Judges are typically tasked to consider sentencing benefits but not costs. Previous research finds that both laypeople and prosecutors discount the costs of incarceration when forming sentencing attitudes, raising important questions about whether professional judges show the same bias during sentencing. To test this, we used a vignette-based experiment in which Minnesota state judges reviewed a case summary about an aggravated robbery and imposed a hypothetical sentence. Using random assignment, half the participants received additional information about plausible negative consequences of (...) incarceration. As predicted, our results revealed a mitigating effect of cost exposure on prison sentence term lengths. Critically, these findings support the conclusion that policies that increase transparency in sentencing costs could reduce sentence lengths, which has important economic and social ramifications. Ethical issues surrounding the marketing and trade of controversial products such as tobacco require a better understanding. Virginia Slims, an exclusively women’s cigarette brand first launched in 1968 in the USA, was introduced during the mid 1980s to major Asian markets, such as Japan and Korea, dominated by male smokers. By reviewing internal corporate documents, made public from litigation, we examine the marketing strategies used by Philip Morris as they entered new markets such as Japan and Korea and consider (...) the extent that the company attempted to appeal to women in markets where comparatively few women were smokers. The case study of Virginia Slims reveals that the classification of “vulnerable” consumers is variable depending on culture, tobacco firms display responsive efforts and strategies when operating within a “mature” market, and cultural values played a role in informing Philip Morris’ strategic decision to embrace an adaptive marketing approach, particularly when entering the Korean market. Finally, moral questions are raised with tobacco being identified as a priority product for export and international trade agreements being used by corporations, governments, or trade partners in efforts to undermine domestic public health policies. Sartre posed a problem for himself in his discussion of bad faith: how is it possible to deceive oneself, given the unity and translucency of consciousness? Many critics of Sartre interpret translucency as transparency; some, such as M.R. Haight, conclude that Sartre's account of consciousness makes self-deception impossible.A reply to those critics takes the form of showing that translucent consciousness has a number of dimensions: (a) non-positional versus positional aspects; (b) prereflective versus reflective levels; (c) temporally synthetic flux; and (d) (...) the first-person perspective versus the third-person perspective. These dimensions enable Sartre to succeed in describing subtle and varied patterns of self-deception, based on such strategies as obscuring, evasion, distraction, misdescription and disavowal. The translucency of consciousness is not a barrier to self-deception.However, there is another problem in Sartre's claim that all purposive activity is conscious, including our practice of self-deception. The bodily subject of consciousness performs important purposive activities beyond the range of the most obscure non-positional consciousness. This calls into question Sartre's existentialist claim that we are wholly responsible for all we do. (shrink)

Weinstein of the U.S. District Court for the Eastern District of New York issued an opinion on October 15, 2002 making statistical proof available to address plaintiffs’ common questions and prove required elements of consumer fraud.The dilemmas inherent in tobacco litigation as a mass tort action include overcoming the collective action problem, mobilizing appropriate and persuasive legal theories (...) for recovery, and meeting the standards of proof, all in a timely and cost-effective manner. In list-method directed forgetting, reexposure to forgotten List 1 items has been shown to reduce directed forgetting. proposed that reexposure to a few List 1 items only during a direct test of memory reinstates the entire List 1 episode. In the present experiments, part-list reexposure in the context of indirect as well as direct memory tests reduced directed forgetting. Directed forgetting was reduced when 50% or more of the items were reexposed, and was intact when only 25% were reexposed. In this article, it is argued that to move beyond mapping genomic variation to understanding its role in complex disease aetiology and treatment will require extending data sharing for the purposes of clinical research translation and implementation.

The article presents an approach to the formation of a decision support system in the management of energy consumption of production technological systems. Such systems allow the company to detect and respond in a timely manner to the appearance of hidden energy losses, to carry out organizational measures aimed at energy saving and to optimize the timing and scope of repair and restoration work. The approach is based on the modeling of stationary sections of energy consumption, presented in the form (...) of precedents, their accumulation and subsequent analysis in the space of influential technological parameters. In addition to the base of precedents, the system includes software modules for assessment and formation of the profile of hidden energy losses, modules of technical condition, forecast and formation of precedents. The analysis of precedents consists in the selection of similar cases of energy consumption, the formation of efficient energy consumption functions and the calculation of energy losses with its help. Hidden energy losses can be calculated in real time for all technological systems of the enterprise. This allows you to build a profile of energy losses of the enterprise. The advantage of this approach in comparison with the known ones is that it allows to adapt to technological systems with different energy sources. The article emphasizes that the method can work with the energy manager with both linear and nonlinear dependence of energy consumption on process parameters. However, the limitations of this approach are noted. Thus, the determination of latent energy losses and technical condition of the equipment requires the participation of qualified specialists of the enterprise, who must be able to analyze the results and propose measures to eliminate energy losses. We know that the Philosophical Notebooks do not constitute a finished work, but are working digests done by Lenin, not for publication but only for himself, and as a basis for further work on questions of dialectics. This circumstance must always be remembered when one turns to the Philosophical Notebooks. Here are recorded and collected Lenin's remarkable thoughts as they developed upon reading the works of Hegel and other philosophers as well as certain natural scientists, and Lenin's exceedingly valuable plans (...) and notions pertaining to further work on theoretical problems of the materialist dialectic. But, at the same time, the Philosophical Notebooks contain numerous passages copied by Lenin as he did the digests of the philosophical works he read. Moreover, it is sometimes difficult to say for what purpose and toward what end Lenin did this copying: was it in order subsequently to adduce these extracts and quotations in support of his own views and postulates; was it for purposes of criticism — to demonstrate that the propositions of Marxist dialectics were incompatible with them; or was it merely as the roughest kind of material for work he would subsequently do? Many of the copied extracts in the Philosophical Notebooks are accompanied by Lenin's critical remarks, negative and positive, in brief analyses and rather extensive commentaries. But some of them remained open questions for Lenin himself. In such an instance he noted for his own information that it would be necessary to return again to the proposition he had copied, because it was something that he did not fully understand: it seemed to him that at the given point Hegel wished to say this or that; but perhaps that is not the case. To help people study Marxist-Leninist philosophy, it is particularly necessary to be careful about the accuracy of philosophical terminology. Vague and ambiguous expressions must be firmly eliminated. Among them, in our view, is the saying, current among us, to the effect that "the world as a whole" is the subject matter of philosophy, Marxist philosophy included. The present article is devoted to criticism of that view.
