a subjetividade perdida e a carnavalização. Para isso, analisou- se uma das obras mais caras do pensamento waratiano: A ciência jurídica e seus dois maridos. Buscou-se através da análise empreendida, elaborar uma crítica sobre paradigmas tradicionais de ciência, incluindo aqui, a própria Ciência do Direito. Sobreleva-se o caráter de indisciplina das atividades artístico-literárias para (...) insinuar as falhas históricas das disciplinas bem instituídas, do pensamento e da cultura dominantes. [ES]Una historia de la ontología que pretenda dar cuenta de su acontecer de manera integral y equilibrada, ha de considerar tanto los aspectos historiográficos y filosóficos de sus fuentes así como los relativos a su contexto socio-cultural y necesariamente en relación con los de la metafísica, pues sus historias están indisolublemente ligadas, aunque ello no significa que necesariamente sean las mismas. En este trabajo, se intenta de manera elemental y mínima bosquejar dichas consideraciones, a través de una breve revisión historiográfica (...) de distintas nociones y hechos que puedan configurar una base sólida para la constitución de la historia de la ontología e interpretación de su significado y naturaleza. [EN] A history of ontology that pretends to be an integral and well-balanced account of its development, must considerer the historiographical and philosophical aspects of its sources, as well as the relation with its socio-cultural context, and necessarily, the relation with the same aspects of Metaphysics, as both histories are inextricably related, without necessarily being the same. In this work, it is intended, in a minimal way, to outline such considerations, trough a brief historiographic revision of the distinctive facts and notions that can configure a solid ground for the constitution of the history of ontology and the interpretation of its significance and nature.
