Objective Semiotica is published in six annual issues, in two languages (English and French). From time to time, Special Issues, devoted to topics of particular interest, are assembled by Guest Editors. Enfin, quatrièmement, s'il est indéniable que le texte pourrait bénéficier d'une visibilité complémentaire due à la ferveur liée au contexte récent de la coupe du monde de football au Qatar, il couvre surtout de nombreux autres domaines d'applicabilité qui reflètent des tendances majeures telles que la gamification générale de la vie, portée par les nouveaux médias et les technologies numériques. The author argues that according to Sextus Empiricus, (a) the "sensual" nature of the phenomenon is a metaphorical notion, since it is indistinguishably extended both to sensuality and thinking; (b) the phenomenon manifest itself with irresistible force of impact, through a wide range of passive states of mind; (c) the impact of phenomena is always mediated by our ego, because all skeptic expressions are strongly correlated with the first person singular. The article proves that Descartes could not refute the (...) “excess” of skeptical doubt and make an immanent critique of skepticism without borrowing the aforementioned statements of Sextus. Such borrowing (1) has created a common ground for discussion between Descartes and skeptics; (2) made it possible for the meditator to give persuasiveness to careful observation of his own internal experience. Descartes' search for certainty in "Meditations" is entirely based on [а] evidence of "phenomena", "states of mind", "passions"; [b] refusal to agree with the "non-evident" proclaimed by Sextus Empiricus. Learning the unique linguistic forms and structures that construct and communicate scientific principles, knowledge, and beliefs is important for developing students’ disciplinary literacy. The use of scientific language is apparent in the texts that scientists produce to communicate their findings to other scientists—the research articles. Texts are underused in the science classroom and the texts that students do read often do not reflect the core attributes of authentic scientific reasoning. Adapted primary literature refers to an educational genre that enables the (...) use of scientific articles in high school. In the adaptation process, the language of the article is changed to make it more accessible for high school students. Here, we present a systemic functional linguistics analysis of an APL article compared to the original research article and to a popular article. The three texts were systematically scanned and compared for specific lexicogrammatical items that characterize five linguistic features of scientific writing: informational density, abstraction, technicality, authoritativeness, and hedging. We found that the adaptation process lowered the lexical complexity, while retaining the authenticity of the scientific writing. APL articles, as suggested by the linguistic analysis presented here, may serve as models of scientific reasoning and communication and may promote students’ language awareness and disciplinary literacy. We suggest using APL articles as an apprenticeship genre, for learning about the unique features of authentic scientific texts, and the reasoning that is reflected in the way the articles are written. The Lithuanian success of implementing international obligation in order to encourage the regulation of labour relations by means of collective agreements is analyzed in this article. It is emphasized that development of social partnership is too slow, coverage of regulation of labour relations by means of collective agreement also is low-level and collective agreements basically are made at the plant level. It is noticed that, because of the need to find a suitable balance between implementing the international obligation to (...) encourage regulation of labour relations by means of collective agreements, and the necessity to undermine the raison d’être of the regulation by means of collective agreements itself, as the process, where attitudes of social partners has to be harmonised at maximum, the state has limited scope to influence the process of making collective agreements. There are some problems in the implementation of rulings of the Constitutional Court. The legislator should make more efforts for implementing the concept of the provisions of the Constitution provided in the reasoning parts of rulings of the Constitutional Court. The Statute of the Seimas should be supplemented with provisions obligating structural sub-units of the Seimas to carry out permanent and systemic analysis of reasoning parts of rulings of the Constitutional Court. It would allow timely to prepare proposals how to (...) amend still unchallenged legal regulation which, however, from the constitutional standpoint is doubtful. One should consider whether the norm of Item 4 of Paragraph 1 of Article 64 of the Law on the Constitutional Court, which allows one to challenge the compliance of a legal act with the Constitution on the grounds of the procedure for adoption regardless of any terms expired after the adoption of a law or other legal act, should be amended. It is to be presumed that the principles of legal certainty and legal security entrenched in the Constitution, as well as other constitutional provisions, imply a certain reasonable period of time within which the subjects provided for in the Constitution may apply to the Constitutional Court with a petition requesting to investigate whether a law or other legal act is not in conflict with the Constitution according to the procedure of their adoption. This period of time should not be a long one, for example, half a year or a year since the official publishing of the law; this term should be a prescriptive one–after it has finished, it would not be allowed to challenge the compliance of a law or other legal act with the Constitution according to the procedure of their adoption. In order to speed up the consideration of cases at the Constitutional Court, one would have to change the procedure of consideration of cases in this Court in essence. (shrink)

This paper is a presentation of Russian translation of the article « La Défenestration » by Marc Richir. In this paper we depict the philosophical context in which the article was written and define its place in the totality of Richir’s works. Our main goal is to help the reader to understand the features of Richir’s complex thought and to give explicit definition to the term “defenestration.” The defenestration, understood as a philosophical concept, is a process of reconsideration (...) of major phenomenological presuppositions. Thus, we distinguish three main steps of defenestration basing on Richir’s critique of previous phenomenologists: 1) the abolition of the transcendental ego as a structure external to “the world”; 2) the rejection of the universe of beings as the one and only universe people inhabit ; 3) rethinking the phenomenalisation on the basis of “nothing” as a primary universe and, therefore, overcoming the classical dualism of the sensible and the intelligible. We conclude that by analyzing systems of previous philosophers through the concept of defenestration Richir in this early work determines the direction of his future philosophical research. (shrink)

It is widely accepted among medical ethicists that competence is a necessary condition for informed consent. In this view, if a patient is incompetent to make a particular treatment decision, the decision must be based on an advance directive or made by a substitute decision-maker on behalf of the patient. We call this the competence model. According to a recent report of the United Nations (UN) High Commissioner for Human Rights, article 12 of the UN Convention on the Rights (...) of Persons with Disabilities (CRPD) presents a wholesale rejection of the competence model. The High Commissioner here adopts the interpretation of article 12 proposed by the Committee on the Rights of Persons with Disabilities. On this interpretation, CRPD article 12 renders it impermissible to deny persons with mental disabilities the right to make treatment decisions on the basis of impaired decision-making capacity and demands the replacement of all regimes of substitute decision-making by supported decision-making. In this paper, we explicate six adverse consequences of CRPD article 12 for persons with mental disabilities and propose an alternative way forward. The proposed model combines the strengths of the competence model and supported decision-making. (shrink)

The first important reaction in favor of generic criticism here was that of the Chicago neo-Aristotelians, whose feisty polemics against the "New" critics must have seemed, in the 1940s and 1950s, like voices crying in the wilderness. The popularity of Northrop Frye's Anatomy of Criticism—also ostensibly based upon Aristotle's example—won the concept of genre broader support. And today, if the books covering my desk are anything to go by, genre criticism has emerged in force. The flood has brought forth historical (...) studies of Renaissance genres, analyses of traditional genres like the picaresque or of new ones like "the fantastic," ambivalently generic essays in "thematics," efforts to systemize the genres of narrative fiction, and even attempt, through the philosophic analysis of dozens of generic systems, to go "beyond genre." Indeed, the late sixties spawned a journal entitled Genre entirely devoted to theoretical and practical criticism employing the concept. David H. We present counterexamples to the widespread assumption that Moorean sentences cannot be rationally asserted. We then explain why Moorean assertions of the sort we discuss do not incur the irrationality charge. Our argument involves an appeal to the dual-process theory of the mind and a contrast between the conditions for ascribing beliefs to oneself and the conditions for making assertions about independently existing states of affairs. We conclude by contrasting beliefs of the sort we discuss with the structurally similar but (...) rationally impermissible beliefs of certain psychiatric patients. (shrink)

Kovacs calls for collaborating teams to indicate the proportional credit that each author of a multi-authored paper deserves.1 This approach addresses the problem of giving each of the co-authors full credit for the article when their publication records are assessed. This problem is, however, a weakness in the evaluation system, not in the publication system, and it will not be solved by the proposed strategy.As the author notes, publication records are critical to decisions on hiring, promotion, tenure, salaries and (...) allocation of research resources. At each of these points, what matters most is the quality of the candidate's work, which cannot be adequately assessed by quick counts of articles, even when the counts are weighted by numbers of citations or impact factors. Contemporary ‘crisis studies’ seek to advance democracy by emphasizing the threats that technocracy and populism pose to a specific form of it, liberal-democracy. Crisis studies argue that, since the 1970s, technocratic policymaking has deepened economic inequality. This has fostered citizenly anger, which populists exploit. Four well-known iterations of this argument are evaluated using a political realist lens. Political realism emphasizes the historical context of politics, actors’ possible motives, and a normative orientation derived from the political order itself, rather than an (...) external ethico-moral ideal. The realist lens encourages comparison of crisis studies with historical political theory, which situates liberal-democracy within the long-term development of oligarchic systems of authority, and political history, which portrays technocracy as a product of the well-funded reaction to assertions of the democratic impulse that began in the 1970s. Populism is in this view not so much a perversion of liberal-democracy as it is a perhaps unintended consequence of anti-democratic reaction. The crisis studies make this error because based on a moral defence of the justice of the liberal-democratic order. Revealing the democratically unhelpful moralism at the core of crisis studies demonstrates the usefulness of political realism as a form of applied political theory, and not simply theory about theory. Preparing to lecture on Aristotle's contribution to Nursing at the International Philosophy of Nursing Conference August 22, 2016, in Quebec City, Quebec, Canada, I came upon the recently published article by my IPONS colleague, Allmark (2016), “Aristotle for Nursing.” Allmark (2016) provides a comprehensive and understandable overview of Aristotle's philosophical system including the substantial nature of being and the four causes of change. Nurses using Aristotle to support practice and theoretical research will benefit from a careful reading of Allmark (...) to enrich their use of the realist understanding of knowledge of nature (epistemology) and the matter–form causal relationships within natural being (ontology and teleology). Allmark carefully displays the distinction between good health and flourishing; a distinction sometimes hard to grasp. Nurses are concerned with the end of health, but cannot achieve for others, the fullness of living which is flourishing.We will limit ourselves to expanding three areas that seem important, first, that nursing is much more than a productive science or craft, second, that Aristotle does provide an important note on the persistence of the soul, and, third, while Aristotle does not address the possibility of a personal creative highest being as Allmark says, his references to the divine are worth considering. In Philip K. Dick’s Counter-Clock World the direction of time flips in 1986, putting the Earth into what its inhabitants call the ‘Hogarth Phase’. Named after the scientist who predicted that ‘time’s arrow' would change direction, the Hogarth Phase is a period in which entropy decreases instead of increases. During this time the dead call from their graves to be excavated, people clean their lungs by ‘smoking’ stubs that grow into mature cigarettes, coffee separates from cream, and so on. Although (...) such reversals may be familiar from works of fiction, we are utterly unfamiliar with them in experience. The processes of nature behave in a temporally asymmetric manner. Once the cream mixes with the coffee, it stays that way, never to return to its original separated state. Neither cigarettes nor people ever fully reconstitute themselves. This kind of asymmetric behaviour is ubiquitous in thermodynamic, radiative, and quantum mechanical phenomena. But we also find our common-sense impression ofthe world painted with temporally asymmetric concepts. Time feels like it is ‘f|owing’ forward and causation appears to be an asymmetric relation. These phenomena and impressions stand in sharp contrast with the world as perceived through eyes tutored by modem science. Spacetime, rather than.. (shrink)

What should the EU do about the fact that some Member States are backsliding on their commitments to democracy, supposedly a fundamental value of the EU? The Treaty provisions under Article 7 TEU are widely criticized for being ineffective in preventing such developments. Are they legitimate? I argue that the ultimate sanction of Article 7 TEU falls into a performative contradiction, which undermines its ability to coherently defend fundamental values. Instead, expulsion from the EU is the appropriate, coherent (...) and legitimate final political sanction for democratic and rule of law backsliding by a Member State. The argument has the following steps: In Part 1, I argue that the current Article 7 framework for responding to democratic and rule of law backsliding in the EU is normatively problematic, in that the mechanism currently in the Treaty undermines the values it purports to defend; in other words, it falls into a performative contradiction. It is undemocratic to deprive Member States of their right to vote in the Council while holding them subject to Council decisions. However, Part 2 studies relevant philosophical arguments from an adjacent literature on criminal disenfranchisement, concluding that allowing backsliding Member States to keep their voting rights in the Council _also_ taints the democratic character of Council decision-making. In Part 3, I consider the resulting paradox in light of the literature on militant democracy. Could militant democracy justify Article 7? I argue not; even if we accept the hypothetical justifiability of militant measures, they are not legitimate here since a democratically acceptable alternative exists that would safeguard the democratic character and legitimacy of Council decision-making: expulsion from the Union. I also address a central objection to an expulsion mechanism—that it would require treaty change and is therefore practically impossible. (shrink)

At the same (...) time, through his study of eras when the brain was not malfunctioning while supporting philosophers who recognized what is wrong, he offers us a clearer idea of what civilization should be and how nihilism might be overcome. Street vendors are prominent on public streets and in traditional markets in most developing countries. They raise significant problems for public authorities, residents, pedestrians, and formal retailers. Their informal business is problematic, leading to conflicts and sometimes violence. Moreover, unlicensed street vendors employ children and women and are accused of counterfeiting and drug trading. However, they participate in reducing poverty and unemployment. The current data article aims to formulate a public perception on the problematic issue of street vending pervasiveness (...) by describing a survey dataset on street vending and its main driving factors. Street vending has traditionally be examined by linking it with one or more determinants; thus, the dataset covers poverty, lack of education, immigration, unemployment, urban culture, low-income consumption, resistance, and lack of microfinance as latent constructs. Five measurable variables are introduced that reflect each construct. All variables are measured via seven-point Likert scales. Using a Google Form, 425 responses were collected that reflect the attitudes of the general public in Baghdad, Iraq. This dataset is useful for research on socio-economic problems; more specifically, it introduces reliable measurement models for street vending and the eight factors driving it. (shrink)

Truth commissions have emerged as popular devices for countries which are trying to move from a past of mass human rights violations to a stable and democratic future. South Africa's Truth and Reconciliation Commission (TRC) was by no means the first official commission to inquire into and report on a fraught past, yet it has attracted more interest, including philosophical interest, than any of its predecessors.

Making decisions is an important component of everyday living, and issues surrounding autonomy and self-determination are crucial for persons with intellectual disabilities. Adults with intellectual disabilities are characterized by the limitations in their intellectual functioning and in their adaptive behavior, which compromises three skill types, and this starts before the age of 18. Though persons with intellectual disabilities are characterized by having these limitations, they are thought to face significant decisionmaking challenges due to their disability. Moving away from this generalization, (...) Article 12 of the United Nations Convention on the Rights of Persons with Disabilities addresses this issue of decision-making for persons with disabilities, recognizing the right to legal capacity. The article examines the situation that has developed in the contemporary age and being named differently: postmodernism, post-postmodernism, digital modernism, metamodernism, etc. It is noted that, despite the difference in naming, all the terms indicate a global crisis of culture and man. The three most important signs of this crisis are identified: degradation of a man – the predominance of his animal nature; total technicism; oblivion of national traditions, sacred things. These features are briefly explained. It is concluded that (...) the basis of these signs is the loss of human spirituality. It is stated that music has extraordinary opportunities to elevate the spiritual needs of a person. It is emphasized that these opportunities contributed to the strengthening of the impact of religious practices within various worships – shamanism, Zoroastrianism, Sufism, and others, which ensured the maintenance of the humanity of the world. It is believed that the use of spiritual-creative possibilities of music will help overcome the existing global crisis and prepare the formation of the era of culture and man, the era called a New Humanism by M. Eliade. It is argued that there are composers in Russia and in other countries today who purposefully use the spiritual-creative potential of music in their work to overcome the crisis that has arisen. We offer an interview with one of them – Russian composer Dmitry Stefanovich. In conclusion, it is noted that the following articles will continue to analyze the processes taking place in contemporary culture, and, in this regard, there will be presented stories about music and interviews with composers from Russia and other countries. Given the extraordinary level of his philosophical achievements, John Rawls was by all accounts a remarkably modest man. This essay will focus, not on the role that Rawls’s modesty played in the presentation of his own ideas, but on the role it plays in his interpretations of the other canonical texts under examination in his Lectures on the History of Political Philosophy. It argues that the personal virtue of humility stands in a complicated relationship with the preeminent hermeneutic virtue of (...) interpretive charity: the principle (which Rawls repeatedly, explicitly endorses throughout his Lectures) that a text must always be read in its intellectually strongest form. Born in the 17th century, journal peer review is an extremely diverse technology, constantly torn between two often incompatible goals: the validation of manuscripts conceived as a collective industrial-like reproducible process performed to assert scientific statements, and the dissemination of articles considered as a means to spur scientific discussion, raising controversies, and civically challenging a state of knowledge. Such a situation is particularly conducive to clarifying the processes of valuation and evaluation in journal peer review. In this article, such (...) processes are considered as specific tests in order to emphasize the uncertain properties of pre-tests manuscripts. On the one hand, evaluation tests are examined at the core of the validation of manuscripts, such as defining the coordination of judging instances or controlling the modalities of inter-knowledge between reviewers and authors. They are also studied regarding the dissemination of articles, notably through the contemporary conception of a continuing evaluation test termed “post publication peer review”. On the other hand, valuation tests are both part of the validation of manuscripts, such as the weighting of different judgments of the same manuscript and the tensions that these hierarchies cause, and of the dissemination of articles, such as attention metrics recording the uses of articles.
