The military service of combat soldiers may pose many threats to their well being and often take a toll on body and mind, influencing the physical and emotional make-up of combatants and veterans. The current study aims to enhance our knowledge about the combat experiences and the challenges that female soldiers face both during and after their service. The study is based on qualitative methods and narrative analysis of in-depth semi-structured personal interviews with twenty military veterans. It aims to analyze (...) the narratives of American and Israeli female combat soldiers regarding their military service, with emphasis on the soldiers’ descriptions, in their own words, about their difficulties, challenges, coping and successes during their service and transition to civilian life. A recurring theme in the interviews with the veterans of both militaries was the need to be heard and the fact that societies, therapists, and military institutions do not always truly listen to female veterans’ experiences and are not really interested in what actually ails them. Our research suggests that conventional methods used in research relating to veterans might at times be inadequate, because the inherent categorization might abstract, pathologize, and fragment a wide array of soldiers’ modes of post-combat being. Moreover, female veterans’ voices will not be fully heard unless we allow them to be active participants in generating knowledge about themselves. (shrink)

I left to be finished for my journey thither, nor any notice of it [...]. I agreed with mr. Allen upon price and the time that he should finish it, if he hath failed me he hath done me the greatest injury that can be. 1A great injury indeed, because Greaves's journey to Italy and the Levant was all about measuring—luckily the instrument did reach him at some later stage. The thirty-six-year-old Professor of Geometry at Gresham College was taking the measurements of countless monuments and objects in the locations he visited. In Rome he measured, among many other ancient structures, Cestius' Pyramid and St. Peter's basilica. In Lucca, deeply impressed, he counted his paces around the beautiful city walls. In Siena he observed together with a "Mathematical Professor" one of the Sidera Medicea using "a glass." In Egypt he even hurt his eyes gazing at the sun, looking for sunspots and measuring its diameter. 2 His measuring mission, however, culminated in the fixing of the [End Page 555] latitudes of Istanbul, Rhodes, and Alexandria. As Bishop Juxton wrote before the trip to Greaves's employers at Gresham College (apparently using Greaves's own promotional language): This worke I find by the best astronomers, especially by Ticho Brache [ sic ] and Kepler, hath beene much desired as tending to the advancement of that science, and I hope it wil be an honour to that nation and prove ours if we first observe it. 3A mathematician-Orientalist, commanding the ancient and modern astronomical and geographical literature of Latin, Greek, Hebrew, Arabic, and Persian authors, Greaves was arguably the best qualified European at the period to perform the task. That he miscalculated the latitude of Rhodes is of less consequence for his present-day readers. 4 However, one of the most obscure and therefore telling of his measurement activities was the survey of the Pyramids of Giza, which resulted in the Pyramidographia (1646). 5 This remarkable learned treatise and travel account hybrid, which is at the focus of the present study, gives us a glimpse into the rich and complex world of scientific antiquarians.Greaves is most conveniently remembered today as an Orientalist. While we must be thankful to Edward Said for broadening the meaning of Orient-alism—from an academic discipline, accumulating objective knowledge of the East, into a much wider cultural discourse, his emphasis on the nineteenth and twentieth centuries and on the European colonial mindset is less useful for making historical sense of what early modern Orientalists were doing—physically and culturally. We can understand Greaves's "Oriental" enterprise in its [End Page 556] depth and variety only within long established European traditions of scholarship and keeping the intellectual concerns of his time in mind. 6But beyond articulating for us the nature of early Orientalism, the Pyramidographia, as well as Greaves's entire scientific career, situated in their wider European context, provide a fine entry point into a foreign world of learned practices and methods. It teaches us how well into the seventeenth century astronomy and philology, observation and bookishness, could coalesce in one figure, in one enterprise. 7 We still lack a modern biography of Greaves, a complex protagonist of a complex period, and even a full evaluation of his intellectual work. In _The Curious Case of the Camel in Modern Japan_, Ayelet Zohar addresses issues of Orientalism, colonialism, and exoticism in modern Japan, through images of camels – the epitome of Otherness, and a metonymy for Asia in the Japanese imagination.

I present evidence in favor of an overarching motivational self: a mental function that regulates expression of multiple goals. Goals often conflict with each other, and the role of a motivational self is to consciously or unconsciously prioritize pursuit of these goals. When observing inconsistency in expression of goals, it is therefore useful to consider whether the motivational self is attempting to balance between conflicting goals or if such inconsistency results from temporary self-control weakness.

This text reads into the work of Ibrahim Nubani (1962—), a Palestinian-Israeli painter who was diagnosed with schizophrenia in 1988, during the first Intifada. Nubani’s painting has undergone a tremendous change from the 1980s and the period of his hospitalization to his painting style today: from geometric, Modernist-type painting, gradually moving into his contemporary chaotic and saturated style of expression. I draw parallels between Nubani’s personal and psychological condition and the political events that affected him. I refer to his state (...) in relation to the discourse of mimicry and camouflage in nature, comparing his position to that of the invisible presences in the background in a perfect camouflage, referring to Roger Caillois’ interpretations. I look at his diagnosed psychiatric state of schizophrenia as the materialization of the meaning of being a Palestinian-Israeli in a life of fragmentation and rejection, by referring to Bhabha and Shammas. I relate to Deleuze and Guattari’s notions of schizophrenia as a cultural rebellion against the moderating mechanisms of cultural/national identification. I demonstrate how Nubani’s work and speech undermine the modalities of mainstream Israeli society, acting like a cultural insurgent, terrorizing Zionist axioms. While analysing Nubani’s iconography I identify several tropes, images and icons that serve as signifiers of his personal crisis and artistic development. I link Nubani’s eyes/ocelli images to Lacan’s discussion of ‘symbolic castration’ as the core of his personal becoming part of Israeli society and his collapse, the in-between desire to assimilate in the early stages of his life, and his current desire to fully live his life as a Palestinian. The text moves between his images and images from other sources that open Nubani’s world into the discourses of Western painting, schizophrenia, high Modernism, the postcolonial condition and so forth. The text is fragmented into eight pieces, following the schizophrenic break-up of Nubani’s personal state and his painted work. I read his work as a destabilizing agent, and identify visual references drawn from the wider context of art history, and specifically referring to masterpieces of the Israeli art canon. (shrink)

I argue that images of the notion of group, in correspondence with their social and political values, shape the debate over the evolution of altruism by group selection. Important aspects of this debate are empirical, and criteria can decide among a variety of selection processes. However, leading researchers undermine or reinterpret such tests, explaining the evolution of altruism on the basis of a single extreme metaphor of ‘group’ and a single inclusive selection process. I shall argue that the extreme images (...) for the notion of group are associated with ideologies that these researchers support or fear. Hence, the history of social and political uses of ‘group’ and ‘group selection’ can explain, at least in part, some of the empirical deficiencies of the debate, and why it has continued without resolution or dissolution. Plutarch’s exuberant writings reaped praise in both antique and modern times. Various aspects of his work have been amply studied and analysed, yet some remain less discussed. This paper therefore aims to contribute to the ongoing research of his works by examining Plutarch’s references to stasis in general, and more particularly to the Roman civil wars. Plutarch lived through the civil wars of 69 CE, and although he did not suffer by experiencing them directly, these events no doubt contributed to (...) his views on the role of stasis and civil war, especially in Roman history. While Plutarch does not openly express his convictions on these events, especially not on contemporary occurrences, civil unrest is nevertheless a deliberate and significant theme in all of his writings. This paper presents various examples from Plutarch’s work which illuminate his particular understanding of Roman civil dissension and the ways in which he cleverly and meticulously approached this issue, being aware of the threat it may have posed him during the principate. This paper examines the empirical aspect of the debates over group selection. I argue that specific narrow readings of the notion of ‘group’ result in a deficient experimentation of the group selection process. Criteria for empirical testability are presented and used to reexamine two well-known experiments of group selection. I argue that the former holds a narrow image of ‘group’ that does not distinguish group selection from selection at other levels; while the latter holds a multifaceted image of ‘group’ that (...) offers a way to achieve substantive progress in the debate. However, most supporters and opponent of group selection maintain a narrow and restricted image of ‘group’, which implicitly undermines informative details regarding population dynamics and population structure. These details may improve our understanding of the evolution of altruism and the evolution of sociality. To conclude, adopting a wide-ranging meaning of ‘group’ may empirically advance the group selection debates. (shrink)

Many theoretical publications make assumptions about the facts of globalization, and in particular about the role and autonomy of the nation state. These factual claims and assumptions often play an important role in justifying the normative conclusions, yet remain under-explored. This interdisciplinary volume examines questions that are central to the problems of both social and international justice, and in particular, to their interdependence: How do global and transnational factors influence the capacity of states to be internally just? Has the state (...) lost its capacity for autonomous action in the global economy, and thus its ethical significance for theories of justice? If so, which institutional reforms could address this problem? What is the role of the state in a just international order? The authors address important connections between domestic social justice and global dynamics, by identifying problematic practices and trends in the current global order. Is territorial jurisdiction over natural resources justified? This paper argues that a freedom-based account of self-determination coupled with ‘functionalist’ justifications of territorial right support territorial jurisdiction over natural resources. This justification simultaneously gives rise to limits on the permissible exercise of the right: the principles of reciprocity and generality, and of equal freedom. This ‘reciprocal’ view on territorial jurisdiction over natural resources, defended here, differs from two alternatives: the traditional sovereignty view on the one hand and the transnational jurisdiction view—which (...) favours the transfer of sovereignty over natural resources from states to transnational institutions—on the other hand. Investor-state-dispute-settlement is an arbitration mechanism to settle disputes between foreign investors and host-states. Seemingly a technical issue in private international law, ISDS procedures have recently become a matter of public concern and the target of political resistance, due to the power they grant to foreign investors in matters of public policies in the countries they invest in. This article examines the practice of ISDS through the lenses of liberal-statist theories of international justice, which value self-determination. It argues that the investor-state (...) arbitration system illustrates how liberal-statist theories of international distributive justice ought to care about relative socioeconomic disadvantage, contra the sufficiency principle that they typically defend. The sufficiency principle draws on a questionable conception of the freedom that self-determination consists in. (shrink)

Proponents of global egalitarian justice often argue that their positions are compatible with the principle of self-determination. At the same time, prominent arguments in favor of global egalitarianism object to one central component of the principle: namely, that the borders of states (or other political units) are normatively significant for the allocation of rights and duties; that duties of justice and democratic rights should stop or change at borders. In this article, I propose an argument in defense of the normative (...) significance of territorial boundaries that draws on a political interpretation of the principle of self-determination. The political interpretation is distinct from the two major approaches to self-determination: the national and the democratic. It makes a twofold contribution to the debates about global justice and democracy; while it (a) challenges the position that political memberships and political borders are morally arbitrary; it (b) helpsdefine the realm of permissible autonomy for self-governing political units, which does not ignore duties to nonmembers and outsiders. End-of-life decisions concerning euthanasia, stopping life-support machines, or handling advance directives are very complex and highly disputed in industrialized, democratic countries. A main controversy is how to balance the patient’s autonomy and right to self-determination with the doctor’s duty to save life and the value of life as such. These EoL dilemmas are closely linked to legal, medical, religious, and bioethical discourses. In this paper I present and defend a highly demanding principle of justice in education that has not been seriously discussed thus far. According to the suggested approach, “all the way equality”, justice in education requires nothing short of equal educational outcome between all individual students. This means not merely between equally able children, or between children from different groups and classes, but rather between all children, regardless of social background, race, sex and ability. This approach may seem implausible at (...) first, due to the far-reaching implications it entails, primarily its requirement to deny better-off children their advantage for the sake of equality. However the paper argues that all-the-way-equality, in fact, does a better job realizing the goals of justice in education than alternative conceptions of justice. It is further argued that at least some of the principle’s most radical consequences, those that make it seem counterintuitive, can be mitigated by balancing all-the-way-equality with competing interests. The border is one of the most urgent issues of our times. We tend to think of a border as a static line, but recent bordering techniques have broken away from the map, as governments have developed legal tools to limit the rights of migrants before and after they enter a country's territory. The consequent detachment of state power from any fixed geographical marker has created a new paradigm: the shifting border, an adjustable legal construct untethered in space. This transformation (...) upsets our assumptions about waning sovereignty, while also revealing the limits of the populist push toward border-fortification. At the same time, it presents a tremendous opportunity to rethink states' responsibilities to migrants. We argue that ‘locality’, perhaps the most mundane term in ecology, holds a basic ambiguity: two concepts of space—nomothetic and idiographic—which are both necessary for a rigorous resurvey to “the same” locality in the field, are committed to different practices with no common measurement. A case study unfolds the failure of the standard assumption that an exogenous grid of longitude and latitude, as fine‐grained as one wishes, suffices for revisiting a species locality. Why Law Matters argues that public institutions and legal procedures are valuable and matter as such, irrespective of their instrumental value. Examining the value of rights, public institutions, and constitutional review, the book criticises instrumentalist approaches in political theory, claiming they fail to account for their enduring appeal.

In the latter half of the 20th century, Western medicine moved death from the home to the hospital. As a result, the process of dying seems to have lost its spiritual dimension, and become a matter of prolonging material life by means of medical technology. The novel quandaries that arose led in turn to medico-legal regulation. This paper describes the recent regulation of dying in Israel under its Dying Patient Law, 2005. The Law recognizes advance directives in principle, but limits (...) their effect and form through complex medico-legal artifices. It reflects a culture that places high value on both scientific medicine and the sanctity of life as such, and illustrates a medical culture that pitches battle against death. At the same time, the Law constructs the will of the individual in a medico-legal language that is alien to the lay person. The paper suggests an alternative approach to advance care planning that is patient-centred and addresses the psycho-social needs of the individual in terms of her relational autonomy. From this perspective, advance care planning becomes an opportunity to extract the patient from the medical context and allow her to speak about her approaching death with close ones in her own terms of reference. To this end, there is a need for facilitation of an intimate encounter where patients can speak about their concerns with their loved ones. The paper also presents a methodological approach of attentive listening, which can be applied across diverse cultures and circumstances. (shrink)

This Article sets out to initiate the development of a theory about the financial obligations that joint parenthood imposes. It considers what joint parents owe one another, separate and apart from any obligation they may or may not have as former spouses or partners. The Article suggests that parenthood is not merely a vertical relationship between an adult parent and a child, but also a horizontal relationship between adults who share it. It is further suggested that the relationship created by (...) joint parenthood should be a significant factor in defining adult family relationships and their legal implications. This proposal intends to contribute to promoting caregiving as a value, in law in general and in family law in particular. This Article focuses on the financial obligations joint parenthood imposes, based on the premise that caring for children and the costs of such care are the joint responsibility of a child’s parents. Childrearing costs as defined in this article refer not only to the actual money spent on providing children with food, healthcare, education, clothing, and the like, but also, and even primarily, to the personal costs that parenthood exacts from parents in terms of the impairment of earning capacity or career progress, and the loss of leisure time. The Article suggests that when co-parents do not share a relationship, either because they have separated or because they never had one, there are good reasons to be concerned about the way the costs of raising children are allocated between them. The Article addresses the failure of existing legal frameworks of property division, alimony, and child support to adequately deal with the concerns over the allocation of childrearing costs between parents, and calls for a new legal framework to be defined to address this issue. This article deals with what we call “being-towards-eternity,” a modification of Martin Heidegger’s “being-towards-death,” through which Hutner seeks to reconcile genuine anxiety in the face of finitude with an unwavering belief in resurrection and life after death. This paper provides an economic justification for the exemption from liability for omissions in torts and for the exceptions to this exemption. It interprets the differential treatment of acts and omissions under tort law as a proxy for a more fundamental distinction between harms caused by multiple injurers, where each one can single-handedly prevent the harm, and harms caused by a single injurer. Since the overall cost to which a group of injurers is exposed is constant, attributing liability to many (...) injurers reduces the part each has to pay and, consequently, reduces each one’s incentives to take precautions. Broad exemption from liability for omissions is a way of carving a simple, practical rule to distinguish between the typical cases in which an agent can be easily selected and provided with sufficient incentives and cases in which there is a serious problem of dilution of liability. The exceptions to the rule exempting from liability for omissions are explained in terms of efficiency. The imposition of liability for omissions depends on the ability to identify a salient agent, i.e., to single out one or few liable agents and differentiate their role from that of others. Tort law designs three types of "salience rules." It either creates salience directly, or it can exploit salience created "naturally," or it can induce injurers to create salience voluntarily. The COVID-19 pandemic poses a major challenge to policy makers on how to encourage compliance to social distancing and personal protection rules. This paper compares the effectiveness of two policies that aim to increase the frequency of responsible health behavior using smartphone-tracking applications. The first involves enhanced alert capabilities, which remove social externalities and protect the users from others’ reckless behavior. The second adds a rule enforcement mechanism that reduces the users’ benefit from reckless behavior. Both strategies should be effective (...) if agents are expected-value maximizers, risk averse, and behave in accordance with cumulative prospect theory or in accordance with the Cognitive Hierarchy model. A multi-player trust-game experiment was designed to compare the effectiveness of the two policies. The results reveal a substantial advantage to the enforcement application, even one with occasional misses. The enhanced-alert strategy was completely ineffective. The findings align with the small samples hypothesis, suggesting that decision makers tend to select the options that lead to the best payoff in a small sample of similar past experiences. In the current context, the tendency to rely on a small sample appears to be more consequential than other deviations from rational choice. (shrink)

The question of what works in psychotherapy has been a subject of debate in the recent years, occupying both clinicians and researchers. In this study, we aimed to assess the current perspectives held by clinicians regarding the processes which produce changes in psychotherapy, as well as the predictors of specific views. Licensed therapists, consisting mainly of psychodynamically and integratively oriented psychologists, were asked to write in their own words what they think works in psychotherapy. Thematic analysis was employed to assess (...) the main mechanisms of change as perceived by the therapists. Differences in the prevalence of specific themes were assessed using Friedman and Wilcoxon signed-rank tests. Univariate logistic regressions were employed to assess the factors that predict the probability of reporting a specific mechanism of change. The results indicated that the therapeutic bond was the most highly reported mechanism of change, followed by theory-driven mechanisms of change, therapist characteristics, therapist professionalism, and client motivation. Male therapists were more likely to indicate the professionalism as a mechanism of change compared to female therapists. Higher education was associated with lower reports of therapists’ characteristics as the mechanisms of change. These results suggest that therapists acknowledge the importance of the working alliance, and that the perception of the mechanism of change is associated with various factors which comprise therapist orientation. Limitations and directions for future research are discussed. (shrink)
