Morality is demanding; this is a platitude. It is thus no surprise when we find that moral theories too, when we look into what they require, turn out to be demanding. However, there is at least one moral theory – consequentialism – that is said to be beset by this demandingness problem. This calls for an explanation: Why only consequentialism? This then leads to related questions: What is the demandingness problematic about? What exactly does it claim? Finally, there is the (...) question of what we do if we accept that there is a demandingness problem for consequentialism: How can consequentialists respond? In this paper, I offer a solution to the Capacity/Equality Puzzle. The puzzle holds that an account of the franchise may adequately capture at most two of the following: (1) a political equality-based account of the franchise, (2) a capacity-based account of disenfranchising children, and (3) universal adult enfranchisement. To resolve the puzzle, I provide a complex liberal egalitarian justification of a moral requirement to disenfranchise children. I show that disenfranchising children is permitted by both the proper political liberal and (...) the proper political egalitarian understandings of the relationship between cognitive capacity and the franchise. Further, I argue, disenfranchising children is required by a minimalistic, procedural principle of collective competence in political decision-making. At the same time, I show that political equality requires the enfranchisement of all adults, regardless of cognitive capacities, and that the collective competence principle does not ground adult disenfranchisement. This justifies the progressive legal trend that holds the capacity-based disenfranchisement of adults to be incompatible with liberal democratic principles. (shrink)

This paper focuses on the narrative aspect of Seneca’s idea of self-transformation. It compares Seneca’s viewpoint with some modern notions of the narrative self to highlight some parallels and significant differences between the ancient and modern conceptions and it establishes the reading of some parts of De Brev. Vit. in the context of other passages as concerned with the narrative self. The paper argues, amongst other points, that in Ep. 83.1–3, Seneca extends the practice of meditatio (ethically directed self-examination) by (...) incorporating the construction of a narrative self into this process, in dual roles, as examiner and examined. It concludes that Seneca expected us to avail ourselves of a similar self-assessment based on a dialogue with philosophical texts. (shrink)

(OPEN ACCESS) This paper offers a novel substantive justification for mandatory electoral quotas—e.g., gender or racial quotas—and a new methodological approach to their justification. Substantively, I argue for a political egalitarian account of electoral quotas. Methodologically, based on this account and a political egalitarian grounding of political participatory rights, I offer an alternative to the External Restriction Approach to the justification of electoral quotas. The External Restriction Approach sees electoral quotas as at best justified restrictions on political participatory rights. I (...) argue for the Internal Restriction Approach instead, which can justify electoral quotas by specifying the pro tanto scope of political participatory rights rather than by justifying restrictions on the pro tanto scope of these rights. On this approach, adequately set electoral quotas do not even conflict with and are not balanced against political participatory rights, while electoral quotas—when justified—are pro tanto required rather than merely permitted. (OPEN ACCESS) In this article, I explore the implications of three moral grounds for the justification of supported voting – respect as opacity, respect as equal status, and respect as political care. For each ground, I ask whether it justifies surrogate voting for voters unable to either communicate or give effect to their electoral judgments, due to some cognitive or communicative disability. (Henceforth: incommunicability cases.) I argue that respect as opacity does not permit surrogate voting, and equal status does not (...) justify such support – although the latter account can make sense of the value loss involved in the persistent non-participation of individuals with cognitive and communicative disabilities. Finally, I argue that an account of supported voting based on the ethics of political care can accommodate a pro tanto moral permission to provide surrogate voting as a form of support in incommunicability cases, and it can account for the inclusive approach of the UN Convention on the Rights of Persons with Disabilities to supported decision-making. However, I show that in incommunicability cases, what the political community and individual caretakers ultimately owe to adult fellow citizens as equal members of the political community is some adequate form of political care – but not necessarily surrogate voting. Thought experiments are widely used in the informal explanation of Relativity Theories; however, they are not present explicitly in formalized versions of Relativity Theory. In this paper, we present an axiom system of Special Relativity which is able to grasp thought experiments formally and explicitly. Moreover, using these thought experiments, we can provide an explicit definition of relativistic mass based only on kinematical concepts and we can geometrically prove the Mass Increase Formula in a natural way, without postulates of conservation (...) of mass and momentum. The Guarded Negation Fragment (GNFO) is a fragment of first-order logic that contains all positive existential formulas, can express the first-order translations of basic modal logic and of many description logics, along with many sentences that arise in databases. It has been shown that the syntax of GNFO is restrictive enough so that computational problems such as validity and satisfiability are still decidable. This suggests that, in spite of its expressive power, GNFO formulas are amenable to novel optimizations. In this (...) article we study the model theory of GNFO formulas. Our results include effective preservation theorems for GNFO, effective Craig Interpolation and Beth Definability results, and the ability to express the certain answers of queries with respect to a large class of GNFO sentences within very restricted logics. (OPEN ACCESS) In this paper, I criticize two views on how political equality is related to equally distributed political power, and I offer a novel, pluralist account of political equality to address their shortcomings—in particular, concerning their implications for affirmative action in the political domain, political representation, and the situation of permanent minorities. The Equal Power View holds that political equality requires equally distributed political power. It considers affirmative action—e.g., racial or gender electoral quotas—, representation, and more-than-equal power to permanent (...) minorities pro tanto objectionable. The Equal Status View, in contrast, holds that political equality concerns equal relations and status, and it is only contingently related to equally distributed power. I argue that while the Equal Status View is right that equal power can be insufficient for—or even objectionable from the viewpoint of—political equality, it is wrong to conclude that equal power has no independent significance in an account of political equality. My pluralist account shows that political equality entails not only status-based requirements but also independent egalitarian requirements to distribute political power equally. This account provides a finer-grained understanding of affirmative action in the political domain. It justifies affirmative action but holds that it should only be used to realize equal political status until thorough-going social reform allows us to maintain both equal political status and equally distributed political power at the same time. Similarly, representation should be amended with power-balancing institutions, and permanent minorities should enjoy equal status with minimal compromise to power equality. (shrink)

(OPEN ACCESS) This paper establishes moral duties for intermediaries of political advertising in election campaigns. First, I argue for a collective duty to maintain the democratic quality of elections which entails a duty to contain some forms of political polarization. Second, I show that the focus of campaign ethics on candidates, parties and voters—ignoring the mediators of campaigns—yields mistaken conclusions about how the burdens of the latter collective duty should be distributed. Third, I show why it is fair to require (...) intermediaries to contribute to fulfilling this duty: they have an ultimate filtering position in the campaign communication process and typically benefit from political advertising and polarization. Finally, I argue that a transparency-based ethics of campaign advertising cannot properly accommodate a concern with objectionable polarization. By contrast, I outline the polarization-containing implications of my account, including a prohibition on online targeted advertising, and intermediaries’ duties to block hateful political advertising. In this paper, we study on the ways the Intergovernmental Panel on Climate Change communicates scientific knowledge on climate change to policymakers in the Summary for Policymakers of the Fifth Assessment Report ; the most recent Assessment Report issued by the IPCC. We investigate implicit argumentation with a special focus on the ways the summary may direct the orientation of the discourse towards the evasion of climate action while appearing to be pro-action on the surface. The results of a systematic (...) analysis of polyphonic constructions in the language of the text indicate that implicit argumentation represents climate action inevitably subordinate to economic goals. In a number of constructions, the discourse reconstructs pro-economic-growth-based frames in contrast to prioritising environmental values when encouraging political action in the context of climate change. Through such language use, the discourses mediated by an institution of such high societal importance and authority as the IPCC arguably have a considerable impact in maintaining conservative climate policies and delaying, even hindering, a transition into a carbon-neutral society. Thus, we conclude that even the most authoritative climate-science-policy institutions should reconsider their use of linguistic representations in terms of implicit argumentation in their communication in order to encourage climate action in a more straightforward manner. As long as the most authoritative actors in science-policy discourse on climate change continue to reinforce cognitive frames evading urgent action to mitigate climate change, it is questionable whether we can expect the policymakers to have the courage to take ambitious action even if the figures in the natural-scientific evidence sections of the reports were demonstrating clear worsening trends. In spite of the constant disdain of conservatives for utopias, they continued the Greek tradition of reflection on the good regime. The good regime for Oakeshott contained the possibility of a decent life and freedom, potentially resulting in conflicts. For him the good regime does not prevent fights, but it provides some solution to settle them. This logic involves the need for enforcement. The authority for many people on the Right seems to be a plausible and convenient solution for the (...) problem of conflicts, emerging from freedom. For Oakeshott, too, authority is a keystone of good order. What is more, authority—just like Sittlichkeit/tradition/practice—is a sui generis reality. Consequentialism is often criticised as being overly demanding, and this overdemandingness is seen as sufficient to reject it as a moral theory. This paper takes the plausibility and coherence of this objection – the Demandingness Objection – as a given. Our question, therefore, is how to respond to the Objection. We put forward a response that we think has not received sufficient attention in the literature: institutional consequentialism. On this view institutions take over the consequentialist burden, whereas individuals, special occasions (...) aside, are required to set up and maintain institutions. We first introduce the Objection, then explain the theory of institutional consequentialism and how it responds to the Objection. In the remainder of the paper, we defend the view against potential challenges. (shrink)

From a juridical standpoint, Kant ardently upholds the state's right to impose the death penalty in accordance with the law of retribution. At the same time, from an ethical standpoint, Kant maintains a strict proscription against suicide. The author proposes that this latter position is inconsistent with and undercuts the former. However, Kant's division between external (juridical) and internal (moral) lawgiving is an obstacle to any argument against Kant's endorsement of capital punishment based on his own disapprobation of suicide. Kant's basic conception of autonomy underlies both of these otherwise distinct forms of lawgiving, such that acts of suicide and capital punishment are rendered equally irrational within his overall framework. Alexander of Aphrodisias engages directly with this account atDe anima68.10–21, and argues against the applicability of the impression in a theory of perception inMantissa10, especially 133.25–134.23. I analyse Alexander’s polemic account atDe anima68.10–21, I demonstrate that it differs from Chrysippus’ criticism of Cleanthes (contrary to some commentators), and I show how it fits in the context of his argument. From this analysis it will emerge how (...) Alexander uses Stoic ideas to form his Aristotelian account. Then, I show that Alexander, by taking ‘typos’ metaphorically, not only prefers the term ‘enkataleimma’ over ‘typos’ in his theory ofphantasia, but he keeps the ‘typos’ terminology only to remain faithful to Aristotle’s use (contrary to some commentators). The paper investigates the notion of friendship in Aristotle’s moral philosophy. The key issue here is what role Aristotle attributes to the ‘other’ as friend in the self-appreciation of the moral individual. The discussion proceeds in three main steps: first I chart the anthropological connections of the Aristotelian notion of friendship; then I delineate in detail the discussions of self-knowledge and self-cognition in the framework of Aristotle’s ontology and philosophy of perception; finally, I set out what consequences Aristotle’s repeated assertion (...) that ‘the friend is another self’ has for the self-understanding of the person. Through these steps I argue for the conclusion that the friend, as the ‘other’, plays an indispensable role, on the one hand in the formation of virtues which are required for right action, on the other in allowing the person to reach self-consciousness and freedom, both of them prerequisites for happiness in the full sense of the term. The topic of this article is the ontology of practical reasons. We draw a critical comparison between two views. According to the first, practical reasons are states of affairs; according to the second, they are propositions. We first isolate and spell out in detail certain objections to the second view that can be found only in embryonic form in the literature – in particular, in the work of Jonathan Dancy. Next, we sketch possible ways in which one might respond to (...) each one of these objections. A careful evaluation of these complaints and responses, we argue, shows that the first view is not as obviously compelling as it is thought by Dancy. Indeed, it turns out that the view that practical reasons are propositions is by no means unworkable and in fact, at least under certain assumptions, explicit considerations can be made in favour of a propositional construal of reasons. We investigate the extension of monadic second-order logic of order with cardinality quantifiers "there exists uncountably many sets such that... " and "there exists continuum many sets such that... ". We prove that over the class of countable linear orders the two quantifiers are equivalent and can be effectively and uniformly eliminated. Weaker or partial elimination results are obtained for certain wider classes of chains. In particular, we show that over the class of ordinals the uncountability quantifier can be effectively (...) and uniformly eliminated. Our argument makes use of Shelah's composition method and Ramsey-like theorem for dense linear orders. (shrink)

To propose a revisionist ontology of art one has to hold that our everyday intuitions about the identity and persistence conditions of various kinds of artworks can be massively mistaken. In my presentation I defend this view: our everyday intuitions about the nature of art can be (and sometimes are) mistaken. First I reconstruct an influential argument of Amie L. Thomasson (2004; 2005; 2006; 2007a; 2007b) against the fallibility of our intuitive judgments about the identity and persistence conditions of various (...) kinds of artworks. Second, I present three objections to this account: two of them concern the semantic and pragmatic rules regulating the use of art-kind terms, while the third one is based on the assumption that the history of art partly comprises a series of successful attempts of transgression of artistic conventions and expectations, therefore our artistic intuitions are dynamic. Taking this point I finally argue that in philosophy of art we need a “reverse” methodology: first we have to provide a general definition, containing all the sufficient and necessary conditions of artworks (“being an artwork”) in any period within the history of art. Only after completing this task are we ready to answer the metaphysical question about the ontological status of works of art. (shrink)

In landscape ecology spatial descriptors (or indices) can be used to characterize habitats. Some of these descriptors can be used for habitat's ranking; this ranking is very important for conservation purposes. We would like to show that two traditional descriptors, namely the compactness and interior-to-edge ratio can give contradictory results. Being the second one is a more relevant descriptor, we would like to propose to avoid the further use the compactness in habitat's ranking.

Different summarized shape indices, like mean shape index (MSI) and area weighted mean shape index (AWMSI) can change over multiple size scales. This variation is important to describe scale heterogeneity of landscapes, but the exact mathematical form of the dependence is rarely known. In this paper, the use of fractal geometry (by the perimeter and area Hausdorff dimensions) made us able to describe the scale dependence of these indices. Moreover, we showed how fractal dimensions can be deducted from existing MSI (...) and AWMSI data. In this way, the equality of a multiscale tabulated MSI and AWMSI dataset and two scale-invariant fractal dimensions has been demonstrated. (shrink)

While some descriptive and normative theories of legislation account for an extensive role of legal interpretation in legislation, others see its legislative role as marginal. Yet in contemporary constitutional democracies, where legislation is limited and guided by constitutional norms, as well as international and supranational law, legal interpretation must play some role in legislation—even if all or most of legislative activity may not be adequately described and evaluated as legal interpretation. In this chapter, I aim to explore some implications of (...) recognizing the role of legal interpretation in legislation—notably, for the conceptualization and significance of legal expertise in the legislative process, as well as for determining the moral duties of legislative representatives. First, I argue that the role of legal interpretation in legislation calls for institutional reforms in legislatures in order to ensure that legal expertise is adequately channeled into the legislative process, including agenda-setting. Second, I argue that interpreting legal norms through legislation implies specific moral duties for legislative representatives, both in their relations to one another and in their relations vis-à-vis their constituents. I show that giving legal interpretation its due in a descriptive and normative account of legislative activity does not imply an elitist understanding of legislation, and it does not compromise our conception of legislatures as loci of political and moral disagreement and democratic representation. Within the small body of philosophical work on strikes, to participate in a strike is commonly seen as to refuse to do the job while retaining one’s claim upon it. What is the relationship, though, between liberalism and the right to strike? This is our main question.

In this paper we analyze and discuss Jennifer Saul’s account of the famous Gricean notions of ‘what is said’ and ‘what is implicated’ and the alleged conflict between them and the so- called Speaker- Meaning Exhaustiveness Thesis (SMET), which is standardly attributed to Grice in the literature. SMET declares that speaker- meaning divides exhaustively into what is said and what is (conventionally or nonconventionally) implicated by the speaker. After a detailed interpretation of Saul’s position, we argue that her analysis partly (...) misconstrues the relation between Grice’s theory of speaker- meaning and his normative account of conversational implicature. First of all, because SMET is not a genuine part of the Gricean theory of language and meaning – Grice was never committed to it. Secondly, Saul’s interpretation of the Gricean account of conversational implicature does not reflect accurately his original ideas. Although we agree with Saul that conversational implicature has an essential normative aspect, her account cannot capture well the real nature of this normativity, since it does not identify its source and does not delineate its scope. Finally, we present an alternative, speaker- oriented normative interpretation of Grice’s account of conversational implicatures, and argue that it fits better with the Gricean picture of communication and handles better the various problematic cases of conversational implicature than Saul’s mainly audience- oriented interpretation. Beginning at the end of the nineteenth century, systematic scientific abstracting played a crucial role in reconfiguring the sciences on an international scale. For mathematicians, the 1931 launch of the Zentralblatt für Mathematik and 1940 launch of Mathematical Reviews marked and intensified a fundamental transformation, not just to the geographic scale of professional mathematics but to the very nature of mathematicians’ research and theories. It was not an accident that mathematical abstracting in this period coincided with an embrace across mathematical (...) research fields of a distinctive form of symbolic and conceptual abstraction. This essay examines the historical, institutional, embodied, and conceptual bases of mathematical abstracting and abstraction in the mid-twentieth century, placing them in historical context within the first half of the twentieth century and then examining their consequences and legacies for the second half of the twentieth century and beyond. Focused on scale, media, and the relationship between mathematical knowledge and its forms of articulation, my analysis connects the changing social structure of modern mathematical research communities to their changing domains of investigation and resources for representation and collective understanding.
