Transparency is now a fundamental principle for data processing under the General Data Protection Regulation. We explore what this requirement entails for artificial intelligence and automated decision-making systems. We address the topic of transparency in artificial intelligence by integrating legal, social, and ethical aspects. We first investigate the ratio legis of the transparency requirement in the General Data Protection Regulation and its ethical underpinnings, showing its focus on the provision of information and explanation. We then discuss the pitfalls with respect (...) to this requirement by focusing on the significance of contextual and performative factors in the implementation of transparency. We show that human–computer interaction and human-robot interaction literature do not provide clear results with respect to the benefits of transparency for users of artificial intelligence technologies due to the impact of a wide range of contextual factors, including performative aspects. We conclude by integrating the information- and explanation-based approach to transparency with the critical contextual approach, proposing that transparency as required by the General Data Protection Regulation in itself may be insufficient to achieve the positive goals associated with transparency. Instead, we propose to understand transparency relationally, where information provision is conceptualized as communication between technology providers and users, and where assessments of trustworthiness based on contextual factors mediate the value of transparency communications. This relational concept of transparency points to future research directions for the study of transparency in artificial intelligence systems and should be taken into account in policymaking. Integrates Spinoza's thought into the contemporary debate on interpersonal relationships and individual autonomy The question of how to understand autonomy has emerged as a critical issue in contemporary political philosophy. Feminists and others argue that autonomy cannot be adequately conceived without taking into consideration the ways in which it is shaped by our relationships with others. This collection of 13 new essays shows what Baruch Spinoza can add to our understanding of the relational nature of autonomy. By offering a relational (...) understanding of the nature of individuals centred on the role played by emotions, Spinoza offers not only historical roots for contemporary debates but also broadens the current discussion. At the same time, reading Spinoza as a theorist of relational autonomy underscores the consistency of his overall metaphysical, ethical and political project, which has been clouded by the standard rationalist interpretation of his works. Two important objections have been raised against exclusivist public reason. First, it has been argued that EPR entails an unjust burden for citizens who want to appeal to non-public reasons, especially religious reasons. Second, it has been argued that EPR is based on a problematic conception of religious reasons and that it ignores the fact that religious reasons can be public as well. I defend EPR against both objections. I show that the first objection conflates two ideas of public justification (...) and that the second objection conflates two ways to understand and identify religious reasons. Ultimately, it turns out that those who defend such objections actually share the concerns that justified EPR in the first place. In other words, if we are clear about the idea of public justification and the kind of religious reasons that EPR is really about, it appears that justificatory liberals are in fact all exclusivists. The expression of emotion works as an argumentative tool in the case of Spanish emigration and its depiction in the media. I have made a comparative analysis of two different political contexts to observe different social parameters at work: the current democratic system and the post-Spanish Civil War dictatorial regime. In both cases, they are exploited by third parties to validate a particular political stance. The analysis made in this work draws on Edwards’ ‘emotion in use’ and the lexical framework (...) within Martin and White’s ‘appraisal model’. The way emigration is emotionally verbalized determines issues such as responsibility. Negative emotion remarks require some agent to be blamed, normally the government for its economic policies, whereas the positive ones have a reinforcement effect and work as a bonding mechanism to the system. Judgment and Affect are found to be interrelated. More specifically, and following Martin and White’s terminology, Affect may work as a graduation instrument in the expression of Judgment. (shrink)

Tulving & F. I. M. Craik , The Oxford Handbook of Memory. Oxford University Press. remember-know-guess paradigm. Subsequently, participants completed processing speed and executive function tests. The results showed that among the older participants, R responses decreased, but K responses did not. Moreover, a hierarchical regression analysis supported the view that the effect of age in recollection experience is determined by frontal lobe integrity and not by diminution of processing speed. In all the volumes of Annales. Ethics in Economy there are several interesting papers about the ethics of teaching in academic schools. I would like to add my paper to this collection at the conference in 2007. In my paper I write about my own experiences during the work with students in several schools. In this description I use the method of job analysis recommended by the International Labour Organization in Geneva: the praxeological method of prof. Kotarbiński and an encyclical (...) of John Paul II. I attempt to prove the thesis that teaching of ethics to students makes sense and gives results only when the teacher is able to convince young people to the value of honest work in their personal lives. This thesis may be promoted by positively motivated teachers and well organized working processes in the school. (shrink)

At the end of the XX century something extraordinary happened in history of Poland. Without using violence the country become independent and Soviet occupation was stopped. The phenomenon proved John Paul II’ s teachings that “peace is made of justice and solidarity”. This article is divided into two parts. The first one is about the principles of solidarity used during the 1980 strike in the Shipyard of Gdańsk. These principles enabled the strike leaders to hold talks with the communist authorities. (...) The agreement was the key which freed the country from the Soviet occupation and eventually gave it its freedom. The second part of the article consists of a description of interhuman and international solidarity which is found in John Paul II’s works. His teaching during the 3rd pilgrimage to Poland that took place in 1987 and which was addressed mainly to the working people of Gdańsk and Gdynia had a great impact on Polish people. However after Poland regained its independence the idea of solidarity was forgotten. It could not be found in the reality described in newspapers or other mass media. It’s high time this changed. Scientists and journalists responsible for the picture of public life, should remind society of the solidarity principles. They should also show the advantages of using these rules in the national economy. Thus showing the way to a successful, peaceful development of work, economic development and well-being in our present day society. (shrink)

This article reviews the influence of Stoic thought on the development of Spinoza's and Nietzsche's ethics and suggests that although both philosophers follow the Stoics in conceiving of ethics as a therapeutic enterprise that aims at human freedom and flourishing, they part company with Stoicism in refusing to identify flourishing with freedom from the passions. In making this claim, I take issue with the standard view of Spinoza's ethics, according to which the passions figure exclusively as a source of unhappiness (...) and bondage from which we must be liberated. I argue that, in fact, Spinoza anticipates Nietzsche and breaks with the Stoics in offering a more positive assessment of the role of passion in a flourishing life. The reading pursued here takes Spinoza's divergence from the Stoic account of the passions to be a consequence of his insistence on the immanence of human being in nature. I outline Spinoza's and Nietzsche's conception of immanence and suggest that it entails a common understanding of our nature as dynamic power or desire, which is simultaneously expressed as a capacity to act and be acted on, to affect and to be affected. The recognition of the complex relationship between passive and active power requires a revaluation of our vulnerability and openness to what can affect us and leads each philosopher to a consideration of the ways in which the passions might be made to support our striving to increase our power and to realize an essentially limited freedom and precarious flourishing. The field of computational law has increasingly moved into the focus of the scientific community, with recent research analysing its issues and risks. In this article, we seek to draw a structured and comprehensive list of societal issues that the deployment of automatically processable regulation could entail. We do this by systematically exploring attributes of the law that are being challenged through its encoding and by taking stock of what issues current projects in this field raise. This article adds to (...) the current literature not only by providing a needed framework to structure arising issues of computational law but also by bridging the gap between theoretical literature and practical implementation. Key findings of this article are: (1) The primary benefit (efficiency vs. accessibility) sought after when encoding law matters with respect to the issues such an endeavor triggers; (2) Specific characteristics of a project—project type, degree of mediation by computers, and potential for divergence of interests—each impact the overall number of societal issues arising from the implementation of automatically processable regulation. When generally applicable rules clash with one’s cultural, religious or moral commitments, should exemptions be granted? The debate on exemptions raises the question both of what it means to treat people equally and of what it means to protect diversity adequately. The objective of this paper is to defend the no-exemption argument and to make it a more attractive position for liberals. I first argue that exemptions violate the principle of equal treatment because they rely on distinctions that cannot be (...) neutrally justified. I then argue that diversity can be adequately accommodated if we use a more demanding interpretation of the justification of generally applicable rules. There should be no exemption to fully justified rules, but rules are only fully justified when the particular demands that they impose on individuals are justified, i.e. when they are either neutral or pass both a Necessity Test and a Sufficiency Test. When rules are not fully justified, they should be repealed or modified. Based on this focus on the demands of rules, equality can be reconciled with an adequate accommodation of diversity. (shrink)

Alan Patten’s Equal Recognition offers a new and powerful argument to support the ‘strong cultural rights thesis’. Unlike other culturalist arguments, his argument is not based on a problematic and essentialist conception of culture but on a particular understanding of liberal neutrality as fair treatment and equal recognition. What justifies the existence of such rights is not culture itself but what culture means for people and the negative consequences it can have for them when they form a cultural minority. Patten’s (...) argument, however, faces another challenge: I argue that culture and neutrality cannot be fully reconciled, and that, ultimately, the concept of culture might not be playing any significant role in his argument for minority rights. In this introduction, we provide a brief overview of the debate on religion in political philosophy. We present the main arguments defended by Cécile Laborde in Liberalism’s Religion and explain how these arguments contribute to the debate.

Mi propósito en este trabajo es reconsiderar una de las lecturas más relevantes y provocativas que se han hecho sobre John Dewey en el mundo de habla hispana. En la primera parte reconstruyo las circunstancias que rodearon la difusión, interpretación y traducción de las obras de Dewey en el México de mediados de los años 1940, y en concreto las razones que llevaron a que la visión sociológica que José Medina Echavarría quiso dar de Dewey fuera finalmente desplazada por la (...) filosófica de José Gaos. En la segunda parte analizo la traducción y lectura que Gaos hizo de Experience and Nature de Dewey, teniendo muy presente sus comparaciones con Sein und Zeit de Heidegger . Finalmente, propongo algunas críticas a la visión que Gaos transmite de Dewey como un pensador carente de un tipo de "soberbia diabólica" propia de la verdadera gran filosofía. The purpose of this work is a reconsideration of one of the most relevant and provocative readings of John Dewey written in the Hispanic World. In the first part I reconstruct the circumstances which surrounded the publicity, interpretation and translation of John Dewey's works in the Mexico of the middle 1940's, particularly the reasons why the sociological reading of Dewey that José Medina Echavarría proposed was finally displaced by the metaphysic perspective of José Gaos. In the second part I reconsider Gaos' own translation and interpretation of Experience and Nature, taking in consideration his comparisons with Heidegger's Sein und Zeit . Finally I analyze critically Gaos' view of Dewey as a thinker whose philosophy lacked the "diabolical arrogance" that true great philosophy would seem to require. (shrink)

We suggest in this paper that the practice of philosophy with children can be fruitfully understood as an example of a transindividual system. The adoption of the term ‘transindividuality’ serves two main purposes: it allows us to focus on individuation as a process and at the same time to problematise some of the classical antinomies of Western philosophy that continue to inform our understanding of the relation between individuality and community. We argue that the practice of philosophical inquiry with children, (...) when interpreted in terms of Spinoza’s conceptions of relational individuality and affective reason, offers a compelling example of how shared thinking operates as an individuating process in that knowledge and affect, interiority and exteriority, individuality and collectivity can be experienced in action and thought as complementary aspects of the same process. As one would expect, Kant believes that there is a tension, and even a conflict, between our bodily humanity and its ethical counterpart: ‘Inclination to pleasurable living and inclination to virtue are in conflict with each other’ (Anthropology, 185-86 [7:277]). What is more unexpected, however, is that he further claims that this tension can be resolved in what he calls an example of ‘civilised bliss’, namely dinner parties. Dinner parties are, for Kant, part of the ‘highest ethicophysical good’, the ultimate (...) resolution of the conflict between our physical body and our moral powers, which consists in finding the right proportions for the ‘mixture’ between our partly ‘sensuous’ and partly ‘ethicointellectual’ nature. The aim of this paper is not only to explain Kant’s account of the ideal proportions of ethicophysical good in dinner parties, but also, and more importantly, to argue that dinner parties are in fact the ultimate experience for us, human beings. Scholarship on Plato's Timaeus has paid relatively little attention to Tim. 77a–81, a seemingly disjointed passage on topics including plants, respiration, blood circulation, and musical sounds. Despite this comparative neglect, commentators both ancient and modern have levelled a number of serious charges against Timaeus' remarks in the passage, questioning the coherence and explanatory power of what they take to be a theory of respiration. In this paper, I argue that the project of 77a–81e is not to sketch theories of respiration, (...) circulation, and digestion, but to explain how the human body is maintained in light of and despite constant environmental depletion. Further, I argue that in order to understand this account of “the replenishing system,” we need to understand Timaeus' striking analogy of the fish trap or nassa. Commentators have generally focused directly on the workings of the bodily construction that Timaeus likens to a fish trap, but without considering how we should understand the analogy qua analogy. I develop a functional reading of the analogy that yields a coherent account of the replenishing system on which previous criticisms of Timaeus' remarks on respiration do not arise. Aside from lending greater unity to the passage, both internally and within its immediate context in the dialogue, this account of the replenishing system contributes to our understanding of Timaeus' reason-and-necessity explanatory framework as applied to the human body and has noteworthy implications for specific explanatory principles, in particular like-to-like motion and circular thrust. This article analyzes the rise of contemporary neo-macho discourse in South Korea and its dissemination on online platforms of great accessibility for Korean and Asian youth in general. More specifically, it focuses on the discourse of the leader of 신 남성연대 in a long 40-minute interview published on one of the most impactful YouTube channels for Asian youth. In 2021, their demands focused, among other issues, on the need to end the Ministry of Gender Equality and Family of South Korea, (...) a struggle that was reflected in the electoral campaign of the candidates for the presidency in 2022, even reaching the political position of the progressive candidate who was also against said Ministry, despite having been conceived by his own party and having operated for five years. This article will address the Kantian concept of respect for persons from the constructivist approach of philosopher Carla Bagnoli. Her proposal is an inspiring and elaborate update of the concept, but some aspects suggest difficulties. I will argue that these difficulties would have to do with issues that would need to be clarified and with some tensions, understood as arising from certain interpretations and redefinitions, that would also raise the need to consider a revision of what constitutes the status of (...) a person. I will point out that these tensions simultaneously concern the idea of agency. (shrink)
