Whenever that happens, you know something in the world has gone awry.Similarly to most Israeli Jews, I had to enlist in the military when I was 18. As part of my basic military training, I had to guard a certain settlement in the West Bank for two weeks. The drill was what we call “4–8”: four hours of guarding, eight hours (...) of rest. I was supposed to stand on my feet throughout my shift without eating, reading, or doing anything that might distract my attention. The terrorists are coming, we were told, and they are bloodthirsty. You can save lives! Well, not that of the terrorist, obviously.I did very little guarding during those two weeks. I was too busy coping with depression and loneliness, although I am only now aware of the latter. Desperately struggling to keep my head above water, I did what I could to survive. I read books, lots of books. I remember reading Nietzsche’s Zarathustra’s parable of one’s development in the desert. You start off as a lion, then a camel, and finally a child. If I could bestow only one piece of advice to my younger self, it would be to pack lightly, as even the camel’s back can only take so much. My laziness paid off. Nothing happened during that time. My older brother was kind enough to drive for an hour and bring me and my comrades the best candy Israel has to offer, and Coke. So I snacked, drank, and read.Two years later, I was called to the very same settlement as an emergency medical technician, just about to commence medical school. I was accompanied by my brother, who was then in paramedic school. We were in the midst of a family dinner in one of the too-many Jewish holidays. A terrorist attack occurred—a terrorist penetrated a house while everyone was asleep and shot everything that moved, including a male baby. Being only a couple of months old, his body occupied less than a quarter of the ambulance gurney. The upper part was bare; the lower part was wrapped in a diaper. There was no blood, no obvious visible signs of trauma on his body, except for a small hole in his right arm, just under the bicipital muscle, right where the brachial artery is.Talking about the ethics of futile care seems out of sync in such moments, even if I were aware then of the debate. When a baby is dying, you do everything to save him. Two fingers on the chest, 15 chest compressions, 2 breaths. That is what we had to do then, and that is what we did. Needless to say, the pale body did not respond. My brother and I drove the small body to the morgue. I could do nothing but stare at it throughout the 50-minute drive. There is something wrong in a world where this kind of thing happens. I promised the baby that I would fix it.I have not fixed it. But I have been trying.I am now an emergency medicine physician and a bioethicist. I have not been involved in other terrorist attacks since then, but I have seen my share. Some deaths feel natural and even due; others feel cruel, untimely, and unjust. The latter takes away a tiny bit of your soul and makes you question your role in the world. By being the best physician I can be, I hope to prevent future cruel, unjust, and untimely deaths, one person at a time. But there is only so much a physician can do.Similarly to others working in bioethics, my research spans several topics, from clinical to public health ethics. A few topics, however, are particularly close to my heart, and the Israeli occupation is one of them. The untimely death of the baby drives this passion.I could not save that baby. No one could. The distinction between access consciousness and phenomenal consciousness is a subject of intensive debate. According to one view, visual experience overflows the capacity of the attentional and working memory system: We see more than we can report. According to the opposed view, this perceived richness is an illusion—we are aware only of information that we can subsequently report. This debate remains unresolved because of the inevitable reliance on report, which is limited in capacity. To bypass this limitation, this study utilized (...) color diversity—a unique summary statistic—which is sensitive to detailed visual information. Participants were shown a Sperling-like array of colored letters, one row of which was precued. After reporting a letter from the cued row, participants estimated the color diversity of the noncued rows. Results showed that people could estimate the color diversity of the noncued array without a cost to letter report, which suggests that color diversity is registered automatically, outside focal attention, and without consuming additional working memory resources. The question of whether conscious experience is restricted by cognitive access and exhausted by report, or whether it overflows it—comprising more information than can be reported—is hotly debated. Recently, we provided evidence in favor of Overflow, showing that observers discriminated the color‐diversity (CD) of letters in an array, while their working‐memory and attention were dedicated to encoding and reporting a set of cued letters. An alternative interpretation is that CD‐discriminations do not entail conscious experience of the underlying colors. The predictive processing framework posits that people continuously use predictive principles when interacting with, learning from, and interpreting their surroundings. Here, we suggest that the same framework may help explain how people process self-relevant knowledge and maintain a stable and positive self-concept. Specifically, we recast two prominent self-relevant motivations, self-verification and self-enhancement, in predictive processing (PP) terms. We suggest that these self-relevant motivations interact with the self-concept (i.e., priors) to create strong predictions. These predictions, in turn, influence how people interpret (...) information about themselves. In particular, we argue that these strong self-relevant predictions dictate how prediction error, the deviation from the original prediction, is processed. In contrast to many implementations of the PP framework, we suggest that predictions and priors emanating from stable constructs (such as the self-concept) cultivate belief-maintaining, rather than belief-updating, dynamics. Based on recent findings, we also postulate that evidence supporting a predicted model of the self (or interpreted as such) triggers subjective reward responses, potentially reinforcing existing beliefs. Characterizing the role of rewards in self-belief maintenance and reframing self-relevant motivations and rewards in predictive processing terms offers novel insights into how the self is maintained in neurotypical adults, as well as in pathological populations, potentially pointing to therapeutic implications. This text reads into the work of Ibrahim Nubani (1962—), a Palestinian-Israeli painter who was diagnosed with schizophrenia in 1988, during the first Intifada. Nubani’s painting has undergone a tremendous change from the 1980s and the period of his hospitalization to his painting style today: from geometric, Modernist-type painting, gradually moving into his contemporary chaotic and saturated style of expression. I draw parallels between Nubani’s personal and psychological condition and the political events that affected him. I refer to his state (...) in relation to the discourse of mimicry and camouflage in nature, comparing his position to that of the invisible presences in the background in a perfect camouflage, referring to Roger Caillois’ interpretations. I look at his diagnosed psychiatric state of schizophrenia as the materialization of the meaning of being a Palestinian-Israeli in a life of fragmentation and rejection, by referring to Bhabha and Shammas. I relate to Deleuze and Guattari’s notions of schizophrenia as a cultural rebellion against the moderating mechanisms of cultural/national identification. I demonstrate how Nubani’s work and speech undermine the modalities of mainstream Israeli society, acting like a cultural insurgent, terrorizing Zionist axioms. While analysing Nubani’s iconography I identify several tropes, images and icons that serve as signifiers of his personal crisis and artistic development. I link Nubani’s eyes/ocelli images to Lacan’s discussion of ‘symbolic castration’ as the core of his personal becoming part of Israeli society and his collapse, the in-between desire to assimilate in the early stages of his life, and his current desire to fully live his life as a Palestinian. The text moves between his images and images from other sources that open Nubani’s world into the discourses of Western painting, schizophrenia, high Modernism, the postcolonial condition and so forth. The text is fragmented into eight pieces, following the schizophrenic break-up of Nubani’s personal state and his painted work. I read his work as a destabilizing agent, and identify visual references drawn from the wider context of art history, and specifically referring to masterpieces of the Israeli art canon. (shrink)

Individuals can then be said to have a right against dying a lonely death. Such a right has corresponding duties. The paper further specifies what such duties may entail based on what individuals may need on their deathbed, specifically (...) focusing on the need for human touch. Assuming that human touch might indeed be needed by some individuals in order to avoid a lonely death, the paper explores potential implications from a public health perspective, particularly during infectious disease outbreaks such as COVID. It seems that every singular proposition implies that the object it is singular with respect to exists. It also seems that some propositions are true with respect to possible worlds in which they do not exist. The puzzle is that it can be argued that there is contradiction between these two principles. In this paper, I explain the puzzle and consider some of the ways one might attempt to resolve it. We provide a complete classification of the possible cofinal structures of the families of precompact (totally bounded) sets in general metric spaces, and compact sets in general complete metric spaces. Using this classification, we classify the cofinal structure of local bases in the groups C(X, R) of continuous real-valued functions on complete metric spaces X, with respect to the compact-open topology.

For Kant the definitive end of art is the expression of aesthetic ideas that are sensible counterparts of rational ideas. But there is another type of aesthetic idea: ‘Beauty can in general be called the _expression_ of aesthetic ideas: only in beautiful nature the mere reflection on a given intuition, without a concept of what the object ought to be, is sufficient for arousing and communicating the idea of which that object is considered as the _expression_.’ What are these aesthetic (...) ideas? I argue that Kant is drawing on the idealist conception of art, associated with Vasari, Bellori and Winckelmann, as presenting idealized spatial forms characteristic of natural kinds. He incorporates this conception into his analysis of the beauty of nature and adds that we have non-conceptual access to it. These idealized forms he names aesthetic normal ideas of natural species. §51 of Kant’s Critique of the Aesthetic Power of Judgment opens with an unexpected claim, described by readers as ‘puzzling’, ‘perplexing’ and even as a ‘notorious mystery’.1 1 Beauty can in general be called the _expression_ of aesthetic ideas: only in beautiful art this idea must be occasioned by a concept of the object, but in beautiful nature the mere reflection on a given intuition, without a concept of what the object ought to be, is sufficient for arousing and communicating the idea of which that object is considered as the _expression_. 2 2 I will argue that, in this passage, Kant states that there are two types of aesthetic ideas—namely, aesthetic ideas expressed in beautiful art and aesthetic ideas expressed by beautiful nature. This distinction is surprising for, before this juncture, there is no explicit claim that there are different types of aesthetic ideas. In fact, although Kant offers several seemingly general characterizations of aesthetic ideas, in none of them does he indicate that there is a subdivision of the genus. Noteworthy, too, is the claim that the distinct pleasure we take in beautiful nature is independent of concepts; for strikingly, it can be considered as the expression of what the passage above expressly calls ideas. In his analysis of fine art, Kant draws the distinction between natural and artistic beauty—a distinction that is succinctly repeated in the passage above.3 3 But when he goes on to explicate the notion of an aesthetic idea, he refers only to aesthetic ideas expressed in art. This fact is taken to support the assumption that aesthetic ideas are connected solely to art. This is the heart of the mystery of the passage, for in it, Kant explicitly talks about aesthetic ideas expressed by beautiful nature. This raises a crucial question: Does the explication of aesthetic ideas in the sections on art apply to aesthetic ideas of beautiful nature?I maintain that the answer is negative. Although, in the passage above, Kant uses the same term in relation to both kinds of beauty, he has a clear distinction in mind: Beauty in art is an aesthetically or sensuously unified expression of the conceptual richness of an idea of reason; beauty in nature is an expression of a purely aesthetically or sensuously unified richness. Obviously, this distinction is connected to other significant differences between the two kinds of beauty. But it is important to point out at the outset that the two types of aesthetic ideas have in common only the quality of being a sensuously unified richness. It is in this sense that they are both species of a single genus. But what more precisely does Kant mean by aesthetic ideas expressed by beautiful nature, and what unified richness do they express and how precisely do they express it? It is to the historical genealogy of this notion of aesthetic ideas of beautiful nature and its implications for Kant’s theory of beauty that this paper is devoted. This historical genealogy will reveal a sense of the notion of aesthetic ideas that we easily overlook but would have been familiar to Kant and his contemporaries. (shrink)

Wittgenstein’s private language argument claims that language and meaning generally are public. It also contends with our appreciation of artworks and reveals the deep connection in our minds between originality and the temptation to think of original meaning as private. This problematic connection of ideas is found in Kant’s theory of fine art. For Kant conceives of the capacity of artistic genius for imaginatively envisioning original content as prior to and independent of finding the artistic means of communicating this content (...) to others. The mitigation of pandemics like that caused by the current COVID-19 virus is largely dependent on voluntary public adherence to government rules and regulations. Recent research has identified various individual covariates that account for some of the variance in compliance with COVID-19 behavioral guidelines. However, despite considerable research, our understanding of how and why these factors are related to adherence behavior is limited. Additionally, it is less clear whether disease-transmitting behaviors during a pandemic can be understood in terms of more (...) general behavioral tendencies. The current research has examined the utility of a behavioral-failure lens in predicting adherence to COVID-19 guidelines and in illuminating mechanisms underlying the previously established relationship between Conscientiousness and adherence. In the two studies reported here, individual variations in the predisposition to behavioral failures predicted adherence to COVID-19 measures, and mediated the relationships between Conscientiousness and adherence. The Failure Proneness questionnaire predicted compliance with COVID-19 guidelines, while the Cognitive Failure Questionnaire did not. The results of hierarchical regressions showed that COVID-19 behavior was predicted only through the intentional factors. Hence, our data lend support to the notion that noncompliance with official COVID-19 prevention guidelines is driven mainly by intentional factors related to violation of norms and rules. The theoretical and practical implications of this finding are discussed. (shrink)

Focusing on absolute notions of necessity and possibility, the project's principal aims were to explore the most fundamental questions and issues centred on them — ranging from scepticism about modal notions themselves, anti-realist view such as non-cognitivism, and the tenability of any sort of realism about modal facts, through (...) to questions about the metaphysics, logic, and epistemology of modality which any broadly realist view must answer. Intergroup competition over resources is attested since the dawn of history. Written and archaeological evidence go back to at least the fourth millennium BC. According to accepted views, evolution has favored humans because of their ability to have cumulative cultures, which has made flexible adaptation possible. One major aspect of this adaptation has been the ability to handle power contests without engaging physical force. Instead, increasing prestige dynamics has allowed contest management by displaying symbolic assets. These have growingly been instrumental (...) in deterring external assaults, thus guaranteeing the possession – or expansion – of a group’s resources. However, while material assets are believed to create status by the evidence of their tangible usefulness, symbolic assets are by definition subject to ongoing negotiation, entirely dependent on being socio-semiotically recognized as types of capital. Symbolic stock exchanges thus appear to have been determinative since antiquity in hierarchizing ethnic and political groups fighting over resources, prioritizing ones over the others. They have culminated in repertoires of more solid tangible and intangible assets, from impressive buildings, city gates, gardens and temples, to ideas such as freedom, quality of life and wealth, justice, personal security, or whatever values that have gained universal recognition. The article discusses the creation and expansion of such symbolic repertoires and their uncertain position in recent times. (shrink)

Conflicts of interest in corporate law can be addressed by two main alternatives: a requirement of a majority of the minority vote or the imposition of duties of loyalty and fairness. A comparison of Delaware, the UK, Canada, and Israel reveals that while the conflicts of interest problem within publicly-traded corporations receives different treatment in the different jurisdictions — either a fairness rule or a majority of the minority rule — closely-held corporations receive the same treatment of an imposition of (...) duties of loyalty and fairness. This article explains this finding, demonstrating that determining which of these rules is adopted is, in fact, a choice between liability rule protection and property rule protection. This choice depends on the total and relative transaction costs. These costs include both the negotiation costs attendant upon a property rule, as well as the adjudication costs associated with a liability rule. The sum of these costs is influenced by the efficacy of the judicial system and of extralegal mechanisms such as the market for corporate control, the capital market, and the types of investors active in the market. Because the different jurisdictions have different relative costs, due to differences in the economy and the legal systems, publicly-traded corporations are treated differently in each system. However, sometimes conflict of interest situations share the same main characteristics — as with closely-held corporations—leading to the domination of one solution, and thus the same solution is applied for closely-held corporations in the different jurisdictions. Voting lies at the center of collective decision-making in corporate law. While scholars have identified various problems with the voting mechanism, insincere voting—in the forms of strategic voting and conflict of interests voting—is perhaps the most fundamental. This article shows that insincere voting distorts the voting mechanism at its core, undermining its ability to determine transaction efficiency. As further demonstrated, strategic and conflict of interests problems frequently coincide with one another: voting strategically often means being in conflict, and many fact (...) patterns present aspects of both problems. Finally, this article claims that although the two problems have seemingly different solutions, these solutions are essentially similar in nature: all solutions to insincere voting are variations on two basic rules, namely, property rules and liability rules. Concretization is a concept that has different meanings in different psychological theories and varying manifestations in different psychotherapies. In psychodrama, much of the available information on concretization draws on J. L. Moreno’s initial conceptualization, descriptive case studies, and interpretations in the various approaches. However, concretization has not been empirically studied as a concept or as a therapeutic mechanism of change. Therefore, the purpose of this qualitative study was to generate an empirically based conceptualization and operationalization of concretization as well as (...) to identify its clinical benefits in psychodrama. To this end, semistructured in-depth interviews were conducted with seven experienced psychodrama therapists. Using a grounded theory approach for the data analysis, the model that emerged consists of three pathways toward concretization: realistic concretization, symbolic concretization, and integrated concretization. The findings suggest a sequential multistep operation that can be linear or nonlinear, depending on the protagonist’s need. The findings also underscore four benefits of concretization as a mechanism of change in psychodrama: reducing the ambiguity of the problem, externalizing the protagonist’s problem, enhancing the therapist-protagonist therapeutic bond, and bypassing the protagonist’s defense mechanisms. The model is discussed in light of the findings and the literature, and future directions are suggested. (shrink)

This paper applies the argumentative perspective to the concept of scientific fact by combining the rhetorical and the sociological perspectives. The scientific fact is presented as an entity having both an epistemic and a social meaning, and the scientific paper is presented as a discourse that has both an epistemic value and role related to knowledge and to the description of the ‘world,’ and a social value, fulfilling social roles within its relevant discourse community. The discussion leads to some insights (...) into the connection between scientific language and facts. Scientific language reflects the degree of facticity of the utterance at every stage: various linguistic and discursive elements reflect the current factual status of the utterance. This conception of fact is dynamic and open to discussion, and it is presented from the author’s point of view. On the other hand, language, or the choice of language usage, creates facticity in the sense of social acceptance: by using language, the researcher reports on his belief that what he is describing is indeed a fact. The essence of the scientific paper as an argumentative text is that its point of departure is the faith of the speaker in the facticity of the new information, and its rhetorical aim is to convince the audience, based on its disciplinary rationality, to accept that same faith and thereby usher the new claim into the shared disciplinary body of knowledge. In The Quantum Self, Danah Zohar argues that the insights of modem physics can illuminate our understanding of everyday life -- our relationships to ourselves, to others, and to the world at large. Guiding us through the strange and fascinating workings of the subatomic realm to create a new model of human consciousness, the author addresses enduring philosophical questions. Does the new physics provide a basis by which our consciousness might continue beyond death? How does the material world (for (...) instance, ugly inner cities) impinge upon our sense of self? Is there a subatomic wellspring from which our creativity, our empathy with others, and our feelings of unity with the inanimate world originate?Most important, Zohar shows how the vitality of the new physics combats the alienation and fragmentation of twentieth-century life, and replaces it with a model of reality in which the universe itself may possess a type of consciousness, of which human consciousness is one expression. My dissertation consists of three essays in the Metaphysics of Modality: In "A Puzzle about Truth and Singular Propositions," I consider two theses that seem to be true and then an argument for the conclusion that they form an inconsistent pair. One thesis is that a proposition that is singular with respect to a given object implies that the object exists. This is so because the proposition predicates something of the object. The other thesis is that some propositions are true (...) with respect to possible worlds in which they do not exist. An example is the negation of the proposition that Socrates is wise. This proposition is true with respect to possible worlds in which Socrates does not exist, but it does not exist in those worlds. ;In "Actualism, Ontological Dependence, and Possible Worlds," I consider Actualism, the doctrine that every possible object is an actual object. Plantinga has argued that the actualist is committed to the existence of unexemplified essences if he analyzes statements of modality by quantifying over possible worlds and over members of their domains. I argue that the actualist is committed to the existence of unexemplified essences even if he paraphrases statements of modality by quantifying only over possible worlds and actual objects. ;In "Possibilism and the Nature of Actuality," I consider Possibilism, the doctrine that there are possible objects that are not actual objects. Possibilism seems to be a coherent ontological doctrine. It is not Meinong's doctrine that there are objects of which it is true to say that there are no such objects. If one fails to distinguish between these two doctrines, then one's attempt to refute Possibilism might amount to an attack on a blatant contradiction. I illustrate this claim by arguing that the distinction between Possibilism and Meinong's doctrine has eluded Plantinga. I then consider the view that Possibilism is a consequence of Lewis's doctrine that 'actual' is an indexical term. I also argue that the sense in which Lewis said that 'actual' is indexical is an esoteric sense of the word, not a sense it ordinarily has. (shrink)

One Health is a novel paradigm that recognizes that human and non-human animal health is interlinked through our shared environment. Increasingly prominent in public health responses to zoonoses, OH differs from traditional approaches to animal-borne infectious risks, because it also aims to promote the health of animals and ecological systems. Despite the widespread adoption of OH, culling remains a key component of institutional responses to the risks of zoonoses. Using the threats posed by highly pathogenic avian influenza viruses to human (...) and animal health, economic activity and food security as a case exemplar, we explore whether culling and other standard control measures for animal-borne infectious disease might be justified as part of OH approaches. Our central premise is that OH requires us to reformulate ‘health’ as universal good that is best shared across species boundaries such that human health and well-being are contingent upon identifying and meeting the relevant sets of human and non-human interests and shared dependencies. Our purpose is to further nascent discussions about the ethical dimensions of OH and begin to describe the principles around which a public health agenda that truly seeks to co-promote human and non-human health could potentially begin to be implemented. §49 of the Critique of the Power of Judgment concludes with a striking claim regarding the freedom required for artistic expression. Kant classifies Mannerism as aping, but considers manner the only valid means of artistic expression. These opposed uses of maniera echo a historical controversy, which finds reconciliation in Kant in what I call artistic autonomy. For Kant, artistic expression of genuine originality requires autonomous action, the individual manner in which an artist selects, transforms and applies given academic rules, in (...) a way that renders an aesthetic vision meaningful. His grave concern is that artists, in their aspiration to innovate, might make the freedom to modify and transform rules into the very aim of their artistic endeavor. A growing body of literature focuses on practice as a central aspect of teacher education. Whereas this approach emerged mainly from teacher preparation programs in specific content areas such as math, science, and literacy studies, socially related educational fields have served as a peripheral player alone. Recently, however, scholars have suggested incorporating a practice-based approach to teacher education into the social studies. In this article, we draw on complexity theory to reexamine this proposal, evaluating the connections between teaching practices and (...) democratic citizenship. First, we introduce complexity theory. Second, we offer a critical examination of key publications discussing practice-based teacher education, using the components of complexity theory as an organizing scheme. We then highlight practice-based teacher education’s reductive aspects, leading to an argument that promoting democratic citizenship through civics teacher education should be seen as a complex endeavor where borders are blurred, interactions are nonlinear, and reality changes frequently. The body of research on civic education points to the importance of teachers creating open democratic environments, leading to what has been termed the political classroom. This yearlong study of an Israeli multicultural and bilingual high school civics course, in which students from different citizenship status participated, presents a case in which teachers were unsuccessful in achieving this goal, raising the question of what limited this class's potential to create an educational environment where democratic discourses could have taken place? The (...) main argument points to Israel's current disputative political environment that led to the enactment of four educational mechanisms that resulted in such a futile reality. These included: conflicting objectives, avoiding discussion of controversial issues, implementing traditional teaching practices, and overlooking language issues. The neo-liberal educational environment and a culture of fear and self-censorship were both identified as a common explanation to these, leading to an educational reality in which there was a detach between the lessons and the students’ transcultural lived political experiences. From a methodological perspective, the study illuminates the importance of focusing on such unsuccessful cases, examining their elements, and understanding what influences them. (shrink)

The Analytic of the Beautiful in Kant's Critique of Aesthetic Judgment is a text of unparalleled importance in the history of philosophical aesthetics. Its main claims are adopted by some and rejected by others. A significant number of responses, of both kinds, take the Analytic to apply to all experiences of beauty—most notably, to the beauty of both nature and fine art. Our principal claim is that this assumption is mistaken. The analysis in the misleadingly titled Analytic of the Beautiful (...) applies paradigmatically to judgments of natural beauty. The experience of the beauty of most artworks is different and requires a separate analysis. We detail the modifications required in all four moments of the Analytic and thereby explicate the experience of artistic beauty. This reveals that Kant holds an interesting and historically consequential account of the experience of artistic beauty, which is significantly different from the experience of natural beauty. The analysis further reveals that despite these significant differences, the experiences are both species of a single genus. (shrink)

The philosophy of modality investigates necessity and possibility, and related notions--are they objective features of mind-independent reality? If so, are they irreducible, or can modal facts be explained in other terms? This volume presents new work on modality by established leaders in the field and by up-and-coming philosophers. Between them, the papers address fundamental questions concerning realism and anti-realism about modality, the nature and basis of facts about what is possible and what is necessary, the nature of modal knowledge, modal (...) logic and its relations to necessary existence and to counterfactual reasoning.
