ABSTRACTIs lying in a different language easier or more difficult? The Emotional Distance and the Cognitive Load hypothesis give competing answers. Suchotzki and Gamer measured the time native German speakers needed to initiate honest and deceptive answers to German and English questions. Lie-truth differences in RTs were much smaller for the foreign compared to the native language. In our preregistered replication study in native Dutch speakers, we found that lie-truth differences in RTs were moderately smaller when participants were tested in (...) English than when tested in Dutch. These findings indicate that people struggle with quickly retrieving the truth in another language, and that foreign language use may diminish lie-truth differences. (shrink)

Logical and Spiritual Reflections is a collection of six shorter philosophical works, including: Hume’s Problems with Induction; A Short Critique of Kant’s Unreason; In Defense of Aristotle’s Laws of Thought; More Meditations; Zen Judaism; No to Sodom. Of these works, the first set of three constitutes the Logical Reflections, and the second set constitutes the Spiritual Reflections. Hume’s Problems with Induction, which is intended to describe and refute some of the main doubts and objections David Hume raised with regard to (...) inductive reasoning. It replaces the so-called problem of induction with a principle of induction. David Hume’s notorious skepticism was based on errors of observation and reasoning, with regard to induction, causation, necessity, the self and freewill. These are here pointed out and critically analyzed in detail – and more accurate and logical theories are proposed. The present work also includes refutations of Hempel’s and Goodman’s alleged paradoxes of induction. A Short Critique of Kant’s Unreason, which is a brief critical analysis of some of the salient epistemological and ontological ideas and theses in Immanuel Kant’s famous Critique of Pure Reason. It shows that Kant was in no position to criticize reason, because he neither sufficiently understood its workings nor had the logical tools needed for the task. Kant’s transcendental reality, his analytic-synthetic dichotomy, his views on experience and concept formation, and on the forms of sensibility (space and time) and understanding (his twelve categories), are here all subjected to rigorous logical evaluation and found deeply flawed – and more coherent theories are proposed in their stead. In Defense of Aristotle’s Laws of Thought, which addresses, from a phenomenological standpoint, numerous modern and Buddhist objections and misconceptions regarding the basic principles of Aristotelian logic. Many people seem to be attacking Aristotle’s Laws of Thought nowadays, some coming from the West and some from the East. It is important to review and refute such ideas as they arise. More Meditations, which is a sequel to the author’s earlier work, Meditations. It proposes additional practical methods and theoretical insights relating to meditation and Buddhism. It also discusses certain often glossed over issues relating to Buddhism – notably, historicity, idolatry, messianism, importation to the West. Zen Judaism, which is a frank reflection on the tensions between reason and faith in today’s context of knowledge, and on the need to inject Zen-like meditation into Judaism. This work also treats some issues in ethics and theodicy. No to Sodom, which is an essay against homosexuality, using biological, psychological, spiritual, ethical and political arguments. (shrink)

This paper reviews the social scientific literature on biometric surveillance, with particular attention to its potential harms. It maps the harms caused by biometric surveillance, traces their theoretical origins, and brings these harms together in one integrative framework to elucidate their cumulative power. Demonstrating these harms with examples from the United States, the European Union, and Israel, I propose that biometric surveillance be addressed, evaluated and reframed as a new form of control rather than simply another means of inspection. I (...) conclude by delineating three features of biometric technologies—complexity, objectivity, and agency—that demonstrate their social power and draw attention to the importance of studying biometric surveillance. Logical Philosophy: A Compendium brings together five works by Avi Sion published in 2002-06, namely: Phenomenology (2003), Volition and Allied Causal Concepts (2004), Meditations (2006), Ruminations (2005), and Buddhist Illogic (2002). These works together define what may be termed 'Logical Philosophy', i.e. philosophical discourse distinguished by its steadfast reliance on inductive and deductive logic to resolve epistemological and ontological issues. This collection does not include work done on The Logic of Causation in the same period (published in 2003, 2005).

This book re-theorizes the relationship between pedagogy and play. The authors suggest that pedagogical play is characterized by conceptual reciprocity (a pedagogical approach for supporting children's academic learning through joint play) and agentic imagination (a concept that when present in play, affords the child's motives and imagination a critical role in learning and development). These new concepts are brought to life using a cultural-historical approach to the analysis of play, supported in each chapter by visual narratives used as a research (...) method for re-theorising play as a pedagogical activity. Whenever a cultural-historical approach is applied to understanding pedagogical play, the whole context of the playful event is always included. Further, the child's cultural environment is taken into account in order to better understand their play. Children from different countries play differently for many reasons, which may include their resources, local cultural beliefs about play and specific pedagogical practices. The inclusion and acknowledgement of social, cultural and historical contexts gives credence and value to understanding play from both child and adult perspectives, which the authors believe is important for the child's learning and development. As such, the relationships that children and adults have with human and non-human others, as well as any connections with artefacts and the material environment, are included in all considerations of pedagogical play. Meditations. A meditation is a voluntary exercise intended to increase awareness, sustained over some time. The main purpose of the present Meditations is to inspire and assist readers to practice meditation of some sort, and in particular ‘sitting meditation’. This includes practices such as: observing the mechanisms of one’s thinking, stopping unnecessary thought, forgetting things about one’s self and one’s life that are irrelevant to the current effort of meditation, dealing with distractions, becoming aware of one’s breath, being here and (...) now. After such practice for some time, one gets to realize the value of meditation, and one’s commitment to it grows. The need for behavioral improvement becomes more and more obvious, and one finds it easy and natural to put more discipline into one’s life. Various recommendations are given in this regard. Prior to such practical guidance, so as to prepare the reader for it, the book reviews the theoretical teachings relating to meditation in the main traditions of mankind. The ultimate goals of meditation, the various methods or techniques used to achieve them, the experiential results of meditation, and the interpretations given to them, are topics treated here. The Epicurean account of the origin of language appealed to eighteenth-century thinkers who tried to reconcile a natural history of language with

the biblical account of Adamic name-giving. As a third way between Aristotelian linguistic conventionality and what was perceived as a Platonic supernatural congruence between words and things, Epicurus’

theory allowed for a measure of contingency to emerge in the evolution of initially natural signs. This hypothesis was taken up by authors as different from one another as Leibniz, Vico, Condillac and (...) Mendelssohn. By integrating the Epicurean account of language into their own theories, however, these authors also revived the tensions inherent in the ancient thesis and had to confront the ensuing difficulties in innovative ways. ALL THE MORE, by Avi Sion, Ph.D., comprises a merged list of 72 qal vachomer arguments in the Tanakh, i.e. of a fortiori arguments in the Hebrew Bible. This listing brings together lists proposed in past rabbinic literature and in more recent studies by the author. The literature research for it was carried out mainly by R. Yaakov Gabay, who looked into works in Hebrew by five rabbis who had proposed lists, namely: R. Shmuel Yaffe Ashkenazi (Yefeh Toar, 1597), R. (...) Zvi Hirsch Katzenellenbogen (Netivot Olam, 1822), R. Zeev Wolf Einhorn (Midrash Tannaim, 1839), R. Mattityahu Strashun (Mattat Yah, 1892), R. Chaim Hirschensohn (Berure HaMidot, 1928). The author of the present essay brought additional information from the Tanakh commentary of R. Shlomo Yitzchaki (Rashi, 11th Cent.) and an essay by R. Louis Jacobs (2005), as well as from his own past works (Judaic Logic, 1995, and A Fortiori Logic, 2013). The information thus gathered is here presented in a systematic manner, after careful evaluation by the author of each case with reference to narrative context, language used, and logical form. Efforts are made to identify which cases were known to each of the past authors, and to determine who found each case first and whether subsequent listings of the case (if any) were independent or derivative. The Logic of Analogy is a study of the valid logical forms of qualitative and quantitative analogical argument, and the rules pertaining to them. It investigates equally valid conflicting arguments, statistics-based arguments and their utility in science, arguments from precedent used in law-making or law-application, and examines subsumption in analogical terms. Included for purposes of illustration is a large section on Talmudic use of analogical reasoning.

Background Coping with end-of-life issues is a major challenge for governments and health systems. Despite progress in legislation, many barriers exist to its full implementation. This study is aimed at identifying these end-of-life barriers in relation to Israel. Methods Qualitative in-depth interviews using professionals and decision makers in the health-care and related systems were carried out, along with two focus groups based on brainstorming techniques consisting of nurses and social workers. Data was managed and analyzed using Naralyzer software. Results Qualitative (...) analysis showed identification of six primary barriers: 1) law, procedures, and forms; 2) clinical aspects; 3) human aspects; 4) knowledge and skills of medical teams; 5) communication; and 6) resource allocation. These were further divided into 44 sub area barriers. Conclusions This study highlights the role of the family doctor in end-of-life by training physicians in decision-making workshops and increasing their knowledge in the field of palliative medicine. Effectively channeling resources, knowledge, and support for medical teams, by accounting for the structure and response of the units for home treatment will improve patient’s access to information on and support for end-of-life laws, as well as reduce legislative barriers in other countries that face the same issues. In this paper, we study the impact of CEO and board gender diversity on the risk management decisions of 179 U.S. Real Estate Investment Trusts (REITs) during the 2001–2018 period. Using a bottom-up analysis on the properties in REIT portfolios, we find significant risk reduction associated with gender-diverse REIT leadership. We document that REITs with a woman CEO, in combination with more women on the board, display less active trading and a longer hold period for assets. In addition, REITs with (...) more gender-diverse leadership are more geographically focused, which for REITs is considered a lower risk investment strategy. Finally, REITs with more gender-diverse leadership are more actively investing in environmentally sustainable real estate. We conclude that gender diversity in real estate firms carries real-life implications for U.S. cities, given their key role as developers, owners, and operators of the built world. (shrink)

How could ectogestative technology disrupt gender roles, parenting practices, and concepts such as ‘birth’, ‘body’, or ‘parent’? In this chapter, we situate this emerging technology in the context of the history of reproductive technologies and analyse the potential social and conceptual disruptions to which it could contribute. An ectogestative device, better known as ‘artificial womb’, enables the extra-uterine gestation of a human being, or mammal more generally. It is currently developed with the main goal of improving the survival chances of (...) extremely premature neonates. We argue that the intended use of the technology in neonatal intensive care units, as an alternative to current incubators (’partial-ectogestation’), challenges concepts such as ‘birth’, ‘fetus’, and ‘neonate’, and has several ethico-legal implications. We moreover address a more futuristic scenario where the entire embryological and fetal development could happen within an artificial womb (’full-ectogestation’). Such a scenario reveals the disruption of gender roles, parenting practices, and concepts such as ‘mother’, ‘father’, and ‘parent’. Both full- and partial-ectogestation would have implications for engineering and design, law-making, ethics, and philosophical anthropology. (shrink)

_NeuroAnalysis _investigates using the neural network and neural computation models to bridge the divide between psychology, psychoanalysis, and neuroscience when diagnosing mental health disorders and prescribing treatment. Avi Peled builds on Freud's early attempts to explain the neural basis of mental health by introducing neural computation as a bridging science to explain psychiatric disorders. Peled describes the brain as a complex system of interconnected units and goes on to suggest that conscious experience, feelings, and mood are emergent properties arising from (...) these complex organisations. This model describes mental health disorders in terms of perturbation to the optimal brain organisation, and demonstrates how particular disorders can be identified through a specific breakdown pattern of the brain’s organisation. This note is a postscript to Ramsey's 'Truth and Probability'. It replaces that article's psychological reading of subjective probability with a reading of it as a consistency condition on the theory that we act to maximise expected utility.

How should we react to the contention that there is empirical evidence showing that many judge Gettier cases to be cases of knowledge, contrary to the verdict of most analytical philosophers about these cases? I argue that there is no single answer to this question. The discussion is set inside a view about how to view the role and significance of intuitive responses to some of philosophy's famous thought experiments. One take-home message is that experimental philosophy and conceptual analysis are (...) not as far apart as is often thought. (shrink)

Famously Ryle imagined a visitor who has seen the colleges, departments, and libraries of a university but still wonders where the university is. The visitor fails to realize that the university consists of these organizational units. In this paper I ask what exactly the relation is between institutional entities such as universities and the entities they are composed of. I argue that the relation is constitution, and that it can be illuminated in terms of constitutive rules. The understanding of the (...) ontology of institutions that constitutive rules provide, however, is incomplete. In order to capture the practical significance of institutions, I introduce the notion of a status rule. Status rules concern the normative powers of institutions. The status account of institutions defended here is used to solve the problem of freestanding status terms: it turns out to be rather difficult to identify the entities of which statuses such as corporations and electronic money are composed. Unable to solve this problem, Searle concludes that they are created out of thin air. I criticize this claim and argue that these statuses are imposed on persons. (shrink)

Sohn-Rethel’s great idea was to ‘socialise’ Kant’s transcendental subject by combining it with Marx’s commodity-form. In so doing, he took on three challenges simultaneously: a) the timeless validity of modern natural science; b) the social genesis of empirically pure forms of cognition; and c) socialisation occurring through a purely social synthesis. However, Sohn-Rethel construed Marx’s value-form analysis as an empirical exchange of commodities and held that such exchange performs a real abstraction – in this way, he laboured under the very (...) semblance that money engenders at the surface of society by virtue of its function qua means of exchange. This semblance can be rendered transparent by, on the one hand, explaining value in terms of capitalist valorisation rather than as a product of abstraction, and, on the other, developing money as the measure and form of this valorisation. We enter here upon a history of conversational traffic between the respective departments of philosophy and law in the old academy of liberalism, where lawyers hear much from philosophers, yes-and philosophers hear from lawyers, too, in what has fruitfully been a both-ways exchange. Our philosophical protagonist is John Rawls. This book comprises a study of the rise and workings, within the Rawlsian political-liberal philosophy, of the idea of a country's higher-legal constitution as a public platform for the justification of political (...) coercion. A study of Rawls on constitutionalism can help us, I believe, in scoping out and managing a cluster of constitutional lawyers' debates-interminable ones, it seems, in the constitutional-democratic precincts of our times-that I will catalogue soon below. But conversely, I believe, those seeking the best and truest readings of Rawls might have something to learn from the controversies of the lawyers. My approach to Rawls has accordingly been that of a critically leavened (while no doubt broadly sympathetic) exegesis, while with the legal-discursive materials I take more of a diagnostic turn. My hope is that a treatment of these two discourses in relation to each other will prove an aid to both political-philosophical and legal-practical reflection. (shrink)

What is the role of language in human cognition? Could we attain self-consciousness and construct our civilisation without language? Such were the questions at the basis of eighteenth-century debates on the joint evolution of language, mind, and culture. Language and Enlightenment highlights the importance of language in the social theory, epistemology, and aesthetics of the Enlightenment. While focusing on the Berlin Academy under Frederick the Great, Avi Lifschitz situates the Berlin debates within a larger temporal and geographical framework. He argues (...) that awareness of the historicity and linguistic rootedness of all forms of life was a mainstream Enlightenment notion rather than a feature of the so-called 'Counter-Enlightenment'. -/- Enlightenment authors of different persuasions investigated whether speechless human beings could have developed their language and society on their own. Such inquiries usually pondered the difficult shift from natural signs like cries and gestures to the artificial, articulate words of human language. This transition from nature to artifice was mirrored in other domains of inquiry, such as the origins of social relations, inequality, the arts and the sciences. By examining a wide variety of authors - Leibniz, Wolff, Condillac, Rousseau, Michaelis, and Herder, among others - Language and Enlightenment emphasises the open and malleable character of the eighteenth-century Republic of Letters. The language debates demonstrate that German theories of culture and language were not merely a rejection of French ideas. New notions of the genius of language and its role in cognition were constructed through a complex interaction with cross-European currents, especially via the prize contests at the Berlin Academy. This is a comprehensive study of the far-reaching changes that led to a re-shaping of the philosophical discourse in Islam during the sixth/twelfth century. Whereas earlier Western scholars thought that Islam's engagement with the tradition of Greek philosophy ended during that century, more recent analyses suggest its integration into the genre of rationalist Muslim theology (kalam). This book proposes a third view about the fate of philosophy in Islam. It argues that in addition to this integration, Muslim theologians picked up (...) the discourse of philosophy in Islam (falsafa) and began to produce books on philosophy. Written by the same authors, books in these two genres, kalām and philosophy, argue for opposing teachings on the nature of God, the world's creation, and on the afterlife. This study explains the emergence of a new genre of philosophical books called "hikma" that stand opposed to Islamic theology and at the same wishes to complement it. Offering a detailed history of philosophy in Iraq, Iran, and Central Asia during the sixth/twelfth century together with an analysis of the circumstances of practicing philosophy during this time, this study can show how reports of falsafa, written by major Muslim theologians such as al-Ghazali (d. 505/1111), developed step-by-step into critical assessments of philosophy that try to improve philosophical teachings, and eventually become fully fledged philosophical summas in the work of Fakhr al-Din al-Razi (d. 606/1210). The book ends in a discussion of the different methods of kalam and hikma and the coherence and ambiguity of a Muslim post-classical philosopher's œuvre. (shrink)

The article argues that universals of law, i.e. the laws of nature, are the general axioms of a deductive system of all knowledge, and their deductive consequences. Universals of fact are generalisations deducible from these together with particular facts.

This article studies the monotonicity behavior of plural determinersthat quantify over collections. Following previous work, we describe thecollective interpretation of determiners such as all, some andmost using generalized quantifiers of a higher type that areobtained systematically by applying a type shifting operator to thestandard meanings of determiners in Generalized Quantifier Theory. Twoprocesses of counting and existential quantification thatappear with plural quantifiers are unified into a single determinerfitting operator, which, unlike previous proposals, both capturesexistential quantification with plural determiners and respects theirmonotonicity (...) properties. However, some previously unnoticed factsindicate that monotonicity of plural determiners is not always preservedwhen they apply to collective predicates. We show that the proposedoperator describes this behavior correctly, and characterize themonotonicity of the collective determiners it derives. It is proved thatdeterminer fitting always preserves monotonicity properties ofdeterminers in their second argument, but monotonicity in the firstargument of a determiner is preserved if and only if it is monotonic inthe same direction in the second argument. We argue that this asymmetryfollows from the conservativity of generalized quantifiers innatural language. (shrink)

The present study seeks to lay out the most basic elements of the ontology of classical Aš‘arite theology. In several cases this requires a careful examination of the traditional and the formal lexicography of certain key expressions. The topics primarily treated are: how they understood “Being/ existence” and “being/existent” and essential natures; the systematic exploitation of the equivocities of certain expressions within a general context in which other than words there are no universals proves to be elegant as well as (...) insightful; the basic categories of primary entities: independant beings and nonindependant beings, created and uncreated, the equivocity of “being/existent” as predicated of contingent entities on the one hand and of God and His attributes on the other, and certain problems that arise because of the rigid application of the system's underlying analytic principles. Nous essayons ici de presenter les éléments fondamentaux de l'ontologie de l'aš‘arisme classique. Pour quelques expressions, il a fallu examiner la lexicographie et ordinaire et technique pour bien comprendre leur emploi et leur signification. Les sujets examinés sont: le sens de “Etre/existence” et de “être/existant” et le concept de réalité essentielle; l'emploi nuancé des équivocités de quelques expressions dans un contexte où les seuls universaux sont des mots, emploi qui se révèle philosophiquement élégant; les catégories fondamentales des êtres: êtres indépendants et êtres non-indépendants, soit créés soit incréés, l'équivocité de “être/existant” dit des êtres contingents d'une part, de Dieu et ses attributs d'autre part, et enfin quelques difficultiés qui résultent de l'application rigide des principes analytiques du système. Our intention here is to present the essential character of classical, sunnī kalām within a strictly formal perspective and to set out its basic aspects. It was conceived by the mutakallimīn as a rational, conceptual, and critical science and, although kalām differed in a number of basic concepts and constructs and in its analytic system, the topical organisation of the major compendia parallels that of metaphysics as understood in the contemporary Aristotelian tradition. The debates between kalām and falsafa need to (...) be examined within this context. Kalām, however, is theological in the strict sense of the term and it is as such that its problematic and its procedures are primarily to be understood. Thus seen, the object of kalām is to rationalise the cognitive content presented to Believers in the symbolic language of the koranic revelation. It has, then, four principal tasks, sc, to conceptualise, to order, to explain, and where possible to justify the primary doctrines of the community whose belief is held to be normative. Within this framework the differences that characterise the major schools as such and the various tendencies of individual masters within each school may readily be brought to light. On se propose ici de présenter, d'un point de vue strictement formel, la nature du kālam classique sunnite et d'identifier ses caractéristiques principales. II avait été conçu par les mutakallimin comme une science rationelle, conceptuelle et critique. L'organisation des matières dans ses traités reprend celle de la métaphysique dans la tradition aristotélicienne de l'époque, bien que le kalām s'en distingue par plusieurs de ses structures et concepts fondamentaux, ainsi que par son système analytique. C'est dans ce contexte qu'il faut considérer les debats qui s'instaurèrent entre kalām et falsafa. Le kalām, cependant, est d'ordre strictement théologique et c'est principalement dans ce cadre qu'il faut comprendre sa problématique et ses procédures. Le kalām a pour fonction de rationaliser le contenu cognitif offert aux croyants dans le langage symbolique de la révélation coranique. Il en résulte quatre tâches principales; il s'agit de conceptualiser, ordonner, expliquer et, dans le mesure du possible, justifier les doctrines principales reconnues par la communauté faisant référence en matière de croyance. Institutions are normative social structures that are collectively accepted. In his book Making the Social World, John R. Searle maintains that these social structures are created and maintained by Status Function Declarations. The article’s author criticizes this claim and argues, first, that Searle overestimates the role that language plays in relation to institutions and, second, that Searle’s notion of a Status Function Declaration confuses more than it enlightens. The distinction is exposed between regulative and constitutive rules as being primarily a (...) linguistic one: whereas deontic powers figure explicitly in regulative rules, they feature only implicitly in constitutive rules. Furthermore, he contends that Searle’s collective acceptance account of human rights cannot adequately account for the fact that people have these rights even when they are not recognized. Finally, It is argued that a conception of collective intentionality that involves collective commitment is needed in order to do justice to the normative dimension of institutions. (shrink)

Abstract:In the spirit of green cultural criminology, which considers the way(s) in which environmental crime, harm, and disaster are constructed, represented, and envisioned by the news media and in popular cultural forms, and narrative criminology, which explores how stories can influence (promote, curb, prevent, or resist) action, including harmful action, this provisional article seeks to intercede (although, perhaps, “intervene,” in the McGregorian sense, is more accurate) in the debate, of sorts, between the Indian writer Amitav Ghosh and the British critic, (...) editor, and theorist Mark Bould. Whereas Ghosh, in The Great Derangement: Climate Change and the Unthinkable (2016), laments the failure of contemporary literature to engage with climate change, Bould, in The Anthropocene Unconscious: Climate Catastrophe Culture (2021), considers whether all stories might be stories about climate change. Taking Salman Rush-die’s Haroun and the Sea of Stories (1990) as an example, this article argues that this phantasmagorical tale about the problems of censorship could be applied to and analyzed in the context of climate change. The article considers how we might tell (more, better) stories of climate change and concludes by calling for a marshalling of diverse stories to reflect the most pressing issue of our time. The Unknowable, arguably the greatest Russian philosophical work of the 20th century, was the culmination of S. L.
