This book sets forth a new area in the study of extraordinary individuals in religious traditions. It develops the category of "Religious Genius" as an alternative to existing categories, primarily "saint." It constructs a model by which to appreciate these individuals, suggesting key characteristics such as love, humility, and self-surrender. Religious geniuses transform their traditions and their legacies endure through these very transformations. They also inspire changes across religious boundaries and traditions. The study of religious geniuses in various faith traditions (...) therefore advances interfaith engagement today. The book complements existing, primarily historical, studies of saints by offering a phenomenological approach that seeks to touch the subjectivity of these individuals, and how they have affected the unfolding of their religious traditions. In _The Curious Case of the Camel in Modern Japan_, Ayelet Zohar addresses issues of Orientalism, colonialism, and exoticism in modern Japan, through images of camels – the epitome of Otherness, and a metonymy for Asia in the Japanese imagination.

I present evidence in favor of an overarching motivational self: a mental function that regulates expression of multiple goals. Goals often conflict with each other, and the role of a motivational self is to consciously or unconsciously prioritize pursuit of these goals. When observing inconsistency in expression of goals, it is therefore useful to consider whether the motivational self is attempting to balance between conflicting goals or if such inconsistency results from temporary self-control weakness.

This text reads into the work of Ibrahim Nubani (1962—), a Palestinian-Israeli painter who was diagnosed with schizophrenia in 1988, during the first Intifada. Nubani’s painting has undergone a tremendous change from the 1980s and the period of his hospitalization to his painting style today: from geometric, Modernist-type painting, gradually moving into his contemporary chaotic and saturated style of expression. I draw parallels between Nubani’s personal and psychological condition and the political events that affected him. I refer to his state (...) in relation to the discourse of mimicry and camouflage in nature, comparing his position to that of the invisible presences in the background in a perfect camouflage, referring to Roger Caillois’ interpretations. I look at his diagnosed psychiatric state of schizophrenia as the materialization of the meaning of being a Palestinian-Israeli in a life of fragmentation and rejection, by referring to Bhabha and Shammas. I relate to Deleuze and Guattari’s notions of schizophrenia as a cultural rebellion against the moderating mechanisms of cultural/national identification. I demonstrate how Nubani’s work and speech undermine the modalities of mainstream Israeli society, acting like a cultural insurgent, terrorizing Zionist axioms. While analysing Nubani’s iconography I identify several tropes, images and icons that serve as signifiers of his personal crisis and artistic development. I link Nubani’s eyes/ocelli images to Lacan’s discussion of ‘symbolic castration’ as the core of his personal becoming part of Israeli society and his collapse, the in-between desire to assimilate in the early stages of his life, and his current desire to fully live his life as a Palestinian. The text moves between his images and images from other sources that open Nubani’s world into the discourses of Western painting, schizophrenia, high Modernism, the postcolonial condition and so forth. The text is fragmented into eight pieces, following the schizophrenic break-up of Nubani’s personal state and his painted work. I read his work as a destabilizing agent, and identify visual references drawn from the wider context of art history, and specifically referring to masterpieces of the Israeli art canon. (shrink)

I argue that images of the notion of group, in correspondence with their social and political values, shape the debate over the evolution of altruism by group selection. Important aspects of this debate are empirical, and criteria can decide among a variety of selection processes. However, leading researchers undermine or reinterpret such tests, explaining the evolution of altruism on the basis of a single extreme metaphor of ‘group’ and a single inclusive selection process. I shall argue that the extreme images (...) for the notion of group are associated with ideologies that these researchers support or fear. Hence, the history of social and political uses of ‘group’ and ‘group selection’ can explain, at least in part, some of the empirical deficiencies of the debate, and why it has continued without resolution or dissolution. Plutarch’s exuberant writings reaped praise in both antique and modern times. Various aspects of his work have been amply studied and analysed, yet some remain less discussed. This paper therefore aims to contribute to the ongoing research of his works by examining Plutarch’s references to stasis in general, and more particularly to the Roman civil wars. Plutarch lived through the civil wars of 69 CE, and although he did not suffer by experiencing them directly, these events no doubt contributed to (...) his views on the role of stasis and civil war, especially in Roman history. While Plutarch does not openly express his convictions on these events, especially not on contemporary occurrences, civil unrest is nevertheless a deliberate and significant theme in all of his writings. This paper presents various examples from Plutarch’s work which illuminate his particular understanding of Roman civil dissension and the ways in which he cleverly and meticulously approached this issue, being aware of the threat it may have posed him during the principate. This paper examines the empirical aspect of the debates over group selection. I argue that specific narrow readings of the notion of ‘group’ result in a deficient experimentation of the group selection process. Criteria for empirical testability are presented and used to reexamine two well-known experiments of group selection. I argue that the former holds a narrow image of ‘group’ that does not distinguish group selection from selection at other levels; while the latter holds a multifaceted image of ‘group’ that (...) offers a way to achieve substantive progress in the debate. However, most supporters and opponent of group selection maintain a narrow and restricted image of ‘group’, which implicitly undermines informative details regarding population dynamics and population structure. These details may improve our understanding of the evolution of altruism and the evolution of sociality. To conclude, adopting a wide-ranging meaning of ‘group’ may empirically advance the group selection debates. (shrink)

Many theoretical publications make assumptions about the facts of globalization, and in particular about the role and autonomy of the nation state. These factual claims and assumptions often play an important role in justifying the normative conclusions, yet remain under-explored. This interdisciplinary volume examines questions that are central to the problems of both social and international justice, and in particular, to their interdependence: How do global and transnational factors influence the capacity of states to be internally just? Has the state (...) lost its capacity for autonomous action in the global economy, and thus its ethical significance for theories of justice? If so, which institutional reforms could address this problem? What is the role of the state in a just international order? The authors address important connections between domestic social justice and global dynamics, by identifying problematic practices and trends in the current global order. They examine political, economic and legal changes and offer normative views on concrete policies and institutions that are particularly important and/or problematic – i.e. international health policies, the World Bank, taxation policies and the World Trade Organization. Is territorial jurisdiction over natural resources justified? This paper argues that a freedom-based account of self-determination coupled with ‘functionalist’ justifications of territorial right support territorial jurisdiction over natural resources. This justification simultaneously gives rise to limits on the permissible exercise of the right: the principles of reciprocity and generality, and of equal freedom. This ‘reciprocal’ view on territorial jurisdiction over natural resources, defended here, differs from two alternatives: the traditional sovereignty view on the one hand and the transnational jurisdiction view—which (...) favours the transfer of sovereignty over natural resources from states to transnational institutions—on the other hand. Investor-state-dispute-settlement is an arbitration mechanism to settle disputes between foreign investors and host-states. Seemingly a technical issue in private international law, ISDS procedures have recently become a matter of public concern and the target of political resistance, due to the power they grant to foreign investors in matters of public policies in the countries they invest in. This article examines the practice of ISDS through the lenses of liberal-statist theories of international justice, which value self-determination. It argues that the investor-state (...) arbitration system illustrates how liberal-statist theories of international distributive justice ought to care about relative socioeconomic disadvantage, contra the sufficiency principle that they typically defend. The sufficiency principle draws on a questionable conception of the freedom that self-determination consists in. (shrink)

Proponents of global egalitarian justice often argue that their positions are compatible with the principle of self-determination. At the same time, prominent arguments in favor of global egalitarianism object to one central component of the principle: namely, that the borders of states (or other political units) are normatively significant for the allocation of rights and duties; that duties of justice and democratic rights should stop or change at borders. In this article, I propose an argument in defense of the normative (...) significance of territorial boundaries that draws on a political interpretation of the principle of self-determination. The political interpretation is distinct from the two major approaches to self-determination: the national and the democratic. It makes a twofold contribution to the debates about global justice and democracy; while it (a) challenges the position that political memberships and political borders are morally arbitrary; it (b) helpsdefine the realm of permissible autonomy for self-governing political units, which does not ignore duties to nonmembers and outsiders. This remarkable collection of essays provides us with a glimpse into people, their spiritual aspirations, and their life (...) journeys. This collection of narratives of Jews and Christians, who recount the story of their involvement with Buddhism, turns out to be a powerful spiritual medium. It allows us to get to know, at times in a very intimate and revealing manner, the stories, struggles, and processes that have shaped participants in this enterprise. Many of the participants are well-known figures in academia and in religious or interfaith circles. Getting to know the person behind the idea, or the book, is always a valuable means of grounding and contextualizing what might otherwise be disembodied ideas or concepts. But the volume does much more than introduce us to an impressive array of sensitive and thoughtful personalities. Through the life stories told in this volume, key elements of the relationship between the three religions—theological, philosophical, and ritual—are confronted. The flow of the book moves in interesting ways between the personal, philosophical, theological, experiential, and mystical, as the various life stories weave the greater whole of this book. The sum total of the fourteen stories of Jews and Christians and their encounter with Buddhism provides an interesting vantage point on the Jewish-Buddhist and the Christian-Buddhist encounters. (I use the term "encounter," as opposed to "dialogue," following the distinction made in this volume byE.Burke Rochford Jr.; "encounter" involves personal change and transformation, something shared by nearly all participants in this volume.) From this perspective, interesting observations emerge regarding the ways in which the encounter impacts and interfaces with both Judaism and Christianity, on the sociological, ritual, theological, and experiential levels. The juxtaposition of two sets of stories, Jewish and Christian, allows us, finally, to make some interesting observations on the difference between these two parallel sets of encounters with Buddhism. [End Page 259]The concept underlying this volume—sharing stories, short spiritual biographies —suggests the growing importance of biography or autobiography and narrative in the study of religion. This collection of short contemporary spiritual biographies makes us aware of the importance of narrative as part of spiritual process, and of its sharing. As the reader discovers, storytelling is a very powerful medium for conveying ideas and sharing processes. Something of the transformative nature of the very enterprise of encounter is thus communicated through the medium of this book. There is no doubt that every reader of this book who is sympathetic to the sensibilities of interreligious encounter will be moved and inspired by some of the stories and testimonies here collected.The strengths of Beside Still Waters are also its weaknesses. The medium of storytelling calls for particular literary skills quite distinct from the spiritual and intellectual qualities that have rightly earned participants in this volume their place in it. Moreover, not all participants are able to share a personal, let alone a spiritual, process. Some of the writers (Cobb, Lubarsky) share an intellectual journey, couched in the appropriate autobiographical context. Others (notably Muck) offer theological insight. At the other extreme, a significant group of Christian contributors shares with us some of the most intimate mystical moments of their spiritual odyssey. The uniform assignment that contributors were asked to fulfill has thus been variously interpreted. This makes the book both highly interesting and, in some sense, weak. The lack of consistent focus takes the reader on a ride between a range of dimensions and experiences—intellectual, experiential, mystical, sociological, and more. With the exception of the mystical-experiential dimension that looms large in some of thepresentations, none of the substantive issues is ever fully developed. The cross between autobiography and religious reflection whets one's reflective appetite, offering tantalizing theological insight, only to fade into one of the dimensions of narrative through which the individual contributors address their task. The border is one of the most urgent issues of our times. We tend to think of a border as a static line, but recent bordering techniques have broken away from the map, as governments have developed legal tools to limit the rights of migrants before and after they enter a country's territory. The consequent detachment of state power from any fixed geographical marker has created a new paradigm: the shifting border, an adjustable legal construct untethered in space. This transformation (...) upsets our assumptions about waning sovereignty, while also revealing the limits of the populist push toward border-fortification. At the same time, it presents a tremendous opportunity to rethink states' responsibilities to migrants. This book proposes a new, functional approach to human mobility and access to membership in a world where borders, like people, have the capacity to move. (shrink)

Conflicts of interest in corporate law can be addressed by two main alternatives: a requirement of a majority of the minority vote or the imposition of duties of loyalty and fairness. A comparison of Delaware, the UK, Canada, and Israel reveals that while the conflicts of interest problem within publicly-traded corporations receives different treatment in the different jurisdictions — either a fairness rule or a majority of the minority rule — closely-held corporations receive the same treatment of an imposition of (...) duties of loyalty and fairness. This article explains this finding, demonstrating that determining which of these rules is adopted is, in fact, a choice between liability rule protection and property rule protection. This choice depends on the total and relative transaction costs. These costs include both the negotiation costs attendant upon a property rule, as well as the adjudication costs associated with a liability rule. The sum of these costs is influenced by the efficacy of the judicial system and of extralegal mechanisms such as the market for corporate control, the capital market, and the types of investors active in the market. Because the different jurisdictions have different relative costs, due to differences in the economy and the legal systems, publicly-traded corporations are treated differently in each system. However, sometimes conflict of interest situations share the same main characteristics — as with closely-held corporations—leading to the domination of one solution, and thus the same solution is applied for closely-held corporations in the different jurisdictions. The propositional account of explicit and implicit knowledge interprets cognitive differences between direct and indirect test performance as emerging from the elements in different hierarchical levels of the propositional representation that have been made explicit. The hierarchical nature of explicitness is challenged, however, on the basis of neuropsychological dissociations between direct and indirect tests of memory, as well as the stochastic independence that has been observed between these two types of tests. Voting lies at the center of collective decision-making in corporate law. While scholars have identified various problems with the voting mechanism, insincere voting—in the forms of strategic voting and conflict of interests voting—is perhaps the most fundamental. This article shows that insincere voting distorts the voting mechanism at its core, undermining its ability to determine transaction efficiency. As further demonstrated, strategic and conflict of interests problems frequently coincide with one another: voting strategically often means being in conflict, and many fact (...) patterns present aspects of both problems. Finally, this article claims that although the two problems have seemingly different solutions, these solutions are essentially similar in nature: all solutions to insincere voting are variations on two basic rules, namely, property rules and liability rules. We argue that ‘locality’, perhaps the most mundane term in ecology, holds a basic ambiguity: two concepts of space—nomothetic and idiographic—which are both necessary for a rigorous resurvey to “the same” locality in the field, are committed to different practices with no common measurement. A case study unfolds the failure of the standard assumption that an exogenous grid of longitude and latitude, as fine‐grained as one wishes, suffices for revisiting a species locality. This Article sets out to initiate the development of a theory about the financial obligations that joint parenthood imposes. It considers what joint parents owe one another, separate and apart from any obligation they may or may not have as former spouses or partners. The Article suggests that parenthood is not merely a vertical relationship between an adult parent and a child, but also a horizontal relationship between adults who share it. It is further suggested that the relationship created by (...) joint parenthood should be a significant factor in defining adult family relationships and their legal implications. This proposal intends to contribute to promoting caregiving as a value, in law in general and in family law in particular. This Article focuses on the financial obligations joint parenthood imposes, based on the premise that caring for children and the costs of such care are the joint responsibility of a child’s parents. Childrearing costs as defined in this article refer not only to the actual money spent on providing children with food, healthcare, education, clothing, and the like, but also, and even primarily, to the personal costs that parenthood exacts from parents in terms of the impairment of earning capacity or career progress, and the loss of leisure time. The Article suggests that when co-parents do not share a relationship, either because they have separated or because they never had one, there are good reasons to be concerned about the way the costs of raising children are allocated between them. The Article addresses the failure of existing legal frameworks of property division, alimony, and child support to adequately deal with the concerns over the allocation of childrearing costs between parents, and calls for a new legal framework to be defined to address this issue. In two experiments during the study phase participants read unrelated context-target word pairs presented below a line drawing of the context word. During test the strong cue group was presented with context words, line drawings, and stems of target words. The line drawings were not presented in the weak cue group. Stems were paired with the same context words as at study , paired with different context words , or corresponded to unstudied words . In Experiment 1 participants were instructed (...) to complete stems with the first word that came to mind . The priming effect for new associations was twice as large in the strong cue group. In Experiment 2 the process dissociation procedure was applied and participants completed stems with studied words or with unstudied words . Results indicated that consciously controlled and automatic retrieval processes mediated the associative effect in both groups. (shrink)

This paper studies dialogicity in posts and their comments. Focusing on political slogans in the Facebook page of Israel PM Binyamin Netanyahu, we examine the ways comments meta-represent the posts in various degrees of resemblance. Starting with the premise that comments/post interactions are dialogic in the Bakhtinian sense, we argue that comments are dialogic in yet another way, which is related to the form and degree of resemblance between them. The conceptualization draws on the notion of meta-representation supplemented by insights (...) gained from accommodation theory and Bakhtin’s dialogism. We argue that through resemblance, the propositional content, ideology and viewpoint conveyed by the initiating slogan are incorporated in the comment, and a tacit dialogue is constructed between them. An additional layer of polyphony is added to the multiplicity of ratified voices otherwise manifest in the interaction between separate posts and comments. (shrink)

The global distributive implications of automatically allocating political membership according to territoriality (jus soli) and parentage (jus sanguinis) principles have largely escaped critical scrutiny. This article begins to address this considerable gap. Securing membership status in a given state or region--with its specific level of wealth, degree of stability, and human rights record--is a crucial factor in the determination of life chances. However, birthright entitlements still dominate both our imagination and our laws in the allotment of political membership to a (...) given state. In this article we explore the striking conceptual and legal similarities between intergenerational transfers of citizenship and property. The analogy between inherited citizenship and the intergenerational transfer of property allows us to use existing qualifications found in the realm of inheritance as a model for imposing restrictions on the unlimited and perpetual transmission of membership--with the aim of ameliorating its most glaring opportunity inequalities. In today's age of restrictionism, a growing number of countries are closing their gates of admission to most categories of would-be immigrants with one important exception. Governments increasingly seek to lure and attract “high value” migrants, especially those with access to large sums of capital. These individuals are offered golden visa programs that lead to fast-tracked naturalization in exchange for a hefty investment, in some cases without inhabiting or even setting foot in the passport-issuing country to which they now officially (...) belong. In the U.S. context, the contrast between the “Dreamers” and “Parachuters” helps to draw out this distinction between civic ties and credit lines as competing bases for membership acquisition. Drawing attention to these seldom-discussed citizenship-for-sale practices, this essay highlights their global surge and critically evaluates the legal, normative, and distributional quandaries they raise. I further argue that purchased membership goods cannot replicate or substitute the meaningful links to a political community that make citizenship valuable and worth upholding in the first place.
