This book proposes a new model of professional ethics enabling lawyers to advise clients upon both the law and ethics. This will better protect clients, and society, and enhance lawyers' professional obligations. The current model of legal ethics, developed in the 19th century, specified that the role of lawyers was only to interpret the law, not also to give ethical advice. This was acceptable to lawyers, clients, and society at that time. However, this is not the case now and legal (...) ethics no longer reflects the needs of modern legal practice. This book draws on moral philosophy to present a new model of legal of ethics that explains the analytical process to include ethical advice. It analyses the potential harm of the present model to the legal profession who have duties to the law and justice that may compete with demands by clients to serve them. Further, lawyers' duty to clients to act in their best interests is sometimes not adequately fulfilled as legal ethics does not permit lawyers to give ethical advice even if it may be in clients' best interests to do so. The work includes a detailed case study of corporate law practice to show why a new legal ethics is required. Other case examples are provided to demonstrate that lawyers practicing in all areas of law encounter ethical issues and they too will benefit from a new legal ethics. This book examines the birth of the scientific understanding of motion. It investigates which logical tools and methodological principles had to be in place to give a consistent account of motion, and which mathematical notions were introduced to gain control over conceptual problems of motion. It shows how the idea of motion raised two fundamental problems in the 5th and 4th century BCE: bringing together being and non-being, and bringing together time and space. The first problem leads to the exclusion (...) of motion from the realm of rational investigation in Parmenides, the second to Zeno's paradoxes of motion. Methodological and logical developments reacting to these puzzles are shown to be present implicitly in the atomists, and explicitly in Plato who also employs mathematical structures to make motion intelligible. This essay proposes a taxonomy of moral injury informed by the ripple effects of harm caused by clergy sexual abuse and its concealment in the Catholic Church. These five categories distinguish between the moral distress endured by perpetrators and victims as well as bystanders and other implicated subjects, the moral fallout caused by a specific event in comparison to exposure (...) to a toxic environment, and as a spectrum that spans from acute to diffuse symptoms of moral violation. The ancient history of flamenco is pure hypothesis, partly owing to the “ Dark Ages “ which shrouded the folk expression of a large portion of Andalusia from soon after the victory of the Catholic Kings at Granada in 1492 until the emancipation laws of Charles III in 1783. Although flamenco as such is a product of the nineteenth century, the hypothesis may be taken right back to pre-Iberian days when there was a flourishing civilization in the south of Spain, (...) with its capital, Tartessos, more or less where Seville—or Cadiz—is now, perhaps the first Empire in the West. The Iberians inhabited the north and the east but the towns along the Andalusian coast were founded by Phoenicians from Tyre (Cadiz) and Phocaeans from Asia Minor (Málaga). During the Celtic invasions the south was held by Carthage until Andalusia finally became Roman as a result of the Punic wars. (shrink)

Dans ce cours intégralement sténographié pour Péguy, on entend Bergson exposer comment le réel se donne et (...) se retire immédiatement à nous, se donne dans un contact absolu, sympathie ou intuition, se retire pour les besoins de l'action et par la force des signes, et doit être reconquis par la métaphysique, dès lors introduite avec sa différence dans le jeu philosophique du siècle. L dossier présenté ici porte ensuite sur Les Deux Sources de la morale et de la religion, publiées trente ans plus tard, en 1932. Il témoigne d'un impressionnant renouveau d'intérêt pour cet ouvrage trop vite et trop exclusivement situé dans l'itinéraire spirituel de son auteur, les querelles religieuses de son époque, les enjeux immédiats des années 1930. Francis’s words and actions have made visible a discipline of mercy, which does more than illuminate God’s character and purpose; it offers an expansive imaginative framework to spark new possibilities for moral agency and growth. Before Francis, mercy received limited attention in the canon of Catholic social thought. Francis’s signature message of mercy retrieves a central moral duty in Scripture, provides a focal lens for Catholic social thought, and aims to inspire (...) a “revolution of tenderness” capable of inspiring personal conversion and social change. As a consequence of the COVID-19 pandemic, the number of decentralized clinical trials, trials conducted in whole or in part at locations other than traditional clinical trial sites, significantly increased. While these trials have the potential advantage of access, participant centricity, convenience, lower costs, and efficiency, they also raise a number of important ethical and practical concerns. Here we focus on a number of those concerns, including participant safety, privacy and confidentiality, remote consent, digital access and proficiency, and trial oversight. (...) As crucial as the idea of autonomy seems to be to the moral life, it is also been criticized for relying on a highly individualistic and overly rationalistic notion of humanity. Oświecenia nie byłoby bez zwrotu w stronę rozumu, a ten nie jest żadną ideą, lecz własnością nader pospolitą – już sto lat wcześniej René Descartes powiadał, że nikt nie uskarża się na jego brak. Osiemnastowieczni filozofowie bodajże po raz pierwszy problematyzują owo nikt, pytając o rozum dzieci, „dzikich”, sawantów, geniuszy, wynalazców, szaleńców, ba – kobiet (dziewczynek, dziewcząt), aktualnych i przyszłych matek „rodu ludzkiego”, a nie tylko o „rozum ludzki”. Ma on zresztą wiele postaci – common sense, zdrowy rozum (rozsądek), „chłopski (...) rozum”, rozum praktyczny, czysty, spekulatywny itd., a także granicę, którą jest utrata rozumu lub zmysłów. Zawsze jednak objawia się wśród ludzi, pośród ludzkich spraw, bez względu na to, czy aktualnie należymy do jakiejś wspólnoty, czy – jak w pewnym momencie Robinson Crusoe albo Denis Diderot – zostaliśmy z niej czasowo wyłączeni. Körper und Seele sind grundlegende Kategorien antiker Anthropologie. Speziell mit der spätantiken Diskussion der Thematik befasste sich 2004 eine Tagung in Konstanz. Der vorliegende Sammelband legt die Ergebnisse vor und enthält Beiträge zu christlichen, gnostischen und paganen Autoren.

Dworkin’s dignity framework has little explanatory value for one moral topic for which it should be especially suited: paternalistic intervention by one adult with another. The dignity framework has little epistemic value for morality regarding paternalism. Dworkin’s conception of dignity is too inchoate to illuminate why and when individual paternalism is wrong, all things considered. Dignity does somewhat better at illuminating why some types of individual paternalism are pro tanto wrong; but not other types. Moreover, the conception of dignity cannot (...) be refined by the process described above and retain any epistemic value on this matter. One would expect that a very natural -- indeed, a central -- use of the conception of dignity dHedgehogs would be to explain and illuminate moral claims about paternalism. That Dworkin’s conception of dignity largely fails to do so is, therefore, particularly important. (shrink)
